07-03-1986 (Planning & Zoning) Agenda Packet AGENDA SUMMARY PLANNING & ZONING COMMISSION THURSDAY, JULY 3, 1986 ITEM NO. 1 - APPROVAL OF MINUTES - No additions or corrections. ITEM NO. 2 - PRESENTATION BY CURTIS CAPELLE OF RUSTIC OAKS Mr . Capelle is represnting a group of homeowners in Rustic Oaks who feel that the development just south of the single- family residential area of Rustic Oaks was misrepresented to them at the time they bought their property. They feel that the salespeople deliberately led them to believe that the area now zoned MF was to be single family with a "greenbelt" to the railroad tracks. They are asking that this area now zoned for MF be changed, by the City, to reflect the zoning they believed to be in effect when they bought their property. Mr. Faires has researched this matter through court cases and will be prepared to present his findings to you at your meeting. Mr. Pappas will be back and will also be in attendance at the meeting. ITEM NO. 3 - PUBLIC HEARING ON ZONING OF 10 ACRES ON SH78 This property is described as 10.4996 acres out of the Francisco de la Pina Survey, Collin County Abstract 688 and is located on E. SH78 in front of Wylie Ranch East. The petitioner is asking for B1 zoning. The staff has reviewed the request and recommends approval . ITEM NO. 4 - PUBLIC HEARING ON RE-ZONING OF "THE MEADOWS" This property is located at the triangle formed by S. Ballard, Stone Road and S. Birmingham. It is currently designated as 2F (duplex) . The petitioner is requesting re- zoning to PD (planned development) and is submitting a plat with this proposal as required by our Subdivision ordinance. It is his desire to build zero lot line houses on this tract. Birmingham. 5 ADJOURN MINUTES PLANNING & ZONING COMMISSION THURSDAY, JUNE 19, 1986 The Planning and Zoning Commission for the City of Wylie, Texas met in regular session on June 19, 1986 in the Wylie Community Center. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were: Chairman Kent Crane, Vice-Chairman Brian Chaney, Ben Scholz , J. F. Hall , Bill Chapman , and Fred Ouellette. Ken Mauk was absent. Representing the city staff was Gus H. Pappas, City Manager; Roy Faires, Code Enforcement Officer; and Amanda Maples, Secretary. The meeting was called to order at 7:00P.M. by Chairman Kent Crane. ITEM NO. 1 - APPROVAL OF MINUTES - Chairman Kent Crane said that Item #2 was written that the SF3 lots would have a square footage of 6000 ft. and it should have been 8000 sq. ft. Bill Chapman made a motion to accept the minutes of the June 5, 1986 meeting with this item changed. F. J. Hall seconded the motion. Motion carried 6-0. ITEM NO. 2 - PUBLIC HEARING ON ZONING OF 2.52 ACRES ON E. FM544 - This property is described as 2.52 acres out of the J. D. Shelby Survey, Collin County Abstract 819 and is located at 1825 E. FM544. The petitioner is requesting B2 zoning for the entire tract. Chairman Kent Crane opened the public hearing. There being no questions or opposition the public hearing was closed and brought before the board for discussion. City Manager , Gus H. Pappas, said that the existing use was backwards from our usual approach at zoning. This request is for zoning on the entire tract. It is now located on an innersection however , the new thoroughfare will bypass this tract and it will no longer be at an innersection. The current land use plan in this area is SF3. Consider the fact that the commercial is on the back and the residential is up front; the construction business would fit into 82 and it takes up the majority of the land so, in that since 82 zoning would be appropriate. Chairman Kent crane stated that the Planning and Zoning Commission was faced with a difficult decision in zoning this property because it would set a precident for the entire area. Keeping in mind the entire area, I am uncomfortable with B2 zoning. I feel that we should protect the other land owners around this property. In my opinion, I feel that the staff was correct in their land use plan for this area whether it is SF3 or SF2. Fred Ouellette said that since the surrounding area was undeveloped, we should leave it as it is until their was more development out there. It won 't hurt his business now, he just can 't expand on it. Bill Chapman made a motion to change the zoning to SF2. Fred Ouellette seconded the motion. Motion carried 6- O. ITEM NO. 3 - REPLAT OF LOTS 1-8. BLOCK 17 RAILROAD ADDITION - This property is described as Lots 1-B, Block 17, Railroad Addition , 1. 64 acres out of the James Truitt Survey, Collin County Abstract 920. The owner , First Baptist Church, is asking that these lots be replated into one lot for future building pruposes. The Engineering Department has reviewed the plat and recommends approval . City Manager , Gus H. Pappas, stated that the First Baptist Church occupies this block and now with their latest expansion they are having problems with crossing lot lines and set backs. Their purpose for replating this into one lot is to alleviate this problem. They are also asking you to abandon the alley. The alley has one ( 1 ) service in it and they will be required to re-route it. Vice-Chairman Brian Chaney made a motion to accept the replat. Bill Chapman seconded the motion. Motion carried 5-0. Chairman Kent Crane obstained from the vote due to his involvement in this matter . ITEM NO. 4 - APPROVE FINAL PLAT FOR POINTE WEST - This tract is located on FM1378 and is bounded by Lake Ranch Road, FM1378 and Lake Ranch Estates. The Engineering Department has reviewed this plat and find that it complies with the subdivision regulations of the City of Wylie. Appropriate fees have been paid and the Engineering Department recommends approval . City Manager , Gus H. Pappas, stated that the staff recommends approval of this plat. They have met the requests of the City Council and the Planning Zoning Commission with great detail . Bill Chapman made a motion to accept the final plat. Vice-Chairman Brian Chaney seconded the motion. Motion carried 6-0. ITEM NO. 5 - APPROVE PRELIMINARY PLAT FOR LAKE RAY HUBBARD MOBILE HOME PARK - This tract is located on FM544 and is in the tri-county area. The plat has been reviewed by the Engineering Department and they find that it complies with the subdivision regulations of the City of Wylie. Engineering therefore recommends approval . City Manager , Gus H. Pappas, stated that in reviewing this preliminary plat remember that this is a Mobile Home Park and not a Sub- division. This is one piece of property and will remain that way because the lots will never be sold. I would like to suggest to you that you review this carefully and become very familiar with this. The staff has reviewed this and it meets our requirments. Vice-Chairman Brian Chaney made a motion to accept the preliminary plat with the exception of • • • • • • designating Lot #24 as an open area for better access to the already purposed open area on the west side also to the meet the minimum requirement for open area in accordance with the City of Wylie Mobile Home Park Ordinance. Bill Chapman seconded the motion. Motion carried 6-0. Chairman Kent Crane asked City Manager , Gus H. Pappas if he had received any responce to the invitation from the Planning And Zoning Commission to the City Council for them to attend some of the P&Z meetings. City Manager , Gus H. Pappas stated that he had talked with some of the Council members but that he had not received any formal responce. Chairman Kent Crane stated that many of the Planning And Zonning members had attended the City Council meeting to see how our system works. I would like to emphasize how important it is for the City Council Members to to see how much consideration is put into our decision making process. I feel that it would be in the best interest of all of the citizens of Wylie. ITEM NO. 6 - ADJOURNMENT - Vice-Chairman Brian Chaney made a motion to adjourn. Bill Chapman seconded the motion.
