Consider a recommendation to the City Council regarding a Final Plat for the Alanis Addition, being all of a certain 5.201 acre tract of land, generally located east of Ballard Avenue and north of Alanis Drive, as described in a deed to Richard D. Nance, et al, as recorded in County Clerk's File No. 97-0054771 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat will create two lots totaling 5.201 acres, and is zoned for Neighborhood Services (NS) uses. Lot 1 is 2.127 acres in size and will be developed in the future as Neighborhood Services retail. Lot 2 is 3.074 acres in size and will be developed immediately as the Stepping Stones Day Care, for which a Site Plan and Preliminary Plat were approved by the Commission in September 16, 2003. A joint access easement is provided between Lots 1 and 2, which will provide access to both lots from the median cut on Alanis Drive. Due to Fire Station on the north of Lot 1 and existing residences to the east of Lot 2, no joint access beyond the subject plat is possible. With no questions for the applicant, or further discussion, a motion was made by Commissioner Chapman, and seconded by Commissioner Phillips, to recommend approval to the City Council regarding the Final Plat for the Alanis Addition. Motion carried 7—0. 2. Consider a recommendation to the City Council regarding a Final Plat, being a Replat of Lot 46, Block D, Cimarron Estates Phase II Addition, being all of a certain 0.195 acre tract of land, located at 2917 Jamestown Drive, as described in a deed to Centex Homes, recorded in Volume 5136, Page 1815 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Thompson stated that the Replat of Lot 46, Block D, of the Cimarron Estates Phase II Addition, will reduce the existing drainage easement width from ten feet to nine feet. This replat is intended to remove an encroachment of 0.8 foot into the easement by the existing house recently constructed on the subject lot. The City Engineer has determined that the calculated storm water can be accommodated within the remaining easement, which is nine (9) feet wide on the subject Lot 46R and five (5) feet wide on Lot 45. P & Z Meeting October 7, 2003 Page 3 of 7 Thompson stated that the Zoning Board of Adjustment typically approves variances for encroachments into required yards. However this is a builder error creating a self imposed hardship, and applies to an easement rather than a side yard, so the best remedy is to replat the lot to remove the encroachment. A motion was made by Commissioner Phillips, and seconded by Commissioner Chapman, to recommend approval to the City Council regarding the Final Plat, being a Replat of Lot 46, Block D, Cimarron Estates Phase II Addition. Motion carried 7—0. 3. Consider a recommendation to the City Council regarding a Final Plat for the Birmingham Farms Phase 4 Addition, being all of a certain 13.955 acre tract combining the 5.911 acre tract of land called Tract A and the 8.044 acre tract of land called Tract B, generally located east of Country Club Road (F.M. 1378) at Talladega Drive, as described in a Contract for Deed to Centex Homes, and being situated in the C. McUlmurry Survey, Abstract No. 629, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat will create 44 lots for single-family detached residential dwellings, as well as common open space for landscaped entries and drainage basins to be owned and maintained by the Homeowners Association. The Plat dedicates additional right-of-way for the future widening of Country Club Road, and provides local streets that will provide access to two City Parks. The subject property was rezoned to Planned Development (PD) for single-family detached residential based on the Single-Family 8.5/17 District with certain stated conditions, including no alleys and 65 feet wide lots rather than the required 70 feet. The Planned Development (PD) 2002-38 was approved by the City Council on September 24, 2002. As provided by the PD, park dedication fees shall be waived provided comparable funds are used for park improvements within or adjacent to the platted area. All park improvements must be in place and accepted by the City prior to filing the Final Plat and issuance of Building Permits. A motion was made by Commissioner Byboth, and seconded by Commissioner Chapman, to recommend approval to City Council regarding the Final Plat for the Birmingham Farms Phase 4 Addition. Consider a recommendation to the City Council regarding a Final Plat for the Birmingham Farms Phase 13A Addition, being all of a certain 25.961 acre tract of land, generally located east of Country Club Road (F.M. 1378) and south of Park Boulevard, as described in a Contract for Deed to Centex Homes, and being situated in the C. McUlmurry Survey, Abstract No. 629, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat includes 25.961 acres and will create 78 single- family residential lots and common areas/open spaces to be owned and maintained by the Homeowners Association. The subject property is the initial phase of the larger Birmingham Farms Planned Development (PD 2002-39), which conforms to the requirements of the Single Family 8.5/17 District except that the minimum lot width is 65 feet and no alleys are required. The Right-of-way for the widening of Country Club Road (FM 1378) will be dedicated by this Plat. Prior to the issuance of a Residential Certificate of Occupancy within Phase 13A, the developer and/or owner of the property will be required to construct a bridge sufficient to carry 3 lanes of traffic and a 4 feet wide pedestrian walkway on Park Boulevard to the northwest of the subject property. A motion was made by Commissioner Chapman, and seconded by Commissioner Seely, to recommend approval to City Council regarding a Final Plat for the Birmingham Farms Phase 13A Addition. Consider a recommendation to the City Council regarding a Final Plat for the Southbrook Phase I Addition, being all of a certain 26.2357 acre tract of land, generally located north of Elm Road (County Rd. 381) and east of South Ballard Avenue, as described in a deed to S.C. Parsons, as recorded in Volume 5049, Page 2916 and Volume 4906, Page 707 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the D.W. Williams Survey, Abstract No. 980, City of Wylie, Collin County, Texas. Thompson stated that the Final Plat will include 26.2357 acres and will create 88 single- family residential lots, landscaped open spaces maintained by the private homeowners association, as well as provide for right-of-way for the future widening of Elm Road. The Planned Development District (PD 2002-08), which established the zoning requirements was approved by the City Council on February 26, 2002, and provides for a minimum lot size of 8,000 square feet with a minimum lot width of 65 feet. Side yards adjacent to streets are to be at least 15 feet wide, unless they are key lots, which must be a minimum of 25 feet. All other side yards shall be a minimum of 6 feet. P & Z Meeting October 7, 2003 Page 5 of 7 With no questions for the applicant, a motion was made by Commissioner Byboth, and seconded by Commissioner Chapman, to recommend approval to City Council regarding a Final Plat for the Southbrook Phase I Addition. Motion carried 7—0. 6. Consider and act upon approval of a Site Plan for the Kwik Kar Lube and Tune (Lot 5A) and Dry Cleaners (Lot 5B), being all of a certain 1.40 acre tract of land, generally located east of Westgate Way and south of F.M. 544, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan is for a minor car repair service on Lot 5A and dry cleaners on Lot 5B of the Greenway Addition. Lot 5A is 33,951 square feet (0.78 acre) in size and the building is 3,652 square feet in size. Lot 5B is 26,806 square feet (0.62 acre) in size and the building is 3,500 square feet in size. A Site Plan and Final Plat were approved for the property as part of the Greenway Addition in April of 2001 prior to the zoning ordinance revision. However, Lot 5 is to be replatted into two lots thus removing all of the vested rights under the previous code and must now be developed entirely under the current code. Chairman George asked the applicant to describe the chiller, which is located on the northwest corner of the dry cleaners building. Craig T. Liebenderfer, Kwik Industries, Inc., 4725 Nall Road, Dallas, Texas, represented the developer, stated that the chiller is an evaporative cooler for the building, and is approximately six feet by eight feet. Chairman George recommended that the chiller be screened. Mr. Liebenderfer agreed to realign the screening around the dumpster and include the chiller, although the wall for the chiller will have openings for ventilation and the dumpster wall will be solid. Commissioner Phillips questioned the four parking spaces on the northwest corner measuring 9 by 18 feet, and recommended that these parking spaces be restriped to measure the current requirement of 10 by 20 feet. Mr. Liebenderfer agreed to restrip the parking spaces on the northwest corner to measure 10 by 20 feet. A motion was made by Commissioner Phillips, and seconded by Commissioner Chapman, to approve the Site Plan with stipulations that screening be included around the chiller and the dumpster; and the four parking spaces be restripped to measure 10 by 20 feet. Consider a recommendation to the City Council regarding a Final Plat for Lots 5A and 5B, Block A, being a Replat of Lot 5, Block A, Greenway Addition, being all of a certain 1.40 acre tract of land, generally located east of Westgate Way and south of F.M. 544, as described in a deed to Greenway-Wylie, L.P., recorded in Volume 4734, Page 2858 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the E.C. Davidson Survey, Abstract No. 267 and in the Duke Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas. Thompson stated that the Replat will create two lots from the existing single Lot 5 of Block A of the Greenway Addition. This replat is intended to create the 0.78 acre Lot 5A to accommodate the Kwik Kar Lube and Tune and the 0.62 acre Lot 5B to accommodate the Kwik Dry Clean Center, for which the Site Plan was previously considered on the current agenda. With no questions for the applicant, a motion was made by Commissioner Chapman, and seconded by Commissioner Byboth, to recommend approval to the City Council regarding a Final Plat for Lots 5A and 5B, Block A, being a Replat of Lot 5, Block A, Greenway Addition. Consider and act upon approval of a Site Plan for the All Storage Center, being all of a certain 4.1438 acre tract of land, generally located north of F.M. 544 and east of McCreary Road, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan is for a self-storage facility on the proposed Lot 2, Block 1 of the McCreary-F.M. 544 Addition. Lot 2 totals 4.1438 acres, and the proposed buildings consist of an office of 750 square feet and storage facilities totaling 83,350 square feet. Lot 1 will be developed for future retail. Edd Haskins, 3631 Coral Gables, Dallas, Texas, represented the applicant, stated that the dumpster has not yet been located but it will be screened. Mr. Haskins stated that all buildings will be 100 percent masonry on the outside and single story. Between each building there will be a wrought iron fence. Along McCreary Road there will be a thirty foot landscape buffer, which will provide an entryway similar to the landscaping for the single-family residential subdivision to the north of the subject property. Mr. Haskins recommended that the Commissioners review and modify the requirement that twenty percent (20%) of such retail sites be landscaped. He had to reduce the square footage of buildings and eliminate desired extra parking in order to obtain enough landscaping. A motion was made by Commissioner Porter, and seconded by Commissioner Chapman, to approve the Site Plan with the stipulation that the dumpster to be screened. Motion carried 7—0. Consider a recommendation to the City Council regarding a Preliminary Plat for the McCreary-F.M. 544 Addition, being all of a certain 7.2575 acre tract of land, generally located north of F.M. 544 and east of McCreary Road, as described in a deed to Heatley-Moist, Inc., Trustee, recorded in County Clerk's File No. 96- 0021299 of the Deed Records of Collin County, Texas (DRCCT), and being situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Thompson stated that the Preliminary Plat will create 2 lots totaling 6.6944 acres. Lot 1 is 2.5505 acres in size and will be developed in the future as retail. Lot 2 is 4.1438 acres in size and will be developed as the self-storage facility, for which a Site Plan was just approved. The subject property is located in unincorporated Collin County but is within the Extraterritorial Jurisdiction of the City of Wylie, and in compliance with the Interlocal Government Agreement approved in March 2002 requires the plat to be approved by the City of Wylie. Development of this lot must comply with the Subdivision Regulations of the City of Wylie and the Building Codes of Collin County. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. The Final Plat substantially conforms to the approved Concept Plan and Development Conditions of the Planned Development PD 2003-18 and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. The Conditions of the PD require that all development comply with the standard requirements of the Zoning Ordinance. The Plat includes a tabulation of how the flexible point system will be achieved for Land Design, Street and Sidewalks and Architectural incentives. 3. The proposed Spencer Lane provides primary access into the subdivision from Forrest Ross Road. A portion of the proposed Park Boulevard Right-of-way will be dedicated by this plat, but only that portion at the intersection of Spencer Lane will be paved in this phase due to the incompleteness of final engineering on the railroad overpass by others. No alleys are required throughout the PD area. 4. The park dedication requirement for this initial phase is 1.5 acres per 100 lots or 2.415 acres and 3.69 acres of parkland are provided by this plat.
