Consider and act upon approval of a Final Plat for the Country Ridge Phase B Addition, being all of a certain 40.2655 acre tract of land, and being a portion of the tract of land conveyed to Shaddock Developers, Ltd. as described in a deed recorded in Volume 4977, Page 1142 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the William Patterson Survey, Abstract No. 716, City of Wylie, Collin County, Texas. Capehart stated that the Final Plat is the second phase of the Country Ridge Addition, and includes 40.2655 acres and will create 132 single-family residential lots. The property is zoned Planned Development District (PD 2001-24) with a total of 312 lots, requiring a minimum lot size of 8,500 square feet and a minimum house size of 2,000 square feet. MISCELLANEOUS 1. Capehart reminded the Commissioners of the joint Work Session with City Council on May 25, 2004 2. A survey for the Population Increase, which was completed by North Central Texas Council of Governments was distributed and discussed. The survey revealed that the City of Wylie ranked 6th in the metroplex with a 22%increase. 3. An article from the Dallas Morning News, discussing reducing the lot size of Townhomes in some area cities was distributed and discussed. 4. An article from The Wylie News, ranking City of Wylie as one of the Top 100 Communities from Relocate-America was distributed and discussed. 5. Capehart gave the Commissioners a heads up on the next P & Z meeting being a long meeting due to a possibility of five Zoning Changes on the Agenda. 6. Capehart informed the Commissioners that a survey was completed regarding the fees charged to applicants for platting and zoning changes, and is being further reviewed by Staff. The survey revealed that the City of Wylie charges below the average for plat applications and zoning changes. Rice Applicant: Skorburg Company Location: Generally located west of South F.M. 544 at Elm and Vinson Roads (Within unincorporated Collin County at time of posting, but to be annexed prior to zoning by Council) Existing Zoning: To be annexed as Agriculture(A)District Requested Zoning: Creation of a Village Center Complex of varied tracts and uses, including Neighborhood Services (NS), Multi-Family Residential (MF), Townhouse Residential (TH), Single-Family 8.5 (SF 8.5/17) and Single-Family 10 (SF 10/19) Summary: The subject property is largely within unincorporated Collin and Dallas Counties and, is therefore, not subject to zoning by either the City or Counties. Annexation into the City of Wylie is to be considered by the City Council on June 8, and the property will be brought into the City of Wylie zoned as Agriculture (A) District. Agriculture is applied as a "holding" classification only until such time as appropriate urban uses are determined for the land. The annexation must be complete prior to the Council considering any action concerning the subject rezoning request, and any recommendation made by the Planning and Zoning Commission will be contingent upon the approval of the annexation. The property totals 185.145 acres, and is undeveloped farm and pasture lands (except for an older, abandoned wood frame residence to the extreme southeast of the subject property). Approximately 0.35 acre of the property and request is already within the City of Wylie, 10 acres is within unincorporated Dallas County and the remaining 175 acres is within Collin County. ZC 04-07, Rice Tract The applicant is requesting several differing classifications of straight zoning for eight (8) tracts within the overall property, in order to create a master-planned Village Center complex of mixed uses, including Single-Family detached residential (detached dwellings on 8,500 and 10,000 sq. ft. lots), Townhouse residential (attached dwellings on individual 3,000 to 3,500 sq. ft. lots), Multi- Family residential (at 15-dwelling units per acre), and Neighborhood Services retail and offices. All development will comply fully with the current requirements of the Zoning Ordinance and other applicable City of Wylie codes. Approval of preliminary and final plats will be required for each Tract prior to the initiation of any development on that Tract, and nonresidential parcels will also require approval of site plans in conjunction with platting. Each Tract should be considered independently on its merits, although within the context of the overall plan for the total property. The Commission may act on the entire property or on any or all Tracts separately, as deemed appropriate. TRACT 1 Tract 1 comprises 7.177 acres, and is located against the north boundary of the subject property, and is defined on the west and south by the proposed eastward extension of Alanis Lane. Lands surrounding this Tract are in agriculture uses, except for a relative new and larger residence on approximately 5 acres which abuts it to the north (not included within the subject property and rezoning request). This Tract is to serve as the core of the Village Center, and the request is to zone the Tract for Neighborhood Services (NS) retail and office uses (which are intended to provide convenience goods and personal services primarily to the closest proximity to residential areas). The new major intersection of Alanis with F.M. 544, both collector thoroughfares, is an appropriate location for such nonresidential uses. The proposed configuration of the Tract dictates that most of this retail development will face the new Alanis with limited buildings facing 544, and a screen wall will be required to the rear/north adjacent to the existing residence. The required engineering geometry of the Alanis roadway extension and its route through the abutting property to the north influence the general size and configuration of Tract 1, and proposed alignment allocates a rather large area and deep lots for convenience retail uses. General Planning philosophy recommends that neighborhood retail centers, intended primarily to serve the convenience needs of the population within their immediate vicinity, be 5 acres or smaller in size. Within Wylie, other NS-zoned tracts vary greatly in size: West F.M. 544 at Springwell Parkway is 3 ac.; F.M. 1378 at Park Boulevard is 5.3 ac.; South Ballard at Alanis is 12.6 ac.; and County Line at the Pheasant Creek Addition is 15.4 ac. Planning philosophy also recommends that approximately 5% of a community's total developed land be allocated to commercial uses, and about 5% of Wylie's total area is zoned for such retail/offices use. The total 8.9 acres allocated to Neighborhood Services zoning within the subject property and request represents approximately 4.8% of the total 185 acres. ZC 04-07, Rice Tract A site plan must be submitted for approval by the Planning and Zoning Commission concurrent with the submittal of any preliminary plat(s) for nonresidential zoning such as is requested for this Tract. As straight NS zoning is requested, the site plan must illustrate full compliance with the basic and incentive regulations of the Zoning Ordinance. TRACT 1 A Tract 1A is a 1.4-acre parcel located in the southwest quadrant of the intersection of 544 and the future extension of Alanis Lane, across Alanis to the south from the 7-acre retail Tract 1. Tract 1A is requested to be rezoned to Neighborhood Services (NS) District, to accommodate convenience retail and personal services to serve the adjacent residential developments. This will serve as the Village Center core of the proposed development, in conjunction with Tract 1. These Tracts together total 8.9 acres, which is within the generally recommended ratio of commercial to the overall acreage of the proposal (ie; +/- 5%). The intersection of major thoroughfares, F.M. 544 and the future Alanis, is an appropriate location for such nonresidential uses. A site plan, illustrating full compliance with the requirements of the Zoning Ordinance, must be approved by the Planning&Zoning Commission in conjunction with the preliminary plat. TRACT 2 Tract 2 comprises 14.468 acres, and is located in the northwest corner of the subject property. The new extension of Elm Drive will form the south boundary of this Tract, and the Alanis extension will serve as it north boundary. It is requested that this Tract be zoned Townhouse (TH) District. The TH District allows only attached single-family dwellings (from duplexes to as many as seven connected units) each on individual lots. The Comprehensive Plan recommends that higher-density residential uses, such as the proposed townhouses, apartments and smaller SF 8.5 lots, be located within walking distance (1,500 feet) of the convenience Village Center retail (the Neighborhood Services of Tracts 1 and 1A), and the proposal complies with this recommendation. The required individual lots of the proposed Townhouse zoning will require public streets at regular block-length intervals (requiring approximately 20% of the developed land), and the standard Townhouse regulations can accommodate as many as 13 dwelling units per acre. The developable portion of the subject Tract could, therefore, accommodate as many as 150 TH dwellings. The recently completed Villages Townhouse complex on Fleming Drive, with 131 lots and dwellings on 16.8 acres is comparable to the development proposed for Tract 2. The Birmingham Farms Phase 2A Addition provides 126 duplex lots and dwellings as well as common open space on 25.6 acres under previous zoning which required larger lots for such attached dwellings. The platting process will serve as the site plan review to verify compliance with the basic and incentive regulations of the Zoning Ordinance. ZC 04-07, Rice Tract The legal description provided by the applicant indicates that the western boundary of the subject property, especially in the vicinity of Tract 2, reflects a potential boundary conflict. This discrepancy must be reconciled prior to approval of a preliminary plat. The properties surrounding Tract 2 are currently undeveloped farmsteads, except for the offices and water storage facilities of the East Fork Special Utility District which abut the Tract to the southwest. The remaining Tracts of the subject request border this Tract to the north, east and south. TRACT 3 Tract 3 is located in the northeastern portion of the subject property, bounded on the east by the existing South F.M. 544, on the north by the future extension of Alanis Lane and on the south by the new Elm Drive. This Tract is 16.832 acres in size. A major electric transmission line occupies approximately 2.3 acres (200 feet in width easement) of the Tract, but this joint- ownership land can be used to some limited extent for parking and open space/recreation for the proposed development. Tract 3 is to be zoned Multi-Family (MF) Residential District, and will accommodate only attached dwellings on a single common lot as apartments for lease. The standard MF requirements of the Zoning Ordinance dictate the such developments may not exceed 15 dwellings per acre, and the remaining developable 14.5 acres of this subject Tract (16.8 ac. less the 2.3 ac. within the electric transmission easement) could, therefore, accommodate as many as 215 dwelling units. The proposed location, adjacent to the Village retail and major thoroughfares, is appropriate for such higher-density residential development. This request is comparable to other MF apartments within Wylie: Cascades is 189 units on 12 ac.; Bachon has 120 units and nearly an acre of drainage easement on 14 acres; and the future MF within the Bozman Farms PD can be 250 units on a yet to be determined specific site and acreage. The applicant has discussed with the Wylie Independent School District the potential of providing a 13-acre school site within Tract 4A, preferably near a major intersection of F.M. 544, and the applicant is proposing a school site for Tract 4A. However, the Comprehensive Plan considers schools to be more appropriately a companion with retail uses within a Village Center, such as those of Tract 1 and 1A. Locating the school site within Tracts 2 and/or 3 will also serve to reduce the higher-density TH and MF uses proposed for these Tracts. A school site has already been identified across F.M. 544 within the Bozman Farms development, and no specific decision has as yet been made by WISD concerning the subject site. A site plan must be approved in conjunction with the platting, to confirm compliance with the regulations of the Zoning Ordinance. ZC 04-07,Rice Tract TRACT 4A Tract 4A is the largest single division of the subject request, at 72.225 acres. It is located along the eastern and southern boundaries of the property: bounded on the east by F.M. 544; on the north by future Alanis extension; and on the south by Twin Creek Drive. A section of the major electric transmission corridor (which cannot be fully developed) and the existing Elm Road corridor (to be relocated and redeveloped) transect this Tract on the north. Approximately 5 acres of this Tract is within unincorporated Dallas County. The applicant has discussed with the Wylie Independent School District the potential of providing a 13-acre school site within Tract 4A near the intersection of F.M. 544 and Elm. However, the Comprehensive Plan considers schools a more appropriate companion to the retail uses of Tract 3 within a Village Center. The legal description provided by the applicant, as illustrated on the Zoning Exhibit, indicates that the southeastern boundary of the subject property and of Tract 4A crosses Vinson Road, rather than parallel its north line as anticipated. This potential boundary conflict must be reconciled prior to approval of a preliminary plat. Tract 4A is bounded on the east (across F.M. 544) by rural homesteads of 2 acres and larger, including the Creekside Estates subdivision, within unincorporated Collin County. To the southeast (across Vinson) is the developing Redwood-by-the-Lake mobile home subdivision, and to the southwest is the Twin Creek Ranch Estates rural subdivision on one-acre lots within unincorporated Dallas County. This Tract is requested to be zoned for Single Family-8.5 (SF-8.5/17) Residential District, in full compliance with the current requirements of the Zoning Ordinance. Assuming the 13-acre reduction for a school and approximately 20% of the area will be needed for streets, this Tract could yield as many as 242 single-family lots and dwellings. The northern and southern portions of this Tract lie within the 1,500 feet distance from the two proposed retail/office Village Centers (Tracts 1/lA and 6), as required by the Zoning Ordinance and Comprehensive Plan. However, at least 8 acres across the center of Tract 4A (and as much as 15 acres if measured from Alanis, and assuming the school site to be adjacent to the retail rather than within 4A) are outside of this 1,500 feet distance. The Zoning Ordinance recommends lower-density Suburban Residential Districts (with lot sizes of between 10,000 sq. ft. and one acre) beyond the 1,500 feet distance from Village Centers, and the draft revisions to the Comprehensive Plan proposed by the P&Z Commission also recommends that much of this area to the center of the subject request be Suburban Residential (with lots at least 10,000 sq. ft.). It should be noted, however, that this central area in question may be too narrow (at 200 ft. if measured from Tract 1A to 500 ft. if measured from the new Alanis and Tract 1) for efficient design of the larger lots as the legal interpretation of the Plan and Ordinance recommends. ZC 04-07, Rice Tract TRACT 4B Tract 4B includes 21.819 acres in the southeastern portion of the property, bounded by F.M. 544 and Vinson. This Tract is to be rezoned to Townhouse (TH) District, allowing any arrangement of attached dwellings on individual lots. The Tract is adjacent to the southern Village Center retail/office services (Tract 6), which is an appropriate location. Assuming 20% of the Tract is required for public streets, the remaining 17.5 acres could accommodate approximately 227 lots and attached dwellings(at 13 units per acre). The approval of a site plan and plats will be required for this Tract prior to development. The disputed southern boundary of the overall subject property and subject Tract must be reconciled prior to platting. TRACT 5 Tract 5 is located in the southwestern portion of the subject property. This Tract totals 50.929 acres, and is partially occupied by the major electric transmission corridor. The extreme southwestern corner of the Tract abuts Cottonwood Creek and is isolated from the remainder of the Tract by the electric easement which restricts development, and the applicant has expressed the intention to dedicate approximately 18.6 acres in this area for public park and open space. The requested rezoning of this area is to Single Family-10 (SF 10/19) Residential District. Assuming the 20% (6.5 acres) for streets, in addition to the promised 16.8 acres of open space, the remaining 25.8 acres could accommodate approximately 112 lots of 10,000 sq. ft. each. The abutting properties to the north of Tract 5 are within unincorporated Collin County and are not platted but are developed in large rural homesteads of 3 to 6 acres each. Properties to the south are within unincorporated Collin County and developed large rural homesteads (larger than 5 acres) and the one-acre lots of the platted Twin Creek Ranch Estates subdivision. TRACT 6 Tract 6 is a 0.349 acre site defined by the intersection of Vinson and County Line Roads, and is actually already incorporated within the City of Wylie and already zoned for Neighborhood Services(NS)retail and office uses. The property abutting this Tract to the south is within Wylie's corporate limits and is already zoned for Manufactured Housing (MH) District, and has been platted for the expansion of the existing Redwood-on-the-Lake Mobile Home Park and subdivision. Adjacent properties to the east, across County Line Road, are within unincorporated Dallas County and are currently undeveloped. ZC 04-07, Rice Tract Issues: 1. As prescribed by State Law the request was published in the official newspaper of the City of Wylie (section 211.006.a of the Texas Local Government Code) and comment forms were mailed to property owners within Wylie within 200 feet of the request (Section 211.007.c) of the Texas Local Government Code). The Commissioners Courts of Collin and Dallas Counties were also provided written notices, and signs were posted on the subject property. At the time of posting, five (5) Comment Forms from properties outside of the City within unincorporated Dallas County have been returned, all opposing the request. 2. The currently-adopted Comprehensive Plan recommends that approximately the southern two-thirds of the subject property be developed as medium-density Suburban Residential uses (accommodating lots of 10,000 square feet or larger) and that the northern one-third be developed as low-density Country Residential (with lots in excess of one acre each), and the Plan does not anticipate any higher-density residential or nonresidential uses. The proposed rezoning does not conform to these recommendations of the current Plan. However, the Planning and Zoning Commission is in the process of reevaluating the current Comprehensive Plan, and is prepared to recommend certain revisions to the Plan. These changes, which are scheduled to be considered by the City Council on May 25, will reinforce and detail the general philosophy of the current Plan, and include a new Village Center at the approximate location as that proposed by the subject rezoning and the adjustment of Planned residential densities accordingly. However, the philosophy also continues to recommend that the higher-density Village Residential Districts (MF, TH and SF-8.5)be confined to no further distance than 1,500 feet from the retail/office core, and that areas between 1,500 and 3,000 feet be zoned for Suburban Residential (Sf-10 to SF-30). The proposed rezoning does not, therefore fully conform to the proposed revisions to the Plan. 3. If developed as recommended by the currently-adopted Comprehensive Plan, with approximately 2/3 Suburban Residential and 1/3 Country Residential, the 185-acre subject property could yield approximately 358 single-family lots and dwellings. If developed as proposed by the requested zoning, the property could accommodate as many as 731 single- family lots, including 354 lots and 377 attached Townhouse lots. With the 215 apartments, the proposal would yield a total of 946 dwellings. The addition of the 8 to 15 acres of 10,000 sq. ft. lots (extending the SF-10 Tract 5 toward the east to split Tract 4A could reduce the proposed density somewhat and bring the proposal into closer conformance with the recommendations of the Comprehensive Plan. 4. The proposal provides for the improvement of several thoroughfares, including the extension of Alanis and Elm Drives and the improvement to old South F.M. 544. The enhancement of these east-west corridors will provide relief to traffic congestion along South F.M. 544, which is currently the only major route completely through of this area. ZC 04-07, Rice Tract 5. The Village Center of the proposal generally conforms to the historic philosophy of the Comprehensive Plan as well as the revision to the Plan as recommended by the Planning and Zoning Commission. The proposed new 21.6-acre Center (including 8.6 acres of retail and the 13-acre school site) is comparable to other existing and planned Village centers within Wylie: including the 36 acres at F.M. 1378 and Park Boulevard for Dodd and its retail; 32 acres for Birmingham and neighboring retail; and 18 acres planned for the school and retail within Bozman Farms. The retail will not only serve the surrounding neighborhoods but also provide increased sales tax revenues for public services. 6. With the proposed rezoning pattern, the applicant has made an excellent attempt both to honor the City's desire to comply with standard requirements of the Zoning Ordinance and still achieve the applicant's goal of obtaining the highest possible lot/dwelling yield (and, therefore economic return). However, when compromises between the two goals is required, the applicant (as expected) has opted in favor of higher densities and smaller lots. Closer compliance to the Comprehensive Plan and Zoning Ordinance would be achieved by a smaller, more compact Village Center with the elimination of Tract 1 A and placing the school in Tracts 2 or 3, thereby allowing larger lots to the center of Tract 4A. 7. If the subject property is developed with the lot sizes anticipated by this subject request, achieving approximately 731 single-family detached and attached lots, the required park land dedication will equal 36.6 acres as well as funds for the apartments and retail acreage. This public parkland would be identified and dedicated in smaller sites by the platting of each residential subdivision. The applicant has indicated that the 16.8 acres within Tract 5 which are isolated by the electric transmission corridor will be dedicated as public park, and that improvements such as off-street parking, trails and a gazebo will be provided as partial fees. There is no floodplain within the subject property, and except for the transmission easement (which cannot count toward park dedication but can accommodate a linear trail), all of the land appears suitable for park use. The Park Board has generally endorsed this concept. 8. The annexation and development of the subject property to higher standards of the City of Wylie provides adequate sewerage and other public services as well as a general upgrading of the quality of development. The proposal could encourage the future annexation and improvement of the immediate area. However, much of the neighboring property is already divided and developed (often contrary to Wylie requirements), greatly limiting the capability for such collective actions as annexation and provision of central sewerage. 9. Although the legal description of the overall subject property as well as the individual Tracts does close geometrically, the survey identifies potential conflicts of ownership along the exterior boundary in at least two locations (the western boundary north of the Elm Drive curve and along the south boundary fronting Vinson Road). These discrepancies must be reconciled prior to platting, and may require legal action or arbitration. ZC 04-07, Rice Tract 10. The surrounding property, although within unincorporated Collin and Dallas Counties, has historically developed as larger rural homesteads, and contrary to the subject zoning request. The proposal does not, therefore reflect the character of existing development. However, these larger rural lots are also required primarily in order to accommodate the septic sewerage systems on individual lots, because of the previous unavailability of a central sewage treatment system. On-site septic is increasingly becoming inadequate to treat even such clusters of rural housing, and quality sewage treatment facilities are increasingly important especially those located within the drainage basins of the water supply of the Dallas Metroplex communities. Adequate sewage treatment through the City system is now available within a reasonable distance of the subject property and the proposed development will be incorporated into Wylie's system. It is increasingly important that human developments obtain quality sewage treatment, especially those located within the drainage basins of the water supply of the Dallas Metroplex communities. The annexation and development of the subject property may encourage improvements to neighboring properties and even ultimately the annexation and urbanization of the areas with adequate utilities. 11. The applicant has attempted to achieve his plan through straight zoning and application of the standard requirements of the Zoning Ordinance (rather than through a Planned Development District as many other larger tracts have been done). This has required additional front-end planning and better definition of the proposal and its consequences. The new flexible regulations of the Zoning Ordinance were designed to reduce if not eliminate the need for PDs in order to clarify understanding of the Zoning Map, and the subject request is one of the largest acreages to be rezoned by straight zoning rather than PD. Staff Recommendation: Approval. The proposal closely replicates the historic philosophy of the Comprehensive Plan of decreasing residential densities around Village service centers, and generally conforms to the Planning and Zoning Commission's recommended revisions to the Plan. However, closer conformity to the Comprehensive Plan and adherence to accepted ratios of residential to commercial land uses might be achievable by the elimination of Tract 1A and the addition of some 10,000 sq. ft. lots within Tract 4A through the eastward extension of Tract 5 (especially if the school does not materialize). This facility will accommodate the relocation of the Bayco Corporation into Wylie as well as provide a public open space connector along Muddy Creek. The subject property totals approximately 11.076 acres, the majority of which is floodplain. It includes the land abutting to the rear/west as well as the north of the existing Southern Fastening Systems facility on Sanden Boulevard. The subject property will be divided into two tracts: Tract One is approximately 8.285 acres to the north and will be platted to accommodate the future development of the Bayco facility; and the remaining 2.791 acres will be added to the Southern Fastening Systems property on the south. Rezoning 04-09 -Bayco The Bayco Corporation proposes to initially construct a single building of 99,439 square feet; 8,764 square feet of which will be office space and 90,675 square feet will be warehouse. A strip of public open space approximately sixty feet wide will be dedicated along the western property line of the subject tracts, and will be dedicated to the City of Wylie to accommodate a recreational trail. The property on which the Southern Fastening Systems facility is currently located was zoned Business Center (BC) in January of 2002. All other neighboring properties are zoned Agriculture (A). On the current agenda is a request to rezone the abutting property to the north from Agriculture to Corridor Commercial (CC). Properties to the east across Sanden are zoned BC and are developed by the requirements of the previous Industrial (I)District with self-storage mini-warehouses and an entertainment facility. Issues: 1. Public Comment Forms were mailed to eight (8) property owners within 200 feet of this request. One (1)Comment Form has been returned at time of posting, favoring the request. 2. The current-adopted Comprehensive Plan recommends that the subject property be developed for Business Center(BC)uses. Light assembly and fabrication are allowed within the BC District, and the proposed rezoning conforms to these recommendations. The Planning and Zoning Commission is in the process of reevaluating the current Comprehensive Plan, and is prepared to make certain revisions to the Plan which are to be considered by the City Council on May 25. These recommended changes will completely eliminate the BC District and convert such existing zoning to other appropriate uses, including the subject property to become Industrial, and Bayco's fabrication of lighting fixtures also conforms to the revised recommendations. 3. The majority of the property is currently occupied by the 100-year floodplain. However, a Certified Letter of Map Revision (CLOMR) was submitted to the Corps of Engineers on April 7, 2000 proposing to reclaim the portion nearer to Sanden Boulevard on which the proposed building and parking will be located. 4. The remaining floodplain to the rear of the development will remain undeveloped, and a sixty feet wide strip along the east side of Muddy Creek will be dedicated to the City as public open space for the purpose of constructing a hike and bike trail in the future. Rezoning 04-09 - Bayco 5. The accompanying Development Plan will serve as an approved Site Plan and Preliminary Plat and satisfies all of the Zoning Ordinance Base Standard Design requirements as well as the incentive points for the Desirable Design Attributes. A Final Plat must be approved prior to initiation of construction. 6. Designed to current regulations of the Zoning Ordinance, the proposed facility will provide sufficient compatibility to any commercial or light industrial uses which may occupy the neighboring sites in the future. Planning and Zoning Commission Meeting: May 18, 2004 Owner: Richard Parker Applicant: Wylie Economic Development Corporation Location: Generally located south of FM 544 and west Sanden Boulevard Existing Zoning: Agriculture(A)District Requested Zoning: Corridor Commercial (CC)District Summary: The Wylie Economic Development Corporation, acting on behalf of the landowner, is requesting initial zoning from Agriculture (A) District to Corridor Commercial (CC) District for as yet undetermined commercial uses. The WEDC plans to market the property in order to attract new businesses to Wylie. The subject property totals approximately 28.376 acres, the majority of which is occupied by the floodplain of Muddy Creek and undevelopable. However, a significant portion of the floodplain has already been reclaimed (with approval of the U. S. Coorps of Engineers), thus opening the property to development. The subject property is the remainder of a larger 34.412 acre tract, of which 11.076 acres has been recently sold to the Bayco Corporation which is being relocated to the City of Wylie by the WEDC. A request to rezone that 11 acres is also on the current agenda for consideration. No site plans have been submitted with this subject rezoning. A Site Plan must be submitted for approval with each future plat on the property. Rezoning 04-10-WEDC Abutting properties to the south are zoned Business Center and are developing for light industrial uses. The properties to the north, across F.M. 544 are currently zones Agriculture and undeveloped, but are recommended by the Comprehensive Plan to become Corridor Commercial uses. Issues: 1. Public Comment Forms were mailed to twelve (12) property owners within 200 feet of this request. No Comment Forms have been returned at time of posting. 2. The current-adopted Comprehensive Plan recommends that the subject property be developed for Business Center (BC) uses. The BC District is intended to accommodate light industry and clean manufacturing/assembly with limited subordinate/supporting offices and convenience retail in large campus settings, and the proposed rezoning to commercial uses does not conform to these recommendations. However, the Planning and Zoning Commission is in the process of reevaluating the current Comprehensive Plan, and is prepared to make certain revisions to the Plan which are scheduled to be considered by the City Council on May 25. These recommends include eliminating the BC District and converting such to Industrial or other appropriate uses. The proposed rezoning does not conform to these revised recommendations as well. The applicant contends that the proposed Corridor Commercial (CC) District is more compatible to development trends within the immediate vicinity and because the subject property is located on a major traffic thoroughfare corridor. 3. A Certified Letter of Map Revision (CLOMR) has been submitted to the U.S. Corps of Engineers to request reclamation of additional portions of the Muddy Creek floodplain. It is anticipated that as much as 60% of the site can become available for future development to development. 4. The property is located at the intersection of F.M. 544 and Sander, and has frontage/access and visibility from both of these major thoroughfare corridors. The property is of sufficient size to accommodate a variety of uses in the future, and designed to the development regulations of the current Zoning Ordinance, the proposed Corridor Commercial (CC) uses can provide greater compatibility to neighboring developments than will the Industrial uses recommended by the revised Comprehensive Plan or the convenience goods and personal services of the Neighborhood Services District which such thoroughfare intersections are normally zoned. But the property must be carefully master planned before dividing into smaller parcels in order to assure that commercial developments to the rear of the tract is provided sufficient visibility and traffic access for the abutting streets. Rezoning 04-10 -WEDC Staff Recommendation: Approval. The proposed traffic-oriented uses are compatible with the location of the tract, adjacent to the intersection of major corridors. I( I = 59° ZONING CASE #2004- 1 0 Subject: Mall and Road Construction Update - May 6, 2004 Hi everyone! It has been awhile since my last update. I wanted to take some time to bring everyone up to speed. So far signed up in the mall are: Dillard's Foley's AMC Theater (16 screens) Barnes and Noble Linen's & Things Circuit City Old Navy The Gap As well as many other name brand stores found at other surrounding malls (this is all of the information that 1 can disclose at this time... but stay tuned!!!) In the surrounding area is: Best Buy Bed, Bath & Beyond Restaurants onsite at the mall are: (There has been a revision) Macaroni Grill Bone Daddy's TGI Friday's Rockfish Additional Restaurants: On the Border P.F. Changs (searching for a site for Pei Wei their fast/casual concept) Big Bowl (Brinker Restaurant) If you would like to see the "MallCam" (on-site webcam taking video of the mall construction) or you would like to see a slideshow of the construction, go to the city website at: www.ci.garland.tx.us and go to the Firewheel Town Center page. There has been a considerable amount of construction completed that cannot be seen by driving by the site. For instance the pouring of piers for building pads has begun for the first four buildings (north end of site). The slideshow shows some of this construction. Mall Roadway Construction: Northeast Parkway will be the "ring road" around the mall. Where you see the big barrier rail currently is where Northeast Parkway will be diverted. 190 will then go underneath the Northeast Parkway extension. For those that were wondering how we were going to separate the two roads hopefully this helps. 190 will then head Northeast and go into Sachse and will then go south through Rowlett and then will come back to Garland along Forest Creek Drive and then access 1-30. Construction for the 190 extension is scheduled to be completed by 2008. Naaman School Road Project From SH 78 to Crist, it will be expanded to a four-lane roadway with a continuous left turn lane to accommodate all the commercial driveways. From Crist to Pleasant Valley it will be expanded to a four-lane roadway with a median and left turn lanes at cross streets. Campbell Road Construction -To be completed by August 2004. North Garland Road Construction —To be completed before the end of 2004. If anyone has any other questions please let me know.
