Request
SUMMARY OF SUBJECT:
The City Attorney is attempting to work out an agreement with Ms. Bair regarding the
City's ability to obtain right-of-way upon development of the state highway if the
property is disannexed. The City Attorney believes that an agreement is forthcoming
in the next few days. Council tabled this request at your last meeting so we are
required to take some kind of action this week. Approval of this item on the Consent
Agenda will table the request for another two weeks.
ALTERNATIVES:
(1) Approve the item on the Consent Agenda to table again
(2) Deny the disannexation request
ACTION REQUESTED:
The City Attorney is recommending that we table this item. If in the next few days an
agreement is not worked out with Ms. Bair, Council can then deny or approve her
request at the next regular meeting.

SUMMARY OF SUBJECT:
At your last meeting, Council considered payment of $2500 to Jeske Construction
that was held according to contract terms until bermuda was established in the
spring. There was a question regarding the city's ability to enforce this provision and
the item was tabled. The City Attorney has determined that the contract provision is
enforceable and if bermuda is not established, the Council is not required to approve
payment.
ALTERNATIVES:

ACTION REQUESTED:
The City Attorney is recommending that we deny this item. While rye grass is

SUBJECT: Regulation of Parking - ommercial Vehicles
DATE: April 30, 1993
Councilman Naish recently made inquiry into the City ordinances for parking of trucks
and commercial vehicles on public streets and in residential. As I understand it there were some
citizen concerns/complaints as to the parking of a tractor trailer rigs in the City, particularly in
the area of the defunct "Southplace" subdivision on South Ballard. One such truck recently so
parked started leaking its contents and required intervention on the part of the Wylie Fire
Department.
I have attached copies of the City's current regulation on parking of truck in streets. In
essence they provide that if the vehicle is over 25 feet in width it cannot be parked on a public
street (20.18) and if its a commercial vehicle it must be parked on private property in residential
neighborhoods. They do not address vehicles containing hazardous materials in residential area
nor parking of vehicles containing hazardous materials on public streets.
An additional concern is that the street in Southplace where the truck(s)have been parking
is not a public street as the subdivision was never platted, thus the street not dedicated.
Therefore it is necessary to pass a provision prohibiting the parking of vehicles containing
hazardous material anywhere in residential areas.
I am forwarding herewith an ordinance which combines the two existing parking sections
and additional ones into one section in the City Code. The heart of the ordinance is in Section
II which spells out what is and is not allowable with regard to parking of commercial vehicles,
vehicles exceeding 25 feet in length and vehicles containing hazardous materials, and should be
fairly clear. The balance of the ordinance contains standard ordinance provisions incident to
enacting the provisions.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING SECTION
20.18 AND 20.20 OF THE WYLIE CITY CODE REGARDING THE PARKING OF
VEHICLES EXCEEDING 25 FEET IN LENGTH ON PUBLIC RIGHT OF WAYS,
PARKING OF COMMERCIAL VEHICLES IN RESIDENTIAL DISTRICTS AND
REGULATING THE PARKING OF VEHICLES CONTAINING HAZARDOUS
MATERIALS; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A
PENALTY CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, parking of commercial vehicles and vehicles exceeding 25 feet in length in
residential districts within the City of Wylie continues to be a concern of the Council; and,
WHEREAS, the City Council has determined that the health safety and welfare of the
citizens of the City may be adversely effected by parking of vehicles containing hazardous
materials in residential districts and upon public right of ways; and,
WHEREAS, the City Council desires to take appropriate action to provide reasonable
protection against the potential danger of such materials within the City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS, as follows:
SECTION I
That Sections 10-20.18 "Vehicles Exceeding Length of Twenty-Five (25) Feet" and Section
10-20.20 "Commercial Vehicles Not to be Parked on Residential District Property" be, and they
hereby deleted from the Wylie City Code.
SECTION II
That the following Section 10-20.18 be, and it hereby is, added to the Wylie City Code:
"Section 10-20.18 Parking Regulations For Commercial Vehicles, Vehicles Exceeding
25 Feet In Length, and Vehicles Containing Hazardous Materials.
a) Parking of any vehicle, trailer, or combination thereof, exceeding 25 feet length on
any street, alley, or other public way is hereby prohibited.
b) Commercial vehicles, of less than 25 feet in length, exclusive of passenger cars, may
not be parked in residential districts unless they are parked on private property with the consent
of the owner of the property.
c)Any vehicle containing hazardous materials is prohibited from parking anywhere within
a residential district, or within 500 feet thereof.
d) Any vehicle containing hazardous materials is prohibited from parking on the streets,
alleys, or other public ways of the City.
e) Parking of vehicles containing hazardous materials on private property shall be allowed
only in Industrial Districts.
f) For the purposes of this Ordinance the term hazardous materials shall have the same
meaning as the term is defined in Ordinance No. as currently existing or hereafter codified
or amended.
g) Any vehicle in violation of this section shall be subject to impoundment as provided
in Section 10-20.01 of this Code, which shall be in addition to any other penalties or fines as
herein provided."
SECTION III
Any person violating the provisions of this ordinance, or any part hereof, commits an
unlawful act and shall be subject to the general penalty provisions of the Wylie City Code as set
forth in Section 1-1.06 thereof, as the same now exists or is hereafter amended.
SECTION IV
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION V
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION VI
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or consistency and all other provisions of the Wylie City Code not
in conflict herewith shall remain in full force and effect.
SECTION VII
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

SUMMARY OF SUBJECT:
A proposal has been submitted by GTE to upgrade the City's existing phone system
to allow direct inward dialing to all stations. With this upgrade, each station
(telephone) would have its own phone number which could be accessed directly
by outside callers, thereby eliminating the DSS ("switchboard") and freeing up
personnel for tasks other than answering/routing incoming phone traffic. Attached
is a brief summary of details relating to the upgrade, including costs. Recurring
operating costs would total $291.29 monthly. Various equipment financing options
are offered (see attached summary) .
ALTERNATIVES:
1 Reject the proposed upgrade.
2. Approve the proposed upgrade.
ACTION REQUESTED:
Council approval for staff to enter into an agreement with GTE to upgrade the
Municipal Complex telephone system for direct inward dialing, with equipment
costs to be financed for a term of 24 months at $505.59 per month.

paid off in June.
Remaining production life cycle of CT-20 phone type is approximately
five to seven years.
