P&Z Commission Meeting May 20,2003 Page 2 of 5 PUBLIC HEARING 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agricultural (A) to Planned Development(PD) District for Village Center Mixed Residential and Nonresidential Uses, generally located east of County Road 389 (Forrest Ross Road) and south of Skyview Drive and north of Kansas City Southern Railroad, being all of that certain 94.16 acre tract as described in a deed to Arapaho East, Inc. recorded in Vol. 5108, Page 1984, and being all of that certain 49.247 acre tract as described in a deed to Arapaho East, Inc. recorded in Vol. 4242, Page 1505, Deed Records of Collin County, Texas, except for those certain called 16.48 and 5.5 acre tracts conveyed to Kansas City Southern Railroad in October 1998, and being in total a 121.11 acre tract of land situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. (Zoning Case 2003-03) Thompson stated that the rezoning to a Planned Development (PD) District will allow a multi- use community comprising of single-family residential neighborhoods of varied densities and building types, retail uses and public open spaces. The property is zoned Agriculture (A) and is undeveloped except for several major water transmission lines. The surrounding properties are either occupied by the railroad or already developed for rural housing. The Concept Plan divides the overall property into three sections, generally along existing property ownership lines or roadway corridors. The Plan provides for the extension of Spring Creek Boulevard as Park Boulevard and allocates a Neighborhood Service retail center abutting this corridor. The PD establishes a maximum of single-family detached residential lots and dwellings at 352, including 50 lots for patio houses on 4, 000 square foot lots surrounding the retail uses, 210 single family residential lots of 7,200 square feet to the west and outer of the area, and 92 single family residential lots of 10,000 square feet to the eastern portion of the area. The overall gross residential density is established at a maximum 2.9 dwelling unit per acre. The specific lot sizes for the single family residential will be submitted as a Development Plan and Preliminary Plat with each subsequent phase of the development, and must generally comply with these allocations of the Concept Plan. Thompson reviewed the Conditions of the Planned Development and compared the proposed requirements to the Zoning Ordinance regulations. Seventy-four percent of the lots will be 7,200 square feet or smaller, and narrow lots with smaller setbacks are proposed. House sizes for the smaller lots are proposed to be smaller than the 1,700 feet of the Zoning Ordinance. Alleys will be provided except for the larger lots and double-fronting lots, and eight-feet wide trail will connect residences to retail and open spaces. Retail development will generally comply with the regulations of the Zoning Ordinance. The recommendation from Staff is denial because the proposal for smaller lots is not consistent with the recommendations of the Comprehensive Plan. P&Z Commission Meeting May 20,2003 Page 3 of 5 Allen Bussell, 1621 Amanda Court, Ponder, Texas, the engineer for the subject property, presented a slide show presentation of the proposed development concept. Bussell stated that there will be eight (8) acres dedicated to parkland rather than the required five (5) acres. Bussell stated that the properties to the north across Skyview are owned by the United States Army Corps of Engineers and the applicant has asked the City to consider leasing options so that the residences are connected to public open space and the lake. Commissioner Snider expressed support for such a direct connection with the lake and recommended orienting more of the lots for views or access to the lake. Bussell stated that the development connects to heavily trees and the development will preserve the trees with trails to the lake. He stated that the proposal is a concept and has not yet been engineered. The philosophy is to provide the same nice amenities for the smaller lots as other larger developments that are adjacent to a lake. The Commissioners and Bussell discussed the location of the trail and sidewalks connecting to the north by the marina. Bussell stated that the development will capitalize on the difficult shape of the property, the village center and the lake. Mark Stiles, 3708 Gwinn Court, Plano, Texas, represented the owner of the property, and stated that the proposal is to provide smaller lots which are currently marketable in this area, as of the two hundred thirty (230) new home sales in the Collin County area less than 50 are on the larger lots anticipated by the Comprehensive Plan. The village center concept creates a pedestrian- _ oriented easy access to the lake and retail services and supports smaller lots. Commissioner George opened the public hearing. With no one wishing to speak, Commissioner George closed the public hearing. A motion was made by Commissioner Snider, and seconded by Commissioner Hughes, to recommend approval with stipulations that future Development Plans reflect more natural amenities and the interior properties reflect stronger relationship to the lake. Motion carried 3 — 2,with Commissioner George and Commissioner Phillips opposing. 2. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Downtown Historic District (DTH) to Planned Development (PD) District for Mixed Uses including Indoor Commercial Amusements, located at 110 E. Oak Street, being Lot 7A, Block 18 of the Railroad Addition, City of Wylie, Collin County, Texas. (Zoning Case 2003-04) Thompson stated that the applicant is requesting a Planned Development District(PD) in order to install and operate an Indoor Commercial Amusement (game room) within a building currently being used for retail sales, mailboxes and snack shop. The parcel is 2,395 square feet and completely developed for the existing building, with the only available parking on the public street. Plans are to utilize the eastern portion of the building as an entertainment center for video games and billiards. P&Z Commission Meeting May 20,2003 Page 4 of 5 The Comprehensive Plan recommends Mixed Uses for the subject property, in keeping with the historic diversity of the old central area. On-street public parking spaces may count for 25 percent of the required parking for nonresidential uses within the downtown area, but the PD provides that no off-street spaces be required. The PD is intended to impose special conditions to make the game activities compatible with neighboring uses. Failure at any time to comply fully with the approved Conditions of the PD will result in the cancellation of the Certificate of Occupancy. Public Comment Forms were mailed to thirty-five (35) property owners within 200 feet of this request. Prior to the meeting, nine (9) Comment Forms have been returned recommending denial of the rezoning, therefore the City Council will be required to have a seventy-five (75) percent approval vote. The proposed video game machines are regulated by the State and the applicant must maintain appropriate certifications at all times. The Conditions of the Planned Development District limits the number of such game machines to 10 and requires that all prizes and awards be products or coupons redeemable on the premise. The PD establishes no age limits for operation of the games. The staff recommends denial. While most of the Conditions of the Planned Development District are sufficient to assure compatibility of the proposed amusement, the PD would allow two parking-intensive uses (restaurant and amusement) on a lot with no on-site parking and no documented arrangement for off-premises parking. Although either one of these uses alone is consistent with similar uses within the area and may be appropriate without additional parking, the proposed increase in parking-intensive uses will have negative impact on the limited on-street parking. On the other hand, on-site parking cannot be provided for any use on the subject property without redevelopment, and to impose the revision of the code on existing development could be considered to render the property useless without compensation. Norine Swanson, 110 E. Oak Street, Wylie Texas, represented the applicant, stated that the game room will occupy approximately 420 square feet. This includes a pool table and game machines. The coffee shop is 280 square feet. The total required parking is 8 spaces at any one time and the measurements in front of the building provide 7 spaces. She does not expect the retail and snack shop uses to require parking at the same time the games do, and she is still investigating sharing off-street parking with neighboring uses. Commissioner George opened the public hearing, and read into the record the comment forms submitted prior to the meeting against the proposed zoning. Bob Heath, 102 N Ballard, Wylie Texas, represented property owner of several buildings in the area, spoke against the zoning because some of the game machines are restricted to adults and such games often bring other problems. P&Z Commission Meeting May 20,2003 Page 5 of 5 Dick Sharman, 101 N Ballard, Wylie Texas, represented property owner of the hardware store across Ballard Street, spoke against the zoning due to the adult game machines. Commissioner Snider proposed to the applicant limiting the number of adult game machines to two of the total 10 or no age-limited machines. Swanson suggested allowing four adult game machines and the rest of the machines will require no age certification from the State. Motion was made by Commissioner Snider, and seconded by Commissioner Phillips to recommend denial based on the inclusion of adult game machines. Motion carried 3 — 2 with Commissioner Chapman and Commissioner Hughes opposing. ADJOURNMENT Motion to adjourn was made by Commissioner Chapman, and seconded by Commissioner Hughes. Bradley, Secretary Cft of IN* Action Item No. 1 Final Plat Birmingham Farms Phase 14A Including Lots 15-23, Block J, Birmingham Farms 2A Planning and Zoning Commission Meeting: June 3, 2003 Owner: Centex Homes Surveyor/Engineer: Carter and Burgess, Inc. Location: Generally located south of the proposed Park Boulevard extension and east of Country Club Road(F.M. 1378) Existing Zoning: Planned Development(PD 2002-40) Summary: The Final Plat under consideration is for the Birmingham Farms Phase 14A Addition, including Lots 15-23, Block J on Birmingham Farms Phase 2A. The property includes 46.395 acres and will create 138 single-family residential lots and 4 common areas/open spaces to be owned and maintained by the Homeowners Association. Lots 15-23, Block J of Birmingham Farms Phase 2A are being replatted as part of Phase 14A in order to extend Pickwick Lane north to Bessemer Drive to improve neighborhood access and traffic flow. None of the lots affected by the replat have been sold or built upon and are currently in the single ownership of the developer. The subject property is phase 1 of the larger Birmingham Farms Planned Development(PD 2002-40), which conforms to the Single Family 8.5/17 District requirements except that the minimum lot width is 65 feet and no alleys are required. Phase 2 is also on the current agenda as Birmingham Farms Phase 14B for P&Z consideration. The Development Plan approved by the City Council as part of the original Planned Development(PD 2002-40) on September 24, 2002 serves as an approved Preliminary Plat. The subject development will comply with all of the applicable requirements set forth in the conditions of the PD 2002-40. Final Plat—Birmingham Farms Phase 14A Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Issues: 1. The Final Plat substantially conforms to the approved Development Plan of the Planned Development PD 2002-40 and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. The right-of-way for the southern portion of Park Boulevard will be dedicated by this plat, although the PD provides that no construction of Park Boulevard will be required. Prior to the issuance of a Residential Certificate of Occupancy within Phase 14, the developer and/or owner of the property will be required to construct a bridge sufficient to carry 3 lanes of traffic and a 4 feet wide pedestrian walkway. 3. Westgate Way shall be extended to the north end of Phase 14 and shall be completed prior to issuance of any residential building permits in Phase 14. Combined funds from the developer and the Wylie Independent School District will be used to construct the extension of Westgate Way. 4. Sanden Boulevard is not required to be extended as a divided arterial road, but instead will be improved as a 32 feet wide undivided neighborhood street. 5. As provided by the PD, park dedication fees shall be waived provided comparable funds are used for park improvements within or adjacent to the platted area. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit on each lot. The property includes 34.488 acres and will create 114 single-family residential lots and 3 common areas/open spaces to be owned and maintained by the Homeowners Association. The subject property is phase 2 of the larger Birmingham Farms Planned Development (PD 2002-40), which conforms to the Single Family 8.5/17 District requirements except that the minimum lot width is 65 feet and no alleys will be required. Final Plat—Birmingham Farms Phase 14B Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Issues: 1. The Final Plat substantially conforms to the approved Development Plan of the Planned Development PD 2002-40 and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. The right-of-way for the southern portion of Park Boulevard will be dedicated by this plat, although the PD provides that no construction of Park Boulevard will be required. Prior to the issuance of a Residential Certificate of Occupancy within Phase 14, the developer and/or owner of the property will be required to construct a bridge sufficient to carry 3 lanes of traffic and a 4 feet wide pedestrian walkway. 3. Westgate Way shall be extended to the north end of Phase 14 and shall be completed prior to issuance of any residential building permits in Phase 14. Combined funds from the developer and the Wylie Independent School District will be used to construct the extension of Westgate Way. 4. As provided by the PD, park dedication fees shall be waived provided comparable funds are used for park improvements within or adjacent to the platted area. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit on each lot. The building is approximately 5,400 square feet in size, and the lot is 1.05 acres in size. The property was rezoned from Industrial (I)to Corridor Commercial (CC) District in November 2001 with the adoption of the City-wide revisions to the Zoning Ordinance and Map. The subject property was previously occupied by the Walker/Roper Fence Company, and is one (1) acre in size. It is developed with a building of approximately 4,560 square feet, faced with masonry on the street front and metal on the sides (two large overhead doors face south), as well as associated concrete parking and fenced open space which is partially paved and partially gravel. Plans are to utilize the building for minor repairs of boats and any boat parking and short-term storage will be behind the screen fence. The subject property has never been platted into an official lot of record. The applicant is aware that the property must be platted prior to issuance of a Certificate of Occupancy. ZC 03-05 Neither the previous nor current Zoning Ordinances defme a specific district for boat repair, and Minor Automotive Repair is the closest specified use to that anticipated by the applicant's operations. The property was rezoned from Business-2 (B-2) to Neighborhood Services (NS) in November of 2001 with the adoption of the City-wide revisions to the Zoning Ordinance and Map. Minor Automotive Repair uses were allowed by right within the previous B-2 District, but are allowed within the current NS District only with an approved Special Use Permit (SUP). The Zoning Ordinance provides consideration of a Special Use Permit (SUP) as a means of establishing special conditions for allowing certain uses in a manner which is more compatible and consistent with the character of adjacent properties than that use may be normally. The Planning and Zoning Commission and City Council shall evaluate a request for an SUP to determine its probable effect on adjacent properties and the community as a whole, and may impose any reasonable conditions for the granting of an SUP. Failure at any time to comply fully with the approved Conditions of the SUP will result in the cancellation of the Certificate of Occupancy. The property to the north are zoned Agriculture (A) with a Special Use Permit (SUP) for the Transportation Center of the Wylie Independent School District. Properties to the east and south are zoned for Neighborhood Services (NS), are undeveloped and owned by the applicant of the subject property. Properties to the west, across Country Club Road, are not platted but are sparsely developed in rural single-family residential and uses and the City of Wylie Fire Station. Issues: 1. The currently-adopted Comprehensive Plan recommends Country Residential uses for the subject property, which is defined as single-family residential and appropriate support uses on lots of one (1) acre and larger. However, the Planning And Zoning Commission is in the process of considering revisions to the Plan, and are considering recommending that the area be developed for commercial uses in conformity to the current zoning. The proposed Special Use Permit will retain the current retail base zoning, and conforms to this proposed recommendation of the Plan. 2. The existing building and site development were constructed in accordance with previous code regulations, and do not comply with some requirements of the current Zoning Ordinance, specifically including only partial masonry building facade, parking space size and landscaping. Section 9 of the Zoning Ordinance provides that such structures which were made nonconforming by changes in City requirements may continue to operate but shall not be encouraged and shall be brought into compliance if and when that structure is vacated without utilities for a period of six months. City records indicate that City water has not yet been terminated and the property remains technically in use. Therefore, full compliance with the current regulations can not be required, but some degree of compliance may be negotiated as a condition of granting the requested SUP. ZC 03-05 3. Boat repair is not a specifically-listed use within the Zoning Ordinance. Section 5.6 of the Ordinance provides that additional and unlisted uses may be permitted when the new use is similar to other uses listed in a zoning district. As defined by the applicant, the proposed use is closest to Minor Automotive Repair than to other listed uses such as Major Auto Repair, Truck or Heavy Equipment Repair or Industrial Assembly/ Manufacturing. Minor Automotive Repair is allowed within the Neighborhood Service District when all activity and operations are conducted within an enclosed structure and when service bays do not face public rights-of-way. The existing development and proposed operations comply fully with these special regulations. Although the applicant anticipates the repair of boats only, it is considered that any similar minor vehicle repair likewise complies with the intent of the Ordinance, and this proposed Special Use Permit is not limited to boat repairs but will permit any such minor repairs. 4. Although it is common for Special Use Permits to provide additional conditions of development and/or operation, no such conditions are proposed for this Special Use Permit, as the existing construction is considered to be sufficiently in compliance with the standard regulations of the Zoning Ordinance. Unless specifically limited to boat repair by such special conditions, approval of the SUP will allow the operation of any similarly defined Minor Vehicle Repair on the property. The approved SUP for the adjacent WISD Transportation Center has no additional conditions of development or operation, and therefore will allow any similar governmental facility to replace the bus maintenance and parking. 5. Public Comment Forms were mailed to nine (9) property owners within 200 feet of this request. No Comment Forms have been returned at the time of posting. Staff Recommendation: Approval. Location: West of Westgate Way and north of Dallas Area Rapid Transit/KCS Railroad Corridor Existing Zoning: Agriculture (A) District—38.1 Acres Townhouse (TH)— 15.5 Acres Requested Zoning: Planned Development (PD) District for Single- Family Residential Uses Summary: The applicant is requesting rezoning of the subject property in order to permit development of a single-family detached residential neighborhood and public open spaces. The proposal is intended to continue the residential patterns established by the Westgate neighborhood to the north and the townhouse and apartment developments to the east, and better address the property's adjacency to the railroad corridor. The proposed Planned Development District includes a total of 53.6 acres of land, and is currently being consolidated under single ownership. The eastern 15.5 acre portion adjacent to Westgate Way is zoned for Townhouse residential (TH) uses, and the western 38.1 acres is zoned Agriculture (A) District which is generally a holding District until appropriate urban land uses are proposed. The property is undeveloped. ZC 03-06: Creek Hollow PD The property abutting the proposed Planned Development District to the north is zoned Agriculture (A) and is undeveloped. The railroad corridor of the Dallas Area Rapid Transit (DART), previously owned by the Kansas City Southern Railroad, serves as the southern boundary of the tract. Properties to the east, across Westgate Way, are zoned for Townhouse (TH) Residences, and are largely undeveloped except for the Fleming Street entry of the currently-developing Westgate Hollow zero-lot line residential neighborhood (PD 90-22). Properties to the west are within the floodplain of Muddy Creek and are largely undevelopable. The Development Plan for the Planned Development District provides a monumental divided entry street approximately mid-way along the Westgate Way frontage as the primary access to the subdivision and envisions the extension of Fleming Street westwardly as a secondary entry. Along the Westgate frontage is a 25 feet wide landscape perimeter to be owned and maintained by the Homeowners Association. The Plan allocates the western floodplain as public park land, and provides a linear park along the south boundary as a buffer from activity on the railroad corridor as well as pedestrian connection to Westgate Way. No alleys are provided throughout the subdivision. The Development Plan is to serve as the preliminary plat. The Conditions of the Planned Development District establish the maximum possible number of single-family detached residential lots and dwellings at 200 and a maximum density of 3.75 dwelling units per acre. The PD Conditions provide a minimum lot size of 7,000 square feet and minimum dwelling size of 1,600 square feet. The PD proposes a modification of the standard architectural regulations of the Zoning Ordinance, largely a reduction of the masonry requirement. Issues: 1. The Comprehensive Plan recommends that the entirety of the subject property be developed in Country Residential uses, with single-family dwellings on lots of an acre or larger. The Planning and Zoning Commission is in the process of considering potential revisions to the Comprehensive Plan, but has recommended this same low-density residential for the area. The requested rezoning to smaller residential lots is not consistent with these recommendations of either the adopted or draft revision of the Comprehensive Plan. However, if developed as recommended by the Comprehensive Plan (15.5 acres of townhouses at 14 dwellings per acre and 38.1 acres of Country Residential acre lots), the subject 53.6 acres could yield a total of 255 lots or 27.5% more dwellings than proposed by the Planned Development District. Additionally, the higher-density townhouses allowed by the current zoning are more appropriately bounded by smaller lots such as proposed by the PD than by the acre lots recommended by the Plan. ZC 03-06: Creek Hollow PD 2. The stated purpose of a Planned Development District is to allow flexibility from the rigid requirements of the Zoning Ordinance in order to allow innovation in the use and design of land or to overcome constraints to standard development. The recent revisions to the Zoning Ordinance were specifically designed to provide such flexibility and thereby avoid the need for PDs. Neither the configuration or character of the site nor the proposed Conditions of Development appear to justify rezoning as a Planned Development District rather than compliance with the standard regulations of the Ordinance. However, the applicant contends that the market for the larger residential lots required by the Zoning Ordinance (currently, the smallest lot allowed is 8,500 square feet) is limited, and argues that the smaller lots and higher-density proposed by the PD are compatible with the existing densities of the immediate Westgate area and a proper transition from the higher densities to the east to lower densities west of the creek/floodplain. Furthermore, the eastern third of the subject property is already zoned to allow Townhouse residences at a potential density of 14.5 dwellings per acre rather than the PD's established maximum of 3.75 d.u./ac. The coordinated PD can, therefore, achieve both the City's goal of lower density and the market goal for smaller lots better than literal compliance to the Zoning Ordinance and Comprehensive Plan. 3. The PD proposes to dedicate approximately 6.5 acres of land as public park, compared to the 3 acres (at 1.5 acres per 100 lots) required by Wylie's park dedication regulations. However, over 4 acres of that identified on the Development Plan as park dedication is within the floodplain and not eligible for dedication, and nearly 2 acres in a narrow linear strip along the railroad boundary, or a total of 6 acres which is not likely to be allowed as the required dedication. This area may still be dedicated, if approved by the Park Board, but funds in lieu of land will be required to equate to the dedication requirement. 7.
