Executive Summary
The property totals .952 acres on two commercial lots. This Replat proposes to combine two lots into one
to accommodate the development and expansion of an adjacent commercial business. Originally platted in
December 2007 as part of a planned development commercial business center adopted May 22, 2007, the
property has recently been acquired by an abutting property owner. An Amended zoning application was
approved on March 22, 2011 for the property in association with Zoning Case 2011-03 which addresses
current and future planned development stipulations.

Discussion
When a citizen thinks of 9-1-1 they usually think of police, fire trucks and ambulances with lights and sirens
blaring. But the initial first responder is the 9-1-1 dispatcher answering the initial emergency call. Dispatchers
are often overlooked as an emergency responder, but the reality is....they are first responders too. They work
long hours, holidays and weekends, with poise under pressure, aid and compassion in times of distress, all while
making critical decisions under pressure. They are first responders to the general public, as well as being first
responders to fire and police personnel. They are the voice, giving medical direction to a parent, whose infant is
no longer breathing, or contacting other emergency agencies for assistance, when local fire and police personnel
are overwhelmed. Many people do not stop to think about these individuals until they are faced with an
emergency themselves, but these professionals often make the difference between life and death in many
instances.

Declare the month of April as Tornado Awareness Month.
Discussion
Wylie Fire-Rescue and the City of Wylie believe awareness and preparation can help save lives. With the
Spring season upon us, severe weather with Spring storms can occur with little warning. Thunderstorms can
produce heavy rain, strong winds, lightning, hail and tornadoes. Tornadoes are the most destructive and
devastating product of a thunderstorm. Tornadoes are often accompanied by lightning, heavy rain and hail. A
tornado watch is issued when conditions are favorable for tornadoes to develop. Tornado warnings are issued
when radar indicates a tornado or a trained spotter reports a tornado. The City of Wylie does all it can to
forewarn citizens regarding weather emergencies through its SkyWarn volunteers, Nixie program, and outdoor
warning sirens, although the primary responsibility for awareness belongs to each individual resident, utilizing
radio, television, and weather radios. WFR intends to conduct a short campaign through email, newsletters,
websites and newspaper articles to further educate and remind citizens of the need for planning and responding
to tornadoes.

K-9 Officer Brenda Martin and Caro win Top Dog competition
Recommendation
Recognize the accomplishment of Officer Martin and Caro.
Discussion
Officer Brenda Martin and K-9 Caro attended the United States Police Canine Association trials (USPCA) in
Conroe, TX. All canine units working for law enforcement agencies are required to demonstrate their abilities
at an annual certification process involving a variety of single and combined skill demonstrations. Event
organizers keep tabs on the animal's score and time to determine winners in individual and over-all competitive
events. Officer Martin and K-9 Caro are bringing home the Top Dog trophy for the overall competition, first
place for Patrol Dogs, and the Zantos trophy. The Zantos trophy is named after a former Garland PD dog and
the trophy is given for the top combined score in criminal apprehension and obedience. Officer Martin has
trained and handled police dogs for 11 years for the Wylie Police Department and has won Top Dog before with
her first partner, Carlo.

Announce the presence of a Quorum.
Mayor Eric Hogue called the meeting to order at 6:00 p.m. with the following Wylie City Council
members present: Mayor pro tem Red Byboth, Councilwoman Kathy Spillyards, Councilman
Carter Porter, Councilman Rick White, Councilman David Goss, and Councilman Bennie Jones.
Staff present were: City Manager, Mindy Manson; Assistant City Manager, Jeff Butters;

attendance included: Gavin Pugh, Tanner Gowing, Austin Byboth, Cailin Stewart, Matthew Still,
Danny Fox, Nicholas Mormile, Ryan Still and Dan Barnhary. Pack leader Roger Barnhart was
also in attendance.

location. They asked those in attendance to purchase tickets and attend the event.

Staff Comments
Finance Director Bantz addressed council stating that the current two year term of the City of Wylie
Municipal Prosecutor expires March 31, 2011 and is renewable for a subsequent two (2) year term. She
noted that if reappointment was approved the term would become effective April 1, 2011 through March
31, 2013 and could be renewed for subsequent two(2)year terms.
Bantz reported that compensation for services provided by the Municipal Prosecutor is at an hourly rate of
$125.00, with time billable in units of one-tenth hour each. This reflects an increase in his hourly rate of
$10.00 per hour. Prosecutor Don High has not had an increase since prior to 2007 and has served the
City for almost sixteen years. Bantz noted that a budget amendment will be forthcoming at midyear to
provide the additional funding.
Council Action
A motion was made by Councilwoman Spillyards, seconded by Councilman Goss to adopt
Resolution No. 2011-07(R) authorizing the appointment of Don High as Municipal Prosecutor
for the City of Wylie effective April 1, 2011, setting terms and stipend of service. A vote was
taken and the motion passed 7-0.
2. Hold a Public Hearing and consider, and act upon, Ordinance No. 2011-10 adopting
the Standards of Care for Youth Programs. (R. Diaz, Recreation Supervisor)
Staff Discussion
Recreation Supervisor Diaz addressed council stating that since the inception of the summer youth
programs in 2000, the Standards of Care have been reviewed yearly and adopted as an ordinance in
order to comply with the Texas Human Resources Code, Section 42.041 (b) (14). Diaz explained that this
year a camp review was added to the agenda report to update the council on activities from last year.
Public Hearing
Mayor Hogue opened the public hearing regarding Standards of Care for Youth Programs at
6:13 p.m. asking anyone present wishing to address council to come forward and limit their
comments to 3 minutes.
No one came forward to address council during this public hearing.
Mayor Hogue closed the public hearing at 6:13 p.m.
Council Action
A motion was made by Councilman White seconded by Councilman Jones to approve

Staff Comments
Planning Director 011ie addressed council stating that the subject tract was part of a Planned
Development adopted on May 22, 2007 to create a viable office-showroom/warehouse development to
accommodate the growing demand for flexible facilities designed to support the light
manufacturing/assembling & hi-tech industry. However, with the unfortunate downturn in the economy the
business campus has sat vacant for several years, with the exception of two buildings which were
constructed and occupied in 2008.
The remaining eight (8) lots were purchased in May of 2010 by American National Bank and are now
under contract with Arborilogical Services, Inc. (Applicant). Arborilogical owns the lot immediately east of
the subject property and has been operating there over 26 years, and their growth requires expansion.
Lot 10, also a part of the subject rezoning request is owned and operated by Sheffield Electronic Industry.
Lot 8 was purchased by Regions Bank in June 2010 and is now under contract with VS Rhinestone
Designs.
The surrounding uses include existing mini-warehouses to the north, heavy manufacturing/fabrication to
the west and contractor's maintenance yards & heavy equipment & repair facility to the south and east.
The Comprehensive Land Use Plan recommends Light Industrial zoning on the subject property as well
as abutting properties. This request is consistent with the Land Use Plan.

Staff Comments
Fire Chief Corbin addressed council stating that the Cities recognize the vulnerability of the people and
communities located in our area to damage, injury, and loss of life and property resulting from disasters
and/or civil emergencies that may result in the lack of personnel and/or equipment beyond an individual
city's capabilities. The City of Rockwall and staff of the City of Wylie request entry into a mutual aid
agreement between the two entities which would allow for better coordination of effort, providing
adequate equipment and manpower and would help ensure that mutual aid is accomplished in the
minimum time possible in the event of a disaster or civil emergency.

A motion was made by Councilman White, seconded by Councilman Porter to adopt Resolution
No. 2011-08(R) authorizing the City Manager to execute an Interlocal Agreement by and

Mayor Hogue convened into Work Session at 7:50 p.m.
WORK SESSION
• Presentation by Community Park Improvements design firm, Teague Nall and
Perkins, Inc., to summarize the current status of the project design work and to
solicit Council input prior to bidding the project. (M. Sferra, Public Works
Director)
Public Services Director Sferra addressed council stating that this work session was an update
from staff to summarize the current status of the design work and proposed bid package and to
solicit any additional council input prior to bidding the project. He explained that staff is bringing
this item forward now so that if permission is granted to solicit bids, construction can begin after
the spring sports season as per the anticipated schedule which included: Authorization to bid —
March 22; Park Board reviews bid tabulation and makes recommendations on add alternate
items, April 25th; council considers award of a construction contract, May 10th; Construction
begins, June 13t"
He explained that on April 28, 2009 the City Council chose Teague Nall and Perkins to design
the Community Park Improvement project. On November 10, 2009 the City Council authorized
the City Manager to enter into a contract with the firm in the amount of $52,500 for field design
survey, preparation of conceptual exhibits and participation in public meetings related to the
project. On March 9, 2010 City Council approved a professional services contract to TNP in the
amount of$243,000 for the design of community park Improvements.
Since that time, City staff and the Parks Board have met with the firm on numerous occasions
regarding the project design, budget, base bid and add alternate items. Stakeholders, such as
the athletic leagues that use the park have contributed their input during these meetings.
On March 7, 2011, the Park Board agreed on a recommendation to the City Council regarding
the elements that should be in the initial bid package. The consensus was to structure a base
bid package that contains the most essential elements and to list a variety of other elements,
which are also important, as add alternates. Public Services Director Sferra explained the base
bid and add alternates recommended and noted that the bids once received could come in
much lower allowing for alternates to be added. Those costs were as follows:

Public Services Director Sferra asked direction from Council regarding the bid package and
solicitation of bids for the project. There was no direction given by council regarding the
proposed base bid and alternates included in the bid proposal.
Council/Public Comments
Several sports league representatives were present and addressed their concerns regarding the
fall playing season with the improvements that will be taking place at Community Park. The
softball and football organizations asked if alternate fields at Founder's Park could be shared for
the fall season.
Mayor Hogue stated City Council and staff had never discussed cancelling the fall season for
any of the sports played at the parks. He suggested all sports leagues meet with Parks and
Recreation staff and come to a consensus of where and when each organization will practice
and play during the downtime for improvements at Community Park. Public Services Director
Sferra stated that he would plan a meeting with the associations in the next couple of weeks
and would look at alternative playing fields used by other entities that might be available for
practice and play during the fall season.
Recreation Supervisor Diaz commented there were possibilities for other grass fields that could
be used in the short term while renovations to Community Park are underway. Staff would
research those possibilities.
Direction from council was to move forward with the bid packet as presented.

• Police Department Annual Overview. (J. Duscio, Chief of Police)
Police Chief Duscio gave a short overview of the Wylie Police Department. He reported staffing
for patrol current was 4 officers per shift. He noted recommended staffing was 5-6 officers per
shift. Chief Duscio reviewed the procedures for CID investigations and how those investigations
are prioritized. Other areas reported by Chief Duscio included School Resource Officers,
Records Division, and SWAT.
ADJOURNMENT
With no further business before the Wylie City Council, a motion was made by Councilman
Goss, seconded by Councilman Jones to adjourn the meeting at 9:35 p.m. A vote was taken
and the motion passed unanimously.

WORK SESSION
• Planning the Grand Opening of the Wylie Municipal Complex (City Council)
Mayor Hogue reported there were only 50 days remaining before the scheduled date for the
Grand Opening of the Municipal Complex (June 18, 2011). He asked the Council, based on the
small window of time and other factors such as: staff time to organize a large daylong event,
confirmed funding for the event, and with the 125th Anniversary of the City of Wylie happening in
the next year, would it be better to combine the fund raising for the events and scale down the
Municipal Complex Grand Opening and continue the celebration and fund raising into the next
year for the 125th Anniversary.

Mayor Hogue stated that currently the daylong event was estimated to run in the neighborhood
of$250,000. Would there be enough time to obtain that kind of funding prior to the June date?
Council members discussed the likelihood of accomplishing the planning and fund raising for
the June 18th timeframe. Councilman White had concerns with regard to how much funding
could be raised in a short amount of time. Mayor Pro Tem Byboth commented that
sponsorships could not be started until the committee had verification of what would be offered
for those sponsorships. Byboth reported that a few companies had stated they would donate
but no dollar amount was confirmed.
City Manager Manson explained that it would take at least three staff members per committee
working a few hours per day on the project as it is currently planned. Manson stated "there were
many plans that needed to be completed in a very short amount of time such as maps, VIP
parking, advertising, and logistics for the event. Manson noted that she felt something on a
smaller scale with ribbon cutting and fireworks might be more doable.
Councilman Jones noted that if staff felt the event should be sized down that he was in
agreement. Council members concurred.
Council direction was to set the event for June 18, 2011 from 5:00 p.m. to 10:00 p.m. Council
directed committee members (Council) and staff to bring back options for logistics, ground
breaking ceremony, estimated costs for the event, sponsorship packages, fireworks, food
vendors and entertainment for further discussion at the next work session to be held April 5,
2011 at 6:00 p.m..

WORK SESSION
• Planning the Grand Opening of the Wylie Municipal Complex (City Council)
Mayor Hogue presented a sponsorship letter giving specifics for various sponsorship
opportunities for the Municipal Complex Dedication Event and the 125th Anniversary of the City
to be celebrated as a year long event. They ranged from the Colonel W.D. Wylie Level of
$25,000 to the Wylieite Level of $500. He asked each council member to choose contacts for
sponsors and corporate partners they wished to seek sponsorship from. Council members
agreed to divide the lists and send letters out by Friday, April 8, 2011. They also agreed to
follow up in the next 10 days with each contact, to speak to them personally. Direction from
council was to send all commitments for sponsorships to City Manager Manson who would keep

a tally on funds raised and letters sent. The deadline for those commitments would be May 1,
2011.
Public Information Officer Kelly presented several options for staging and fireworks for the
event. Direction from council was to use Option #1 which showed the stage in the main grass
area in front of the Recreation Center. Kelly presented the fireworks options and pricing for
each option. Council decided to wait until firm numbers were in for sponsorships before
choosing an option.
Staff also presented options for timing of the events. Direction from council was to hold the
building dedications from 7:00 p.m. to 8:00 p.m. Two bands would entertain the crowds from
5:00 to 7:00 p.m. and after the dedication the headline band would perform through the
fireworks show scheduled for 9:45 p.m.
Mayor Pro Tem Byboth reported the entertainment committee was working and had spoken to
bands interested in performing for the dedication. He noted the committee was still working to
confirm the headline entertainer.
Councilwoman Spillyards and committee member Ehrlich reported that in speaking to some of
the prospective vendors, they found the fees, set for food vendors at $200, a little high. The
vendors requested the fees be lowered due to the event being new and the reduction in the
event time from 10:00 a.m. to 10:00 p.m. to 5:00 p.m. to 10:00 p.m. The committee
recommended a lower fee in order to get a good mix of food and drink vendors. Council
direction was to lower the fees to $100 per food vendor.
Council requested posting a short work session for the April 12, 2011 regular council meeting to
discuss progress with the event planning.

Recommendation

Discussion
On February 8, 2011 the Wylie City Council approved Resolution No. 2011-02(R) ordering the May 14, 2011
General Election to be held jointly with the Wylie Independent School District; administered by the Collin County
Elections Administrator.
Since that time it has been brought to staffs attention that the original address for the Wylie Bible Church Family
Center was changed from 109 W. Jefferson to 206 N. Jackson. This is the same polling location that has been used
for the past 12 years, only the physical address has been corrected.
Pursuant to new legislation in Section 85.004 of the Texas Election Code, a list of all polling places must be included
in the "Order" and Notice of Election and must be published with the notice in English and Spanish in the official
newspaper. The early voting polling places were not yet determined by CCEA at the time Resolution No. 2011-
02(R) was passed, however a notation was placed in the order stating"voters may vote at any of the additional Early
Voting locations open under full contract services with the Collin County Elections Administration". The Notice of
Election was not presented until such time as those county wide polling places could be determined.
Staff has now received the final list of county wide polling places where Wylie voters may vote early from the Collin
County Elections Administrator. Pursuant to Section 6 of the Order of Election, the City Secretary is hereby
authorized and directed to publish and/or post, in the time and manner prescribed by law, all notices required to be so
published and/or posted in connection with the conduct of this election. The election, including providing notice of
the election shall be conducted in accordance with the Texas Election Code.

Recommendation
Motion to approve the final payment to Glenn Thurman, Inc. in the amount of $165,984.95 for the
reconstruction of FM 1378 from FM 544 to Brown Street, and accept the project as complete.
Discussion
On March 23, 2010, a construction contract was awarded to Glenn Thurman, Inc. in the amount of
$3,233,598.46 for paving and drainage improvements to FM 1378 from FM 544 to Brown Street. The project
included reconstruction to a 6-lane concrete pavement section with related storm sewer improvements and
sidewalks.
All punch list items have been addressed by the contractor. The final contract amount after field changes and
quantity adjustments is $3,270,199.03. The construction of the project was funded through Collin County and
the Texas Department of Transportation State Highway 121 Subaccount in the amount of$7,463,905.00. The
City has requested additional funds from Collin County to cover the change orders and quantity adjustments.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS,
AMENDING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF WYLIE, AS
HERETOFORE AMENDED, SO AS TO CHANGE THE
ZONING ON THE HEREINAFTER DESCRIBED
PROPERTY, ZONING CASE NUMBER 2011-03, FROM
PLANNED DEVELOPMENT (PD-2007-14) DISTRICT TO
PLANNED DEVELOPMENT (PD) DISTRICT — TO
MODIFY EXISTING RESTRICTIONS AND REMOVE
PROPERTY OWNERS ASSOCIATION AND TO REQUIRE
EACH LOT MAINTAIN AT LEAST FIVE (5%) PERCENT
LANDSCAPE COVERAGE; PROVIDING FOR A PENALTY
FOR THE VIOLATION OF THIS ORDINANCE;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES
IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City
of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the
amendment of the Comprehensive Zoning Ordinance, have given the requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair hearing to
all property owners generally and to owners of the affected property, the governing body of the
City is of the opinion and finds that the Comprehensive Zoning Ordinance and Map should be
amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE,TEXAS:
SECTION 1: That the Comprehensive Zoning Ordinance of the City of Wylie, Texas,
be, and the same is hereby, amended by amending the Zoning Map of the City of Wylie, to give
the hereinafter described property a new zoning classification of Planned Development (PD),
said property being described in Exhibit"A" (Legal Description), Exhibit "B" (Conceptual Plan),
and Exhibit"C"(PD Conditions) attached hereto and made a part hereof for all purposes.
SECTION 2: That all ordinances of the City in conflict with the provisions of this
ordinance be, and the same are hereby, repealed and all other ordinances of the City not in
conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 3: That the above described property shall be used only in the manner and for
the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended
herein by the granting of this zoning classification.
SECTION 4: Any person, firm or corporation violating any of the provisions of this
ordinance or the Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful
act and shall be subject to the general penalty provisions of Section 1.5 of the Zoning Ordinance,
as the same now exists or is hereafter amended.

SECTION 5: Should any paragraph, sentence, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof, other than the
part so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of the
Comprehensive Zoning Ordinance as a whole.
SECTION 6: This ordinance shall be in full force and effect from and after its adoption
by the City Council and publication of its caption as the law and the City Charter provide in such
cases.
SECTION 7: The repeal of any ordinance, or parts thereof, by the enactment of this
Ordinance, shall not be construed as abandoning any action now pending under or by virtue of
such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any
penalty accruing or to accrue, nor as effecting any rights of the municipality under any section or
provisions of any ordinances at the time of passage of this ordinance.

DEVELOPMENT STANDARDS
(Zoning Case 2011-03)
1. Section 4.3 Nonresidential Design Standards shall be adopted, except as shown on the
Zoning Exhibit and/or as noted herein.
2. Service and loading areas shall not directly face a public street but may face the interior
drive and shall be screened on three sides with solid masonry or a living screen or a
combination of masonry columns and living screen. The opening shall be equipped with a
solid gate. Gates must have tie backs to secure in the open position.
3. All mechanical units located on the roof of a building shall be screened with a parapet
wall.
4. All buildings shall be finished on all sides in a unified architectural concept conforming
to LI Standards.
5. At least 5%of each lot must be landscaped,
6. Parking requirements shall be based on total developable area.
7. Front yard setback shall be 25 feet. Side and rear setback shall be 10 feet minimum.
8. Allowed uses shall be as permitted under Article 5 Use Regulations, Section 5.1 Land
Use Charts, Figure 5-3 Land Use Tables, Non-Residential Districts, LI and Section 5.2
Listed Uses, as defined in the Zoning Ordinance of the City of Wylie.
9. Signage shall be limited to one monument sign per street access and contained within a
sign easement as established by plat and minimal on building identification.
10. The front property line of all lots shall terminate at the centerline of the access drive
easement as indicated on the zoning exhibit or as modified through replatting or the site
planning process.
11. The access drive easement is maintained to the centerline of each lot by the respective
property owner.

Discussion
The property totals .952 acres on two commercial lots. This Replat proposes to combine two lots into one to
accommodate the development and expansion of an adjacent commercial business.
Originally platted in December 2007 as part of a planned development commercial business center adopted
May 22, 2007, the property has recently been acquired by an abutting property owner. An Amended zoning
application was approved on March 22, 2011 for the property in association with Zoning Case 2011-03 which
addresses current and future planned development stipulations.
The Replat complies with all applicable technical requirements of the City of Wylie.
Planning Commission voted 6-0 to recommend approval of the Replat.
