Mayor John W. Akin called the meeting to order with the following
Councilmembers present: Jim Swartz, Reta Allen, John Mondy, Steve Wright, Ortie
Messenger, and Bud Naish. No members were absent.

25 City Manager Steve Norwood explained that the city contribution of $316,168.80 in
water and sewer system improvements would over-match the $250,000 grant
requested. Swartz made a motion to approve the consent agenda. Allen seconded
the motion. The motion was voted on and passed unanimously.
30 PUBLIC HEARING ON PROPOSED 1993-1994 ANNUAL OPERATING BUDGET
City Manager Steve Norwood outlined the proposed budget for 1993-1994 and
outlined the city's general fund accomplishments over the previous year. Norwood
explained that the proposed .635 cents per $100 valuation was a two cent tax
35 increase over the previous three years and the 1994 projected fund balance was
$377,050.
He stated that 48% of revenues came from ad valorem taxes, 12% from sales
taxes, 12% from franchise fees, 12% from service fees, 6% from a utility transfer, 4%
40 from court fees, 2% from licenses and permits, 2% from intergovernmental revenues,
and 2% from interest and miscellaneous income.
Norwood also noted that 43% of revenues were expended on general
government, 28% on public safety, 13% on streets and development, 8% on
45 community services, 5% on urban development and 3% on capital project reserve.

Naish made a motion to approve the ordinance adopting a $0.635 tax rate.
Mondy seconded the motion. The motion was voted on and passed unanimously.

PURPOSE OF PAYING THE CURRENT EXPENSES OF SAID CITY OF THE FISCAL YEAR
ENDING SEPTEMBER 30,1 994, AND FOR THE FURTHER PURPOSE OF CREATING A
65 SINKING FUND TO RETIRE THE PRINCIPAL AND INTEREST OF THE BONDED
INDEBTEDNESS OF SAID CITY; PROVIDING FOR A LIEN ON ALL REAL AND PERSONAL

AUTHORIZATION FOR CITY OF WYLIE TO REGULATE CERTAIN CABLE RATES
Norwood explained that under the 1992 Cable Act, cities could receive FCC
authority to regulate local cable companies through annual review of basic cable
75 rates. Wright made a motion to authorize the City Manager to submit the application
to FCC on behalf of the City of Wylie. Mondy seconded the motion. The motion was
voted on and passed unanimously.
HOUSING DEMOLITION APPEALS BOARD

Norwood explained that the Uniform Code for the Abatement of Dangerous
Buildings adopting by the City of Wylie provided for a Housing Demolition Appeals
Board. He recommended that the Planning and Zoning Commission be assigned the
role of the Board as opposed to appointing a separate board. Naish questioned if the
85 appointment would conflict with a charter requirement regarding limitations of number
of boards individuals could serve one. City Attorney Steve Deiter stated the members
were not be appointed to serve on additional boards, the Council was expanding the
scope of a board already in place. Swartz made a motion to assign the task of the
Housing Demolition Appeals Board to the Planning and Zoning Commission.
90 Messenger seconded the motion. The motion was voted on and passed
unanimously.

REQUEST FROM WYLIE ATHLETIC ASSOCIATION FOR ALL-NIGHT SOFTBALL
TOURNAMENT ON OCTOBER 16, 1993
95 Norwood explained that should Council want to approve the request, an
ordinance amending the park regulations would be needed to allow Council to grant
waivers or special exceptions. Tina Sorrells requested on behalf of the WAA that
Council approve the request.
100 Council discussed the distraction of the tournament to neighbors due to lights,
noise, traffic and possible vandalism. Naish suggested closing Pirate Drive and
Wright discussed safety of children camping out while parents played. Mondy made
a motion to approve the request contingent on the passage of an ordinance at the
next meeting establishing a special exception process. Messenger seconded the
105 motion. The motion was voted on and passed with all in favor except Wright and
Mayor Akin who were opposed.
PROVISION OF WATER TO RESIDENTS ON FM-1378 OUTSIDE OF THE WYLIE
CITY LIMITS

Norwood explained that eight County residents outside of the City limits
adjacent to Presidential estates were losing service from NTMWD. He explained that
these residents were willing assume the cost of tying on to the City line, pay a $500
tap fee and $60 deposit if the City Council would grant approval. Naish made a
115 motion to approve the request. Swartz seconded the motion. The motion was voted
on and passed unanimously.
WORKSESSION
120 Council adjourned into a worksession to hear statements from Jackie Lange, of
the J.D. Russell Company regarding development problems with her proposed site.
She stated that the Wylie zoning/platting approval process of six weeks to three
months was too long, the engineering requirements on the site were too costly, and
that J.D. Russell Company would be developing a less expensive tract in another
125 community to avoid such severe development requirements.
Council discussed adoption of a tax exemption ordinance for disabled
residents and a possible ordinance allowing refusal of building permits for non-
payment of taxes.

10-8-93 Amendment of City Code to Allow Council to Waive Curfew in
�+ Community Park
SUMMARY OF SUBJECT:
At the last Council Meeting the Council expressed its desire to amend the City Code to allow for wavier of the
curfew at Community Park. The waiver would allow the Council to Consent, on a case by case basis,to
activities which run past the 1:00 a.m. curfew, such as the proposed all night softball tournament. The
proposed ordinance amends the code by retaining the present curfew but gives the Council the discretion to
waive it under certain circumstances. Passage of the Ordinance would authorize Council to authorize such
waivers.
ALTERNATIVES:
(1) Approve proposed Ordinance allowing Council to waive curfew times for Community Park
(2) Approve Ordinance allowing for waiver of curfew with changes as deemed appropriate by Council
(3) Take no action - which will have the effect of making the curfew to be without exception
ACTION REQUESTED:
So long as Council desires to establish power to waive curfew, and staff as staff understands the case to be,
alternative (1) adoption of Ordinance allowing Council to waive curfew restrictions at Community Park is
recommended. •

SUBJECT: Amendment of Park Ordinance to Allow Council to Approve "All night" Events
DATE: October 1, 1/993
At its September 28, 1993 meeting the Council approved having an all night softball
tournament in Community park. The approval was contingent upon the Council's passing an
ordinance which gave the Council power to consent to certain functions being held past the
park's 1:00 a.m. curfew.
I have prepared such an ordinance for Council's consideration. The draft provided with
this memorandum is a marked up copy showing the old language, the new language and the
unchanged language. The net effect of the ordinance is that the existing curfew is maintained
but the Council has discretion to allow events past the curfew time on a case by case basis.
The way the ordinance is drafted the Council has control over what, if any further, all
night events would take place at the park. In the event that the first event does not work out the
Council is entirely free to not approve any future all night tournaments.
In addition to amending the City Code the ordinance modifies the existing park policies
by stating that the tournament times may be waived by the council pursuant to the procedure
provided for in the Code.
To give effect to its conditional consent for the tournament the Council needs to pass the
ordinance prior to the tournament. I would also suggest that the Council vote on giving the
consent (again) immediately after the ordinance is adopted.

6.00 PARK RFfULATIONS
f 6.01 Park Hours Open to the Public
The community parks,recreation and community
center, shall be open to the general public only
between the bouts of 6:00 a.m. and 1201 a.m.,
unless a ball game or other recreational or
community activity unexpectedly exceeds a time
required to close at 12:01 a.m. In that event the
time for closing the particular facilities involved
will be extended to 1:00 a.m., at which time all
activities in such facilities will cease, then the
facilities will be closed to the public until 6:00
a.m. the next morning.
It shall be unlawful for any person except members
of the police and fire deparuneaer or employees of
the parrs department ganged in the performance of
their official duties to be in any muo3dpd part
between the bows of 12:01 a.m. and COO a.m..
unless the forgoing exception applies.

A tournament is defined as team competition separate and distinct from league play
involving the payment of an entry fee or additional fees in which to participate. A curfew
of 12:00 Midnight shall be imposed on all tournaments utiizkig lights, Monday -
Thursday; 1:00 a.m. on Friday and Saturday. A curfew of 11:00 p.m. shell be imposed

AMENDING THE ATHLETIC FIELDS POLICY AS ADOPTED BY ORDINANCE
93-9; BY MAKING PROVISIONS FOR THE CITY COUNCIL TO GRANT WAIVERS
OF PARK CURFEW HOURS ON A CASE BY CASE BASIS, REPEALING ALL
CONFLICTING ORDINANCES;CONTAINING A PENALTY CLAUSE;CONTAINING
A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Section 6.01 of the Wylie City Code provide that the Wylie Community Park
shall be closed to all activities from midnight to 6:00 a.m. each day, except for ball games or
other activities which unexpectedly exceed the midnight curfew which said activities may
continue until 1:00 a.m.; and,
WHEREAS, the City has received a request to allow an all night softball tournament in
Community Park which would be in violation of said Section 6.01 as well as the allowable
tournament hours as set out in the City of Wylie Athletic Fields Policy - Community Park, as
adopted by ordinance 93-9; and,
WHEREAS, as a result of heavy usage and high demand for park facilities, as well as
other factors, the Council anticipates the City will be receiving additional requests for similar
activates which it could not allow or consent to under the present park regulations; and,
WHEREAS, the Council has determined that certain activities continuing past 1:00 a.m.
would not disrupt the peace and tranquility of the neighborhoods surrounding the Community
Park, nor jeopardized the safety and welfare of the citizens of the City, nor imperil the
improvements within the park, so long as the activity was properly conducted by responsible
individuals or groups; and,
WHEREAS, the Council has determined that it desires to amend the existing Code to allow
Council to approve, on a case by case basis, activities which will go on past the 1:00 a.m.
extended curfew;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION 1
That Section 6.01 of Chapter 1 of the Wylie City Code, be and hereby is, amended by
deleting the existing section in its entirely and substituting the following therefore:
"§ 6.01 Park Hours Open to the Public
(a) The community parks, recreation and community center, shall be open to the general
public only between the hours of 6:00 a.m. and 12:01 a.m.. unless a ball game or other
recreational or community activity unexpectedly exceeds atime-mired-to-elese-4-2:04.1-
a rn- the 12 01 a.m.: curf +---In-that-,:in which event the time for closing the particular
facilities involved will be extended to 1:00 a.m., at which time all activities in such
facilities will cease, then and the facilities will be closed to the public until 6:00 a.m. the
next morning.
) The curfew restrictions as provided in section (a) may be waived by the City
Council, on a case by case basis, on the written request of the sponsor(s) of an activity
or event, if the Council determines that such activity or event will be.conducted insuch
a fashion so as not to cause disruption of the peace of the neighborhood, and not
otherwise adversely effect the safety or welfare of citizens or City facilities.
(c) It shall be unlawful for any person except members of the police and fire departments
or employees of the parks department engaged in the performance of their official duties
to be in any municipal park between the hours of 12:01 a.m. and 6:00 a.m. unless ade
of the foregoing exceptions appliesy."
SECTION II
That Ordinance 93-4 be, and it hereby is amended by addition of the following sentence
to the last paragraph of the "tournament use" paragraph of the Policy adopted by said ordinance:
"The curfew provisions of these'policies shall be subject to waiver by the City Council
in accordance with Section 6.01 of Chapter 1 of the Wylie City Code."
SECTION III
Any person violating the provisions of this ordinance, or any part hereof, commits an
unlawful act and shall be subject to the general penalty provisions of the Wylie City Code as set
forth in Section 1-1.06 thereof, as the same now exists or is hereafter amended.
SECTION IV
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION V
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION VI
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not
in conflict herewith shall remain in full force and effect.
SECTION VII
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

10-7-93 Establishing Local Tax Exemption for Disabled Persons
SUMMARY OF SUBJECT:
The state Tax Code allows Cities to exempt a portion of a person's homestead from City ad valorem taxes if
the person is over 64 or disabled. The City currently provides such an exemption in the amount of $30,000
for persons over 64. Council has indicated its to desire to provide a similar exemption for disabled persons.
Such an exemption is established by the passage of an ordinance and would become effective for the next tax
year following the present tax year.
ALTERNATIVES:
(1) Pass Ordinance Establishing tax exemption for disabled persons in the amount of $30,000, as stated in
the proposed ordinance
(2) Pass Ordinance Establishing tax exemption for disabled persons with such modification as deemed
appropriate by Council.
(3) Take no action and not provide and continue to not provide any exemption for disabled

DATE: October 7, 1993
The Council has previously considered the possibility and effect of establishing an
exemption from City ad valorem taxes for residence homesteads for disabled persons. At its last
work shop Council directed staff to go forward with such actions as were necessary to establish
the exemptions.
I have drafted an ordinance,which implements the exemption, for Council's consideration
and passage. The ordinance sets the exemption at $30,000 as directed by the Council. This is
the amount of exemption the City currently provides those 65 or over.
The benefit of the ordinance will not go into effect until the tax year following the current
year (FY 95 beginning October 1, 1994). In other words the exemption will appear on the tax
bill which people will be receiving a year from now.
Application and qualification for the exemption is through Central Appraisal. Once a
person qualifies they do not need to re-qualify each year. However, they would cease to be
eligible if they were no longer disabled on January 1 of any given year.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ADOPTING AN
EXEMPTION IN THE AMOUNT OF $30,000 FOR RESIDENCE HOMESTEADS
OWNED BY DISABLED PERSONS IN THE CITY OF WYLIE; REPEALING ALL
CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Section 11.13 of the State Tax Code (Code) makes provision to allow Cities
to establish tax exemption from City ad valorem taxes on residence homesteads owned by
disabled persons in an amount determine and set by the City Council; and,
WHEREAS, the City Council has determined in its legislative capacity that granting such
an exemption for the disabled residence homestead owners in the City would provide a benefit
to such homeowners which would exceed the loss of revenue to the City; and,
WHEREAS, the City presently provides a similar homestead exemption under the authority
of the same section of the Code in the amount of$30,000.00 and therefore deems it appropriate
to establish the disabled exemption in a like amount;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION I
There is hereby established an exemption from taxation by the City of Wylie, Texas, in
the amount of$30,000.00 of the appraised value of the residence homestead of an individual who
is disabled, as disability is defined by Section 11.13 of the Code, as amended.
SECTION II
The exemption herein established shall be available for all tax years beginning after
December 31, 1993.
SECTION III
Persons seeking such exemption shall make application therefore to the Chief Appraiser
of the Central Appraisal District, on or before May 1, of the year in which they desire the
exemption to become effective. All such applications, the forms therefore, and determination
of eligibility for such exemption shall be determined by the Chief Appraiser in accordance with
Chapter 11 of the Code and other applicable state law.
SECTION IV
A disabled person who is eligible for the exemption herein created who is also 65 or older
may not received both a disabled and an elderly residence homestead exemption but may choose
either.
SECTION V
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part o:r provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION VI
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION VII
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not
in conflict herewith shall remain in full force and effect.
SECTION VII
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

WHEREAS, federal unfunded mandates on city governments have increased
significantly in recent years; and
WHEREAS, federal mandates require cities to preform duties without consideration of
local circumstances or capacity; and
WHEREAS, federal mandates require compliance regardless of other pressing local
needs and priorities affecting the health, welfare, and safety of municipal citizens; and
WHEREAS, excessive federal burdens on cities force on citizens and taxpayers either
higher local taxes and fees, reduced local services, or both; and
WHEREAS, federal mandates are too often inflexible, "one-size-fits-all" requirements
that impose unrealistic time frames and specify procedures or facilities when less costly
alternatives might be just as effective; and
WHEREAS, existing mandates impose harsh pressures on local budgets, and the
federal government has imposed a freeze upon funding to help compensate for any new
mandates; and
WHEREAS, the cumulative impact of these legislative and regulatory actions directly
affects the citizens of our cities; and
WHEREAS, the Nation League of Cities (NLC), in conjunction with other state and
local government representatives and state municipal leagues, including the Texas Municipal
League (TML), has begun a national public education campaign to help citizens understand
and then reduce the burden and inflexibility of unfunded mandates, beginning with a
National Unfunded Mandates Day on October 27, 1993;
NOW, THEREFORE, BE IT RESOLVED that the City of Wylie endorses the efforts of
the National League of Cities and the Texas Municipal League and supports working with
NLC and TML to fully inform our citizens about the impact of federal mandates on our city
finances and the pocketbooks of our citizens; and
BE IT FURTHER RESOLVED that the City of Wylie endorses the events that will begin
the process on October 27th; and
BE IT FURTHER RESOLVED that the City of Wylie resolved to redouble efforts to
inform and work with members of our Congressional Delegation to inform them about the
impact of federal mandates and actions necessary to reduce their burdens on our citizens.

SUMMARY OF SUBJECT:
Due to the hardship placed on surrounding property owners by a transient work force
(i.e. urinating in public and theft of water services.) The following is offered
for consideration.
Amend current Building and Construction Regulations to require the placement of
temporary toilet facilities at the job site, or proof that delivery will occur,
prior to the issuance of any permits. Temporary facilities may serve more than
one site if they are within one hundred fifty (150) feet of additional sites
measured along the direction of travel. Also, to require the authorized connection
to the potable water supply to be complete prior to placement of any concrete.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING CHAPTER 3
OF THE WYLIE CITY CODE BY REQUIRING AVAILABILITY OF TEMPORARY
TOILET FACILITIES AND CONNECTION TO CITY POTABLE WATER SUPPLY;
REPEALING ALL CONFLICTING ORDINANCES; CONTAINING A PENALTY
CLAUSE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City has received numerous complaints regarding the lack of toilet facilities
at construction sites within the City; and,
WHEREAS, there is a significant amount of ongoing construction activities in residential
neighborhoods that are partially built out and inhabited, thereby subjecting the residents, some
of which are children, to the unsightly and inappropriate actions of some of the workers at such
sights relieving themselves in full view of those in the vicinity; and,
WHEREAS, the City has experienced problems at construction sites, including without
limitation, improper clean up of concrete jobs, and the incidence of such problems could be
alleviated or significantly reduced if there was a water supply at the sit prior to undertaking any
concrete work; and,
WHEREAS, the City generally has the power to regulate the aforesaid areas of concern
under to insure to health, safety, and welfare of its citizens; and,
WHEREAS, the Council has determined, in its legislative capacity that it should take action
to regulate the aforesaid activities at construction sites and therefore desires to make issuance of
a building permit conditioned upon compliance with both of said provisions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION I
That Chapter 3 of the Wylie City Code be and it hereby is amended by addition of the
following section:
" 1. No building or construction permit shall be issued unless the applicant shall furnish
proof, to the satisfaction of the building official, or their representative, that the site at which
the construction will take place has met both the following requirements:
1
a) Temporary toilet facilities have been placed at the site, or at a neighboring site within
150 feet thereof and accessible by workers on the subject site; and
b) The public potable water supply to the premises shall be connected by the public entity
responsible therefore;
2. In the event that either of these aforesaid requirements shall become non-existent
following issuance of a permit, carrying on of any further construction at such sight thereafter
shall be deemed a violation of this Code and subject the person or persons carrying on such
activities to a fine under the provisions of Chapter 1, section 1.06 of this Code.
SECTION II
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION III
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION IV

The Planning and Zoning Commission was concerned that an auction house could
locate in a retail zoning classification prior to public hearings putting auction houses
in an appropriate zoning classification in our ordinance. We have the ability to refuse
inappropriate uses in any classification but this resolution will enforce the staff's
current practice. The resolution does not create a new or revised procedure.

WHEREAS, the City routinely receives applications for uses within a particular zoning
classification which are not one of the specified allowed uses; and,
WHEREAS, upon receipt of such application the appropriate person on the City Staff
must make a decision as to whether the intended use is of either not allowed, or possibly allowed
as a use of a similar nature and character of the intended uses; and,
WHEREAS, the decision of whether such intended use is allowed, or not, may be
effected by the outcome of an review proceedings then pending before the Planning and Zoning
Commission (P&Z) and/or the City Council and therefore if an application is received during
the pendency of any such review actions it would be consistent with orderly development and
use of properties within the City to delay taking action on such application pending the outcome
of the review proceedings then in progress;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS, as follows:
I.
In those instances where the staff shall receive an application for occupancy of the
property and there is at that time proceedings pending whereby P & Z and City Council will
be considering changing the zoning ordinance in such a fashion that it would effect the granting
of the application, the staff shall delay taking action on such application until final resolution of
the review proceedings by City Council.
II.
This Resolution and the procedures herein established immediately on the passage hereof.

INTERLOCAL AGREEMENT
AGREEMENT, made and entered into between the City of Wylie, Texas,
herein referred to as "City" and the County of Rockwall, Texas, herein referred to
as "County".
WITNESSETH:
WHEREAS, a portion of Rockwall County in the northwest corner thereof is
non-contiguous with and separated by Lake Ray Hubbard from other parts of
Rockwall County, thereby rendering it difficult for County to provide adequate fire
protection in the said area; and
WHEREAS, said area lies outside of the corporate limits of the City but is
easily accessible by City; and
WHEREAS, City has heretofore provided fire protection for said non-
contiguous par of Rockwall County under a previous written agreement; and
WHEREAS, the parties desire to enter into a written agreement providing for
City's continuing its fire protection service and defining the terms and conditions
thereof; and
WHEREAS, parties authority to enter into interlocal agreements under Article
4413 (32c) of Vernon's Annotated Civil Statutes;
NOW, THEREFORE in consideration of the above stated premises and
further consideration of the promises and conditions hereinafter set forth the
parties do hereby agree as follows:
1. The City agrees to provide for fire protection outside the corporate
limits of City, in Rockwall County for the benefit of County in that portion of
Rockwall County described as follows:
An Area in the northwest corner of Rockwall County bounded by Lake Ray
Hubbard on the East, the Rockwall/Dallas County line on the west, Liberty
Grove Road and the Rockwall/Dallas County line on the south and on the
north by the Rockwall/Collin County line (as indicated on the map
designated as Attachment 1 attached hereto, and fully incorporated herein
by reference.
2. The initial term of this agreement shall commence on the approval of
this agreement by both the City and the County and continue to and include the
31st day of December 1994. The agreement shall be automatically renewed for
additional one calendar year terms unless otherwise terminated by either party as
herein provided.
3. County agrees to pay City the sum of two hundred fifty dollars
($250.00) for each dispatch of City fire equipment to any location within the subject
area of Rockwall County during the initial or any extended term of this agreement.
4. In the event either party shall desire to amend or terminate the
agreement the party so desiring shall give the other party ninety (90) days prior
written notice of such intent. Amendments shall be allowed only on annual basis
to become effective on January 1 of the following year; but termination may be
made at any time; provided, however, that any amendment or any termination
shall in any event be subject to the ninety (90) day notice requirement as above
provided.
5. The term "fire protection" as used herein shall mean that the City shall
exercise due diligence and dispatch to respond to any fires which it is informed of
in the subject area and shall take all reasonable efforts available to it to timely
extinguish and limit the damage of any such fire, provided, however, that nothing
in this agreement shall require the City to perform any activities other than that
which could reasonably be expected from it in lieu of its existing equipment and
personnel, at any given time.
IN WITNESS WHEREOF, the parties have caused this agreement to be
executed under the authority of appropriate action taken by their respective
governing bodies.

succussfully germinated. Jeske Construction Company did attempt in good faith to
correct the ditch.

Wylie Oldo Towne Mural... t
Proposal: A painted mural on the south wall of the
building owned by K & S Hair Care Center.
Thorne: "Watching Wylie Waken"... Wylie historical
buildings & references, depicting formative
years of the town.
SiZO: Approximately 12' by 60' on cement block.
Materials: Background coat: all-weather latex paint.
Mural: outdoor bulletin enamels.
Cost: $1700 plus materials, (approximately $300).
Total cost: $2,000. First $500 to be paid by
K & S building owners. The remainder to
be paid by the City of Wylie.
Labor: David Eden, pastor of True Vine Fellowship
& local artist pastor, has provided a working
sketch for the City's approval. Upon approval
Mr. Eden will also paint & supervise the paint-
Caing of the design. He will invite local citizens,
especially youth, to help paint background

colors. This will inspire community pride.
