ACTION AGENDA
1. Consider a recommendation to the City Council regarding a Preliminary Plat for
the Ambers Cove Addition. Subject property being all of a certain 12.290 acre
tract of land described in a deed to George F. Ketch, as recorded in County
Clerk's File Number 97-0017475, Deed Records of Collin County, Texas, and
being situated in the L. B. Outlaw Survey, Abstract No. 676, Collin County,
Texas, and the Nathaniel Alterberry Survey, Abstract No. 1099, Collin County,
Texas.
Thompson stated that the Preliminary Plat will create six (6) single-family residential lots
exceeding 2 acres each, and dedicates half of the right-of-way for the existing Troy Road.
The property is not within the city limits, but within unincorporated Collin County, and
will conform to County codes. The property cannot yet be annexed because it is not
contiguous to any property now within the City.
Bill Boyd, 2517 McDearmon, Sachse, Texas, represented as the applicant, stated that
deed restrictions require that exterior walls be at least 75% masonry and single-story
residences must be at least 2,200 square feet of living area. A septic system will be used
in the subdivision, however, the deed restrictions require that homes tap into the City
sewer system within 90 days when available.
The Commissioners and Mr. Boyd discussed the access to lots behind lot 6 of the subject
property. Mr. Boyd agreed to submit documentation of communication with the owner of
the lots, Mr. Martinez, regarding mutual access easement on the referenced lots as part of
the Final Plat.
A motion was made by Commissioner Hughes, and seconded by Commissioner Larson,
to recommend approval to the City Council with stipulation that documentation be
provided in reference to mutual access easements on lots behind Lot 6. Motion carried 6
—O.
PUBLIC HEARINGS
1. Hold a Public Hearing and consider a recommendation to the City Council
regarding an amendment to the Zoning Ordinance defining and regulating body
piercing and tattooing establishments.
Thompson stated that the Council has requested clarification and regulation of body
piercing and tattooing, therefore requiring an amendment to the Zoning Ordinance. The
proposal denies such operations as State Law defines them, and allows them to be located
only within the Industrial District.

The Commissioners discussed with Thompson the medical clinics which are exempt by
State Law, and the feasibility of exempting medical clinics from City Ordinance as well.
It was general decided not to address exceptions for medication practices until specific
requests are made in the future.
Commissioner Hennesey expressed concern of congregating such establishments within
the Industrial District, which could then allow other such similar uses and creating an
entire area on the outskirts of town full of these uses instead of more appropriate
Industrial commercial uses. He would rather such questionable uses be located along
State Highway 78 where they are highly visible and can be better policed.
Chairman Seely opened the Public Hearing and with no one wishing to speak, Chairman
Seely closed the Public Hearing.
A motion was made by Commissioner Byboth, and seconded by Commissioner Larson,to
recommend approval of the submitted amendment of the Zoning Ordinance to City
Council regarding the tattoo and body piercing establishments located in Industrial
District only. Motion carried 5 — 1, with Commissioner Hennesey voting in opposition.
ADJOURNMENT
A motion was made by Commissioner Hughes, and seconded by Commissioner Byboth,
to adjourn the meeting at 7:54PM.

Summary:
The applicant is requesting a Special Use Permit (SUP) in order to attach a tower to his existing
single-family residence for the operation of an amateur radio station. The new tower/antenna will
replace three connected monolithic poles with stationary wire antenna currently attached to the
residence and fence. The new tower will be attached to the rear roof-line of the residence. The
tower will be thirty(30) feet high and will be tubular truss construction. The antenna will be a 28
feet wide grid constructed of four 1.5 inch metal tubes.
The subject property was created in 1986 by the platting of the Westgate Phase I Addition, and
the subsequent construction of the applicant-owned single-family residence. At the time the
residence was built the property was zoned Single Family-3 (SF-3) District, but the zoning was
changed to Single Family-8.5/17 (SF-8.5/17) District in November of 2001 with the adoption of
the City-wide revisions to the Zoning Ordinance and new Map. Both the previous and current
Ordinances allow amateur radio transmission antennas within residential districts only with an
approved Special Use Permit.

The Federal Communications Commission (FCC) ultimately controls the operation of individual
amateur radio communicators as well as the limits which local governments such as Wylie may
restrict such operations. PRB-1, adopted in 1985, states that the FCC "will not specify any
particular limitations beyond which a local government may not regulate, nor will the FCC
suggest precise language that must be contained within local ordinances. Local regulations which
involve the placement, screening or height of antennas based on acceptable health, safety and
aesthetic considerations must also be crafted to reasonably accommodate amateur
communications, and to represent the minimum practicable regulation to accomplish the local
authority's legitimate goals and purpose."
Section 5.2.J.7 of the Zoning Ordinance requires an approved Special Use Permit (SUP) for the
construction and operation of such amateur communication towers/antennas within the Single
Family-8.5/17 District. The Ordinance also limits such towers to one (1) per lot, the height of
which may not exceed seventy-five (75) feet. The Ordinance states that such towers may not be
located within any front, side or rear setbacks. Single antennas may not exceed 900 square feet
and multiple antennas may not total more than 1,400 square feet
The Zoning Ordinance allows consideration of a Special Use Permit (SUP) for certain uses within
certain districts as a means to more carefully and specifically evaluate the effects of certain uses
on surrounding properties or when necessary to establish for such uses in such locations any
special conditions which insure that the use is more compatible and consistent with the character
of adjacent properties than that use may be normally in other locations. An SUP does not change
the zoning but overlays the existing zoning with site-specific and limited additional uses and
regulations. The Planning and Zoning Commission and City Council shall evaluate a request for
an SUP to determine its probable effect on adjacent properties and the community as a whole, and
may impose any reasonable conditions for the granting of an SUP. Failure at any time to comply
fully with the approved Conditions of the SUP will result in the cancellation of the Certificate of
Occupancy.
Issues:
1. Public Comment Forms were mailed to thirty-two (32) property owners within 200 feet of this
request. Four (4) Comment Forms have been returned at the time of posting, two opposing
and two favoring the request. The responses allow a simple-majority decision by the
Commission.
2. All surrounding properties are zoned SF-8.5/17 and are fully developed as such urban-density
residences. This existing pattern is also in compliance with recommendations of the
Comprehensive Plan. The neighborhood is stable, and is expected to maintain its residential
uses and character as it ages. The subject residence is single-story masonry, but neighboring
houses are a mixture of single- and two-story.

3. Amateur communications towers/antennas require approval of a Special Use Permit (SUP)
because such towers have the potential to adversely effect the surrounding land uses,
especially in regards to the visual or aesthetic impact of the transmission equipment and
interference with the receiving capability of other communications equipment within the
vicinity.
a. The potential for towers and antennas to obstruct views and become an annoyance
aesthetically depends directly on how visible the tower is from neighboring properties,
and, therefore, is determined by the tower's location, height and structural materials. The
proposed tower will be located in the rear yard and attached to the roof overhang of the
house. The top of the tower and antenna (at 30 feet maximum) will be approximately 4
feet higher than the peak of the house roof(26 feet), so will be largely screened by the
roof from the front yard/street-level. The tower will be an open truss construction with
legs/stanchions spaced 14 inches apart, which will provide through visibility and will blend
with the existing residence. It will replace a three-pole antenna which encircles the rear
yard (one pole attached to the house chimney and two attached to side fences). There are
several TV receiving antennas and dishes of similar or greater height and configuration
currently visible on neighboring residences.
b. The FCC confirms the potential for the radio transmitting to interfere with other air-wave
communication receiving equipment within the immediate area (also cited by one of the
negative respondents). Such interference is largely caused by inadequate design and
manufacture of the equipment being interfered with and is most readily solved by
adjustments to that equipment. Such interference may also be caused by electrical
equipment within the interfered-with house.
If caused by the radio operations, the interference will occur only when the amateur
operator is talking and the new antenna will rotate to achieve better directional
transmission than the existing stationary wire antenna. The applicant already operates
radio communications and there is a second radio transmitting antenna which is a
monopole mounted on the chimney of a neighboring house. Radio transmissions should
not interfere with cable-receiving equipment. (See attached FCC report)
4. There is no record that the required Special Use Permits were approved for either the existing
towers on the applicant's property nor for the tower on the neighboring house. If the SUP is
approved, the applicant will replace the existing pole antennas with the tower and frame
antenna, thereby legalising the existing operation.

5. A survey of area municipalities reveals that most allow private communication towers and
antennas by right, like other common appurtenances such as chimneys, vents flues, steeples
and utility cases. Special Use Permits are generally not required for towers of a common
height (such as that allowed for the main building or some maximum such as Wylie's 75 feet).
6. The applicant is a member of a not-for-profit private/religious volunteer disaster relief group,
and states that the radio is used primarily in times of such emergencies. However, nothing in
the proposed request establishes limits to the times the radio transmissions may occur. It is
common for Special Use Permits to provide such special conditions, and such provisions may
be established as a stipulation for approval if desired by the Commission and accepted by the
applicant.
7. The proposed tower and antenna will comply fully with all applicable regulations of the
Zoning Ordinance. The height of the tower (30 feet rather than the allowed 75 feet) and the
size of the antenna (782 square feet rather than the allowed 900 square feet) are well within
the limits allowed by the Ordinance. The SUP provides for no special regulations other than
those established by the Ordinance, and all future towers and antennas on this lot must fully
comply with the standard requirements of the Ordinance. However, the Commission may
establish reasonable conditions desired, either these proposed dimensions or any others as
ultimate limits of construction.
Staff Recommendation:
Approval.
The use already exists in the neighborhood, the proposed single tower and antenna reduce the
potential for noxious influences on neighboring properties, and construction will comply fully with
current code requirements.

I am submitting an application to install a 30 foot Radio antenna tower, which
consists of three 10 foot sections of triangle Radio Tower. The bottom section will be
anchored to 3 pieces of pipe in a concrete base. The Tower will be grounded to a
grounding rod about 17 feet away which is also used for house and phone line grounding..
If additional ground rods are needed they are easy to install.
A Rotor will be mounted atop the Tower and a 3 Element Antenna will be
connected to the Rotor.
All Antenna cables will have devices to prevent receivers from lightning strikes.

INTERFERENCE
Background
Interference is any unwanted radio frequency signal that prevents you from watching
television, listening to your radio or stereo, or talking on your telephone. Interference may
prevent reception altogether, may cause only a temporary loss of a signal, or may affect the
quality of the sound or picture produced by your equipment.
Causes
Before you can resolve an interference problem you must isolate the actual interference
source. Interference originates from many sources -the equipment itself, your residence, or
the neighborhood.
The two most common causes of interference are transrni rs and electrical equipment.
Communication systems that transmit signals (trangmitters) are capable of generating
interference; these include amateur radios, CBs, and radio and television stations. Electrical
interference may be caused by power lines or electrical equipment in your home.
Defining the Source -Transmitter Interference
Transmitter interference is normally caused by the actual design of the (interfered-with)
equipment itself. Many manufacturers do not protect internal wiring with adequate shielding or
sufficient filtering, so the interfered-with equipment is susceptible to receiving unwanted
signals - interference.
The source may be as simple as a frayed wire that connects your speakers to an amplifier. A
faulty wire can act as an antenna that will carry interfering signals. Check the incoming wire
from your outside antenna for any damage or corrosion. Replace any twin-lead cable with a
coaxial cable; a coaxial cable offers the best protection from all types of outside interference.
To determine whether the interference is coming from the interfered-with equipment itself,
unplug one component at a time on the interfered-with equipment or on other equipment to
see if you can isolate the source. Also, disconnect other electrical equipment (answering
machines, telephones, fax machines, etc.) one by one. If the problem goes away when the
device is disconnected, you have found the source -the device itself.
If your equipment is reacting to transmitters such as an amateur radio or CB, you will have
I'; interference only when the radio o erator is talkin ; you will be able fo hear only half of the
conversa ion. is pe o interference is normally intermittent during specific times of the day.
You will probably be able to verify your conclusion if you see an antenna mounted on a nearby
house or car. Stereos, electronic organs, home intercom systems and other devices can react
to nearby radix transmitters and will function as radio receivers. Cordless telephones use radio

frequencies and have no protection from interference. If you are experiencing interference on
your cordless phone, you should contact the manufacturer for assistance.
Defining the Source - Electrical Interference
Electrical interference appears on the audio and video portion of television programming.
There are various patterns; the entire screen may be covered with rolling horizontal lines, bars
on the TV screen or a series of diagonal dashed white lines. Short bursts of interference may
be caused by hair dryers, sewing machines, electric drills, doorbell transformers and garage
door openers. If the pattern is on continuously, it may be caused by equipment that is in use
full time, such as aquarium heaters and fluorescent lighting. Interference caused by your
power company's electrical equipment is normally continuous and your power company should
be notified.
A simple method of determining the location of electrical interference is by using a portable AM
radio tuned to a quiet frequency at the lower end of the dial. If you hear static or a buzzing
sound, check to see if it corresponds with the interference to your equipment. The closer you
get to the source of the interference, the more intense the static will be.
If you cannot locate the interference source in your own house, check with your neighbors to
see if they also receive interference. The house that has the worst interference will most likely
be the source of the interference.
If you can determine that the electrical interference is not caused by any device in your home
or a neighbor's home served by the same transformer, contact the customer service
department of your local power company. Most power companies will investigate the problem
and take steps to correct it.
The manufacturer of your home electronics equipment is in the best position to offer
assistance in resolving your interference problems. The dealer who sold you the equipment
should be able to provide contact information for the manufacturer.

Summary:
The Site Plan under consideration is for a Church facility. The subject tract totals 6.48 acres, and
the complex will be constructed in several phases. The existing house will be converted to
educational and office uses, and the proposed Phase 1 building will total 5,720 square feet. The
property consists of two lots, which have never been platted, and a Final Plat combining the two
lots into a single official lot of record is also on the current agenda for the commission's
consideration.
The subject tract has been zoned for agricultural uses since at least 1998. Churches are allowed
within agricultural zoning districts as a permitted compatible use.
Existing agricultural zoning abuts the subject tract both to the east and west and a major
electrical utility right-of-way lies to the south.
Primary access will be provided by Parker Road (F.M. 2514), which is a State owned and
maintained thoroughfare. Sixteen parking spaces will be required for the temporary use of this
existing structure that will be provided before a Certificate of Occupancy will be issued.
Additional parking will be constructed along with the Phase 1 of the new construction that will
be adequate for the future requirements of Phase 2. The required fire lane will be expanded in
each phase of construction to insure proper circulation for emergency vehicles and each phase of
new construction will have fire sprinklers installed. The engineering and utilities for future
expansion of the church, which will be directed to the south towards the rear of the property, will
be completed in this initial phase of development.
Site Plan — Faith Lutheran Church
Section 8.1.D of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning
and Zoning Commission for any development within a nonresidential zoning district. The purpose of the
site plan is to ensure harmonious and efficient development of land, compliance with appropriate design
standards, accommodation of sensitive environmental issues, safe and efficient vehicular and pedestrian
circulation, and provision of supporting utilities and other services, and site plans shall contain sufficient
information related to existing site considerations as well as the proposed site design and development
characteristics. Site plans shall serve as part of the zoning for the property,and changes in site plans shall
constitute a change in the zoning. No development shall occur or building permit approved for the
property,which does not conform to the approved site plan.
Issues:
1. The proposed Site Plan for the Faith Lutheran Church complies with the Non-Residential Design
Standards of the Zoning Ordinance for Site Design, Landscaping and Architectural. A tabulation on
the Site Plan illustrates how the flexible points will be achieved in accordance to the Zoning
Ordinance.
2. The proposed driveway expansion for access to Parker Road (F.M. 2514) will require tentative
approval by TxDOT before any building permits will be issued. Parker Road will be improved in the
future,but no plans or schedules are as yet available.
3. The proposed church construction will be accomplished in three phases and the schedule for future
phases is yet to be determined. In the interim before new construction is initiated the existing
residential structure on the property will be utilized for office and educational purposes after a new
concrete parking lot and driveway entrance are constructed. All construction will comply fully with
the requirements of the current codes.
4. All parking spaces provided will be the required 10 feet by 20 feet, and the required 16 parking
spaces is based on the potential occupancy of the existing residential structure.
5. The front yard setback is required to be 50 feet within the existing Agriculture District(AG/28)under
which the church is being constructed. The Site Plan as submitted shows the porte-cochere to be 40
feet from the front property line or an encroachment of 10 feet. The applicant is aware of this issue
and because of time constraints due to the holidays will be unable to make the necessary corrections
before the scheduled Planning and Zoning Commission consideration. The applicant was counseled
that rezoning to another residential district with a reduced setback requirement was an option but
decided that maintaining the AG/28 zoning and revising the site plan was in their best interest.
Therefore, the applicant has requested that this item remain on the current agenda with the request
that the Commission consider approval with the stipulation that revisions to the site plan to meet the
required 50 feet setback be made before the accompanying Final Plat is considered by the City
Council on January 27,2004.
Staff Recommendation:
Approval with stipulation that 50 feet front setback be met.

feet. The Plat will create a single lot of 6.48 acres from two existing unplatted lots.
Section 212.005 of the Texas Local Government Code states that "the municipal authority
responsible for approving plats must approve a plat that satisfies all applicable regulations".
Section 212.009(a) states that "the municipal authority responsible fore approving plats shall act
upon a plat within 30 days after the plat is filed. A plat is considered approved by the
municipality unless it is disapproved within that time period".
Issues:
1. The Final Plat complies with the Subdivision Regulations and all other pertinent code
requirements of the State and City of Wylie, and substantially conforms to the Site Plan,
which is also on the current agenda for consideration.
2. No additional Right-of-Way for Parker Road(F.M. 2514)will be required with this plat

Proposed Revision of the
Comprehensive Land Use Plan
Planning and Zoning Commission Public Hearing: January 6, 2004
Applicant: City of Wylie
Issue: Consider and provide direction to the City Council
regarding certain proposed revisions to the Comprehensive
Plan for the City of Wylie
Background:
The current Comprehensive Plan was adopted by City Council in July of 1999. The subsequent
adoption and administration of the new Zoning Ordinance which is intended to implement the
Plan have raised several issues of concern with the Plan.
The Planning and Zoning Commission reviewed the Comprehensive Plan in February of 2003,
concluding the need for several revisions to the Plan. This reconsideration of the Plan applied the
same philosophy used to initially formulate the Plan, therefore recommending only slight changes
to the pattern of the Plan. The following concerns remain to be considered and finalized:
1. The Plan does not cover Wylie's entire corporate limits and extraterritorial jurisdiction,
especially to the east and north where reliable base maps have been unavailable. Recent
development pressures in this area require that these areas be incorporated into the Plan.
2. The Plan recommends three levels of residential densities, decreasing with the distance from
Village retail centers. The Zoning Ordinance establishes the lot sizes of these varying
residential types, recommending most of the remaining undeveloped lands as Suburban
Residential (lots of 10,000 to 30,000 square feet) and Country Residential (lots of one acre
and larger). Changes in these density patterns (Country at 1 dwelling per acre and Suburban
at 3 or 4 dwellings per acre) have significant consequences on sizing of sewers and roadways.
Revisions to the Comprehensive Plan
3. The Business Center category of the Plan and subsequent Zoning regulations envisions limited
commercial uses in larger campus-style developments. However, the two areas (Regency and
Century) designated for this use/district are largely platted and developed to different
standards with limited opportunity for converting to BC characteristics.
The City Council will discuss these outstanding issues on January 13, in consideration of
recommendations of density limits for sizing of roads and sewers. The Commission will discuss
these issues in open session on January 6, and provide direction for future action by staff and
Council.
Staff Recommendation:
Provide direction to staff and Council concerning the appropriateness of the proposed revisions.
