A motion was made by Commissioner Byboth, and seconded by Commissioner Larson, to approve the minutes as submitted. Motion carried 5 —0. P & Z Commission Meeting November 2, 2004 Page 2 of 6 ACTION AGENDA 1. Consider and act upon approval of a Site Plan for an office building located at 2800 Capital Street, being all of a certain 0.505 acre tract of land of the Regency Business Park Addition, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan will create a 6,000 square feet building, which consists of 1,000 square feet dedicated to office space and 5,000 square feet for warehouse use. The property has been platted since 1987 as Lot 8, Block C of the Regency Business Park Addition Phase 2. The tract was rezoned from Industrial (I) to Business Center (BC) District in February with the adoption of the new city-wide Zoning Ordinance and Map. Office/warehouse is a permitted use within the current Business Center (BC) Zoning District. The Commissioners questioned several notes of the Plan concerning points for achieving the regulations, including two types of façade materials and the articulation of the building. The applicant was not present to respond and a motion was made by Commissioner Larson, and seconded by Commissioner Spillyards, to consider the item after Agenda Item number 6. Motion carried 5 —0. 2. Consider and act upon approval of a Site Plan for an office and warehouse building located at 1500 Martinez Lane, being all of a certain 0.311 acre tract of land of the Metrotech Addition, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan will create a two story office/warehouse facility. The building totals 2,100 square feet, and consists of 1,287 square feet dedicated to office space and 1,818 square feet for warehouse use. Office/warehouse is a permitted use within the current Business Center(BC)Zoning District. Tim Burke, 2725 Las Palmas, Plano, Texas 75025, represented the engineer for the subject property, stated that the building will be brick and mortar with a steel roof, and the roof pitch will be 3:12. The fence will have cedar posting all around the property. Commissioners questioned the dumpster. Thompson stated that for this use a dumpster will not be required, but if a future use requires a dumpster, the Site Plan notes where one is to be located. A motion was made by Commissioner Larson, and seconded by Commissioner Byboth, to approve, as submitted, the Site Plan for an office and warehouse building located at 1500 Martinez Lane of the Metrotech Addition. Consider a recommendation to the City Council regarding a Replat for Lots 1 R- 3R1, 1R-3R2 and 1R-4R, Block C of the Woodlake Village Addition, as recorded in Cabinet P. Pages 926 & 927 of the Deed Records of Collin County, Texas. Thompson stated that the Replat will subdivide a single retail lot into two lots and provide an access easement onto Lot 1R-4R, of the Woodlake Village Addition. A Site Plan for the retail center on this lot is also on the current agenda for consideration. The property will be developed in phases. Lot 1R-3R2 will be 2.9 acres and will be constructed as phase one, and the extreme rear portion consisting of 2.411 acres will be developed at a later date, but no final plans for this tract as been determined. A variance to allow shared/off-premises parking and landscaping was approved by the Zoning Board of Adjustment at their meeting on October 25, 2004. Commissioners questioned the drainage easement. Thompson stated that the drainage easement is for an underground pipe, but stops at the Municipal Complex property line and continues north. A motion was made by Commissioner Hennessey, and seconded by Commissioner Spillyards, to recommend approval of the Replat for Lots 1R-3R1, 1R-3R2 and 1R-4R, Block C of the Woodlake Village Addition. Motion carried 5 —0. 4. Consider and act upon approval of a Site Plan for a retail center, being all of a certain 5.311 acre tract of land of the Woodlake Village Addition, generally located north of Highway 78 and west of Spring Creek Parkway, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan relates to the Replat of Woodlake Village Addition which was just considered on the current agenda. The Site Plan will be developed under Phase One with a 20,250 square feet strip retail center. The subject property conforms to the requirements of the Corridor Commercial District. The Plan provides for common access between the subject development, and the adjacent Wal-Mart and Municipal Complex lots this joint access easement also serves as a fire lane for emergency vehicle access. P &Z Commission Meeting November 2, 2004 Page 4 of 6 Commissioner Byboth questioned the screening around the property. Thompson stated that no screening is required between common non-residential uses, and the building will be open in the back. Mr. Kim Sutton, Wilcox Development Services, 14001 Dallas Parkway, Dallas, Texas, represented the developer for the subject property, stated that there will be a landscaping screen of wax myrtles and flowering trees along the west property to screen the rear of the building and loading area. Mr. James Patterson, Omniplan, 1845 Woodall Rodgers, Suite 1500, Dallas, Texas 75201, represented the architect for the subject property, stated that the building will be tilt-up concrete along all four sides with a wainscot of aesthetic stone at the bottom. Two bays are at each end that are raised up 24 feet, compared to a typical height of 20 feet, and a different type of canopy with a metal shed roof at the high panels, and at the lower panels a flat metal roof supported by the concrete panels. Commissioners recommended including canopies over the back doors facing the Municipal Complex. Mr. Sutton and Mr. Patterson agreed to have standard metal shed canopies over the back doors. A motion was made by Commissioner Larson, and seconded by Commissioner Byboth, to approve, with stipulation that standard metal shed canopies over the doors facing west, the Site Plan for Woodlake Village Addition, Lots 1R-3R1 and 1R-3R2. Motion carried 5 -0. 5. Consider a recommendation to the City Council regarding a Preliminary Plat for Akin Addition. Subject property being generally located at W.A. Allen Blvd. and Springwood Lane, and being all of a tract of land conveyed to the Wylie I.S.D. by deed recorded in Volume 2448, Page 867, Deed Records of Collin County, Texas. Thompson stated that the property will include 10.154 acres and will create 6 single- family residential lots and 1 lot for the existing Akin Elementary School. The lots will exceed 10,000 square feet and the current zoning allows lots as small as 8,500 square feet. The property to the north is undeveloped and a potential developer has requested consideration of some access street through the school site. On October 12, 2004, an alley waiver was approved by City Council, as well as the right to front lots on W. A. Allen. Ronny Klingbeil, RLK Engineering, 111 W. Main Street, Allen, Texas, 75013, represented the engineer for the property, stated that the property to the north is owned separately from the subject properties, and no access onto W. A. Allen can be provided due to limited space and drainage problems. In order to accomplish the access the playground would be compromised. Currently, the playground slopes uneven with the school and when new grading is completed, the playground will be even with the school. P &Z Commission Meeting November 2, 2004 Page 5 of 6 WISD has determined that the subject properties is surplus and can be sold for revenue to go toward the new construction. Thompson stated that the cost to develop the property to the north should be shared, but that is a decision of the private parties rather than City. A motion was made by Commissioner Spillyards, and seconded by Commissioner Larson, to recommend approval to the City Council meeting on November 9, 2004, of the Preliminary Plat Akin Addition. Motion carried 5 —0. 6. Consider a recommendation to the City Council regarding a Preliminary Plat for Birmingham Ranch Addition. Subject property being a tract of land generally located west of Parker Road and east of the Birmingham Farms Phase 14 Addition, and being part of a 16.039 acre tract and being all of a 15.486 acre tract of land conveyed to T. F. Birmingham and Hattie A. Birmingham Trusts recorded in Volume 2362, Page 90 of the Deed Records of Collin County Texas and being all of a 0.552 acre tract of land conveyed to Wylie Independent School District recorded in Volume 1187, Page 15, Deed Records of Collin County, Texas. Thompson stated that the Preliminary Plat will create 53 single-family residential lots on 16.039 acres. The subject property is zoned Single Family 10/19 District, with the minimum lot size being 10,000 square feet. No alleys are being proposed and an alley waiver will be submitted to the council for consideration. The property was previously owned by the Wylie Independent School District. The applicant is proposing to connect to Parker Road through the Northeast Water Supply facility. The City Engineer has accepts the 40 foot street right-of-way as proposed to connect to Parker Road, but there are other alternative routes. The access to the development will be reconciled at the Final Plat. Rob Adams, Adams Consulting Engineers, 500 Nolan Drive, Southlake Boulevard, Southlake, Texas, represented as the engineer for the subject property, stated that the subject property is a challenging site to develop, the property backs up to two water towers, and a 300 foot television antenna, as well as the difficult access. Randy Potts, R & B Venture LP, 17480 Dallas Parkway, Suite 200, Dallas, Texas, represented the applicant for the subject property, stated that the houses will be priced above the neighboring starter homes, and the builder possibly will be Colonnade Homes. A motion was made by Commissioner Byboth, and seconded by Commissioner Larson, to approve the Preliminary Plat for Birmingham Ranch Addition, to City Council meeting on November 9, 2004. A motion was made by Commissioner Larson, and seconded by Commissioner Byboth, to table the Site Plan for an office building located at 2800 Capital Street, until the November 16, 2004, in order for the applicant to be present. WORK SESSION 1. Discuss land use philosophy and potential revisions to the Comprehensive Plan. Thompson distributed and reviewed a list of issues that the Commissioners had expressed on the Plan, and seeking direction from the City Council. After discussing each item in extent, the Commissioners recommended that the following changes be made to the proposal: a. Encourage low-density detached residential — eliminate 8.5K, set 10K minimum for Suburban (delete 20K and 30K) and raise Country to 3-5 acres, but keep patterns as illustrated on map—allow nothing smaller. b. Eliminate flexible zoning requirements and make Desirables mandatory minimum Base. c. Utilize in-fill or conversion/redevelopment of existing single-family lots for higher-density detached residential. d. Eliminate other neighborhood retail zoning. e. Revise Zoning accordingly and encourage straight zoning in compliance with Plan — use PDs only for truly innovative proposals (not just variance to Plan/ZO code). The Commissioners requested a joint work-session with City Council on November 23, 2004. Thompson responded that the request would be forwarded to Council for consideration and an answer would be available at the next Planning and Zoning meeting on November 16, 2004. (ZC 2004-14) Located at the southeast corner of Brown Street and Kreymer Lane. STAFF RECOMMENDATION: Denial. Neither the proposed retail use nor residential density of the PD conform to the recommendations of the Comprehensive Plan. SUMMARY: Owner: DR Horton Homes and Kreymer Family Applicant: DR Horton Homes The subject property totals 158 acres, 66.2 acres of which are not within the Wylie corporate limits. The annexation of this County jurisdiction is under consideration by the City Council and must be complete prior to consideration of zoning. Annexation will be finalized on December 14. Most of the property is undeveloped and earlier used for agriculture, except for several scattered rural homesteads. A 30 ft. wide sanitary sewer easement, which traverses the tract in a north/south direction, generally divides the property in two sections. The western section is nearly 92 acres in size and already incorporated. It is traversed in an east/west direction by a 250 ft. wide easement for a major overhead electric transmission line. The eastern section is currently being annexed and totals 66.2 acres, and is traversed north/south by a limited floodplain. (ZC 2004-14) SUMMARY (Continued): The Comprehensive Plan recommends the entirety of the property (including the newly annexed portion) be developed as Country Residential uses with single-family detached lots exceeding 1 acre in size. This recommendation of the Plan allows potential for approximately 150 lots or density of 1 lot per acre. The PD Conditions allow as many as 456 residential lots or a potential density of 2.9 lots per acre (nearly three times that recommended by the Comp Plan). The PD therefore does not conform to the recommended density of the Plan. The proposal is to create a dense, pedestrian-oriented neighborhood, based on a modification of Neotraditional or New Urbanist planning philosophies. The Conditions of the PD establish 10 different lot types, ranging from 4,400 sq. ft. (23% of the total lots) to 20,000 sq. ft. (4.4%of the total). 77.6% of these are to be less than 8,500 sq. ft. or less,the smallest lot currently permitted by the Zoning Ordinance. Only 19.3% are to be to be greater than 10,000 sq. ft. and none are the acre size recommended by the Comprehensive Plan. The PD also proposes smaller setbacks than required by the Zoning Ordinance, with front and rear yards of 15 ft. and 20 ft. respectively(rather than the normal 25 ft.) and side yards of 5 to 15 ft. (rather than the standard 7 to 15 ft.). The PD Conditions establish a minimum house size of 1,750 sq. ft. and 77.6% of the total houses may be as small as this, while 20.4% of the houses must exceed 1,900 sq. ft. The minimum house size recommended by the Comprehensive Plan for the property is 2,600 sq. ft. The PD proposes to substitute architectural design of the residences based on "traditional neighborhood design", rather than the standard requirements of the Zoning Ordinance. Although some of these requirements are very similar to the standards of Wylie's Ordinance (front porches, steeply-pitched roofs with dormers, vertical windows, yard trees and picket fences), others are not (the PD proposes "cementatious fiber board" for exterior wall materials rather than the required 100%masonry walls. Nonresidential development will comply fully with the current City regulations. The PD proposes street rights-of-way of 27 ft., rather than the currently required 31 ft. Alleys are proposed to be 16 ft. of right-of-way and 10 ft. of pavement, than the required 20 ft. and 12 ft. The City Engineer recommends denial of this element of the PD. The PD proposes to dedicate 34.3 acres (22% of the total property) as public land, and that this open space and developer-funded park improvements (the PD mentions "trails"), and these are to substitute fully for the City Park Dedication requirement. A private swim center is proposed. This open space and facility are to be maintained by the private Homeowners Association, and be largely limited to access by the residents of the development. The City's park land dedication requirement is 22.8 acres for the proposed 456 lots. However, about 13 acres of the proposed open space is occupied by the electric transmission lines or floodplain, and not eligible for dedication. The remainder of the open space/park land is divided into numerous small tracts (the largest of which is 3 acres) in order that every residential lot adjoin open space. The PD provides significant public park acreage at no public cost, and the resulting residential density permitted by the PD is approximately that recommended by the Comprehensive Plan. SUMMARY: Owner: J.L. Brand, Jr. Applicant: S.C. Parsons, Inc. The property totals 100 acres, 40% of which is occupied by the floodplain of Muddy Creek (including the Muddy Creek reservoir) and therefore is not developable for urban uses. Lakefield Drive (65 ft. wide collector) currently terminates at the western property line and must be extended thru the property to connect with Country Club Road. The southern boundary is the DART/KCS railroad corridor. The Lakefield Estates subdivision (PD 1999-18) abuts to the southwest, allowing lots as small as 6,000 sq. ft. (ZC 2004-22) SUMMARY (Continued): The Comprehensive Plan recommends that 90% of the property (all of the developable portion) be developed as Suburban Residential uses with single-family detached lots averaging 20,000 sq. ft. and 10% as Country Residential with lots exceeding 1 acre. If developed according to these recommendations of the Plan, a potential density of 2.2 lots per acre would be realized. The PD Conditions provide that the maximum number of residential lots shall not exceed 200, and provide for the dedication of 43.8 acres of public park land. This formula realizes a potential density of 2 lots per gross acre (similar to that recommended by the Comp Plan). The PD therefore conforms to the recommended density of the Plan. The PD Conditions establish a minimum lots size of 7,200 sq. ft., but require that 50% of the total lots exceed 8,500 sq. ft. (the smallest lot allowed by the current Zoning Ordinance). All lots must have a width of 70 ft. at the building line (compared to 70 ft. for standard SF-8.5 and 75 ft. for SF-10 zoning). Interior side yards must be at least 5 ft. (compared to the minimum 7 to 10 ft. of standard zoning). The PD Conditions establish a minimum house size of 2,100 sq. ft., and 35% of the total houses must exceed 2,200 sq. ft. and 15% exceed 2,500 sq. ft. The standard SF-8.5 requires a minimum house size of 1,700 sq. ft., and the SF-10 requires 1,900 sq. ft. The PD provides that alleys not be required, but requires that 30% of the houses have garages that do not face the front street. An additional 5% of the total lots are corner lots which accommodate side entry garages. The developer must extend Lakefield Drive 1,150 ft. eastward to connect with Country Club Road, 640 ft. beyond the subject property. The City Engineer recommends approval of this element of the proposal. The PD dedicates 43.76 acres for public park (the required dedication is 10 acres) including the Muddy Creek reservoir, and provides 2 points of public access and trailheads for connection to a future trail system along Muddy Creek. Although most of this area cannot be developed,the owner/applicant is not required to dedicate it, and it serves valuable public-welfare functions, including flood control, water quality protection, air quality enhancement, energy conservation and wildlife protection. The Park Board recommends approval of this element of the proposal. Housing backing on to the park must have visually-open wrought iron fences rather than wood stockade style fencing. The PD provides for a landscaped earthen berm screen/buffer along the railroad corridor. Although the proposed mixed commercial uses are appropriate for the tract, the deteriorated noncompliant Carlisle facility should be cleared and redeveloped rather than encouraged to remain indefinitely as proposed. SUMMARY: Owner: Carlisle Coating & Waterproofing/Greenway-78, LP Applicant: Greenway Investment Company The subject property is on the south side of FM 544, with railroad corridor and drainage channel bordering to south and east. Albertsons and Home Depot abut to west. Southern portion abutting railroad is occupied by the nonconforming and deteriorated Carlisle manufacturing building and a cell tower, and the northern 544 frontage is vacant. The current 3 tracts are proposed to be reconfigured into 2 tracts - Tract A is 3.53 ac. along 544 frontage, and is to comply fully with CR regulations except to allow mini- warehouses and drive-thrus for banks and restaurants without SUPs. Tract B is 4.62 ac. to south/rear, and is to comply fully with the regulations for Industrial, and allow CR uses as well as distribution, light assembly manufacturing and storage. ZC 2004-23 SUMMARY (Continued): The property has never been platted and will require platting prior to initiation of redevelopment. The platting eliminates all vested rights in previous code regulations and requiring full compliance with current regulations. Site plan approval will be required with platting. The existing Carlisle facility is a legally nonconforming structure. It is temporarily being used by Sanden for storage/warehousing(a nonconforming use in CR), which will terminate in January. The building and grounds do not conform to the current requirements of the Zoning Ordinance or Building Code and the Fire Marshall has concluded that it is unsafe for permanent occupancy. The PD permits continued utilization of this facility indefinitely. It is a stated goal of the Zoning Ordinance "not to encourage the survival of nonconforming uses and structures". The Comprehensive Plan recommends that this area be developed for light industrial uses with limited, subordinate retail uses, due to its excellent accessibility to highway and rail transport. The proposed industrial use of Tract B conforms with this recommendation of the Plan and is approppriate. Likewise, the property is too deep to support efficient retail development, except as a unified complex. The proposed CR retail of Tract A, as well as the existing CR zoning of the entire property, does not conform to this recommendation of the Plan. The Comprehensive Plan recommends that the intersection of SH 78 and FM 544 develop into Wylie's new central commercial district, and the proposal as well as the Albertsons/Home Depot development to the west complements this recommendation. The proposed mixed commercial uses could serve to attract more such diverse commercial development to this significant community core.
