CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the January 6, 2004 Regular Meeting. A motion was made by Commissioner Porter, and seconded by Commissioner Hughes,to approve the minutes with changes on page 5, the last sentence to correct by stating "Allow for smaller areas of 1+ acre lots, and make these higher quality homes." Motion carried 5 —0. P & Z Commission Meeting January 20, 2004 Page 2 of 2 ACTION AGENDA 1. Consider a recommendation to the City Council regarding a Final Plat for the Creek Hollow Addition, being all of a certain 53.606 acre tract of land, generally located west of Westgate Way and north of F.M. 544, said tract of land being comprised of two parcels described in deeds to Creek Hollow-Wylie Lot Option, L.P., recorded in Volume 5474, Pages 8959 and 8967 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the E.C. Davidson Survey, Abstract No. 266, City of Wylie, Collin County, Texas. Thompson stated that the subject property totals 53.606 acres, and will create 200 single- family residential lots, 8 common areas/open spaces to be owned and maintained by the Homeowners Association and one public park. The property is zoned Planned Development (PD 2003-13), which limits the number of residential lots to a maximum of 200 and modifies the requirements of the Single Family 8.5/17 District to allow 7,000 square foot lots, with 1,600 square feet dwelling sizes. Exterior walls will be a minimum of 75% masonry except all walls having street frontage shall be 100% masonry and any dwelling adjacent to Westgate Way shall be single story and 100% masonry exterior. Commissioner Byboth questioned the dedication of Westgate Way right-of-way. Thompson stated that there is no additional right-of-way dedication by the Plat, as Westgate Way is already built. A portion of Westgate Way obtained right-of-way by a deed and part has never been officially dedicated or deeded to the City. Commissioner Porter questioned the location and access of the park. Thompson stated that on the Concept Plan approved with the zoning there was proposed a park along the railroad to the south as well as the north adjacent to the floodplain. The Final Plat dedicates the park on the north, as well as access to the park to be located between lot 12 and lot 13 of Block B. Rob Adams, Adams Engineering, 500 Nolen Drive, Suite 550, Southlake, Texas, represented as the engineer for the proposed development, stated that Legacy Homes is the homebuilder and twenty-five percent of the lots will have side entry garages. The same house plan will not be built on lots side by side or directly across the street. The exterior screen wall along Westgate Way will be a seven foot high with brick columns. The entire west side of the property will be screened with iron fence. Landscaping in the entry median as well as along the screen wall will be maintained by the homeowners association. P & Z Commission Meeting January 20, 2004 Page 3 of 3 Commissioner Spillyards questioned the aesthetic plan entry to the park. Mr. Adams stated that this will be a twenty foot wide right-of-way with a concrete linear trail. There is a second entry on the far south side adjacent to the railroad tracks by a twenty-foot access easement to the park. Thompson stated that the ordinance does require land in a development to be dedicated as park land or funds in lieu of land. A minimum of one and half acres can be dedicated as park land, and the requirement recently was increased to five acres. The Park Advisory Board has accepted the proposed parkland open space. A motion was made by Commissioner Porter, and seconded by Commissioner Hughes, to recommend to the City Council approval with recommendation to the Park Board that emphasis placed on parking. Motion carried 5 —0. 2. Consider proposed revisions to the Comprehensive Map and possible recommendations to the City Council. Thompson reviewed with the Commission their previously proposed revisions for the Comprehensive Map. The City Council discussed the Plan and generally accepted the Commissions' recommendation to reduce the amount allocated to larger lots and recommended expansion into the extraterritorial jurisdiction areas especially up the eastern side of Lake Lavon. Location: Generally located west of Westgate Way and north of F.M. 544 Existing Zoning: Business Center(BC) Summary: The Site Plan under consideration is for an automated bank teller machine (ATM) facility. The subject tract totals 14,833 square feet (0.340 acre). The facility consists of an ATM kiosk building of 57 square feet standing 10.5 feet tall, as well as an access drive, parking and landscaping. A Preliminary Plat creating the lot of record is also on the current agenda for consideration. Lot 1 of the American National Bank Addition No. 2 is for future retail development, and the subject ATM facility will be developed on Lot 2. Section 8.1.D of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning and Zoning Commission for any development within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, accommodation of sensitive environmental issues, safe and efficient vehicular and pedestrian circulation, and provision of supporting utilities and other services, and site plans shall contain sufficient information related to existing site considerations as well as the proposed site design and development characteristics. Site plans shall serve as part of the zoning for the property, and changes in site plans shall constitute a change in the zoning. No development shall occur or building permit approved for the property, which does not conform to the approved site plan. Site Plan — American National Bank ATM Facility Issues: 1. The proposed Site Plan for the American National Bank ATM facility complies with the Nonresidential Design Standards of Section 4.4 of the Zoning Ordinance and all other applicable codes and ordinances of the City of Wylie. 2. A tabulation of how the project will comply with the flexible development requirements of the Zoning Ordinance is included on the Site Plan. 3. The Plan provides for common access between the subject ATM development and the adjacent Lot 1, this joint access easement also serves as a fire lane for emergency vehicle access. Location: Generally located west of Westgate Way and north of F.M. 544 Existing Zoning: Business Center(BC) Summary: The Preliminary Plat under consideration will create 2 lots totaling 1.730 acres. Lot 1 is 1.390 acres in size and will be developed in the future for as yet undetermined retail uses.. Lot 2 is 0.340 acre in size and will be developed immediately as the American National Bank automated teller machine (ATM) facility. Joint access is provided between the two lots. A Site Plan for the bank facility is also on the current agenda for consideration. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Preliminary Plat — American National Bank Addition No. 2 Issues: 1. The proposed Preliminary Plat for the American National Bank Addition No. 2 complies with the Subdivision Regulations and all other pertinent code requirements of the State and City of Wylie. 2. No additional right-of-way for the expansion of either Westgate Way or F.M. 544 is required by this plat. A joint access easement that also serves as a fire lane provides public and emergency vehicle access to both lots. Financial Considerations: Plat application fees—Paid The applicant is aware that park dedication fees must be paid prior to filing of a final plat for this property and development impact fees must be paid prior to issuance of a building permit. Staff Recommendation: Approval.
