Consider a recommendation to the City Council regarding a Final Plat for the Wooded Creek Estates, Phase 2, Addition, being all of a certain 21.893 acre tract of land generally located north of Lakeside Drive and east of Springwell Parkway and the Wooded Creek Estates, Phase 1 Addition, being part of that tract of land described in a deed to Wooded Creek Estates, Ltd. as recorded in Volume 5090. Page 1590, Deed Records of Collin County, Texas, and being situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat for this second phase of the Wooded Creek Estates Addition will create 78 single-family residential lots on 21.893 acres. Just less than 3/4t of an acre is dedicated for park and open space, and additional fees or improvements in lieu of land will be required to satisfy the remaining parkland dedication requirements. The Plat also dedicates a site for a sewerage lift station. The Planned Development District (PD 02-02), which established the zoning requirements for the Wooded Creek Estates Addition, provides for an overall average lot size of 8,500 square feet. No lot shall be less than 7,200 square feet, and there shall be no fewer than 97 lots having a minimum size greater than 8,500 square feet. Of the 78 total lots proposed for this phase, 64 are 8,500 square feet or larger in size, complying with the PD regulations. The Preliminary Plat was approved by the City Council on December 11, 2002, and the only difference between the proposed Final Plat and earlier-approved Concept Plan of the PD and Preliminary Plat is the point of access from this development to the undeveloped tracts to the east. The current proposal provides better access to the land-locked parcel to the east. The continuation of Lakefield Drive id also dedicated with this Plat. With no questions for the applicant or staff, a motion was made by Commissioner Phillips, and seconded by Commissioner Hughes, to recommend approval to the City Council the Final Plat for the Wooded Creek Estates Addition, Phase 2. Motion carried 5 —O. 2. Consider a recommendation to the City Council regarding a Final Plat for the RSR Addition, being all of a certain 8.043 acre tract of land generally located west of Sanden Boulevard and south of FM 544, being part of a 34.412 acre tract of land conveyed to R. Richard Parker and Ben L. Scholz by deed recorded in Volume 4708, Page 1628, Deed Records of Collin County, Texas (DRCCT) and all of a called 5.263 acre tract of land conveyed to RSR, LLC by deed recorded in Volume 5120, Page 3027 DRCCT, and being situated in the D. Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas. Thompson stated that the Southern Fastening Systems tract was approved in May of 2002 and subsequently developed, but the Plat was never filed. The current Plat will add approximately 3 acres to the earlier SFS tract, and provide a open space for a public trail along Muddy Creek to the west. The Plat conforms to the provisions of the approved Specific Use Permit. P &Z Commission Meeting June 1, 2004 Page 3 of 4 The majority of the new property is currently occupied by the 100-year floodplain, a portion of which has been reclaimed for the Southern Fasteners development. Sam Satterwhite, Wylie Economic Development Director, represented the applicant, presented an overview of the reasons for purchase of the additional three acres which is in the floodplain. A study of the floodplain was performed in April 2000, and a Certified Letter of Map Revision (CLOMR) was submitted to the U.S. Corps of Engineers on April 7, 2002, to verify reclamation of a portion of the floodplain. A motion was made by Commissioner Hughes, and seconded by Commissioner Spillyards, to recommend approval to the City Council of the Final Plat for RSR Addition. Motion carried 5 —O. 3. Consider a recommendation to the City Council regarding a Final Plat for the Bayco Addition, being all of a certain 8.285 acre tract of land generally located west of Sanden Boulevard and south of FM 544, being part of a 34.412 acre tract of land conveyed to R. Richard Parker and Ben L. Scholz by deed recorded in Volume 4708, Page 1628, Deed Records of Collin County, Texas (DRCCT) and all of a called 5.050 acre tract of land conveyed to Wylie Economic Development Corporation by deed recorded in Volume 5620, Page 705 DRCCT, and being situated in the D. Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat will create a 8.282 acre lot in order to accommodate a office/warehouse building of approximately 100,000 square feet for relocation into Wylie of the Bayco Corporation (a lighting fixtures manufacturer). Also dedicated as Lot 2 with this Plat is a sixty foot wide public open space connector along the Muddy Creek floodplain on the western property line of the subject tract. The property abuts to the north of the RSR property, for which a Final Plat was also considered on tonight's agenda. The subject 8.3 acre parcel is the lower part of a 28.4 acre tract recently rezoned from Agriculture to Business Center (BC). No plans have as yet been suggested for the remaining twenty acres within the hard corner of Sanden Boulevard and F.M. 544. With no questions for the applicant or staff, a motion was made by Commissioner Phillips, and seconded by Commissioner Spillyards, to recommend to the City Council approval of the Final Plat for Bayco Addition. Motion carried 5 —0. MISCELLANEOUS 1. Chairman Seely and all the Commissioners wished a Happy Birthday to Mary Bradley. Chairman Seely adjourned the meeting at 7:25PM for a break, and reconvened for a work session at 7:30PM. P &Z Commission Meeting June 1, 2004 Page 4 of 4 WORK SESSION 1. Consider revisions to Comprehensive Plan. Thompson reviewed the earlier-adopted philosophy of the Comprehensive Plan, as well as the proposed revisions recommended by the Planning and Zoning Commission in March. Commercial land uses are divided into three categories, depending on the level of service which they provide: the Village Center retail is to provide convenience goods within walking distance of residences; Community Retail is to provide shopper/comparison goods located at the intersection of major streets; and Corridor Commercial is to accommodate goods and services which require automotive access and are located along the major streets in strip fashion. This hierarchy of nonresidential in turn defines a hierarchy of housing types and residential densities, Including: high-density apartments, duplexes/townhouses and 8,500 sq. ft. lots within a 5-minute walk of the Village Centers; medium- density Suburban Residential lots of 10,000 to 30,000 sq. ft. requiring a longer walk or short drive; and the lowest-density Country Residential of 1-acre or larger located to the outside requiring driving to all destinations. After comparison of the existing zoning with the proposed Comprehensive Plan, Commissioners generally affirmed the philosophy, and that the proposed revisions generally comply well with that philosophy. However, Commissions also concluded that the Plan provides for too much commercial (especially the smaller Village retail centers), and too much high-density residential (especially attached- and multi-family dwellings). Future work sessions will consider alternatives to correct this, either expanding the distances between densities, or deleting some Village Centers from the Plan and Zoning Map. Surveyor/Engineer: Dowdey, Anderson& Associates, Inc. Location: Generally located east of McCreary Road and Sage Creek Phase IV Addition and south of McMillen Existing Zoning: Planned Development District (PD 04-11)for Single Family Residential Uses Summary: The Final Plat for Phase VIII of the Sage Creek Addition includes 45.711 acres and will create 111 single-family residential lots, as well as public park land and a trail corridor along Muddy Creek. The subject property was rezoned by Planned Development District (PD 04-11) in March of 2004, as an addition and continuation of the Sage Creek development. The original Sage Creek Addition was established by a Planned Development District 1999, as a revision to the earlier Lakeside Estates Planned Development District. Final Plats have subsequently been filed and public infrastructure accepted for Phases I, II, III, IV, V, VI and VII, as well as for a private common Amenity Center. The Planned Development District for the subject property (PD 04-11) provides regulations which closely conform to the provisions of the earlier Sage Creek PD (99-9) but modify the current standard requirements of the Zoning Ordinance. The minimum lot size is 6,000 square feet, but 54% must be larger than 7,200 sq. ft. and nearly 10% must be one acre or larger. Lot widths and side yards are smaller than the current zoning requirements. Final Plat— Sage Creek Phase VIII Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipality unless it is disapproved within that time period" Issues: 1. The Final Plat substantially conforms to the approved Development Plan of the Planned Development District, which serves as the Preliminary Plat. The Plat also complies with all applicable technical requirements of the City of Wylie. 2. The Conditions of the Planned Development District provide that a combination of park land and developer-funded improvements will be used to comply with Wylie's park dedication regulations, and the Plat satisfies that requirement. 3. Alleys are not provided by the Plat, as the approval by the Planned Development District and the existing pattern of earlier Sage Creek developments. 4. As submitted, the Plat does not legally provide an adequate second point of access for emergency circulation to the proposed subdivision. The Plat does indicate the extension of the existing Aqueduct Drive to align with Hunters Way within the property. The applicant has investigated several options for providing the required secondary access but has to date not finalized an acceptable solution. However, prior to acceptance of the subdivision infrastructure and filing of this Final Plat, an approved second point of access must be provided. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to the issuance of a building permit on each lot. Location: Generally located west of Sachse Road and south of the intersection of Pleasant Valley Road Existing Zoning: Planned Development (PD 98-15) Summary: The Final Plat under consideration is for Phase 9 of the Woodbridge Addition. The subject property includes 48.824 acres and will create 230 single-family residential lots, as well as a landscaped entry feature and other common areas/open spaces to be owned and maintained by the Homeowners Association. Lot sizes range in size from a minimum 5,500 square feet to over 7,500 square feet. The subject property is a continuing portion of the larger mixed-use Woodbridge Planned Development (PD 98-15), which consists of Single-Family Residential of varying densities, Multifamily Residential, a private golf course, commercial, a school site, and a park and common open spaces. The entire Planned Development totals 921 acres in size of which approximately 409 acres and 1,650 single-family lots of the PD are located within the Sachse corporate limits and is nearing completion. The portion of the Woodbridge Planned Development which is located within the Wylie city limits is approximately 512 acres in size and includes the golf course and club house, a school site, and open spaces, as well as approximately 980 single-family residential lots ranging in size from 5,500 sq. ft. to 8,400 sq. ft. The Phase 9 Addition currently under consideration is the first residential phase entirely within the City of Wylie. Final Plat—Woodbridge Phase 9 A Concept Plan was approved with the PD Conditions by the City Council on June 9, 1998, and a Development Plan/Preliminary Plat was approved by the Council in September of 2003. The subject development will comply with all of the applicable requirements set forth in the conditions of the PD 1998-15. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Issues: 1. The Final Plat substantially conforms to the earlier-approved Concept Plan of the PD and Development Plan/Preliminary Plat, and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie in effect at the time the PD Ordinance was approved. 2. The current addition provides only one point of access/egress, Creek Crossing Lane which intersects Sachse Road, whereas Wylie's code requires that all developments provide at least two points of access for emergency vehicles. Creek Crossing and Lost Highlands Lanes will serve as collectors constructed with 37 feet of pavement and will eventually be extended to connect, respectively, with the City of Sachse to the west and with Alanis Drive within Wylie to the north. In order to comply with the requirement for two points of access for emergency vehicles, an ordinance will be established prohibiting parking on both Creek Crossing and Lost Highlands until these streets are extended through to provide other entry points (no residences face to these street segments). The applicant has agreed that plats for future phases of this Planned Development will not be approved unless a permanent second point of entry is provided. 3. The parkland dedication requirement has been satisfied by the provision of public amenities and open spaces within the golf course and surrounding green belts. The common open spaces, as well as the entry feature and screen wall landscaping, will be maintained by the Homeowners Association. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit on each lot. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Final Plat—Creekside Estates Phase 3 Issues: 1. The Final Plat substantially conforms to the approved Development Plan, which serves as the Preliminary Plat. The Plat also complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. The Conditions of the Planned Development District provide that the minimum size of lots in this Phase shall be 8,500 square feet, and all lots exceed 8,800 square feet. 3. SLIDE SHEET 2 OF 3 A I'C -A# ylie 4 Public Hearing Item No. 1 Rezoning 04-11, Troy Road at County Line Road Planning and Zoning Commission Meeting: June 15, 2004 Owner: WM Watermark 19, LLC Applicant: Realty Development Trust Location: Generally located east of Troy Road and north of County Line Road Existing Zoning: Agriculture(A)District Requested Zoning: Tract 1 to Neighborhood Services (NS)Retail, and Tract 2 to Single-Family 1 Acre(SF 1A/26) Summary: The property included within this request was annexed into the City of Wylie on June 8, 2004, and was at that time zoned as Agriculture (A) District. Agriculture is applied as a "holding" classification to undeveloped properties only until such time as appropriate urban uses are determined for the land. The subject property totals 14.7697 acres, and is undeveloped forest and pasture lands. The property is part of a nearly twenty (20) acre tract under the same ownership. This larger tract is traversed by a major electric transmission line of the Garland Power and Light Company which is the corporate jurisdiction of the City of Garland. The remaining 5 acres to the southeast is within unincorporated Rockwall County and within the Extraterritorial Jurisdiction of the City of Rowlett, and abuts the City of Dallas owned and managed Lake Ray Hubbard. ZC 04-11, Troy at County Line The property to west of the subject property across Troy Road is within the City of Wylie and is undeveloped but zoned for Multi-Family (MF) Residential uses. Properties abutting to the north of the subject property are within unincorporated Rockwall County, and are largely developed with single-family residences as the Sunrise Beach Estates subdivision with lots of approximately 1/3rd acre. Properties to the south are undeveloped and within unincorporated Rockwall County. The applicant also owns the lake-fronting property to the east of the City of Garland power transmission corridor as well as the property to the south of the subject property, and is currently offering this area for sale as rural lots of 5 acres or larger. The applicant is requesting straight zoning of the subject property as two (2) separate tracts and zoning classifications. Tract 1 comprises 4.7664 acres and fronts Troy Road. This Tract is to be zoned for Neighborhood Services (NS) and developed for convenience retail goods and personal services to accommodate the population of the immediate vicinity. Tract 2 comprises 10.0033 acres and lies between Tract 1 and the City of Garland corporate strip. Tract 2 will be zoned Single-Family 1A Residential (SF 1A/26) which allows lots of one acre, although the applicant anticipates developing it in two lots of 5 acres each. All future development will comply fully with the current requirements of the Zoning Ordinance and other applicable City of Wylie codes. Approval of preliminary and final plats will be required for each Tract prior to the initiation of any development on that Tract, and nonresidential parcels will also require approval of site plans in conjunction with platting. Each Tract should be considered independently on its merits, although within the context of the overall plan for the total property. The Commission may act on the entire property or on either or both Tracts separately, as deemed appropriate. Issues: 1. As prescribed by State Law, notification of the request was published in the official newspaper of the City of Wylie, and notification was mailed to the three (3) property owners within the City of Wylie within 200 feet of the request as well as to the Commissioners Court of Rockwall County. Signs were also posted on the property. At the time of posting, six (6) Comment Forms had been returned, all opposing the requested Neighborhood Services but generally supporting the Single-Family Residential. Of these six responses, one is from property within the City of Wylie and five are from properties within the unincorporated County. Because owners of more than 20% of the land within the notification area have submitted written protests, an affirmative vote of at least three-fourths (3/4ths) of the all members of the City Council will be required to approve the requested zoning change. ZC 04-11, Troy at County Line 2. The currently-adopted Comprehensive Plan recommends that the entirety of the subject property be developed for low-density County Residential uses(with lots in excess of one acre each), and the proposed SF-1A/26 District on Tract 2 does conform to this recommendation of the Plan. However, the current Plan does not anticipate any nonresidential uses, and the proposed NS zoning on Tract 1 does not, therefore, conform to the current Plan. On the other hand, the Comprehensive Plan, intended as a general guide, recommends most of this sparsely-developed area (including the adjacent Tract within the City and already zoned for MF) as low-density Country Residential, probably because of the limited knowledge of anticipated future development when the Plan was initially formulated. The Planning and Zoning Commission is in the process of reevaluating the current Comprehensive Plan, and is prepared to recommend certain revisions to the Plan which generally reinforce and detail the philosophy of the current Plan. However, Village Center retail is identified by the Plan (and already zoned as NS) on County Line Road approximately 1,500 feet from the subject property, the proposed revisions envision the entirety of the subject property as Suburban Residential uses with lots of 10,000 to 30,000 square feet in response to this existing Center. The requested rezoning of Tract 2 to one-acre lots or larger does conform to this recommendation, but the proposed NS zoning of Tract 1 does not conform to the proposed revisions to the Plan as it is located too close to the existing retail Village Center. The Commission has also generally concluded that, in interpreting the Plan's Village Center philosophy, there should be fewer retail centers and higher residential densities. 3. If developed as recommended by the currently-adopted Comprehensive Plan, as Country Residential uses accommodating lots of at least an acre in size, the entire 14.8 acre property could accommodate 12 residential lots (assuming a lose of 20% of the land for streets). The entire 14.8 acre tract could yield approximately 26 lots if developed in lots averaging 20,000 sq. ft. according to the Suburban Residential of the revised Plan, and the 10 acre Tract 2 could accommodate 17 of the revised Plan's Suburban lots. The applicant indicates that the 10 acre Tract 2 will be divided into only two (2) lots of 5 acres each, as the neighboring property to the south are currently being sold. Neither the State nor Rockwall County require that lots of 5 acres or larger be platted, although all lots within the City of Wylie must be platted regardless of size. 4. All developments within the City of Wylie must be connected to the City's sewerage system, and the entirety of the subject property can be connected to the public system. No properties outside of the City's jurisdiction may be connected to City Sewerage, so all lots outside of the City must be served by private on-site septic systems and must be of sufficient size to accommodate such systems. Rockwall County and the City of Rowlett have endorsed the use of septic tanks for this area, but lots must generally be at least one and three-fourths (1 1/3) acres to such on-site treatment. ZC 04-11, Troy at County Line 5. The philosophy of the Comprehensive Plan dictates that Village Center retail developments should be located at least one mile apart. The Neighborhood Services (NS) zoning proposed for Tract 1 is only 1,500 feet from the parcel on County Line Road which is already zoned NS retail and identified in the proposed revisions to the Plan as the vicinity's retail Village core. Such convenience retail is also normally located at the intersection of major streets, whereas the proposed NS is not located at an intersection. However, the applicant contends that some retail uses are both appropriate to serve the immediate area and to justify the reduced number of larger lots being developed. The 4.8 acres of new Neighborhood Services proposed for Tract 1 is smaller other existing and planned retail Village Centers within Wylie, and would serve the only the needs of the limited immediate population with limited traffic generation. Other Village retail include the 14 acres zoned on County Line Road at the Pheasant Creek Addition, 18 acres planned on Troy Road within Bozman Farms, 16 acres zoned at Country Club and Park Boulevard, and 30 acres zoned at the intersection of South Ballard Avenue and Sachse/Pleasant Valley. Such retail not only serves the needs of surrounding neighborhoods but also provides increased sales tax revenues for public services. Furthermore, the existing residence at the corner of Troy Road and Sunrise Drive, adjacent to Tract 1, appears to be used already as a commercial wood- working shop. 6. The recent annexation of the subject property into the City of Wylie, and compliance with the City's development codes, provides a general upgrading of the quality of development as well as adequate sewerage and other public services. The proposed larger rural residential lots could have been accomplished without annexation into the City and at a lower cost/quality by compliance with the lesser development codes of the County. The proposed development could encourage the future annexation and improvement of the immediate area. However, some of the neighboring property is already divided and developed contrary to Wylie requirements, greatly limiting the capability for such collective actions as annexation and provision of central sewerage. 7. The limited frontage along Troy Road (approximately 350 feet), its triangular configuration, the traversing power transmission corridor, and differing governmental jurisdictions, present constraints to the development of the subject property. The proposed development into larger lots allows it to be served by rural streets and surface drainage and eliminate the need for alleys. 8. The applicant has attempted to achieve his development plan through straight zoning and application of the standard requirements of the Zoning Ordinance (rather than through a Planned Development District as many others have done). This has required additional front- end planning and better definition of the proposal and its consequences. The new flexible regulations of the Zoning Ordinance were designed to reduce if not eliminate the need for PDs in order to clarify understanding of the Zoning Map. ZC 04-11, Troy at County Line Staff Recommendation: Denial of the requested NS retail on Tract 1. The site is too close to existing NS zoning, and does not conform to the recommendations of the Comprehensive Plan. Approval of the SF 1A/26 on Tract 2. The request is consistent with the recommendations of the currently-adopted Comprehensive Plan and exceeds the recommended revisions to the Plan which allow lots of between 10,000 and 30,000 square feet.
