CALLED CITY COUNCIL
MEETING — MINUTES
SEPTEMBER 17 , 1985
7 :00 P. M.
The Wylie City Council met in a called session on Tuesday ,
September 17 , 1985 at 7 : 00 P . M. in the Wylie Community
Center . A quorum was present and notice of the meeting had
been posted for the time and in the manner required by law .
Those present were Mayor John W. Akin , Mayor Pro Tem Don
Hughes , Councilmembers Randall Gaston , Percy Simmons ,
William Martin , Haorld Spence , and Joe Fulgham, City Manager
Gus Pappas , City Secretary Carolyn Jones , Public Works
Director Bill Windham, Finance Director James Johnson , Carl
Riehn , Truett Smith , and Dolan McKnight .
Mayor Akin called the meeting to order .
Truett Smith thanked the council for the opportunity to come
before then . In our consideration , if the cities of Plano ,
Mesquite , Rockwall and other cities in the district could
operate they own sewer treatment plants , wouldn ' t they be
doing so . When it is time to build another plant , North
Texas Municipal Water District can do this for the City .
Carl Riehn said basically NTMWD is locally oriented and
created primarily to help the cities . NTMWD only existence
is to work for and serve the cities . Also the enforcement
of such plants is going to become more strenuous than in the
past . The next time Wylie ' s permit comes up , they will have
to comply with the advance secondary plant permit .
Dolan McKnight gave a slide presentation on the different
water and wastewater treatment plants that NTMWD has .
Mayor Akin voiced his opinion about more and more smaller
cities are going to contract the wastewater treatment plants
out to larger firms .
Mayor Pro rem Hughes said he felt that the city staff could
do the ieb , but we are growing and have a lot facing us and
he does' not want to over load our staff at the present time .
Councilman Gaston said that NTMWD should give the City
Manager a written report each month on the time spent and
the equipment used and what was done while at the Wylie
Wastewater Treatment Plant .
Councilman Spence said that NTMWD is an asset to Wylie , not
only because it is their home base but they will take care
of the city .

Councilman Fulgham said he cannot believe that it would cost
the city more to maintain and operate the wastewater
treatment plant themselves . Councilman Fulgham does think
we should have more control and imput on the new treatment
plant it we do go out for Bonds for this new plant .
Councilman Simmons said to stay with NTMWD but that the City
deserves more consideration and respect from NTMWD than what
we have had in the past .
City Manager Gus Pappas said that the report that Carl Riehn
said was given to the Mayor , was received , but there were no
instructions that the City was to mail this letter on to
Austin . The council never received an answer to the
question of lower bonds rates from Carl Riehn . This answer
is no , the bonds are issued on the cities bond rate and not
no what NTMWD can give . Therefore , NTMWD can not give lower
rates . If the City allows NTMWD to accept the contract ,
that is to take part in the new plant , that it will be
harder to break away from them . On the subject of regional
areas , Murphy is already in a regional area and so are
Rowlett , Garland and Sachse . What cities would be put in a
region with Wylie . The Council should also remember that
NTMWD does not pay any taxes , they have easements and water
lines all through the City , but pay no taxes . The only
asset is the water supply .
In looking at the staff , Bill Windham has a "B" license in
Wastewater , James Johnson has a master degree in finance ,
and I , Gus Pappas , has a master degree . NTMWD has no more
on their staff then the City of Wylie has . Wylie has an
engineer on staff and in a few years we will be able to put
together a staff such as NTMWD has put together .
City Manager Gus Pappas said he has bonded and built a
wastewater treatment plant in Florida . James Johnson has
bonded and built a wastewater treatment plant in Texas . Bill
Windham has operated wastewater treatment plants .
The City of Wylie has been threaten by the State of Texas ,
not NTMWD , but Wylie has to answer all questions and be
responsible .
Mayor Pro Tem Hughes wanted to know if we entered into a
contract could the city deal direct with the State on the
new plant and with the engineers . Mayor Pro Tem Hughes also
said he is not in total agreement to let NTMWD take over the
wastewater treatment plant .
Councilman Gaston said to make this clear that this is a one
year contract for service .

City Manager Gus Pappas said he had had a discussion with
the Mayor about Kirby Street . City Manager would recommend
that Kirby St . be covered with hot mix asphalt and then
amend the street ordinance to lay hot mix asphalt .
Estimated the cost for hot mix asphalt to be about 10 cents
more a square foot . The only complaints received was it was
not smooth and not black top . Council requested the cost
figures up to now on the street and cost figures on hot mix
asphalt for the October 8th agenda .
City Manager Gus Pappas also said that the City has received
a request from the County on doing approximately 4000 ft . of
base work on Murphy Road . To the best of our sources , it is
Murphy Road . The only thing is that our equipment and crew
would be out of the City about seven ( 7) to ten ( 10) working
days .
In the financing of City Hall , lease/purchasing is an option
and is available on long terms . Have talked with First
Southwest and the bond market has gone up . The City needs
to secure a place in the bond market before it continue to
rise .

The Wylie City Council met in regular session on Tuesday ,
September 24 , 1985 at 7 : 00 P . M . in the Wylie Community
Center . A quorum was present and notice of the meeting had
been posted for the time and in the manner required by law .
Those present were Mayor Pro Tem Don Hughes , Councilmembers
Randall Gaston , William Martin , Harold Spence , Percy
Simmons , and Joe Fulgham , City Manager Gus Pappas , City
Secretary Carolyn Jones , Public Works Director Bill Windham ,
Finance Director James Johnson , Code Enforcement Officer Roy
Faires , Scott Dorsey and Elayne Mayes of The Wylie News ,
Lester Gayler , Dr . Tom Jones , Tom Mayes , Mike Cummings , Jim

town .
Mayor Pro Tem Hughes called the meeting to order and
Councilman Martin gave the invocation .
APPROVAL OF MINUTES : There being no corrections or addition
to the minutes , a motion was made by Councilman Gaston to
approve as submitted . Seconded by Councilman Martin . The
vote was as follows : Mayor Pro Tem Hughes - in favor ,
Councilman Simmons - in favor , Councilman Spence - in favor ,
Councilman Martin - in favor , Councilman Fulgham - in favor ,
and Councilman Gaston - in favor . This motion carried with
all in favor .
RECOMMENDATION FROM THE PLANNING AND ZONING COMMISSION TO
CHANGE THEIR MEETING NIGHTS : This item was placed on the
last P&Z agenda by the staff . At their meeting they voted
unanimously to recommend a change to the first and third
Thursday of each month . The primary reason for this change
is that items usually appear before the P&Z before they are
placed on the Council agenda but , with the meeting times set
as they are , the P&Z meets after the Council and any item
transmitted to the Council , then has a full two week delay .
If this change is approved , it could not be affected until
Jan . 1 , 1986 . Motion was made by Councilman Gaston to
approve the change . Seconded by Councilman Fulgham . The
vote was as follows : Mayor Pro Tem Hughes - in favor ,
Councilman Simmons - in favor , Councilman Spence - in favor ,
Councilman Martin - in favor , Councilman Fulgham - in favor ,
Councilman Gaston - in favor . This motion carried with all
in favor .

PUBLIC HEARING ON THE REQUEST FOR PLANNED DEVELOPMENT ZONING
AND THE APPROVAL OF THE CONCEPT PLAN FOR 57 . 1017 ACRES OUT
OF THE FRANCISCO DE LA PINA SURVEY , ABSTRACT 688 : This
property is located on East Stone Road and is known as
Benedict Estates . Mayor Pro Tem Hughes opened the public
hearing . Mr . James Langcaster representing Benedict Estates
said they were providing larger lots and open areas than
what the City ' s ordinance calls for . Has a of minimum home
size of 2200 square feet . Benedict will also dedicate the
green belt to the City but they would want to keep it until
it is all complete . City Manager Gus Pappas said the only
comment from staff was the lack of alleys . There are no
alleys in this development . Staff has no objections to this
plat and does recommend approval . There being no other
questions , the public hearing was closed .
APPROVAL OF ZONING ORDINANCE FOR 57 . 1017 ACRES OUT OF THE
FRANCISCO DE LA PINA SURVEY , ABSTRACT 688 : This property is
located on East Stone Road an is known as Benedict Estates .
The Planning and Zoning Commission recommends approval of
the PD designation by a vote of 6-0. There being no
question , a motion was made by Councilman Gaston to approve .
Seconded by Councilman Fulgham. The vote was as follows :
Mayor Pro Tem Hughes - in favor , Councilman Simmons -
abstained , Councilman Spence - abstained , Councilman Martin
- in favor , Councilman Fulgham - in favor , and Councilman
Gaston - in favor . This motion carried with four (4 ) in
favor and two abstentions .

the City had no liability in the parks as they would remain

police and fire protection . Chief Abbott has been working
with the Cor . of Engineers and the County for the City to he
granted the moneys set aside for this type of protection
from the State . There being no other questions or

Collin Park . All of this property is Federal Land belonging
to the United States of America . Mayor Pro Tem Hughes
opened the public hearing . Mr . Richard Abernathy , attorney ,
representing Mr . Mill of the Collin Park Marina wanted to
know what plans the City has for this area after annexation .
City Manager Gus Pappas said there would be police and fire
protection immediately and water and sewer service will be
available as required by state law . The question was asked
about the road leading into Collin Park , and did the City
have plans for any other road . If this road is a county
road , then the County would be responsible for maintaining
it , and at this time , the City does not plan on any other
road . The next question asked was about the zoning for this
area . City Manager Gus Pappas said at the present time
there is no zoning . After annexation , the actual use of
this property would be grandfathered and the marina would be
allowed . It is very doubtful for any type of zoning other
than what is being used at present . Mr . Abernathy said he
and Mr . Miller welcomes the City of Wylie and the police and
fire protection .
Mr . Carl Shear feels this property will be a burden on the
City if annexed . City Manager Gus Pappas said this was the
first of two public hearings then there would be a twenty
(20) day wait prior to signing the annexation ordinance . At
the time of signing the ordinance , the City staff and
Council has had time to look over the annexation and make
the right decision for the City . The city limits of St .
Paul does not extend out to the Federal Land that the City
of Wylie is annexing . Because a road carries the name of St .
Paul Road , does not mean it is in the city limits . Mr .
Shear is concerned that the City will put up toll gates .
City Manger Gus Pappas said the City of Dallas has Lake Ray
Hubbard but this lake is within the Wylie ETJ and it does
not have toll gates . You must remember that the Parks will
remain under the control of the Cor . of Engineers and not
under the control of the City . The City may and will
enforce the ordinances and laws , but will not be allowed to
control the parks . There being no other questions , the
public hearing was closed .
ACCEPTANCE OF PUBLIC IMPROVEMENTS IN POINTE NORTH ADDITION :
City Manager Gus Pappas said the Council is being asked to
accept these improvements , but at this time staff can not
recommend these improvements . In the Subdivision Ordinance ,
there is a requirement for streets to have a seven ( 7 ) day
break and a twenty—eight ( 28) day break . The p . s . i . on the
7 days did not exceed the 3000 psi requirement and the 28
day break will not be ready until Oct . 5 , 1985 . This
acceptance should be placed on the next Council agenda and
this has been told to the developer . Staff recommends this
time not be acted on until the Oct . 8th meeting .
Mr . Jim McKnight said the developer wanted this to be
accepted contingent upon the twenty-eight ( 28) day break .
Mr . McKnight also reminded Council that this was done for
another developer . City Manager Gus Pappas said the special
consideration for the other developer was done because it
was one day after council meeting that the twenty-eight ( 28 )
day break would occur . If this had not been done , the
developer would have had to wait for two or three weeks .
Motion was made by Councilman Gaston to table until the
twenty-eight day break . Seconded by Councilman Simmons .
The vote was as follows : Mayor Pro Tem Hughes - against ,
Councilman Simmons - in favor , Councilman Spence -
abstained , Councilman Martin - in favor , Councilman Fulgham
- in favor , and Councilman Gaston - in favor . This motion

AUTHORIZATION TO GO OUT FOR BIDS FOR TWO (2) JEEPS : These
jeeps were authorized in the 1985-86 budget , one goes to
engineering and one goes to meter reader . Motion was made
by Councilman Simmons to grant authorization to go out for
bids . Seconded by Councilman Fulgham . The vote was as

CARS : These patrol cars were authorized in the 1985-86
budget . A bid process started now will get delivery of the
two cars in February or March . Motion was made by
Councilman Fulgham to grant authorization to go out for gids
for two ( 2 ) police patrol cars . Seconded by Councilman

FM 1378 and will need water service from the City . This
tank is needed to be bid now in order that we may have a
tank coming for the development of Moussa/Beckham on FM 1378
North of Birmingham. Motion was made by Councilman Spence
to grant authorization to go out for bids for water ground
storage tank . Seconded by Councilman Martin . The vote was

This item needs to be advertised for bid in order to place
an order for calibrated metering equipment to be installed
turn-key at the various tank sites . The individual pieces
are less than the bid requirements but the whole package is
just over the $5000 . level and we want to buy the entire
item , including adjustments and setting from one source .
Motion was made by Councilman Simmons to grant authorization

PRESENTATION BY FIRE MARSHAL: Lester Gayler apologized for
not be able to make the last council meeting , as it was due
to sickness in his family . Mr . Gayler asked the Council to
consider doubling his compensation pay , which is now at
$270 . 00 per month . Mr . Gayler said the amount he is
receiving now does not compensate his time from his shop and
for the business he is unable to do .
Councilman Martin asked how much time he was devoting to the
fire marshal position . Lester said 20 hours a week is what
his pay is based on but he said he gives more than 20 hours .
Mayor Pro Tem Hughes wanted to know how many hours he is
spending now. Lester Gayler said he did not keep a record
but that it was more than 20 hours .
Councilman Simmons asked how many on-site inspections he did
each week . Lester said 3 to 5 in a month .
Councilman Martin wanted to know how may pay increases .
Lester said from $6 . 00 a month the first year up to $25 . 00
then to $ 100 . 00 and then to the present $250 . 00 plus $20 . 00
car allowance . Councilman Martin asked if he used his car
all the time . Lester said at one time last summer he used
the fire car that belongs to the city .
Councilman Fulgham said this needed to be discussed further .
Councilman Simmons said this needed to be looked at and
studied more before making a decision .
Motion was made by Councilman Martin to set aside a work
session for discussing this matter . Seconded by Councilman

ADOPTION OF REVISED 1984-85 BUDGET : Finance Director James
Johnson reported to the Council the major changes as
follows :
added $50 , 000 . to the Library , added $15 , 000. to
Sanitation and $33 , 000 . for water and pipeline ,
$17 , 000 . Streets and Drainage and $10 , 000 . for bulk
water purchases .
Motion was made by Councilman Gaston to adopt the revised
1984-85 Budget . Seconded by Councilman Simmons . The vote
was as follows : Mayor Pro Tem Hughes - in favor , Councilman
Simmons - in favor , Councilman Spence - in favor , Councilman

CITIZEN PARTICIPATION : Mr . Gene Perish introduced himself
as being the new District Manager of Lone Star Gas out of
the Garland district . Mr . Perish said if he could help the
City in any way to please contact him .
COUNCIL DISCUSSION : Councilman Gaston said it was very dark
outside the Library and Community Center . Mr . Roy Faires
said that the poles and lights were to be under
construction . The poles are up , and the lights should be up
soon .
Councilman Spence said the lighting on Highway 78 needed to
he addressed , as there are parts of the Highway that have no
lights at all .
Councilman Spence also stated that Mr . Roy Faires new
assistance is a very eager person . Mr . Kenny Powell went by
a house that had a sign for siding in the front yard and
immediately sent out a letter to the citizen about running n
business out of his home . This sign was for the company
putting siding on this citizens home . Councilman Spence
would like for Mr . Faires to apologize to this citizens .
City Manager Gus Pappas told Councilman Spence that he was
aware of what had happened and that the citizens was in his
office when Mr . Faires apologized to him for the letter .
Councilman Spence said he was having problems with builders
in the Oaks addition using the vacant lot as a dump ground .
Could Mr . Faires assist in this problem. Also there have
been boats ( large boats ) parked on the street on Spence
Drive . Will Mr . Faires please take care of this .
Councilman Spence said the City was sending out a lot of
weedy lot letters and yet they were not mowing the highway
right-of-ways . City Manager Gus Pappas said it was the
state responsibility to mow the highway right-of-way .

City Manager Gus Pappas has had a request from an individual
who is in the Steel Industrial Park area and needs to errect
a 984 foot tower for his communication business . He will be
making application with the Zoning Board of Adjustments for
this special permit for such a tower .
City Manager Gus Pappas said he has a report on the cost of
hot mix asphalt for Kirby Street . This can be on the work
shop for discussion .
Council requested a work shop on Tuesday , October 1 , 1985 at
7 : 00 P . M .

said because there would be no one to pay for the paving of
these sections. After the developer has sold the lots then
the City would have to assess the properties in order to
pave the streets. Motion was made by Bill Chapman to
recommend to Council approval of the preliminary plat for
Regency Business Park with the stipulation that the
developer go ahead and extend Capital and Regency Streets at
the time of developing this property. Seconded by Bryan
Chaney. This motion carried with six (6) in favor and Don
Montgomery voting against the plat.
AppRDyAL OF FINAL PLAT FOR RUSTIC OAKS IV: City Manager Gus
Pappas said that the streets, Winding Oaks and' Rustic Trail ,
coming from Rustic Oaks I and II will continue through
Rustic Oaks IV. Fleming Street will be a collector street
which will require 60' right-of-way but will only require
37' of pavement. This plat has met all requirements for
drainage and staff recommends approval . Motion was made by
Brian Chaney to recommend apprLval to Council of the final
plat for Rustic Oaks IV. Seconded by Bill Chapman. This
motion carried with all in favor.
APPROVAL OF PRELIMINARY PLAT FOR CRESCENT COVE SOUTH: This
property is located on FM 1378, This plat has met all
requirements and staff recommends approval . Motion was made
by Brian Chaney to recommend approval to Council of the
preliminary plat for Crescent Cove South. Seconded by Don
Montgomery. This motion carried with all in favor.

property is located between FM3412 and FM 544 (Kirby St ' ) '
City Manager Gus Pappas said this property has the option of
going under the old zoning ordinance or going under the new
zoning ordinance. This plat has a connecting street from FM
3412 to FM 544 of 60' right-of-way and the ordinance
requires a 65' right-of-way. The staff recommends this plat
with the stipulation that thi s\ 60` right-of-way be changed
to a 65' right-of-way.
Mr. Kent Flynn, Mr. Billy Thompson, and Mr. Bill Baker were
present to represent the development of Westgate' Mr . Flynn
gave the presentation which included pictures of the types
of 2F homes and single family homes that would be built'
This development is proposing 370 units in multi-family and
this is considerably less than the density in the zoning
ordinance.
Chairman Kent Crane said the problem he had with this plat
_ was the curve in the connecting street and having parked
cars on it. With this curve in the street, you would need
the extra five (5) feet of right-of-way. If two cars on

parked on this road, one on each side of road, it would only
leave 20 feet on the curve for traffic.
Mr. Baker said the reason for a 36' instead of 37' street
and 60' instead of 65' right-of-way was to discourage thru.
traffic.
Kent Crane said it would be good if you could discourage
traffic but the truth is it will collect a lot of thru
traffic.
City Manager Gus Pappas said we had lost track of what we
are dealing with. First, Planning and Zoning put the road
in the middle of this plat and not city staff . Staff has
asked for E.5' right-of-way and have not asked for this to ,bf
paved. The City has only asked for- the developer to pave
T.Y7' street.
Motion was made by Frill Chapman to recommend approval to
Council of the preliminary plat for Westgate Addition with
a `: 5' right-of-way and with 37' paved street. Seconded by
Don Montgomery. This motion carried with all in favor .
Chairman Kent Crane called for a motion to adjourn since-
there were no other questions or items of business. Motion
was made by Brian Chaney to adjourn.

MEETING _ MINUTES
OCTOBER 19 1985
The Wylie City Council met in a called session and workshop
on Tuesday, October 1 , 1985 at 7: 00 P. M. in the Wylie
Community Center. Mayor Pro Tem Don Hughes presided. A
quorum was present and notice of the meeting had been posted
for the time and in the manner required by law. Those
present were Mayor Pro Tem Don Hughes, Councilmembers Percy
Simmons, Randall Gaston, Joe Fulgham, William Martin, and
Harold Spence, City Manager Gus Pappas, City Secretary
Carolyn Jones° Public Works Director Bill Windham, Finance
Director James Johnson, Mike Ghurtleff and West Bell from
Farmers Electric Co--op.
Mayor John Akin was out of town.
Mayor Pro Tem Don Hughes called the meeting to order.
APPROVAL OF RESOLUTION TO SUSPEND THE PROPOSED STATEMENT OF
INTENT TO CHANGE ELECTRIC RATES, FROM FARMERS ELECTRIC CO-
OP: Finance Director James Johnson said this resolution was
to suspend intent to change electric rates for Farmers
Electric Co-op. The Council has the right to suspend this
for 90 days from October 10, 1985. For Council information,
the PUC has also suspended this rate increase for 150 days.
Mr. Johnson is requesting this resolution be passed until a
further study can be made.
Mr. Johnson asked the two gentlemen from Farmers Electric
Co-op to send him a break down of the rates, because of the
different classification of customers.
City Manager Gus Pappas said it had just been a few weeks
ago that the City became involved with Farmers Electric Co-
op due to the fact they have come into the City with
electrical lines and service. Farmers Electric Co-op is
preparing a franchise agreement with the City, which will be
coming to the Council for action. Farmers Electric has been
serving East Fork Water District and down Highway 78 towards
Garland.
Mr Shurtleff said this rate is being taken into
consideration due to growth. This is the first rate increase
Farmers Electric has requested in three (3) years. Two
things are very important --- one is the cost of living and
second is 10. 2 million dollar system improvements are being
done.

City Manager Gus Pappas asked Mr. Shurtleff if Farmers
Electric has been contacted by developers in Wylie, Mr.

Shurtleff said yes, they had been working with some of the
developers. Farmers Electric will also be serving the new
South Fork Mobile Home Park.
After some discussion, staff recommended that Farmers
Electric Co-op rate increase be suspended.
Motion was made by Councilman Martin to approve and sign
resolution to suspend the rate increase of Farmers Electric
Co-op. Seconded by Councilman Simmons. The vote was as
follows: Mayor Pro Tem Hughes - in favor, Councilman
Simmons - in favor, Councilman Spence - in favor, Councilman
Martin - in favor, Councilman Fulgham - in favor, and
Councilman Gaston - in favor. This motion carried with all

Council convened into a work session:
A. Discussion of City' s policies concerning the mowing of
State rights-of-way within the corporate limits of the City
of Wylie. City Manager Gus Pappas said the city crew has
been mowing the right-of-way for the Railroad and Highway 78
between Brown and Kirby Streets and several time have mowed
down to Martinez Lane. All the city crew does is to mow
with the tractor and there is a lot of area that needs to be
done by hand. The only suggest that Bill Windham and I
could come up with is to wait till the winter kill off and
them spray these ares with roundup .
Councilman Fulgham said he would like to see the City take
care of it when they could otherwise don' t worry about.
Mayor Pro Tem Hughes wanted to know why many men and how
many days it would take with winter to clean all the areas
up. Bill Windham said he has two (2) full time employees as
of today, that would be put on this job.
Councilman Simmons wanted to know if these two men can
handle all the work through the spring and summer for parks
and mowing. Bill Windham said these two men should be able
to do this work.
Councilman Spence wanted to know about when there would be a
need for a Parks Director. Bill Windham said this would
depend upon how many more parks the City acquires and the
growth of the City. .
City Manager Gus Pappas said what he was getting was for the
city crew to have the policy of spraying city drainage
ditches and go ahead with clean up of Highway 78 and Ballard
and the ditch in front of the apartments on Ballard.

B. Discussion of compensation for City Fire Marshal .
Councilman Martin wanted to know if this office would be in
tack until a full time fire department was enforced. City
Manager Gus Pappas said yes, until the City has a full time
fire department, Lester or someone like him, would need to
fill that position. Lester is currently paid $270. 00 a
month plus $500. 00 when he goes to A & M for school plus the
cost of the school is paid for by the City. Lester is
asking for $540. 00 a month.
Councilman Martin asked if 20 hours a month was average or
actual . Lester said he could put in as many hours as
necessary.
Mayor Pro Tem Hughes wanted to know how many fires has he
(Lester ) investigated the last 6 months. Lester said all
structures and trash fires. Lester said his reports consist
of notes that stay in his files.
Councilman Gaston wanted to know what kind of buildings
Lester inspected. Lester said all commercial and industrial
buildings.
Councilman Gaston said how many structure fires a month.
Lester said five (5) structure calls in the City.
Mayor Pro Tem Hughes wanted to know. if the small number of
fires was due to Lester making inspections. Lester said
year, he has made the people fire cautious.
Lester was then asked about the house on First Street that
contained a lot of lumber in the back yard. Lester said the
man was storing concrete foundation forms in his backyard.
the neighbors kids were climbing over the fence to play on
these forms' The man came to see Lester on a Saturday at
the barber shop, which is Lester busy day. Lester said he
did not have time for the man on Saturday and told the man
to keep his kids on his side of the fence. Lester said he
may have told the man to come to the City Council .
Mayor Pro Tem Hughes told Lester if he could not find a fire
code, he needed to call the City Manager for instructions.
Mayor Pro Tem Hughes said one of the things Council wants is
for Lester to go to the City Manager with the problems prior
to coming to Council .
Mayor Pro Tem Hughes asked Lester if he had reason to ask
for and increase. Lester said in order to do his job, he
has to put in more hours and to do more hours he needed more
pay.
City Manager Gus Pappas said that what Lester was asking
Council for is $7° 000. 00 a year and the Council is thinking

about going to full time personnel for the fire department.
If the full time comes up or you (Lester) going to take the
full time position. City Manager Gus Pappas said he has the
opinion that Lester would stay until the full time position
and the would choose his barber shop.
Councilman Simmons asked Lester if he would go full time and
what his feelings were for a full time fire department.
Lester said when we started sending him to school , he was
asked if he was going to quit on the City as soon as they
had him trained. Lester said it would depend on the salary
for full time. Mayor Pro Tem Hughes said it would be
$16, 000. 00 a year. Lester said he could not take a full
time job for $16, 000. 00 a year.
Councilman Spence asked if $540. 00 was the least pay.
Lester said this was what he needed.
Councilman Gaston asked for written reports in order to
merit his increase. Lester said he could not go that way.
Lester said there was no way he could write down his hours.
Councilman Gaston said there was no bases of input on number
of hours Lester is spending. Councilman Gaston says we need
to pay Lester just as we pay other contract labor personnel .
Lester said he could not be comfortable on putting down
hours and being paid on this basis.
Mayor Pro Tem Hughes said if Lester only puts in 20 hours,
then he is asking for $28.00 per hour.
Lester said it was wasting his time to fill out reports.
City Manager Gus Pappas told Lester that the City just hired
a subdivision inspector for
$16,000. 00 per year and we pay
Mr. Bill Kreymer $12. 00 per hour and no car allowance.
Councilman Fulgham said he voted for a Fire Chief/Fire
Marshal to be in the budget. Councilman Fulgham said that
after talking with Lester, the City needed the full time
fire department.
Councilman Gaston recommended that on the next Council
agenda the Council convene into executive session and
discuss an hourly pay scale for the fire marshal position.
C. Discussion of dual service considerations for two (2)
electric utilities within the corporate limits of the City
of Wylie. Finance Director James Johnson reported to the
Council that the Public Utility Commission Board set up
districts for the different utilities to operate in. In

these districts, there be more than one electric company.
In order for the City to have some control , they should have
a franchise agreement with each utility inside the corporate
limits of the City. Mr. Johnson showed the Council the
district map for the City and surroundings areas.
D. Discussion of the Kirby Street improvement and the
future policy of the City~ sroad surface treatment process.
Mayor Pro Tem Hughes said as soon as it was dry enough the
city crew needed to do some _more clean up on Kirby Street in
the ditch area and this will help the looks of the street.
City Manager Gus Pappas said the question is whether to use
hot mix asphalt or two course penetration. After much
discussion, the Council had rather see the hot mix asphalt
on all streets.
E. Discussion of plans for the proposed City Hall Complex
and various financing approaches. Councilman Fulgham wants
to look at bids without turn key operation. Councilman
Martin said we need to go back to the people. City Manager
Gus Pappas said if we went to the people then the vote would
be in April of 86, if possible and could be as late as April
87. After much discussion, it was agreed that there would
be a work shop on October 15th in the Library Work Room to
go over all bids. After this work shop then city staff
should send out another letter for the people to voice their
opinion on.

TION HEREIN STATED; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING
PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO

OFFENSE; AND DECLARING AN EFFECTIVE DATE'
WHEREAS, the City Zoning Commission and the City Council of
the City of Wylie, Texas, in compliance with the laws of the
State of Texas with reference to the granting of zoning
changes under the zoning ordinance and zoning map, have
given requisite notices by publication and otherwise, and

Comprehensive Zoning Ordinance of the City as amended herein
by the granting of this zoning classification.
SECTION 4. That should any paragraph, sentence,
subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional , illegal or invlaid,
the same shall not affect the validity of this ordinance as
a whole or any part or provision thereof other than the part
so decided to be invalid, illegal or unconstitutional and
shall not affect the validity of the Comprehensive Zoning
Ordinance as a whole.
SECTION 5. That any person, firm or corporation violating
any of the provisions or terms of this ordinance shall be
subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore
amended, and upon conviction shall be punished by fine not
to exceed the sum of two hundred dollars ($200. 00) for each
offense, and that each day such violation shall continue to
exist shall constitute a separate offense.
SECTION 6. It is necessary to give the property described
herein the above mentioned zoning classification in order to
permit its proper development and in order to protect the
public interest, comfort and general welfare fo the City'

that territory which is legally subject to being annexed by
the City and should any portion of the above described
territory be not subject to legal annexation by the City of
Wylie , Texas , such fact shall not prevent the City from
annexing such portion of said territory which is subject to
legal annexation by the City of Wylie , Texas . Therefore , if
any provision or portion of the territory herein described
is held to be invalid by a court of competent jurisdiction ,
such provision or portion of land shall be deemed as
separate , distinct and independent and such holding shall
not affect the validity of the remaining provisions of this
ordinance or portions of land annexed by this ordinance .
SECTION 3 . This ordinance shall take effect from and after
its passage as the law in such cases provides .

Dear Mr. Johnson:
Please find enclosed a franchise agreement granting Farmers Electric
Cooperative , Inc . an electric light , heat and power franchise.
I have also enclosed an ordinance that would, if approved by the
City Council, allow the Public Utility Commission of Texas ( PUC )
to exercise exclusive original jurisdiction over utility rates ,
operations and service of Farmers Electric Cooperative.
We urge that this ordinance be approved for the following reasons :
Farmers Electric Cooperative serves a relatively small number of
customers in Wylie . Each of these customers already has a voice
in the management of the Cooperative and its rates through their
election of directors . Thus the Cooperative is directly accountable
to its membership. As if this were not enough, the Cooperative ' s
rates and service rules are scrutinized by the Texas Public Utility
Commission. This commission maintains a fulltime staff with the
expertise to evaluate rate requests . Thus customers in the City
of Wylie will be fully protected by regulation without expense to
the city if it elects to have the PUC exercise original jurisdic-
tion. At any time the city is not satisfied with the actions of
the PUC the city may reinstate its own jurisdiction .
We doubt that it is economically effective for the city to retain
original jurisdiction over Farmers Electric Cooperative. The cost
of city review and hearing must ultimately be borne by so few
ratepayers that each is likely to notice a significant increase in
his or her bill. The Cooperative would like to avoid this and have
uniform system-wide - ates-, applicable to all customers in both city
and rural areas . [- N

FRANCHISE AGREEMENT
AN ORDINANCE GRANTING TO FARMERS ELECTRIC COOPERATIVE, INC. ,
ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC LIGHT, HEAT AND POWER
FRANCHISE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE , TEXAS:
Section 1: That there is hereby granted to Farmers Electric
Cooperative, Inc. , its 'successors and assigns (herein called the
"Grantee" ) , the right, privilege and franchise until , -.2405 ,
to construct, maintain and operate in the present and future streets ,
alleys, and public places of the City of Wylie , Texas, and its
successors, electric light and power lines, with all necessary or
desirable appurtenances (including underground conduits, poles,
wires and other structures and facilities, for the purpose of sup-
plying electricity to the said City, as well as all those areas that
may be annexed at any future time, the inhabitants thereof, the
persons and corporations beyond the limits thereof, for light, heat ,
power and other purposes. This franchise shall be subject to a
renewal option by joint agreement with Grantor and Grantee therein
for a period of fifteen (15 ) years.
Section 2: Poles, structures, and other appurtenances shall
be so erected and maintained as not to interfere unreasonably with
traffic over streets and alleys. The location of all poles, con-
duits and other structures shall be fixed under the supervision of

Grantee shall give the ,City of Wylie " , Texas, ninety (90 ) days '

Section 3: Grantee all use reasonable diligence to supply
electric utility service to said City and its inhabitants. The

Section 4: The Grantee shall hold the City harmless from all
expense or liability for any act or neglect of the Grantee hereunder.

Section 5: That on acceptance of thi ranchise by Farmers
Electric Cooperative, Inc. , it shall pay anneal3y to the City of
( Wylie , Texas, beginning On January 1, 1986 and then each suc-
ceeding year for the life of this franchise, a sum equal to three
' percent ( 3%) of its gross revenue received from the sale of electric
power and energy by said Company within the corporate limits of

said City for the preceding twelve months ending December 31st ,*
in full payment for the privilege of using and occupying the streets ,
highways , easements, alleys, parks and other public places in the
City of Wylie , Texas , whether as rental, supervision and
inspection charges , or otherwise for twelve months succeeding
January 1st of each year in which payment is made. This payment
shall be in lieu of any other tax or increased rate of tax or
other imposition, assessment, or charges, except ad valorem taxes.
*For the calendar year 1985,. the sum of three percent (3%) of gross
revenue to be paid will be prorated, based on the period of time
that the franchise agreement is in effect.
Section 6: The Grantee shall file its written acceptance of
this franchise within sixty (60) days after its passage and
approval.
Section 7: This franchise is not exclusive, and nothing herein
contained shall be construed so as to prevent the City from granting
other like or similar ,rights and privileges to any other person, firm
or corporation.

ELECTRIC UTILITY _RATES, OPERATIONS, AND SERVICE OF FARMERS
ELECTRIC COOPERATIVE, INC. FUTURE INCORPORATED LIMITS OF
THE CITY OF WYLIE , 'TEXAS, : PROVIDING FOR AN EFFECTIVE
DATE, PROVIDING FOR NOTICE. OF THIS ORDINANCE "TO_ THE PUBLIC ,
UTILITY COMMISSIONOF TEXAS;' AND' EXCEPTING FROM SUCH SUR
RENDER AND RETAINING UNTO SAID .CITYTHE EXCLUSIVE, ORIGINAL
JURISDICTION OVER !tHE RATES, OPERATIONS, AND SERVICES OF
WATER OR SEWER UTILITIES .OR OTHER UTILITIES WITHIN THE
EXISTING AND FUTURE INCORPORATED LIMITS OF SAID CITY:
WHEREAS, provision' is made in Section 17(b) of the Public Utility
Regulatory Act (Article: 1446c) , Vernon's Annotated Texas Statutes)
whereby a municipalitymay elect to have the Public Utility Commission
of Texas exercise exclusive original jurisdiction over electric utility
rates, operations , and services within the incorporated limits of said
municipality; and
WHEREAS, the Public Utility Commission of Texas is well equipped
to regulate the rates, operations and services of electric utilities
within the City in keeping with the best interests of the consumers
and electric utilities;, and
WHEREAS, the City, after having thoroughly considered the matter,
is of the opinion that the best interests of the City will be served
by having the Public Utility Commission of Texas exercise the exclusive
original jurisdiction over electric utility rates, operations , and
services of Farmers Electric Cooperative, Inc. but that the City should
retain the exclusive original jurisdiction over the rates , operations ,
and services of other utilities;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE , TEXAS:
Section , 1: That the City does hereby elect to have the Public
Utility Commission of Texas exercise exclusive original jurisdiction
over electric utility rates, operations, and services of Farmers
Electric Cooperative, Inc. within the existing and future incor-
porated limits of the City.
Section 2: That the City hereby expressly retains the exclusive
original jurisdiction over the rates, operations , and services of
water and sewer utilities and other utilities within the existing
and future incorporated limits of the City.
Section 3: That this Ordinance shall become effective and
the Public Utility Commission of Texas shall exercise the exclusive
original jurisdiction. over said electric utility rates , operations ,
and services of Farmers Electric Cooperative, Inc. on and after
1985 , and-the rates of Farmers Electric Cooperative, Inc.

Texas .
Section 4 : That the City Secretary shall give notice of this
Ordinance to the Public Utility Commission of Texas by forwarding
a certified copy of same to the ,Public Utility Commission of Texas
upon the passage of this Ordinance.

On both Proposal 1 & 2 there is a statment that the amounts quoted may change.
The coverage on both proposal 1 & 2 are in the same range as the
TML coverage the City is currently under.
I recommend staying with the TML group as they have already committed the
monthly premiums as remaining the same.
