PLANNING & ZONING COMMISSION
REGULAR MEETING
THURSDAY MAY 21. 1987
The Planning and Zoning Commission for the City of Wylie.
Texas met in a Regular Meeting on May 21 . 1987 in the
Community Room at 800 Thomas Street. A quorum was present.
notice of the meeting had been posted for the time and in
the manner required by law. Those present were: Chairman
Brian Chaney. R.P. Miller, Jay Davis. and Ken Mauk. Those
absent were Vice-Chairman Ben Scholz and Bill Chapman.
Representing the city staff was Roy Faires, Code Enforcement
Officer and Amanda Maples, Secretary.
The meeting was called to order at 7:30 p.m. by Chairman
Brian Chaney.
ITEM NO. 1 - APPROVAL OF MINUTES OF MAY 14. 1987- Ken Mauk
made a motion to accept the minutes as presented. Jay Davis
seconded the motion. Motion carried 4-0
ITEM NO. 2 - CONSIDER RECOMMENDATIONS TO CITY COUNCIL ON THE
PASSAGE OF AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE -
Roy Faires, Code Enforcement Officer, presented the Planning
and Zoning Commission with a different copy of the amendment
to the Subdivision Ordinance for their review, explaining
that and ordinance in the book had been misnumbered and this
new ordinance changes the wording in paragraph 8, section A
and makes provisions for a letter of credit.
Mr. Faires explained further, that the reason for this
amendment proposal is that the Council has had some concerns
recently about off-site water and sewer problems, easements
that have been threatened against Public Utilities and with
the fact that contractors should be required to have
liability insurance due to a recent accident which occurred
with a contractor and the lady threatened to bring a lawsuit
against the City.
Chairman Brian Chaney stated that he felt that this would
give the City more protection and that he did not see any
problem with adding this to the Subdivision Ordinance.
Ken Mauk said that he felt that this amendment was good
because it protected both parties.
R. P. Miller made a motion to approve the amendment to the
Subdivision Ordinance. Jay Davis seconded the motion.
Motion carried 4-0.
ITEM NO. 3 - ADJOURN - Ken Mauk made a motion to adjourn the
May 21 , 1987 Regular Meeting of the Planning and Zoning
Commission. Jay Davis seconded the motion. Motion carried
4-0.

AN ORDINANCE OF THE CITY OF WYL IE, TEXAS
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE #81-
5, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, TEXAS, AS
HERETOFORE AMENDED, BY ADDING TO THE SPECIFIC USE CLASSIFICATION A NEW
AND HERETOFORE UNLISTED USE, TO WIT: PAWN SHOPS; PROVIDING A REPEALING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR
VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND
DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to
amendments to the zoning ordinance and zoning map, have given requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair
hearing to all property owners generally, the said Governing Body is of the opinion
that the Comprehensive Zoning Ordinance of the City of Wylie should be amended in
the exercise of its legislative discretion:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1. That Ordinance #81-5, the Comprehensive Zoning Ordinance of the
City of Wylie, Texas, be, and the same is hereby amended, by adding to Section 18,
subheading 18.1, under the listing for specific uses a new listing to read as follows:
"9. Pawn Shops"
SECTION 2. That Ordinance #81-5, the Comprehensive Zoning Ordinance of the
City of Wylie, Texas, be, and the same is hereby amended, by adding to Section 19,
subheading item 8, a new listing to read as follows:
"G. Pawn Shops"
SECTION 3. That all ordinances of the City in conflict with the provisions of
this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions of this ordinance shall remain in full force and
effect.
SECTION 4. Should any paragraph, sentence, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or Invalid, the same
shall not affect the validity of this ordinance as a whole or any part or provision
thereof other than the part so decided to be invalid, illegal or unconstitutional and
shall not affect the validity of the Comprehensive Zoning Ordinance as a whole.
SECTION 5. Any person, firm or corporation violating any of the provisions or
terms of this ordinance shall be subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction
shall be punished by fine not to exceed the sum of One Thousand Dollars ($1,000.00)
for each offense, and each day such violation shall continue to exist shall constitute
a separate offense.
SECTION 6. This ordinance shall take effect immediately from and after its
passage and publication of its caption, as the law in such cases provides.
