INVOCATION & PLEDGE OF ALLEGIANCE Chairman Seely gave the invocation and Commissioner Alexander led the pledge of allegiance. CITIZEN PARTICIPATION The following citizens spoke in opposition of Wylie Independent School District's proposal for a high school on Bennett Road: Beverly Wardwell, 2916 Jamestown Drive; Diane Culver, 2918 Jamestown Drive; and Janaid Najamuddin 212 Palmdale Drive. This subject property will be brought before the Commission on March 22, 2005 as a zoning change to single-family residential homes, which the WISD proposes to construct a high school if the zoning for single-family residential homes does not get approved. CONSENT AGENDA 1. Consider and act upon approval of the Minutes from the February 15, 2005 Regular Meeting. A motion was made by Commissioner Hughes, seconded by Commissioner Byboth, to approve the minutes as submitted. Motion carried 7—0. P & Z Commission Meeting March 1, 2005 Page 2 of 8 Due to a conflict of interest, Chairman Seely excused himself from the meeting for the first and second agenda items. Vice-Chairman Larson took over the meeting. PUBLIC HEARINGS 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) to Planned Development (PD) District for commercial and single-family residential uses of varied densities, being part of a 111.848 acre tract of land situated in the William Sachse Survey, Abstract No. 835, conveyed to Iona H. Ingram and being part of a 87.282 acre parcel of land called Tract 2, conveyed to Mary Allene Jones, from the partition of the Estate of Mollie Sachse, described in Partition Deed recorded in Volume 826 at Page 579 of the Deed Records of Collin County, Texas, and also being a part of a 111.848 acre tract conveyed to Mary Allene Jones by Executrix's Deed recorded in Volume 05102 at Page 04465 (County Clerk's File No. 2002-0020781) of the DRCCT. (Zoning Case No. 2005-01). Thompson stated that the property totals 186.56 acres, and is south of FM 544 and west of Regency Business Park Addition. Portion of the property is undevelopable due to a 150 feet wide right-of-way electric power transmission line, which divides the property into two tracts, the one to the north is 130.7 acres and the one to the south is 55.8 acres. The zoning request proposes to divide the property for varied uses. Only 60 acres to the north along FM 544 is designated for Corridor Commercial uses. To the east and south, 87 acres are designated Village Residential, creating 332 detached single-family residential on 7,000 square feet lots. The remaining 35 acres along the west/central portion is designated for 102 Suburban Residential on 10,000 square feet lots. Twenty-eight notifications were mailed, with two (2) returned, one opposing and one favoring. Thompson further described the PD proposal and compared the proposal to the currently- adopted Comprehensive Plan, stating that staff recommends denial because the request does not fully conform to the recommendation of the Comprehensive Plan for large-lot residential, nor does it offer innovations to justify a PD other than variances from the regulations of the Zoning Ordinance. The PD does provide for extension of McCreary Road as a four-lane divided roadway, south of FM 544 and tie into Mill branch Development in Sachse. Vice-Chairman Larson opened the public hearing at 7:25pm. P & Z Commission Meeting March 1, 2005 Page 3 of 8 Herschel Leffel, Meritage Homes, 2845 Dallas Parkway, Plano, Texas, representing the builder of the proposed development, stated that the proposed homes will be priced at $150,000 to $300,000. Craig Jones, 5925 Dewitt, Sachse, Texas, property owner of the subject property, stated that the property was used for farming, and desires to see the property developed in a positive way. The proposal from Legacy Homes is a positive proposal, and expressed enthusiasm for the dedication for McCreary Road extension. Mr. Leffel stated that Mr. Jones will maintain ownership of the commercial property, and Meritage Homes will maintain ownership of the single-family residential lots. Mr. Chris Lander, Neitzel Real Estate, 5220 Spring Valley Road, Suite 510, Dallas, Texas, stated that the proposed property is not being marketed, but he has received numerous inquiries and unsolicited offers regarding the 60 acres along FM 544 for potential retail/commercial development. Vice-Chairman Larson closed the public hearing at 7:56pm. The Commissioners expressed approval for the commercial development, but expressed opposition for the single-family residential lots and density. After discussing the lot size and density with Mr. Leffer, he requested that the item be tabled until April 5, 2005, to give them time to amend issues for lot size and density. A motion was made by Commissioner Alexander, and seconded by Commissioner Spillyards, to recommend to the City Council tabling the zoning change 2005-01 until April 5, 2005 for P&Z and April 26, 2005 for City Council. Motion carried 6—0, with Chairman Seely absent. 2. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) to Single-Family 20/21 (SF-20/21) District for single-family residential uses, being a tract of land situated in the A. Atterberry Survey, Abstract No. 23, Collin County, Texas, said tract being out of a 45.07 acre tract described in Volume 309, Page 285, Collin County Deed Records, and said tract described in Volume 2359, Page 296, Collin County Deed Records. (Zoning Case No. 2005-02). Thompson stated that the subject property totals 33.943 acres, and is located west of FM 544/South Stone Road and south of Stoneridge Farms Additions. The subject tract is effectively land-locked, being long and narrow with developed properties on three sides, allowing access only from the narrow frontage of FM 544. The applicant is proposing to develop single-family residential lot size of 20,000 square feet with a minimum dwelling size of 2,100 square feet. P &Z Commission Meeting March 1, 2005 Page 4 of 8 Nineteen public comment forms were mailed as required, and only two written comments returned, both opposing the zoning change. Vice-Chairman Larson opened the Public Hearing at 8:10PM. Rob Adams, Adams Consulting Engineers, 500 Nolen Drive, Suite 550, Southlake, Texas, represented the engineer for the subject property, stated that City Council approved a request to waive the alley requirement on January 11, 2005. Because the property is long and narrow the entry access will be an oversized boulevard with a median, which will allow access for emergency vehicles. The minimum number of single-family residential will be 54 on half acre lots. Mike Foster, 1600 S. Lakeshore Drive, Rockwall, Texas, represented the applicant, stated that the screening along FM 544 will be a berm with landscaping, and the decision for a gated community is not finalized as of yet. However, when the homeowners association takes control of the development, the final decision for a gated community will be made at that time. Bill Dower, Paul Taylor Homes, 2204 Pembrooke, Denton, Texas 76205, represented the home builder, stated that he will commit to build a minimum 3,000 square foot dwelling and have a wooden fence along the exterior. The driveways will not be street-facing entries they will either be J-Drives, center or coming from the rear for access to the garages. Jamie Van Eaton, 1001 Oakbrook Drive, Wylie, Texas, homeowner directly to the north of the subject property, and represented several homeowners within the same subdivision, spoke in opposition of the half-acre lots. Joel Orr, 921 Oakbrook, Wylie, Texas, homeowner to the north of the subject property, spoke in opposition due to amount of traffic. Vice-Chairman Larson closed the Public Hearing at 8:35PM. The Commissioners discussed with Mr. Adams the inability to regulate the house size for straight zoning requests. Mr. Adams requested to withdraw the item. A motion was made by Commissioner Byboth, and seconded by Commissioner Hennesey, to recommend to City Council acceptance from the applicant to withdraw the zoning change. Motion carried 6—0, with Chairman Seely absent. Vice-Chairman Larson adjourned the meeting at 8:40PM. Chairman Seely reconvened and rejoined the meeting at 8:50PM. P &Z Commission Meeting March 1, 2005 Page 5 of 8 3. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) to Planned Development (PD) District for single-family residential uses of varied densities, being a 59.234 acre tract of land situated in the Moses Sparks Survey, Abstract No. 849, Collin County, Texas, located south of Sage Creek Phase 8, North of FM 544 and west of FM 1378 (Country Club Road). (Zoning Case No. 2005-03). Thompson stated that the subject property totals 59.24 acres, and is located west of Sage Creek Phase 4 and 7 Additions and north of Wooded Creek Estates. The request is to expand the existing Sage Creek Planned Development District(PD 99-9) for single-family residential uses, with similar dwelling and lot size. Public Comment forms were mailed to forty-eight property owners with seven returned, six opposing and one favoring. A petition was received with 17 property owners, four of which are in the notification area, and one of those represents the property owner who submitted favoring, but stated on the petition was in opposition of the zoning change. The currently-adopted Comprehensive Plan recommends low-density Country Residential (1 acre lots), and revisions to the Comp Plan currently being considered recommend medium- density residential (10,000 to 20,000 square feet lots). The Conditions of the PD establish a minimum dwelling size of 1,700 square feet, larger than most of the existing Sage Creek subdivision but the same as the most recently approved Phase 8. The Conditions of the PD establish a minimum lot size of 7,200 square feet, which is smaller than both those recommended by the Comprehensive Plan and developed and/or being developed in neighboring subdivisions. The PD provides 30 acres of dedication for park land, all of this within the floodplain and park board reviewed and approved on February 28, 2005. The subject property is land-locked, with development on three sides and on the fourth partially developed to the center line of the creek and then the floodplain, which is undevelopable on the eastern side as well. Chairman Seely opened the public hearing at 9:35PM. Neal Heckel, Ashton Woods Homes, 13800 Montfort Drive, Suite 100, Dallas, Texas, stated that an eight foot trail system will tie in with the existing trails to the south and west. An amenity center in the form of either another club house or sport court, with adequate parking for both facilities is proposed, which will take pressure off the existing amenity center in the middle of Sage Creek. P &Z Commission Meeting March 1, 2005 Page 6 of 8 John Bull, 5225 Village Creek Drive, Plano, Texas, represented Dowdey, Anderson and Associates Engineering Company, stated that improving Hunters Way to the north, and Wooded Creek Lane to the south will provide access into the development which should alleviate traffic through Claybrook. The following property owners spoke in opposition of the zoning change because of traffic, lot size and density: Dana Alvarez, 3000 Claybrook; Rodney Whitted, 1001 Lake Ranch Lane; Teresa Shea, 3001 Dylan Drive; Michelle Anderson, 3012 Claybrook; Jessica Kaltenbach, 3004 Claybrook; Danielle Raper, 3203 Warwick Court; Sidra Carzola, 3108 Claybrook Drive; Greg Burget, 3411 Everglade Lane; and Brett Teller, 3110 Claybrook. Jamie Gregg, 1102 Spring Tide, president home owners association for Sage Creek, spoke in opposition of the zoning change, stated that a petition with over 200 signatures opposing the zoning change will be submitted to City Council on March 22, 2005. Chris Lander, Neitzel Real Estate, 5220 Spring Valley Road, Suite 510, Dallas, Texas, represented the property owner Mr. Housewright, stated that the desire from the Mr. Housewright is to have the property developed consistent with the existing surrounding developments. Chairman Seely closed the public hearing at 10:05PM. The Commissioners discussed the traffic issues, and lot size with Mr. Heckel. Mr. Heckel offered to amend the Conditions of the PD, for 80%to be minimum 2,000 square feet single- family residential dwelling size. Commissioners expressed desire to have minimum 2,500 square feet single-residential dwelling size. After much discussion, Mr. Heckel requested for a five-minute break to review with engineer and applicant on resolution for issues. Chairman Seely adjourned the meeting at 10:30PM. Chairman Seely reconvened the meeting at 10:35PM. Due to the inability to resolve all of the issues, Mr. Heckel requested to table the zoning change until April 5, 2005 for Planning and Zoning and April 26, 2005 for City Council. A motion was made by Commissioner Larson, and seconded by Commissioner Alexander, to recommend to the City Council acceptance to table the request until April 5, 2005. Motion carried 7—0. P &Z Commission Meeting March 1, 2005 Page 7 of 8 4. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) to Planned Development (PD) District for single-family residential uses of varied densities, being a 185.1449 acre tract of land situated in the E.M. Price Survey, Abstract No. 725, the D.W. Williams Survey, Abstract No. 980, the Nathaniel Atterberry Survey Abstract No. 1099, and the William Sutton Survey, Abstract No. 860, Collin County, Texas and the E.M. Price Survey, Abstract No. 1114, Dallas County, Texas, said tract being all of a 53.42 acre tract of land and a 134.33 acre tract of land conveyed by deed to Mrs. Thelma Rice by Lone Star Boat Co., recorded in Volume 561, Page 226, Deed Records, Collin County, Texas. (Zoning Case No. 2005-04). Thompson stated that the property totals 185.1449 acres, and is located west of FM 544, south of Stone Road and north of Vinson Road. The property was annexed into the City of Wylie on September 28, 2005. Five public notification forms were mailed to surrounding property owners, and no comment forms were received. The Comprehensive Plan recommends 72% Suburban Residential on a minimum 10,000 square foot lots and 28% Country Residential on a minimum of 1 acre lots. The proposed Conditions of the PD specify minimum lot size of 7,500 square feet with 60% larger than 10,000 square feet and 10% larger than 12,000 square feet. Two types of residential lots, type A lots will have a minimum dwelling size of 2,400 square feet on 10,000 square feet and 12,000 square feet lots. Type B is divided into three dwelling sizes, 2,400 square feet, 2,300 square feet, and 2,200 square feet lots. No alleys are required within the development, however, no garages shall face the front street, and alleys are not appropriate adjacent to thoroughfare. The proposed PD realigns Elm Drive as a 60 foot right-of-way secondary collector street. HOA will own and maintain street medians, green belts and common areas. Chairman Seely opened the Public Hearing at 10:40PM. Ryan Betz, Skorburg Company, 3838 Oak Lawn, Suite 1212, Dallas, Texas, represented developer for the subject property, stated that 28 acres will be dedicated as park land. The proposed builders could possibly include Paul Taylor Homes, but will be custom home builders. The following property owners spoke in opposition of the zoning change due to traffic issues and lot sizes to the south, and drainage detention: Nancy Hansen, 806 Meadow Drive; Del Beezley, 1945 East FM 544; and Dolores Beezley, 1945 East FM 544. Mr. Betz stated that there will be a drainage detention with a pond on the south side of the property. Commissioners discussed with Mr. Betz the dwelling size variations. After much discussion, Mr. Betz agreed to amend the dwelling size to 2,400 square feet for all lot sized and require all architectural roofs to be dimensional. A motion was made by Commissioner Larson, and seconded by Commissioner Alexander, to recommend approval to the City Council of the zoning change 2004-04, with stipulations to the PD Conditions that the dwelling size of all residential lots will be 2,400 square feet and all residential dwellings have architectural roof dimensions. Motion carried 6— 1, with Commissioner Hennessey voting in opposition. MISCELLANEOUS Thompson distributed and reviewed with Commissioners two newspaper articles. Thompson also reminded the Commissioners that a public hearing will be held on April 5, 2005 for the Comprehensive Land Use Plan. It is further proposed to construct three single-story masonry office/warehouse buildings on these lots in three phases. The Site Plan complies with all applicable technical requirements of the City of Wylie, and includes a tabulation of how the development regulations will be achieved. Office/Warehouse is a permitted use within the current Business Center(BC)Zoning District. A Replat is on the current agenda for consideration. SUMMARY: Owner/Applicant: D.H. Horton-Texas LTD. The property totals 64.38 acres, west of Kreymer Lane and south of Brown Street. Notification/Responses — Twenty-three (23) notifications mailed. Twenty-two (22) written responses returned OPPOSING the request, several outside of the legal notification area but representing 27% of the total land w/in the notification area. Requires super majority (75%)vote for Council approval. Comprehensive Plan recommends that the entire tract be developed as Country Residential (1 ac lots). The property is located east of Kreymer Lane and south of Brown Street. The base zoning district for the planned development is proposed to be the SF-8.5/17 district. The following is a brief description of our proposal. The minimum lot size for the planned development will be 8,500 square feet. The minmum average lot size for the community however,will be established at 10,000 square feet. In addition, as depicted in the Development Plan(Exhibit C) greater than 56 percent of the lots within the community have a minimum lot size of 11,000 square feet. With respect to minimum house size, at present, the SF-8.5/17 zoning district requires a minimum house size of 1,700 square feet. We are proposing no more than 50%of the houses within the community will have a minimum house size of 1,700 square feet. The remaining houses shall be at a minimum size of 2,000 square feet. Additionally, in coordination with our intent to not have alleys in this community, we are proposing garage doors cannot face the front of the lot unless the garage door is at least 6' behind the primary front façade of the house. This, in concert with the curvilinear street pattern and the use of swing garage configurations, will greatly minimize the impact of garage doors on the visual appeal of this community. We have oriented the lots so as to minimize this neighborhood's impact on adjacent neighbors as well as on the community as a whole. The perimeter lots on the northern, eastern, and southern boundaries of the property are generally the largest lots in the community and they are oriented such that they back to the adjacent properties. Meanwhile,the lots along the western boundary, which are immediately adjacent to Kreymer Lane side to the street. This, in combination with a 20' landscape buffer will enable Kreymer Lane to have a more attractive view corridor than it would have had if lots backed to Kreymer Lane. We feel that this development, as proposed, is compatible with the surrounding community whether it is the newly developed"suburban" areas to the west or north, or the more rural areas to the east and south. Due to previous obligations, I am not able to attend the next School Board meeting nor the next Planning S, Zoning meeting,so I want to make sure you are aware that I am a resident of Cimarron Estates who is opposed to this idea. I would much rather see the zoning change requested by Skorburg Development approved and to see that land used for housing. I am not at all interested in the increased traffic flow to the area and/or the other problems that will come with having a high school located in such proximity to already existing housing and agriculture (specifically crime, noise, pollution in the way of trash being discarded out of car windows, etc.). I already have a hard time each morning turning onto Anson Parkway from my street due to the hoards of traffic that are already using it as a way to avoid the construction and/or to avoid the light at Wal-Mart. Each morning, I count no less than 10 vehicles SPEEDING from the highway to make their way over to Brown Street where the majority of them turn right and head right back to the highway. Here's an idea: If the city would like to increase their coffers significantly each month, I would suggest they park an officer on the street each morning and evening and start writing citations. (Trust me when I say there is money to be made here!) The two speed limit signs that have been erected are quite simply being ignored. This is not just a morning problem either, it is just as bad in the evening. Here's what scares me the most: I hear stories from my children at least a couple of times each week about idiots driving like maniacs down Anson Parkway when they are exiting the school bus. I met my son down there one day and there were no less than 25 perhaps as many as 30 children exiting the bus from Akin Elementary. I have not had the opportunity to meet my older son when he is arriving on his bus, but I'm clear that there are also a large number of children coming to this neighborhood from Harrison Intermediate school. My children have friends who also live in Cimarron Estates, but on the other side of Anson Parkway and due to the current situation it already makes me nervous when they must cross Anson Parkway. Please do not make this situation worse and endanger the safety of our children by placing a high school so close with limited access roads. I moved to Wylie from Garland, near North Garland High School and the issues I mentioned in the first paragraph of this communication are all very real and I am NOT interested in having that experience again. The street I lived on was a race track each morning before school and each afternoon when school was dismissed. I did not have to look at the clock to know what time it was, I could hear the traffic zooming by each day. I chose this neighborhood in Wylie over others because it is smaller and not connected to a million other streets,with a million other houses. I would like to keep that"small"feeling and reduced amounts of traffic that I thought I would experience in Cimarron Estates. Frankly,the other neighborhoods made me feel like a rat in a maze. Especially with all the front entry drives I would also suggest that the city require the builders to use alleys whenever possible and/or require larger lots if front entry drives are used. It just makes the neighborhood feel more like a small town quiet neighborhood and less like an inner-city rat in a maze scenario. I understand that the builders don't want the expense of building the alleys, but I would ask then,who is in charge the city or the builders? It has come to my attention that there is the possibility of a High School being built on Bennett Road with the main entrance to the school being on Brown Road and Anson. Recently I received a letter from people in my neighborhood who are trying to start a petition against the building of a school at this location in favor of a housing development by Skorburg Development. I would not oppose an elementary or middle school being built, but if this is to actually be a high school with grades 10, 11 and 12, then I will definitely sign any petition passed my way. I am the father of a two year old and a four year old. Already I have strong concerns about living on the corner of Anson Parkway, or should I say speedway as that is what many people(especially teenagers) use it for. If this high school is built with it's main entrance on Anson and Brown it will not only greatly increase the traffic on Anson, but it will also greatly increase the people driving irresponsibly down this street at high speeds. I do not want either of my children being potential casualties due to reckless high school students speeding to or from school past my home. Recently I moved here from a neighborhood in Piano next to East Plano High. There were always conflicts between the neighborhood and the reckless driving of teenagers from the school. I lived on one of the side streets a little further from the school, but this did not deter these young drivers from speeding in a 30 mile an hour zone, or from throwing a variety of objects (eggs and pizza in my case)at the parked cars. So again, if any petition comes my way to block a high school, I will sign it. If the petition fails and the school is still built, I hope and pray that the City of Wylie will take all necessary actions to slow down and limit the amount of traffic on Anson Parkway. Even at this stage of development in this area, I already feel that speed bumps are necessary on this street, but if the school is built it will be a much more dangerous street to live on. Here is what I am aware of. To my knowledge the school does not own this property it is currently owned by the Brimingham Land Trust ( which I am the Chairman). The Trust has a contract to sell the property to the Skorberg Company contingent on gaining requested zoning to build homes on large lots. The trust also has a backup contract with the WISD to purchase the land should the Skorberg Company not be able to obtain the zoning. Legally the WISD can "take" the property at fair market value from the Skorberg Company or the trust under imminent domain proceedings, if they choose, for the greater good of the community. I would suggest that you attend the next school board meeting on Monday Feb. 22 at 7 pm if you want your voice heard and assist them in making this decision. The proposal complements similar recent redevelopments (Walgreens, Albertsons)toward achieving this goal. The property will be platted to create four (4) lots for compatible retail and office uses. A medical clinic by Baylor Health Care will occupy the northern-most rear lot immediately, but uses have not yet been announced for the remaining lots. The Baylor facility will be partially obscured from view of traffic along S.H. 78, especially when additional retail buildings are constructed in front of it facing 78. ZC 2005- 08 STAFF RECOMMENDATION: Denial. The proposal does not conform to the Comprehensive Plan, and the applicant has not documented the value of the variants/innovations to justify the Planned Development Zoning. SUMMARY: Owner—Trimble Family Investments, Ltd. Applicant—McEwen Partners Property totals 4.54 acres, west of Thomas Street and south of Stone Road. Abutting properties to the west are platted as the Caldwell Estates and those to the north are within the Eldridge Additions, both created in 1962. WISD and City of Wylie ownership and facilities abut the tract on the south. The property is part of a larger Trimble homestead which has never been platted. The subject tract was split from the remainder of the homestead by the extension of Thomas Street. Notification/Responses — Twenty-four (24) notifications mailed. Two (2) written responses were returned OPPOSING the request. Requires simple majority vote to approve. The PD envisions a cloistered neighborhood on a private street. Houses will be a Neotraditional/New Urbanist design, with smaller yards and shared common open space. These innovations are intended to justify the PD. ZC 2005-08 SUMMARY (Continued): Comprehensive Plan recommends Village Center Residential uses, with minimal lot size of 8,500 s.f., or a gross density of 4.4 lots/dwellings per acre. The request for smaller lots does not comply with this recommendation of the Comp Plan. Certain revisions to the Comprehensive Plan recommend that high- density residential uses, including detached lots smaller than 10,000 s.f as well as townhouses and apartments, be restricted to properties already zoned and platted to allow such densities. The proposal does not comply with this recommended policy of the Plan. The property is accessable only from Thomas Street. A drainage channel platted to WISD separates the tract from the private Pirate Drive. A recent replatting of the WISD property terminates Pirate Drive at Hilltop, eliminating any potential for providing access to the subject tract. The PD proposes 20 lots of 5,100 s.f or larger. The smallest detached residential lot currently allowed by Wylie's Zoning Ordinance is 8,500 s.f., and attached duplexes/townhouses but occupy lots of at least 3,500 s.f. Existing lots within Caldwell Estates to the west are approximately 8,000 s.f., and those to the north within the Eldridge Additions are approximately 13,200 s.f. The PD also proposes setbacks/yards which are smaller than currently permitted by the ZO (15 ft. front and rear yards compared to 25 ft. and 5 ft. rather than 7 ft. side yards (the houses may also be attached like duplexes with no side yard). The requested lot dimensions do not conform to the current regulations of the ZO nor to existing development within the area. The PD proposes that"masonry" may include EIFS and other composite cementuous materials as well as brick and stone, to be approved for durability by the Building Official. The Building Official recommends that exterior wall be restricted to laid masonry units of brick or stone or masonry stucco as currently required by the Zoning Ordinance. Other changes from the standard regulations of the ZO include a larger front porch(48 s.f porches compared to 20 s.f., 6:8 roof pitch rather than 8:12, and skipping 2 lots rather than 4 before repeating the same elevation). If developed according to the Comp Plan, with lots ranging from 8,500 to 10,000 s.f., the property could accommodate approximately 12 lots or a density of 2.6 lots per acre. If houses could front onto and be accessed from Pirate Drive, a total of 15 houses might be achieved. The PD proposes a minimum house size of 1,400 s.f. The smallest detached residential lot currently allowed by Wylie's Zoning Ordinance is 1,700 s.f., and attached duplexes must be at least 1,000 s.f and townhouses 1,200 s.f. Existing houses within Caldwell Estates to the west are average 1,017 s.f with two smaller than 1,000 s.f., and those to the north within the Eldridge Additions are approximately 1,900 s.f with two larger than 2,350 s.f. The requested house size does not conform to the current regulations of the ZO nor to existing development within the immediate area. The PD proposes no alleys be required. There are platted but unimproved alleys to the west and north of the property. The PD proposes that the private open space substitute for the public City parkland dedication requirement. This neighborhood is designed to encourage outdoor activity between families, friends and neighbors and will thereby promote community between those residing in Thomas Square. General Conditions: 1. This Planned Development District shall not effect any regulation within the Code of Ordinances, except as specifically provided herein. 2. All regulations of SF-8.5/17 District set forth in Article 3, Section 3.3 A.3 of the Comprehensive Zoning Ordinance (amended on September 26, 2003) are included by reference and shall apply except as amended herein. 3. The attached Development Plan(Exhibit C) shall serve as a Preliminary Plat. The Development Plan shall conform to the written conditions of the Planned Development, but in case of conflict between the two, the written conditions shall prevail. Special Conditions: 1. Lot Mix Maximum number of Single Family Lots permitted in this Planned Development shall not exceed 20. Minimum 20 lots will be 5100 sq. ft. or greater 2.
