"Red" Byboth CALL TO ORDER Vice-Chairman Porter called the Regular Meeting to order at 7:08 p.m. INVOCATION AND PLEDGE Claude Thompson offered the Invocation and Commissioner Chapman led the Pledge of Allegiance. CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the October 2, 2003, Regular Meeting. A motion was made by Commissioner Hughes, and seconded by Commissioner Chapman, to approve the minutes as submitted. Motion carried 4 — 0. (Commissioner Phillips being absent at the time). P & Z Meeting October 21, 2003 Page 2 of 3 ACTION AGENDA 1. Consider a recommendation to the City Council regarding a Preliminary Plat for the Housewright Addition, being all of a certain 1.022 acre tract of land, generally located east of FM 544 and south of Stone Road, as described in a deed to James E. Housewright, as recorded in Volume 5445, Page 1504 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Allen Atterberry Survey, Abstract No. 23 and in the A. West Survey, Abstract No. 979, Collin County, Texas, and within the Extraterritorial Jurisdiction of the City of Wylie. Thompson stated that the Plat will create one rural residential lot as well as dedicate 15 feet of right-of-way for the future widening of F.M. 544. The property totals 1.022 acres and is located in unincorporated Collin County but is within the Extraterritorial Jurisdiction of the City of Wylie. Thompson stated that most platting within the ETJ are done with minor plats, but the dedication of rights-of-way and easements cannot be accomplished by the Minor Plat. The development of this lot must comply with the Subdivision Regulations of the City of Wylie, but the use is not controlled by the City. Currently, there is no efficient way to tie into the City sewer, but this will be in the future probably through the Bozeman Farms Development. The property has no contiguous boundary with the City limits so cannot be forced to annex into the City. With no questions or discussion for the staff, a motion was made by Commissioner Chapman, and seconded by Commissioner Seely, to recommend approval to the City Council for the Preliminary Plat for the Housewright Addition. Motion carried 5 —0. 2. Consider a recommendation to the City Council regarding a Preliminary Plat for the Wylie Lakes Phase 1 Addition, being all of a certain 49.359 acre tract of land, generally located east of Forrest Ross Road and south of Skyview Drive, as described in a deed to Wylie Lakes, Ltd., as recorded in Volume 5415, Page 4387 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Thompson stated that the subject property includes 49.359 acres and will create 92 single-family detached residential lots, 14 single-family lots for attached patio homes, 55 single-family attached standard townhouse lots, 3 public parks and several common areas/open spaces to be owned and maintained by the Homeowners Association. The property is the initial phase of the 121-acre Wylie Lakes Planned Development (PD 2003-18), which is a mixed-use development approved in August. P & Z Meeting October 21, 2003 Page 3 of 3 The Engineering Standards require each subdivision to have two points of access. The proposed Spencer Lane provides primary access into the subdivision from Forrest Ross Road and will be divided with a median to provide emergency access. A portion of the proposed Park Boulevard right-of-way will be dedicated by this plat, but the Park extension will be several years in the future. Several temporary cul-de-sacs have been provided with this plat to enhance circulation until future development phases can provide additional points of access. The park dedication requirement for this initial phase is 1.5 acres per 100 lots or 2.415 acres and 3.69 acres of parkland are provided by this plat. With no questions for the applicant, or further discussion, a motion was made by Commissioner Chapman, and seconded by Commissioner Phillips, to recommend approval to the City Council regarding the Preliminary Plat for the Wylie Lakes Phase 1 Addition. Motion carried 5 —0. MISCELLEANOUS 1. A special motion was made by Vice-Chairman Porter to acknowledge and wish Commissioner Hughes a Happy Birthday, with all Commissioners acknowledging. 2. Thompson noted the resignation of Chairman George, and stated that the City Council should reappoint a replacement at the October 28, 2003, Council meeting. The Commission will hold elections for Chair and Vice Chair as soon as all positions are filled. Carter Porter, Vice-Chairman Mary Bradley, Secretary • crtyOf Wdie Action Item No. 1 Site Plan AutoZone Planning and Zoning Commission Meeting: November 4,2003 Owner: AutoZone Store Development Designer: AutoZone Store Development Location: North of State Highway 78 and east of F.M. 544 Existing Zoning: Corridor Commercial (CC) District Summary: The Planning and Zoning Commission approved a Site Plan to accommodate an AutoZone Store on this property on June 3, 2003. The property was to be replatted by Minor Plat to create the subject lot. However,the owner of the property took back 60 feet of the lot on the west side and the applicant was forced to completely redesign the site and thus resubmit for Site Plan approval. The Site Plan under consideration is for an auto parts retail store. The building is approximately 6219 square feet in size. The property is zoned Corridor Commercial (CC) District and the proposed retail store is an allowed use within the CC District. A proposed replat creating the new 1.116-acre lot for the facility is under review by the Planning Staff to be approved as a Minor Plat as Lot 3R. Walgreens currently occupies Lot 1R, Block A of the 78 Corner Addition and the remaining 4.215 acre Lot 2R will be divided into two lots by the minor plat creating the lot for AutoZone and the remaining undeveloped 3.102 acre tract. Section 8.1.D of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning and Zoning Commission for any development within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, accommodation of sensitive environmental issues, safe and efficient vehicular and pedestrian circulation, and provision of supporting utilities and Site Plan—AutoZone other services, and site plans shall contain sufficient information related to existing site considerations as well as the proposed site design and development characteristics. Site plans shall serve as part of the zoning for the property, and changes in site plans shall constitute a change in the zoning. No development shall occur or building permit approved for the property, which does not conform to the approved site plan. Issues: 1. The Site Plan complies with all applicable technical requirements of the City of Wylie, including the regulations of the Zoning Ordinance as adopted in February 2002. The Site Plan includes a tabulation of how the development points will be achieved. 2. The code encourages joint/common access/egress drives in commercial developments, and the Site Plan indicates such access is provided by a frontage road to State Highway 78 that will provide access to this development as well as to those properties to the east and west along Highway 78.
