P & Z Commission Meeting May 3, 2005 Page 2 of 4 ACTION ITEMS 1. Consider a recommendation to the City Council regarding a Final Plat for Birmingham Ranch Addition. Subject property being a tract of land generally located west of Parker Road and east of Birmingham Farms Phase 14 Addition, and being part of a 16.039 acre tract and being all of a 15.486 acre tract of land conveyed to T. F. Birmingham and Hattie A. Birmingham Trusts recorded in Volume 2362, Page 90 of the Deed Records of Collin County Texas and being all of a 0.522 acre tract of land conveyed to Wylie Independent School District recorded in Volume 1187, Page 15, Deed Records of Collin County, Texas. Thompson stated that the legal description is incorrect in that the Plat is not 15.486 acres, but is 16.039 acres. The Wylie Independent School District sold an additional 0.522 acre tract to the developer, so the total acreage is 16.039 tract of land. The Plat will create 53 single- family residential lots. The property is located south of Park Boulevard west of Parker Road, and is the old WISD tract. The tract is zoned SF-10, and all lots exceed 10,000 square feet in area. The eastern access to the property has width constraints, which allows only a 40 foot street right-of-way to connect to Parker Road and the Engineer has approved the standard paving section within this narrower right-of-way. The remaining streets have 50 foot rights-of-way. The length of the Lone Star Court cul-de-sac is longer than most streets, and Fire has approved the length. These concessions are allowed in order to achieve two efficient points of access/egress to the subdivision. Rob Adams, Adams Consulting Engineers, 500 Nolen Drive, Suite 550, Southlake, Texas, represented the engineer for the subject property, and stated that the Plat inadvertently left out the setbacks on Lot 1, which is a residential lot. This is a technical issue and will be corrected before submittal to City Council. A retention pond will be located on Lot 13, which will be maintained by the Homeowners Association. A motion was made by Commissioner Hennesey, and seconded by Commissioner Spillyards, to recommend approval of the Final Plat for Birmingham Ranch with the understanding that the technical requirements will be corrected before submittal to the City Council. Motion carried 6 —0. P &Z Commission Meeting May 3, 2005 Page 3 of 4 PUBLIC HEARINGS 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) to Planned Development (PD) District to allow for Neighborhood Retail Services being situated in the Williams Patterson Survey, Abstract No. 716, Collin County, Texas, and being a resurvey of a called 1.138 acre tract of land described in a deed to Dennis Bell and Dave Bell, of record in Volume 4765. Page 3150, Deed Records of Collin County, Texas (Zoning Case No. 2005-10). Item to be tabled to the June 7, 2005 meeting. Thompson stated that the applicant has requested that consideration of this request be tabled to the June 7, 2005 Commission meeting. The property is located on the southwest corner of FM 1378 (Country Club Road) and FM 2514 (Parker Road). A motion was made by Commissioner Alexander, and seconded by Commissioner Ames, to accept to table the item to the June 7, 2005 Commission meeting as requested by the applicant. Motion carried 6—0. WORK SESSION 1. Hold a Work Session to discuss revisions to the Comprehensive Plan. Thompson reviewed the revisions to the Comprehensive Plan, and provided copies of an article in the Wylie News. At the Council's meeting on April 26, 2005, a public hearing was held, and Council requested further research and recommendation related to the sufficiency of retail and commercial uses and the proportion of residential densities (lot sizes). The Council will hold one more public hearing on May 10, 2005 and a final hearing and decision is scheduled for May 24, 2005. Commissioners' consensus was to make limited additions to the commercial and retail uses within the southeastern sector. Residential density was discussed in length, with the consensus adding some 10—20,000 square foot lots within the Extraterritorial Jurisdiction closer into the City, with 1-acre lots further out to the southeast. STAFF RECOMMENDATION: Approval SUMMARY: The applicant is proposing to develop 224 multi-family dwelling units on 18.77 acres in the northeast corner of McMillen Road (Park Boulevard) and McCreary Road. The property has been zoned to permit apartments under Planned Development District No. 99-32 since October of 1999. The Site Plan complies with the conditions of the PD and with all other applicable technical requirements of the City of Wylie. The earlier code which was in place at the time the PD was adopted allows the development of 15 dwelling units per acre, ranging in size from 600 s.f for one-bedroom units to 1,000 s.f for three bedrooms and all units must be sprinkled for fire protection. Exterior walls must be at least 75% masonry, and perimeter screening materials may be wood fence, wrought iron, masonry wall, earthen berm or live plants. The PD created a master planned community patterned after the village center philosophy of the Comprehensive Plan, and also includes convenience retail to the west of subject property and single family residences of varied densities to the north which are developed as the Creekside Estates neighborhood. The property abutting on the east is zoned Multifamily (MF)District, and the South Fork Mobile Home Park is to the south across McMillen Road. A Final Plat for the subject property is on the current agenda for consideration. STAFF RECOMMENDATION: Approval, contingent upon reconciliation of outstanding park dedication issue. SUMMARY: A Preliminary Plat was approved on November 2, 2004. An alley waiver for the east property line and the north property line was approved with the adoption of PD No. 02-08. The property includes 40.6225 acres and will create 131 single-family residential lots. The PD established a minimum lot size of 8,000 square feet and lot width of 65 feet. The Final Plat complies with the Subdivision Regulations and with all other pertinent code requirements of the City of Wylie and complies with the conditions of the Planned Development District. This plat dedicates 2.5 acres open space, 0.68 acres of which is to count toward park dedication with the remainder of the park dedication requirement to be provided in cash or equivalent value of improvements. The Commission's approval of this plat will be contingent upon the solution of this park dedication issue by City of Wylie Park staff. The DTH District requires that new structures conform to the exterior design of other structures within that block, either residential or commercial. The existing structure is residential in design, and conforms to this requirement. However, the controlling PD contains certain provisions which the current applicant desires to modify. These include removal of restriction of the proportion of residential to nonresidential uses, and the required parking. The adopted PD provides that not more than 45% of the structure may be used for nonresidential purposes. The applicant desires initially to utilize the building completely for nonresidential uses, but to retain the flexibility to use it either for completely nonresidential, completely for residential or any combination of these uses. To accommodate this, the applicant proposes to modify the PD to generalize the permitted uses (see Special Condition No. 1 of the current PD), and delete the proportional limitation of residential to nonresidential uses (see Special Condition No. 7 of the current PD). The current Zoning Ordinance does not limit the degree to which either residential or commercial uses may occupy residential structures (see Section 6.3.D.2.a. and b.), and the proposed revision to the PD complies with this standard regulation. The adopted PD provides that two on-site parking spaces shall be provided for the retail uses and two on-site spaces provided for the residential use, and that this on-site parking must be located to the rear of the lot. The proposed PD requires that four (4) on-site parking spaces be provided, located to the rear of the lot, and that the drive and garage may count toward the required parking. Four vehicles may be accommodated within the existing drive and garage, in compliance with this requirement. The current Zoning Ordinance provides that within the DTH District parking for residential uses must be on-site, but that parking for nonresidential uses less than 4,000 square feet are not required to provide on-site parking but may utilize on-street parking, and that up to 25% of the required parking may be provided on-street (see Section 6.3.E.4.c.). The Planning and Zoning Commission may grant variances for up to 75% of the required parking within the DTH District. The existing 2,772 square feet building will require 14 parking spaces if used entirely for retail and personal services and 10 spaces if used entirely for office uses. With the allowed 25% on-street parking and 75% variance, the current four spaces comply with the potential parking requirement. Also, additional parking can be constructed within the rear yard should a future potential use require such. Exhibit"B" CONDITIONS FOR PLANNED DEVELOPMENT DISTRICT Southwest Corner of Ballard Street and Brown Street ZC 2005-11 General Conditions 1. This Planned Development District shall not affect any regulation found within the Code of Ordinances, except as specifically provided herein. 2. All regulations of the Downtown Historic District (DTH) set forth in Section 6.3 of the comprehensive Zoning Ordinance (adopted as of November 2001) are included by reference and shall apply except as provided herein. 3. Development shall be in conformance with the approved Detailed Site Plan. Special Conditions 1. No uses shall be permitted except the following, either individually or mixed in any ratio; a. Personal services b. Offices, general & professional c. Retail d. Single-Family residence 2. No outside storage of any equipment or materials shall be permitted. 3. Fencing or hedge shall be permitted in front of building line and shall be limited to a maximum of 4' in height, minimum 50% open. 4. Rear and side yard fence shall not exceed 8' in height. 5. All paving to be concrete—no asphalt allowed. 6. All free-standing.signs shall be limited to monument signs or pole signs. No more than 4' in height. 7. Exterior veneer shall consist of vinyl siding or wood in a residential pattern in keeping with character of surrounding properties. 8. Prohibited outside or concealed behind rear fence. a. Clotheslines, drying racks b. Wood piles and compost piles c. Accessory buildings (such as dog houses, gazebos, storage sheds and greenhouses). 9. HVAC equipment shall be screened by fence or living screen. 10. No T.V. antenna or satellite dish shall be visible from street. 11. Four on-site parking shall be provided for the retail use. Statement of Purpose: The purpose of this Planned Development District is to permit the development of BRADDOCK PLACE. II. Statement of Effect: This Planned Development shall not effect any regulation found in the Comprehensive Zoning Ordinance as adopted and amended, except as specifically provided herein; III. General Regulations: All regulations providing for a Village Center District as set forth in Section 3.3 Village Residential Districts of the current Comprehensive Zoning Ordinance are included by reference and shall apply, except as otherwise specified under the special provisions hereunder. The conditions contained herein and the conditions of the current Comprehensive Zoning Ordinance, which are not amended by this Planned Development, shall constitute all the zoning requirements applicable to this Planned Development. Concept Plan: Development shall be in conformance with the Concept Plan attached herewith; however, in the event of conflict between the Concept Plan and the written conditions of this ordinance, the written conditions shall apply. Subsequent Submittals: A Development Plan shall be submitted for public hearing review and approval of the Planning and Zoning Commission and City Council. The Development Plan shall conform to the approved Concept Plan and conditions of the Planned Development, and shall serve as the Preliminary Plat. IV. Specific Regulations: i. General Residential Regulations 1. Density: The maximum number of Single Family Dwelling units permitted in this Planned Development shall not exceed 600 S.F. Units. In the event the Parks Department accepts the proposed Park depicted on the Zoning Exhibit the maximum number of units shall be reduced to 500 units. In the event Wylie ISD elects to construct a school on the proposed school site depicted on the Zoning Exhibit, the maximum number of units shall be reduced to 560 units. In the event the school and park are both developed according to the Zoning Exhibit, the maximum number of units shall be 460. 2. Lot Mix: A minimum of 10% of the Single Family Lots will be in excess of 12,000 sf. A minimum of 60% of the Single Family Lots will he 10,000 sf or greater. No Single Family lot shall be less than 7,500. For the purposes of determining these percentages, all calculations shall be on a cumulative basis. 3. Alleys shall not be required as part of this Planned Development. However, no garages shall face the street in front of each Single Family Lot. This can be accomplished either through swing driveways or alleys. However, when three car garages are constructed on a lot and a "2&1" configuration is used, the single car door may face the street. Garages may face the street on a corner lot side yard. 4. Distribution of the Single Family Dwelling Unit types shall be distributed within the development as shown on the Development Plan/Preliminary Plat submitted with each phase. ii. Single Family 1. Single Family Base and Desirable Requirements of the Village Residential District (Figure 3-14) shall apply fully to all phases of the Planned Development. 1.A landscaped berm and split rail fence shall be allowed along FM 544 in place of the required masonry screening wall. The berm shall be planted with a combination of hardwood and evergreen trees, irrigated by an underground system, and grassed with Bermuda, buffalo, or a rye/Bermuda mix. All open space areas will be maintained by the HOA. VI. Common Area Platting: All street medians, green belts and common areas not dedicated to the City must be maintained by the HOA, and shall be clearly delineated as such and the acreage shown for each common area on the final subdivision plat. VII. Tree Preservation: Toward the goal of preserving as many existing trees (8 in. caliper or larger) possible, a tree management plan provided by the owner as preserves at least 25% of the riparian tree cover shall be approved by the director of planning prior to commencement of any grading or infrastructure or improvements within the area of this Planned Development. VIII. Landscape Zone: In an effort to preserve the agricultural heritage of the Rice farm, as indicated by the existing fence line trees, the developer shall preserve all hardwood trees with a caliper of 8 inches or greater located within an edge zone that extends 3 feet from perimeter property line. LX. Screening and Landscape: A screening and landscape berm with split rail fence shall be provided along FM 544 in lieu of the brick screening wall . The berm shall have a sculpted. undulating form. A conceptual landscape plan to be provided with the Preliminary Plat. X. Transition Zone: In an effort to make a land use transition from the existing homes in the Twin Creek Ranch Subdivision, the developer shall establish an edge, one lot deep, of lots along the south western property line of this development that have a minimum lot size of 10,000 square foot and a minimum house size of 2,400 sf. In an effort to make a land use transition from the existing Pulliam residence north of the Property, the developer shall: (1)Establish an edge, one lot deep, of lots along the northern property line of this development that have a minimum lot size of 12,000 square foot and a minimum house size of 2,400 sf. and (2) Create a thirty foot (30') landscape buffer between the Pulliam property and Braddock Place that will be planted with evergreen trees thirty feet (30') on center along the edge of the property. Although I realize development of the area will happen, I would once again like to remind the planning department of the traffic situation in the area. There are only two lane roads in and out of the area. With the high density development currently being built in Bozman Farms and in the current rezoning of the Collins tract, traffic conditions will just continue to worsen in the area. As I have stated in the past, the area is primarily large lots and there are some very nice homes in the area. I would hate to see the southeast side of town become the residential nightmare type area the rest of the city is becoming. Most of the area is county residents and we moved to that area for the reason of space between the neighbors. I would like to see the lot sizes stay in the rage of one or '/z acre lots minimum (preferably one acre lots) with home sties no below 3,000 square feet. The following provides staff opinions concerning several issues which have been raised by Council, Commission, citizens and/or staff related to these recommendations. These are provided for your consideration when evaluating the revisions. 1. Competing Goals: Goals of the Comp Plan have always been unclear and even competing. The 1999 citizen survey revealed a dichotomy of opinion — 84% were attracted to Wylie because it is/was a "bedroom community where people live but commute to work and shop elsewhere" (low-density residential), but 85% said they would like it to become a "self-contained small town where people live, work and shop" (mixed-use, higher-density). Toward achieving the"self-contained town" the Plan was based on a pedestrian-oriented "Village Center" philosophy of numerous retail centers surrounded by higher-density residential, but toward achieving the "bedroom commuter community" the Plan endorsed lower-density larger lots which requires vehicular-intensive traffic patterns. Rather than reconcile these conflicting concepts, the Plan attempted to provide for both with a "few scatted retail centers separated by country residential", and even recommended land uses contrary to historic zoning. The goals for the desired future development pattern of Wylie must be more clearly articulated and rationally justified, so that the Plan may be directed to address these goals. 2. Limited Land: Like most suburban communities, Wylie is already largely developed (or undevelopable floodplain and railroad) with limited remaining developable land available for future growth, even within the potential expansion area of its Extraterritorial Jurisdiction (ETJ). The Plan must allocate these limited remaining lands to best attain the expressed community goals. Much of the existing pattern is a suburban-density mixed-use development, while much of the vacant and ETJ lands are rural/small-town character. Furthermore, the current Plan is largely a guide for new development, with limited emphasis on redevelopment of older or obsolete development patterns. Staff Opinions Of proposed Revisions to Comprehensive Plan Page 2 3. Fiscal Impact: Analysis has demonstrated that smaller-lot/higher-density residential yields 30% greater property tax revenue to the City than does acre lots (even with much larger houses), and that the same acreage of commercial use yields at least four times the property and sales tax potential as does residential. It has also been demonstrated that there is no direct relationship between size of lot/house and value/cost/tax yield, but that decreased house cost/value normally results from increased lot cost (forced by increased size and infrastructure) because the total combined cost of house and lot is set by market and financial resources. The Plan's emphasis on low-density residential, transfers an inordinate tax burden to existing smaller-lot residential. 4. Current Development Patterns: Current development patterns reflect more of a bedroom-commuter pattern than balanced, self-contained community. Only 7% of Wylie's total land is currently utilized by high-density residential uses, compared to 47% for low- and medium-density residential, and only 8.5% of Wylie's total housing stock is multifamily. Less than 5% of the total land area is allocated for retail and office uses. 5. Zoning Conflicts: The law requires that zoning and other public development controls be based on the Comprehensive Plan. Private land has the legal right to develop according to the local Plan and code in place when the development is initiated, and the courts have recognized that developers' have right to profits anticipated by the Plan/code. The existing Comp Plan reflects several conflicts with zoning which was in place when the Plan was adopted assuming the ability of the Plan and market to encourage these patterns to change over time, and on several parcels these contrary development rights have already been fully vested with platting. 6. Public/Semipulic: Nontaxable public and semipublic development is currently the allowed in any land use and zoning district, but can be important influences in shaping land use patterns. The Wylie/Northeast Water District is the largest property owner within the City of Wylie, and Wylie is the second largest, with WISD and churches also representing large tracts. The current Plan recommends that municipal offices be centralized within a Town Center in order to create an image of Wylie's central place (although the T.C. may be variedly defined), whereas other municipal uses should be scattered closer within the neighborhoods which they serve. Schools are allocated to the exterior of residential neighborhoods along major thoroughfares accessible by vehicle, rather than within the pedestrian neighborhood. Additional direction is requested.
