ITEM NO. 2 - PUBLIC HEARING ON RE-ZONING OF WYLIE AUTO PARTS This property is described as 0 . 4496 acres out of the S . B . Shelby Survey , Abstract 820 and is located on SH78 and is the site of what is known as Wylie Auto Parts . The petitioner is asking for a change from retail zoning to B-2 zoning . The B-2 zoning is compatable with the existing use and the staff recommends approval . ITEM NO. 3 - PUBLIC HEARING ON ZONING OF 2 ACRES ON SH78 This property is described as 2 acres out of the Francisco de la Pina Survey , Abstract 688 and is commonly known as Wylie Junction , it was also the site of Karen ' s Kitchen. The petitioner is asking for industrial zoning for this tract ; however , the staff feels that this zoning is inappropriate and is not in keeping with the projected land use in that area. The staff feels anything higher than a B- 2 zoning would be inappropriate . ITEM NO . 4 - PUBLIC HEARING ON ANNEXATION OF 51 ACRES ON HOOPER ROAD - This property is described as 51 . 531 acres out of the Wm. Sachse Survey , Abstract 835 and is located on the west side of Hooper Road south of FM544 . This property is also known as the B. C . Wood property . The addition of this property will help firm our borders to the South . The petitioner responded to the City ' s invitation to annex in order to be a candidate for City services which are now being planned and designed for the area. The staff recommends approval . ITEM NO. 5 - PUBLIC HEARING ON ANNEXATION OF 4 ACRES ON SH78 This property is described as 4 acres out of the Francisco de la Pina Survey , Abstract 688 and is located on the southeast corner of Eubanks Lane and SH78 . It is also known as the Walter Pair property . The staff has reviewed the petition and recommends approval . ITEM NO. 6 - PUBLIC HEARING ON ANNEXATION 1 ACRE ON SH78 This property is described as 1 .04 acres out of the Francisco de la Pina Survey , Abstract 688 and is located on the east side of SH78 and is the site of Discount Bait House . This is another tract which will extend our corporate limits out 78 to the northeast . The staff has reviewed the request for annexation and recommends approval . ITEM NO . 7 - PUBLIC HEARING ON ANNEXATION OF 150 ACRES ON S . SH78 - This property is described as 143 . 692 acres out of the R . D . Newman Survey , Abstract 660 and 7 . 297 acres out of the H . J . Hardin Survey , Abstract 438 . It is located east of SH78 and south of Century Business Park. This tract is located in the area of dispute between Wylie and Sachse . The owner is aware of the situation and is prepared to present his case in court . The City of Sachse has been advised , by the owner , of the owner ' s intentions and we do expect the City of Sachse to file an injunction at some point . However , we have not , as of the date of this summary , heard anything from the City of Sachse . This property is adjacent to the Geo Lewis property which was annexed several months ago . The tracts that make up this request for annexation and the 296 plus acres contained in the Geo . Lewis annexation are now under one ownership and that owner desires to have the entire acreage in the City of Wylie . The staff has consulted with the City Attorney and has reviewed the facts and we recommend approval of this petition . ITEM NO . 8 - PUBLIC HEARING ON ANNEXATION OF 23 ACRES ON WEST SIDE OF SH78 - This property is described as 12 . 5158 and 3 . 7014 acres out of the R . D . Newman Survey , Abstract 660 ; 2 acres out of the H . J . Hardin Survey , Abstract 438 and 5 acres out of the I . Clifton Survey , Abstract 193 for a total of 23 . 2182 acres . This property is directly adjacent to the 50 acre tract known as the Harvard tract . It is west of SH78 . The staff has reviewed the matter and recommends approval . ITEM NO . 9 - PUBLIC HEARING ON ANNEXATION OF 149.6546 ACRES WEST OF SH78 - This property is described as 149 . 6546 acres out of the H .J . Hardin Survey , Abstract 438 and the R . D . Newman Survey , Abstract 660 . It is located directly adjacent to the property described in item no . 8 . The petitioner requested annexation several months ago but could not be placed on the agenda due to a lack of contiguity . The annexation of the tract described in Item No . 8 now provides that contiguity . This tract is also one to which the City of Sachse feels they have a claim . The petitioner ' s representative has advised the City of Sachse of the their ( the owner ' s) petition for annexation into the City of Wylie , on the advice of the City Manager of Wylie . The staff has reviewed the facts and recommends approval . ITEM NOS . 10-13 - PUBLIC HEARINGS ON ANNEXATION OF LAKE PROPERTY - This represents the next round of Lake annexations . The staff refers to them as annexations 8 through 11 . A great deal of this property is actually covered by water and puts our city limits out into the Lake itself . However , it does extend our ETJ and allows us to become contiguous to properties whose owners have expressed a desire to be annexed into the City of Wylie . The required notices of intent have been sent to the Corps . of Engineers and while the U . S . government does not voluntarily annex property into a City , they are not opposed in any way . Lake Annexation Q11 . 14 ADJOURN •R,7� is • 4Y MINUTES PLANNING & ZONING COMMISSION fHURSDAY, December 12, 1985 the Planning and Zoning Commission for the City of Wylie, Texas met in regular session on December 12, 1985 in the Wylie Community Center. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were: Chairman; Kent Crane, Brian Chaney, Ken Mauk, Bill Chapman and Don Montgomery. Representing the City Staff were Gus Pappas; City Manager , Roy Faires; Code Enforcement Officer; and Kimberly Leverett ; Secretary. The meeting was called to order at 7: 05 P. M. by Chairman Crane. ITEM NO. 1 - APPROVAL OF MINUTES - Chairman Crane asked if there were any changes or additions to the minutes. Hearing none a motion was made by Brian Chaney to approve the minutes as submitted. Bill Chapman seconded the motion. Motion carried 5-0. ITEM NO. 2 - PUBLIC HEARING ON ZONING OF 0.79 ACRES ON FM 3412 -- This property, described as 0. 79 acres out of the E. C. Davidson Survey, Abstract 266, is located on FM 3412 or W. Brown Street. They are asking for agricultural zoning , which is compatible with current use and surrounding use. The staff recommends approval . Chairman Crane opens Public Hearing for discussion by the public. No one speaks for or against. Chairman Crane brings it back for discussion to the board. Does someone have a request or motion? Motion was made by Bill Chapman to except zoning as requested. Brian Chaney seconded the motion. Motion carried 5-0. SH /8, almost directly across the highway from the site of the new City Complex . the requested zoning is in compliance with the uses described in the Zoning Ordinance of the City of Wylie and is compatible with the projected land use plan for the City. AN ORDINANCE OF THE CITY OF WYLIE , TEXAS ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF WYLIE, TEXAS , AND EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF SAID PROPERTY , ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES , ACTS , RESOLUTIONS AND REGULATIONS OF TILE CITY ; PROVIDING A SEVERABILITY CLAUSE ; AND PROVIDING THE EFFECTIVE DATE OF SAID ORDINANCE . It is the intention of the City to annex only that territory which is legally subject to being annexed by the City and should any portion of the above described territory be not subject to legal annexation by the City of Wylie , texas , such fact shall not prevent the City from annexing such portion of said territory which is subject to legal annexation by the City of t?ylie , Texas .
