Consider, and act upon, approval of the Minutes of the October 25th and November 1, 2011 Regular Meeting of the Wylie City Council. (C. Ehrlich, City Secretary) REGULAR AGENDA Public Hearing 1. Hold a Public Hearing and consider, and act upon, amending the zoning from Agricultural (AG/30) to Planned Development Single Family Detached (PD SF) District. The 36 acre tract is located south of E. Brown Street and west of W.A. Allen Boulevard. ZC 2011-06 (R. 011ie, Planning Director) Executive Summary The applicant is requesting to establish permanent zoning on an approximate 36 acre tract generally located south of E. Brown Street and west of W.A. Allen Boulevard. Annexation of the referenced Kreymer Family tract was in conjunction with a series of comprehensive citywide annexations in 1986. Multiple tracts would eventually be zoned for single family development and several would retain their Agriculture designation and continue to be used for agricultural and open space uses. 2. Hold a Public Hearing and consider, and act upon, an Amendment to PD 2003-01, Section 4.06 to modify parking and landscape requirements as it relates to theater development. ZC 2011-07 (R. 011ie, Planning Director) Executive Summary The subject property(Tract C-1)is located west of Woodbridge Parkway and Wylie High School and south of F.M. 544 and consists of 10.759 acres. The applicant is requesting to amend Section 4.06 Parking Design Requirements of Planned Development 2003-01 to modify the conditions of the PD for the development of a 2,002 seat movie theater(Exhibit"B"). 3. Hold a public hearing and consider, and act upon, approval of Ordinance No. 2011- 25 authorizing the taxation of tangible personal property in transit which would otherwise be exempt pursuant to Texas Tax Code, Section 11.253. (S. Satterwhite, WEDC Executive Director) Executive Summary The 82nd Texas Legislature in Special Session enacted Senate Bill 1 which amends the Texas Tax Code, Section 11.253 (j-1). The bill is very similar to the Freeport exemption passed many years ago, but has potentially a larger impact as time goes on. The City of Wylie has not passed the Freeport exemption and continues to tax Freeport goods, which is primarily inventory of companies such as Sanden International, Bayco Products, Carlisle Coatings&Waterproofing,and Extruders division of Atrium Companies,Inc. General Business 4. Consider, and act upon, Ordinance No. 2011-26 amending Chapter 98 (Solid Waste), Article II (Collection and Disposal) of the City of Wylie's Code of Ordinances; providing for a penalty for the violations of this ordinance; providing for repealing, savings and severability clauses; providing for an effective date of this ordinance; and providing for the publication of the caption hereof. Some of the provisions of the current ordinance conflict with the manner in which solid waste service is currently provided. This amendment eliminates conflict between the ordinance and the current solid waste contract. This amendment also eliminates some of the specifics as to the manner in which solid waste services are provided so that the ordinance will not have to be amended every time Council makes a change in the contract or technology changes. 5. Consider, and act upon, Resolution No. 2011-27(R) casting a vote for a candidate to the Board of Directors of the Dallas Central Appraisal District for a two year term beginning January 1, 2012. (C. Ehrlich, City Secretary) Executive Summary The Property Tax Code requires that the Chief Appraiser conduct an election for the purpose of selecting representatives to the Board of Directors of the Dallas Central Appraisal District every two years. The Dallas Central Appraisal District has a five member Board of Directors; one representing the County (Dallas County Tax Assessor Collector), a representative appointed by the Dallas ISD, a representative appointed by the City of Dallas, a representative elected by the suburban cities (31 cities), and a representative elected by the suburban ISDs(16 ISDs). 6. Consider, and act upon, Resolution No. 2011-28(R) casting votes for a candidate to the Board of Directors of the Collin Central Appraisal District for a two year term beginning January 1, 2012. (C. Ehrlich, City Secretary) Executive Summary The City of Wylie has 65 votes that they may cast for a candidate to the Board of Directors of the Collin Central Appraisal District for a two year term beginning January 1,2012. The City of Wylie may cast all of its 65 votes for one candidate or distribute the votes among any number of candidates that were nominated. WORK SESSION • Discuss Planet Kidz Youth Program update. REGULAR AGENDA 7. Consider, and act upon, modifying the Wylie Recreation Center operational hours and authorizing the City Manager to execute a lease agreement with Planet Kidz, Inc. for the operation of a youth activity program at the Wylie Recreation Center, contingent upon City Attorney approval of the agreement and insurance documents. Diaz, Parks and Recreation Superintendant) Executive Summary If the City Council recommends implementing the Planet Kidz program following the work session on November 8, 2011, staff has placed this individual item for consideration on the Council Agenda per direction provided by City Council at the October 25, 2011 Work Session. This item would allow the Council to alter the Wylie Recreation Center hours of operation and by Resolution authorize the City Manager to enter into a lease agreement with Planet Kidz, Inc. pending City Attorney review of the agreement. Mayor Eric Hogue called the meeting to order at 6:04 p.m. City Secretary Ehrlich took roll call with the following City Council members present: Mayor Pro Tem Red Byboth, Councilwoman Diane Culver, Councilwoman Kathy Spillyards (arrived 6:07 p.m.), Councilman David Goss, Councilman Rick White, and Councilman Bennie Jones. PRESENTATION • Presentation and recognition of participants in the National Community Planning Month from Harrison Intermediate School. Planning Director 011ie addressed Council stating that the sixth grade science students of Harrison Intermediate School recently worked on a project called A Tale of Two Cities. Students were given information that a wildfire had hit Wylie! People were able to return to their home, but City services were down. As a result, trash was piling up, no mail was being delivered, and power was out in all areas of the City including City Hall. Using their knowledge of cells, students presented a short newspaper story and video to assist Wylie in dealing with this wildfire disaster. Student participants included Seth Ragsdale, Reilly Clark, and Maria Ordonez. Don Helium, residing at 301 Rushcreek Drive, Wylie, addressed Council reminding seniors of the change of enrollment time for Medicare to October 15th through December 7th of this year. He explained that Medicare would not accept any changes after the deadline, until the following enrollment year. Bobby Heath, residing at 205 Arborview, Wylie, and representing the Wylie Downtown Merchants Association, addressed Council reminding everyone of "Boo on Ballard" scheduled for October 27th with an alternate rain day of October 31st. He asked citizens to bring their children downtown for the event. REGULAR AGENDA General Business Tabled from 10/11/2011 Regular Meeting Minutes October 25, 2011 Wylie City Council Page 2 Motion to remove from table and: Council Action A motion was made by Mayor Pro Tem Byboth, seconded by Councilman Goss to remove consideration of Item #1 from the table and consider. A vote was taken and the motion passed 7-0. 1. Consider, and act upon, a request by Skorburg Company to construct an estate residential street section on portions of the Braddock Place property to serve lots with square footage equal to or larger than 16,000 square feet, and issues regarding the Wooded Creek Subdivision amenity center. (C. Holsted, City Engineer) Staff Comments City Engineer Holsted addressed Council stating that the City of Wylie Design Standards and Construction Details include a design for an estate residential roadway section for lots of one acre or larger. Skorburg Company has requested to construct an estate residential street section on portions of the Braddock Place property that serve lots with square footage equal to or greater than 16,000 square feet. Citizen Comments Arcos Guerra, 204 Wooded Creek Avenue; Myssie English, 309 Wooded Creek Avenue; and Debbie Rusau, 2805 Sequoia Lane, Wylie, residents of Wooded Creek, Phase 1 subdivision addressed Council with concerns regarding Skorburg Company and the construction of an amenity center including a pool that they had been told would be built in their Wooded Creek subdivision. After several years the amenity center was not under construction or planned. Council Discussion City Manager Manson reported that according to the ordinance adopting the Planned Development for Wooded Creek, there is no time line for the building of the amenity center or pool. She explained that a couple of years ago when citizens in this development complained, the City contacted the City Attorney's Office. They opined that according to the ordinance there was nothing the City could do to expedite the building of the Wooded Creek amenity center until the construction of Phase II. Mayor Hogue asked Mr. Buczek, representing Skorburg, to come forward and explain what the company was planning to do in regard to the Wooded Creek Phase I amenity center. Skorburg Company representative Adam Buczek responded that the Planned Development agreed upon by the developer (Skorburg) and the City did not require the amenity center to be built until the construction of Phase II of the development. Due to the economic turn over the last few years, construction of Phase II of this development has been delayed. Buczek noted that the site for the amenity center has always been located in Phase II. He noted the amenity center and pool would be built during the construction of Phase II of Wooded Creek subdivision. Mayor Hogue asked if Skorburg was soliciting any builders for Phase II. Mr. Buczek reported that his hope was to finalize negotiations with a builder within 30 days. He reported once all documents were approved and paving was completed, the amenity center would be the next construction phase. He noted his goal was to start the amenity within a year. Minutes October 25, 2011 Wylie City Council Page 3 Several Council members indicated that this was unacceptable for the residents of Wooded Creek, Phase I. Mayor Pro Tem Byboth recommended tabling the item and requested Mr. Buczek to go back to his company and come up with a plan and timeline to complete this amenity center in Wooded Creek and bring this plan and timeline back to present to the Council. Mr. Buczek explained that these were two separate items with regard to Wooded Creek subdivision and Braddock Place and had two separate sets of partners and bank obligations. He indicated that he was not sure they could wait for the requested improvements to Braddock Place. He stated if Skorburg needed to make a change, they would make a change, referencing Braddock Place. Buczek stated that Braddock Place with the larger lot program were selling approximately 25 homes per year and the company needed to focus on what is embraced by the consumer. Councilman White commented that one acre lots were approved for Braddock Place, and then Council made the exception to allow some lots to be less than half an acre. He noted that Skorburg was now requesting smaller lots. Councilman White explained that when this PD was passed by Council, he was very much in favor of acre lots and not stepping down from that standard. He noted that six years later he had not changed his mind in this regard. Council Action A motion was made by Mayor Pro Tem Byboth, seconded by Councilman Jones to table Item #1 to a non specific date to allow time for Skorburg to present more information on the Wooded Creek subdivision. A vote was taken and the motion passed 7-0. Public Hearing 2. Hold a Public Hearing and consider, and act upon, approval of a Residential Replat for Railroad Addition, Block 22, Lot 2 subdividing a single residential lot for two-family (duplex) development, generally located west of Fourth Street and south of Oak Street. (R. 011ie, Planning Director) Staff Comments Planning Director 011ie addressed Council stating that the lots total 0.186 acre and will create two residential (duplex) lots. The property is zoned Multifamily (MF) and was originally platted as Original Town of Wylie Addition in late 1930s or early 1940s. The applicant intends to develop a duplex single family residential development on the vacant property. Single Family Dwelling, including `duplex,' is an allowed use by right within MF zoned properties. The applicant plans to preserve all mature trees onsite as possible. 011ie reported that The Commission asked if the duplexes would conform to current standards, staff confirmed all current zoning codes and building codes would be followed. The Commission voted 6-0 to recommend approval. Public Hearing Mayor Hogue opened the public hearing at 7:24 p.m. asking anyone present who wished to address Council on this item to come forward and keep their comments to three minutes. No one came forward to address Council during the public hearing. Mayor Hogue closed the public hearing at 7:24 p.m. Minutes October 25, 2011 Wylie City Council Page 4 Council Action A motion was made by Councilwoman Spillyards, seconded by Councilman Jones to approve a Residential Replat for Railroad Addition, Block 22, Lot 2 subdividing a single residential lot for two-family (duplex) development, generally located west of Fourth Street and south of Oak Street. A vote was taken and the motion passed 7-0. 3. Consider, and act upon, approval of a Parking Agreement between the owners of Block 1, Lot 20R of the Brown and Burns Addition and the City of Wylie. (R. 011ie, Planning Director) Staff Comments Planning Director 011ie addressed Council stating that the applicant is requesting to construct five (5) parking spaces to accommodate his office use as well as additional spaces for visitors to downtown. The subject property is adjacent to a City owned parking lot that consists of ten (10) parking spaces. The parking agreement is needed because of the location of the spaces. A portion of the property line when plated is on City property; therefore, the five (5) parking spaces, if constructed by the applicant would partially be on City property. The property owner would be responsible for construction and maintenance of the parking spaces. The applicant is allowing the City to use these spaces as public parking. Council Comments Mayor Hogue asked when the applicant was planning to start construction of the spaces if approved. Ms. 011ie replied right away if approved. Councilwoman Culver asked if the spaces would ever be restricted from public parking, and if the applicant restricted the spaces would they lose their certificate of occupancy. Planning Director 011ie replied that was correct, at no time would the public parking be restricted, and yes they could lose their certificate of occupancy. Council Action A motion was made by Mayor Pro Tem Byboth, seconded by Councilman White to approve a Parking Agreement between the owners of Block 1, Lot 20R of the Brown and Burns Addition and the City of Wylie. A vote was taken and the motion passed 7-0. 4. Consider, and act upon, acceptance of the resignation of Greg Wooding and appointment of a new member to the Library Board for the unexpired term of October 2011 to July 2013. (R. Orozco, Library Director) Staff Comments Library Director Orozco addressed Council stating that Greg Wooding was appointed in July 2011. Due to personal reasons, Mr. Wooding has resigned. The Library Department recommends that the vacancy be filled by a qualified applicant. Council Action A motion was made by Councilwoman Culver, seconded by Councilman Jones to accept the resignation of Greg Wooding and appoint Timothy McCray as a new member to the Library Minutes October 25, 2011 Wylie City Council Page 5 Board for the unexpired term of October 2011 to July 2013. A vote was taken and the motion passed 7-0. WORK SESSION • Discuss Planet Kidz Youth Program update. Parks and Recreation Superintendent Robert Diaz addressed Council stating that on June 28, 2011 the City Council met to discuss implementing Planet Kidz into the youth programs. At that time Council directed staff to discuss the program with WISD to see if they had any interest in hosting the program. Diaz reported that he had spoken to WISD staff in the Communications and Maintenance Departments and they had not shown an interest in hosting the event. Diaz reported he had taken the item back to the Parks and Recreation Board and the board had recommended revising the hours of the Recreation Center in order to provide the same amount of hours to the members and still host the new program. He reported currently the recreation center was open on Saturday from 8 a.m. to 8 p.m. and Sunday from noon to 8 p.m. (20 hours). He suggested two scenarios, Saturday 6 a.m. to 6 p.m. and Sunday noon to 8 p.m. (20 hours) or Saturday 7 a.m. to 6 p.m. and Sunday 11 a.m. to 8 p.m. (20 hours). Parks board members Matt Rose and Anne Hiney were present and reported the Parks Board was recommending implementing the youth program. Dale Oaks, founder of Planet Kidz, reported the programs in other cities have been very successful and beneficial to the kids. Council Direction Council directed staff to contact WISD staff to determine if the school superintendent and the board of trustees were aware of the request to host this program, and survey the number of recreation members that utilize the facility during the hours in question and report back to Council at the November 8th meeting; including a possible action item. • Engineering Department Overview. City Engineer Hoisted gave a short Engineering Department overview which included current road projects and recommended future road projects. Brown Street and west of W.A. Allen Boulevard. ZC 2011-06 Discussion Owner: Bill Kreymer. Applicant: Jim Douglas with Douglas Properties, Inc. The applicant is requesting to establish permanent zoning on an approximate 36 acre tract generally located south of E. Brown Street and west of W.A. Allen Boulevard. Annexation of the referenced Kreymer Family tract was in conjunction with a series of comprehensive citywide annexations in 1986. Multiple tracts would eventually be zoned for single family development and several would retain their Agriculture designation and continue to be used for agricultural and open space uses. The property's northern boundary abuts Brown Street and the eastern boundary is adjacent to Eastridge single family residential subdivision. The western portion extends to another adjacent A/30 zoned tract and the property extends south to the existing Rush Creek and 100 year flood plain. The property has native vegetation with various groups of mid-to large trees and has varying degrees of topography, mostly sloping towards Rush Creek. Rush Creek is a natural tributary to Lake Lavon and a prominent feature of the terrain as well as multiple open space areas. The applicant/owner is requesting a change in zoning to Planned Development Single Family Detached (PD- SF) District to allow for a suburban single family residential neighborhood. The features of the proposed development will be consistent with the City's Comprehensive Plan in preserving natural open spaces and providing pedestrian paths & connections. PD districts allows for innovation in development projects envisioned by the City's Comprehensive Plan. Further, single family residential developments should be sensitive, compatible in scale, character and intensity with surrounding residential neighborhoods. The prominence of 100 year flood plain, Rush Creek, open spaces and tree canopy groups poses a challenge in following the City's standard SF 10/24 zoning district. Page 1 of 2 Page 2 of 2 The current Comprehensive Plan designates Medium Density Residential for the area of this request. Medium Density Residential category is for single family detached houses requiring minimum 10,000 square foot lots and may be permitted to have special design standards. Adjacent single family residential properties to the east were developed under the 1999 Comprehensive Land Use Plan requiring minimum 8,500 square foot lots. The applicant has provided a zoning exhibit to serve as preliminary plat(Exhibit C) for this proposal as well as a list of proposed planned development provisions (Exhibit B) that will establish additional design guidelines. (See Attached) The applicant has also been collaborating with Park's Department staff and the City's Park's Board in the dedication and construction of public hike & bike trail, open spaces and other recreational amenities (Exhibit D) that will be incorporated through the proposed neighborhood as well as open space and other pedestrian linkages. In summary, the request to rezone property from Agricultural to PD-SF is consistent with the City's Comprehensive Plan Land Use Map and does conform to the Comprehensive Plan's philosophy. In addition, staff recognizes the applicant's desire to preserve open spaces and natural systems along with providing a homeowners association with responsibility of maintenance of those areas accordingly. At the September 26, 2011 Parks Board meeting; the Board accepted the applicant's proposal for parkland dedication and recommends approval subject to planned development provisions. Notification/Responses: Thirteen (13) notifications were mailed, with three (3) written response returned favoring the request and three (3)responses opposing the request at the time of posting. Planning Commission Discussion Fencing would conform to current design regulation requiring board on board with metal post. Commissioner Wright asked if the 50% of houses 2,200 s.f. or larger could be on the higher end closer to 2,800 s.f. The applicant stated that they would build as large a house as the customer desired or the market dictates. The price point would be around $249,000. Erosion control to protect Rush Creek was also discussed and confirmed that it would meet city standards. It was also discussed if a right turn lane would be installed from Brown Street onto the subject property. The applicant stated that they are working with the engineer to determine the need. If the traffic study indicates the need for a right turn lane, then they (the applicant)would install it. Commission voted 5-0 to recommend approval. Commissioners Dahl & Smith were absent. The subject property (Tract C-1) is located west of Woodbridge Parkway and Wylie High School and south of F.M. 544 and consists of 10.759 acres. The applicant is requesting to amend Section 4.06 Parking Design Requirements of Planned Development 2003-01 to modify the conditions of the PD for the development of a 2,002 seat movie theater(Exhibit"B"). The subject tract was annexed into the City of Wylie in 1995 and is part of the overall Planned Development containing 157.29 acres approved January 14, 2003. The development is a master planned multi-use community consisting of mixed uses including both residential and commercial parcels. This request only modifies the conditions of the 10.759 acres of Tract C-1 of the existing PD and does not alter any other uses or regulations in the approved Conditions of the Planned Development District. Prior to adoption of the 2001 Comprehensive Zoning Ordinance, all required parking spaces measured 9 feet wide by 20 feet deep. The original conditions of the PD required all parking spaces be 10 feet wide and 20 feet deep for all commercial development. The parking ratio would be 1 space for every 5 theater seats in lieu of the 1 space for every three seats or bench seating spaces plus one per each employee. Parking aisle widths remain the same at 20 feet wide for one-way aisles and 24 feet wide for two-way aisles. Under the current ordinance, 667 parking spaces would be required plus one space for each employee. Based on the proposed amendment, the subject lot 1 would contain 393 parking spaces on site and 27 parking spaces off- site (lot 2 & 4), for a total of 420 spaces. Page 1 of 3 Page 2 of 3 In addition to the parking spaces, the applicant is requesting to increase the distance between landscape islands within the parking lot. The ordinance requires all parking rows to have a landscaped island every 12 spaces, in addition to no parking space further than 60 feet from a landscaped area on site. The amendment originally requested that for every parking row a landscape island to be no more than 25 spaces. This proposal now asked for an island every 20 spaces. The applicant proposes larger planting areas and buffers along the perimeter of the lot including a wider landscaped pedestrian path through the heart of the lot. The development exceeds the required 25 points of Site Design regulations of the PD. The development will met the desirable by orienting the front facade to the street (10 pts); combining access points with adjacent tracts (20 pts); direct connection between the buildings and street by providing an enhanced landscape walkway (10 pts), for a total of 40 points. The PD requires a minimum of 25 points for Landscape Design. The development also exceeds this requirement. Points will be achieved by exceeding the minimum landscaping of parking lots in excess of 50 s.f . per space (14 pts); creating a landscaped pedestrian connection to the main entrance (20 pts); and increase in width of the public walkway from 4' to 5 feet(5 pts), for a total of 39 points. CONSIDERATIONS: The theory to reduced parking can be summarized as Managed Parking. For example, 100 employees can typically share 60— 80 spaces because not all employees arrive at the same time. Therefore, managed parking as opposed to assigned individual parking eliminates over parking and excessive concrete. Typically the practice of parking ratios for entertainment type uses is based on peak demand periods, which usually cover the periods of Thanksgiving, Christmas and New Years. Other times during the year do not see such high parking demands. The table below is an excerpt from a Shared Parking study performed by Victoria Transport Policy Institute utilizing the Transportation Management Programs (TDM). The Commission recommends that the conditions be modified to allow a maximum spacing of 20. Additionally, the Commission recommends maintaining the 10x20 parking spaces and allowing a parking ratio of 1:5. The Commission discussed drainage issues along Security Court. A property owner commented that their property receives a lot of runoff from adjacent properties. Staff stated that engineering plans would be submitted to the city prior to any permits being released to indicate how the subject property would drain. The proposed 12-screen theatre will have 2002 seats (including handicap area seating) and under the current ordinance, the required number of off street parking spaces would be 667. We are requesting that the Ordinance No. PD 2003-01 be amended to allow for a parking space to seat ratio of 5 seats to 1 space. The included parking lot design has 420 parking spaces on the theatre lot and shared lot; exceeding the requested 5:1 ratio. We believe that the current ordinance is based on outdated assumptions of movie theatre attendance patterns. We believe the current ordinance reflects markets that do not have a multi-screen theatre within their jurisdictions. The current ratio was developed in the 1970's and early 1980's as operators began building theatres with multiple screens. Early multi-screen theaters were 2 or 3 screens with movies showings at equal start times. As the industry evolved over the next 30 years show time staggering was implemented for better traffic flow and theater chains added many screens offering a variety of movies with progressively decreasing audience sizes. The staggered show times and expanded movie selections have continued to decrease peak demand on parking lot capacity. Additionally it has been discovered that the youth audience has increased the pick up and drop off traffic while decreasing parking demand. While the proposed Wylie 12 can seat 2002, it is impractical to expect to ever reach full occupancy. We have included with this letter several documents breaking down actual attendance of two 8- screen movie theatres currently in operation. The drawing area for the Cowley Cinema 8 and the Claremore Cinema 8 will be smaller than a theatre in Wylie Texas but the flow and demand on the facility will be similar. The Daily Gross pages from 2007 are included for the busiest week of the year as well as a week during the school year. These pages illustrate attendance trends throughout the year. Also included in the packet is a break down of these weeks by showtime as well as summary page. Our research and experience tells us that at its busiest time, the Wylie 12 will rarely be more than half full. The proposed site location for this theater project offers another unique opportunity in that historically the slowest time for theater traffic is during school session activities. We believe that the theater parking lot could be used for overflow parking from the adjacent football stadium and if the theater parking ever reached capacity in the summer weekends or at Winter break, the adjacent school parking lot could serve the same function. Please keep in mind that we don't ever expect the theater lot to reach capacity, even at the busiest time. Intermediate Parking Landscape Island Spacing: The current ordinance in Wylie Texas requires that parking fields in retail developments have an intermediate parking landscape island located at a maximum of 12 spaces. We are requesting for maximum spacing be amended to 25 spaces. Given the substantial size of the proposed parking field, we believe that the 12 space requirement will create too many islands in the field which are harder to maintain adequate landscape and keep protected from pedestrian foot traffic. Because of their size and location they catch more abuse than any other part of the parking lot; customers drive up and over them, they are beat up in the parking lot cleaning process, and usually in need of repair and replacement sooner than any other part of the lot. We believe that the proposed solution in our plan offers larger planting areas and buffers at the perimeter of the lot as well as a wider landscaped pedestrian path through the heart of the lot. The lot has also been broken and wrapped around the facility to minimize the field impact. We prefer to place larger landscape end caps with an area that will allow the landscaping to grow and thrive in a larger area than to be limited to only a 50-sq. ft. island every 12 spaces. In order to show our commitment to the landscaping requirement, our current layout provides an extra 34% above the required 23,254 Square Feet of landscape area required per the PD. 9 Foot Wide by 18 Foot Deep Parking Spaces For 90 Degree Parking: The current Wylie ordinance requires that spaces for 90 Degree parking be 10 foot wide by 20 foot deep and we are requesting that spaces in the theatre development be allowed at 9 foot wide by 18 foot deep. It has been our experience that 9' by 18' spaces are adequate and do not impede traffic flow or create a safety concern. In order to minimize the amount of concrete and reduce the heat island effect, we feel it is beneficial to reduce the parking space requirement and move that area that we are saving from the concrete into the landscape islands. This will reduce the feel of a large sea of parking, and provide the required parking spaces for this development. Thank you for taking the time to review the material and I hope it has made sense. These breakdowns show the total weekly attendance for each town. A weekly breakdown is helpful but does not account for peak times. We chose two weeks to break down attendance trends even farther. We chose the busiest week of the year, which in both theatres was the last week of the 2007 (12-21 to 12-27). Since this represented a time when school was not in session we also pulled a week when school was in session (3-23 to 3-29) since attendance patterns can be different then. We pulled the data from each theatre's Daily Gross pages (all of these are included in the last section of this package) and the data was tabulated into the Attendance Breakdown page for each week. As would be expected, the weekend is a peak time for a theatre but the percentage of people attending on the weekend is lower(in relation to the entire weeks attendance) when school is not in session, When school is in session the attendance tends to bunch in the weekend showtimnes. Discussion n d The 82 Texas Legislature in Special Session enacted Senate Bill 1 which amends the Texas Tax Code, Section 11.253 (j-1). The bill is very similar to the Freeport exemption passed many years ago, but has potentially a larger impact as time goes on. The City of Wylie has not passed the Freeport exemption and continues to tax Freeport goods, which is primarily inventory of companies such as Sanden International, Bayco Products, Carlisle Coatings & Waterproofing, and Extruders division of Atrium Companies, Inc. Unlike the above goods which are housed in owner occupied facilities, SB 1 exempts goods, principally inventory, that are stored in a location that is not owned by the owner of the goods and transferred from that location to another location within 175 days. Prior to consideration of the attached Ordinance, the City Council must first hold a public hearing to hear evidence for or against the continued taxation of these goods or the exemption of the same. Failure to act by December 31, 2011 allows these goods-in-transit to become exempt for the 2012 tax year. nd The Wylie City Council passed a similar measure in 2007. The 82 Legislature amended the definition of goods-in-transit, thus requiring political subdivisions to once again declare their intent to tax these goods. The City Council may act to tax these goods in the year following the date Council takes action. To continue to tax these goods, Council must act in such a manner prior to December 31, 2011. Failure to act to tax these goods will allow them to be exempt for the 2012 tax year. WHEREAS, the City Council of the City of Wylie, Texas (“City Council”) has previously adopted Ordinance No. 83-50 of the City of Wylie (“Wylie”) establishing regulations governing garbage and refuse in the City of Wylie, Texas; and WHEREAS, these requirements were codified at Chapter 98 (Solid Waste), Article II (Collection and Disposal) in the Wylie Code of Ordinances; and WHEREAS , the City Council has investigated and determined that it is necessary to amend Chapter 98 (Solid Waste), Article II (Collection and Disposal) of the Wylie Code of Ordinances which will benefit the public health, safety and welfare of the citizens of the City of Wylie; and WHEREAS , Wylie intends to increase waste diversion, reduce landfill usage and meet the City’s green and sustainability goals and objectives; and WHEREAS, the City Council has further investigated and determined that it would be advantageous and beneficial to the citizens of Wylie, Texas to provide for a method of collecting and disposing of refuse and to maintain neighborhood quality aesthetics and maintenance of property values by providing for the general health and welfare of the City of Wylie. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, THAT: SECTION 1: Findings. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amending Chapter 98 (Solid Waste), Article II (Collection and Disposal) of the Wylie Code of Ordinances. Amendment to Chapter 98 (Solid Waste), Article II (Collection and Disposal) of the Wylie Code of Ordinances is hereby amended to read as follows: “Sec. 98-21. Residential collection—Regulations. Ordinance No. 2011-26 Amending Chapter 98 (Solid Waste), Article II (Collection and Disposal) Page 1 599218.1 (a)Collection of regular garbage, rubbish and brush shall occur one (1) time per week in accordance with the terms of the Solid Waste Contract. … (d) Brush or bulky waste shall not be placed for regular solid waste pick up. Brush or bulky waste shall be placed and collected in accordance with the terms of the solid waste contract. … Sec. 98-23 Commercial collection – Regulations. The contractor shall provide commercial containers. Collection shall occur as agreed upon by the contractor and the customer in accordance to the Solid Waste Contract entered into between the parties. … Sec. 98-30 Private Incinerators. (a)Private incinerators shall not be used to burn solid waste on property zoned and/or used for single or multi-family residential purposes. (b)(repealed) … Sec. 98-51 Receptacles for Solid Waste. (a)Every owner, tenant or occupant shall use the receptacle provided by the contractor for solid waste collection and disposal. (b)Brush in excess of what can fit in the receptacle provided by the contractor shall be scheduled for bulk pickup and should be bundled or tied together forming an easily handled package not exceeding four (4) feet in length, or fifty (50) pounds. Sec. 98-52 Commercial container concrete pads. (a)All concrete pads for commercial solid waste containers shall comply with the Wylie Comprehensive Zoning Ordinance. …” SECTION 3: Penalty Provision. Any person, firm, corporation or entity that violates this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be Ordinance No. 2011-26 Amending Chapter 98 (Solid Waste), Article II (Collection and Disposal) Page 2 599218.1 fined a sum not exceeding two thousand dollars ($2,000.00) if the violation relates to the public health and sanitation, otherwise the fine shall be a sum not exceeding five hundred dollars ($500.00). Each continuing day’s violation shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude the Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 4: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 5: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. SECTION 6: Effective Date. This Ordinance shall become effective from and after its passage and publication as required by the City Charter and by law. (b) All private incinerators shall be inspected by the city sanitarian to see that such incinerator is in compliance with the standards provided in this section, and if the incinerator fails to meet such standards, then the owner or occupier of the premises shall have a period of time of 90 days after notice in writing given by the city sanitarian in which to remedy any substandard conditions, and, thereafter, the operating of such private incinerator in a substandard condition shall be a violation of this article. Private incinerators constructed after the effective date of Ordinance No. 72-3 shall be constructed only after the owner or occupier of the premises where such incinerator is to be constructed shall have first obtained a building permit from the city, and shall be constructed to comply with the standards prescribed in this section. (a)Private incinerators shall not be used to burn solid waste on property zoned and/or used for single or multi-family residential purposes. (b)(repealed) Sec. 98-51 Receptacles for solid waste (a) Every owner, tenant or occupant shall use plastic bags or other waterproof, secured containers for garbage receptacles or such other containers authorized in this division. The garbage bags or containers shall be of such a thickness that they can be lifted by the top without breaking, or 1.5 mils, and shall meet city specifications. Each bag shall contain no more than 50 pounds of weight in garbage, nor no more than 30 gallons volume of waste matter. All bags shall have openings securely closed. Water or other liquids shall be drained from garbage. (a)Every owner, tenant or occupant shall use the receptacle provided by the contractor for solid waste collection and disposal. (b) Brush shall be picked up on regularly scheduled route and shall be tied in bundles not to exceed three feet in length with no limbs exceeding three inches in diameter. Bundles of brush shall be comparable in size and weight with bags of garbage, but will not exceed 50 pounds in weight. (c)Brush in excess of what can fit in the receptacle provided by the contractor shall be scheduled for bulk pickup and should be bundled or tied together forming an easily handled package not exceeding four (4) feet in length, or fifty (50) pounds. Sec. 98-52 Commercial container pads No person shall install or maintain a bulk refuse container without first having supplied adequate support and access thereto. The support and access required shall consist of the following: (1) A concrete pad measuring ten feet in width and 20 feet in length. The concrete shall contain no. 4 deformed steel bars placed 18 inches on center each way and shall have a compression strength of 3,500 pounds per square inch after having been cured for 28 days. (2) The access to the pad required in subsection (1) of this section shall have an impervious surface and measure a minimum of ten feet in width and 30 feet in length, and must be totally on the premises being served. (b) The requirements of this section are contained in figure 11-1 following this section.
