Public Hearing
1. Hold a public hearing and consider a recommendation to the City Council regarding a Replat
for Woodbridge Crossing, to dedicate the necessary utility easements to accommodate the
development on seven (7) commercial lots on 27.07 acres, generally located on the
southeast corner of FM 544 and McCreary Road.
2. Hold a public hearing and consider a recommendation to the City Council regarding a Replat
for Woodbridge Crossing, to dedicate the necessary utility easements to accommodate the
development on ten (10) commercial lots on 34.50 acres, generally located on the southwest
corner of FM 544 and Springwell Parkway.
3. Hold a Public Hearing and consider a recommendation to the City Council, amending
regulations to Zoning Ordinance No. 2001-48, Article 6, as it relates to the proposed
expansion of the Downtown Historic District to include property on Ballard Avenue north of
Brown up to approximately 419 North Ballard on the west and Block 1 Tract 48 of the Truett
Abstract on the east(ZC 2009-04).
JOINT WORK SESSION WITH CITY COUNCIL
1. Hold a Joint Work Session with the Planning and Zoning Commission to consider
amendments to Zoning Ordinance No. 2001-48 and to the Official Zoning Map, as it
relates to the proposed addition of Section 6.4 and the creation of the South Ballard
Overlay, including district boundaries and design standards and Article 5 as it relates to
allowed Uses. Generally bounded by Stone Road on the south, Butler Street on the

CALL TO ORDER
Chairman Larson called the meeting to order at 6:30PM. Present with Chairman Larson
were Vice-Chairman Phillip Johnston, Commissioner Ramona Kopchenko,
Commissioner Willie Osborne, and Commissioner Tim Bennett. Commissioner John
Manganilla and Commissioner Ruthie Wright arrived at 6:33PM.
Staff present was Rena& 011ie, Planning Director, Jasen Haskins, Assistant Planner, and
Mary Bradley, Administrative Assistant.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Bennett gave the invocation and Vice-Chairman Johnston led the pledge
of allegiance.
CITIZENS COMMENTS
Chairman Larson opened the Citizens Participation. With no one approaching the
Commissioners Chairman Larson closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the May 5, 2009,
Regular Meeting.
A motion was made by Vice-Chair Johnston, and seconded by Commissioner Osborne, to
approve the minutes from May 5, 2009 Regular Meeting, as submitted. Motion carried 5
—0, with Commissioner Manganilla and Commissioner Wright arriving after the vote.

Public Hearing
1. Hold a Public Hearing and consider a recommendation to the City
Council, amending the zoning from Light Industrial (LI) District to
Corridor Commercial (CC) District for two tracts of land generally located
north and south of Alanis approximately 475 feet west of Century Way.
ZC 2009-03.
Mr. Haskins stated that the subject tracts were originally one tract totaling 8.9558 acres.
In September 2003 the City purchased 1.224 acres for Right-of-Way to expand and align
Alanis to SH 78. Both tracts total 7.7328, with approximately one acre north of the new
Alanis alignment and the remainder south of Alanis.
The applicant is requesting both tracts of land to be rezoned from Light Industrial to
Commercial Corridor. Although the applicant has not submitted a Concept Plan or a Site
Plan, they have indicated an interest to construct a General Merchandise retail use.
General Merchandise or Food Store greater than 5,000 square feet is not allowed by right
within Light Industrial, but is allowed by right within Commercial Corridor.
The property north of Alanis is adjacent to Commercial Corridor zoning district. The
land use map indicates medium density Residential on the south tract and Light Industrial
on the north tract. With the widening and future expansion of Alanis to a four-lane
divided thoroughfare, there is potential for additional zoning changes. Similar zoning
cases allowing Commercial Corridor and Community Retail zoning along the newly
widened and expanded Alanis Corridor have been approved by the Commission and City
Council.
Thirty-seven (37) notifications were mailed to property owners, with five responses
returned, with three in favor and two in opposition of the request.
Commissioner Osborne asked for clarification for the difference between Light Industrial
and Commercial Corridor. Mr. Haskins stated that Light Industrial type of use is not for
public interaction or for consumer on site. Commercial Corridor allows public
interaction, and for consumer coming in and out.
Chairman Larson opened the public hearing.
Ms. Carla Smith, 438 Ewing Way, adjacent property owner, expressed concern of the
screening between the retail use and residential property. Ms. 011ie stated that when a
Site Plan is submitted for development, the Zoning Ordinance requires setbacks and a
type of screen wall between residential and commercial.
Mr. David White, 2801 Vinson Road, represented property owner of the subject property,
stated that the property owner is considering constructing a Dollar Store, totaling no more
than 7,000 square feet building.

Chairman Larson closed the Public Hearing.
A motion was made by Commissioner Kopchenko, and seconded by Commissioner
Osborne, to recommend approval to the City Council, amending the zoning from Light

generally located north and south of Alanis approximately 475 feet west of Century Way.
ZC 2009-03. Motion carried 7—0.
ADJOURNMENT
A motion was made by Vice-Chair Johnston, and seconded by Commissioner Wright, to

Discussion
The property totals 27.07 acres and consists of seven (7) commercial lots. The property is zoned PD 2006-01/2008-43
which allows for a retail shopping center on this portion of the PD.
Lot boundaries, right-of-way dedication and other easements for this development were established by plat and approved
by the City Council in March 2009, and are consistent with the provisions of the PD.
Lot 2R is the site for the Super Target retail development and Lot 3R is being constructed as Viewpoint Bank.
The purpose for the replat is to dedicate the necessary utility easements to accommodate the development of the property.
At this time there are no changes in property boundaries for the established lots or the existing easements on the property.
The Replat complies with all applicable technical requirements of the City of Wylie.

Subject

Tract 48 of the Truett Abstract on the east.
Recommendation
Motion to recommend approval to the City Council, amending regulations to Zoning Ordinance No. 2001-48,
Article 6, as it relates to the proposed expansion of the Downtown Historic District to include property on Ballard
Avenue north of Brown up to approximately 419 North Ballard on the west and Block 1 Tract 48 of the Truett
Abstract on the east.
Discussion
Staff has for some time considered the expansion of the DTH north of Brown on Ballard. As Wylie continues to
grow, traffic on Ballard continues to increase. Current zoning on Ballard north of Brown allows only Single
Family structures and uses which is generally not compatible with high traffic counts. A change in zoning to
DTH would allow the residential structures to be used in light commercial applications as similar structures are
in the current DTH. In addition, the expansion would extend and preserve the pedestrian friendly atmosphere
and architectural character of the Downtown Historic District.
Staff believes that expansion of the DTH is in order. The area should be rezoned as DTH to allow light
commercial uses in residential style structures and allow the city to protect and preserve the historical nature of
the area.
Fifty-seven (57) notifications were mailed to property owners within 200 feet in accordance with State Law. As of
July 1, 2009,twelve (12)responses were received; four(4)in favor and eight(8) against the request.

Discussion
Staff is seeking direction on the process to move forward with adopting an Ordinance to create the South
Ballard Overlay District. This Overlay allows the City to create, in the South Ballard area, a place that will be
economically and geographically viable while also retaining the rich history, community values, and citizen
friendly atmosphere that embodies Wylie. At its May 26, 2009 meeting, Council requested a joint work session
with the Planning and Zoning Commission to further discuss the intent of the Overlay District, including the
design regulations and boundaries.
Consideration
As part of this packet Exhibit "A" is presented in an effort to give the Council and the Commission a visual concept of
how the proposed SBO could develop. The area is currently a mix of zoning consisting of Commercial, Single Family,
and Multi-Family uses.
The proposed SBO boundary, as previously presented, was divided into two separate distinct areas. A Commercial
Boundary consisting of those lots fronting Ballard including lots south of Butler and north of College Street, and a
Residential Boundary consisting of lots along Jackson, east of Birmingham,north of Stone and south of College Street.
Of the 95 total lots within the proposed district there are; one Multi-Family (MF) lot, approximately 19 SF lots that are
currently owner occupied and 48 SF lots that are rental properties (according to Collin CAD), 6 commercial lots and 22
vacant lots. A large majority of the structures, lots, and vacant parcels are legally non-conforming as it relates to current
zoning requirements.
The proposed area is ideally suited for commercial or mixed use development due to high traffic counts and the proximity
to the DTH. In order to facilitate these types of developments, a Form-Based approach to zoning would best serve the
area. Form-Based zoning involves focusing on place making, where not only is the form of the building important but so
is the form of the areas surrounding the buildings (e.g. the City's current Residential Design Standards). By concentrating
on place making, Form-Based zoning adds another element by shaping the spaces around the buildings to create a unique
sustainable area that features a pedestrian intense, shopping and living environment. Generally, Form-Based Ordinances

allow for a larger mix of uses within one district than does conventional ordinances.
Notable communities that have implemented such zoning codes and revitalization processes include the cities of Highland
Park, Grapevine, Richardson, Leander, Fort Worth as well as several other communities throughout the country. The City
of Leander, Texas was awarded the Driehaus Form-Based Codes Award in 2007 from the Form Based Codes Institute of
Wisconsin. Recognized for determining that the most effective strategy would be to update the city's zoning code as a
SmartCode. This SmartCode,which serves as a Unified Development Ordinance, applies in full force and is effective only
within the specified boundaries.
Several key factors stood out among similar North Texas communities that have contributed to the success in
revitalization. We have found that it is crucial that stakeholders and reinvestment land use opportunities are provided
with:
• Flexible zoning that will allow for a variety of uses.
• Flexible and adaptable architectural design standards.
• Pedestrian links to residential, commercial particularly accommodating to personal service uses and shops.
• Historical preservation, design and themes reflecting a community's identity.
• Infrastructure improvements. (streets, sidewalks,utility relocation and alley improvements)
• Incentives tied to permitting and EDCs.
• Developing Public-Private partnerships, this would include partnerships with WISD.
Decisions:
Boundary options for the South Ballard Overlay District include:
Option 1: Lots that front South Ballard south of S.H. 78 and north of Stone Road.
Option 2: Those lots south of S.H. 78,north of Stone Road, the eastern rear property line of those lots facing Ballard,
and Birmingham Street to the west.
