CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the March 18, 2003, Regular Meeting. Commissioners stated that the stipulation to the Conditions for the Special Use Permit should include the planting and maintenance of a living screening at the top of the hill on the east side of the property as well as on the south property line at the cemetery. There will be no outside activities until the screening is high enough to screen light and noise. Page 2 P & Z Meeting April 1, 2003 With no other changes, a Motion was made by Commissioner Chapman, and seconded by Commissioner Hughes, to recommend approval of the Minutes with changes noted. Motion carried 7—0. ACTION AGENDA 1. Consider and act upon approval of a Site Plan for the Sargent Building, being all of a certain 0.899 acre (39,150 square feet) tract of land, located at 2803 Capital Street, being Lot 11, Block B of the Regency Business Park Addition Phase 2, and being situated in the William M. Sachse Survey, Abstract No. 835, City of Wylie, Collin County, Texas. Thompson stated that the subject property was platted in 1987 as Lot 11 of Block B of the Regency Business Park Addition Phase 2. The proposal is to build 8,000 square feet office/warehouse facility of approximately 1,900 square feet of offices and 6,100 square feet of warehouse area. Development rights are vested in the dimensional regulations of the previous code in effect at platting, but the applicant has agreed to comply with the current building requirements. Commissioner George questioned that the point requirement is being fully met. Thompson reviewed the point tabulation on the Site Plan with the Commissioners. Michael Sargent, 2804 Capital Street, Wylie, represented as the applicant of the subject property. He stated that no elevations are available for the building, but that it will be brick and white stone. The intention is to concrete the back portion of the property and have a fence along the back of the property. There will be no outside storage, only a construction trailer with equipment parked on the back of the property. A motion was made by Commissioner Snider, and seconded by Commissioner Chapman, to approve the Site Plan as submitted. Motion carried 7—0. MISCELLANEOUS 1. Commissioner George acknowledged Thompson and Commissioner Snider's Birthday in March. 2. Thompson reviewed discussed articles concerning residential growth in the Wylie area. A memo noted increased Single Family Residential permits culminating in 149 during March being the highest monthly total in Wylie history. A news article compared prices of housing in the Metroplex during the last three years, indicating that most is priced under $150,00. These trends are common to those of Wylie, and why we are encouraging larger lots and enhanced construction to raise prices locally. Page 3 P & Z Meeting April 1, 2003 3. Thompson said that the next several meetings will continue to consider the revisions to the Comprehensive Plan, especially the philosophy, goals, recommendations and actions. Michael George, Chairman Claude Thompson, Director Cify of Wylie Action Item No. 1 Site Plan Bear Foot Lodge School Planning and Zoning Commission Meeting: April 15, 2003 Owner: Bear Foot Lodge School Surveyor/Engineer: Carter and Burgess, Inc. Designer: Charles D. Shearer Location: Generally located south of Park Boulevard and east of Country Club Road(F.M. 1378) Existing Zoning: Planned Development District (2002-39) Summary: The Site Plan under consideration is for a Day Care facility. The subject tract totals 2.873 acres, and the proposed building will total 12,776 square feet. Day Care facilities are normally allowed within residential zoning districts by an approved Special Use Permit. An SUP allows the provision of special development conditions which may be desired to achieve a certain goal for a specific use and site or required to ensure that the proposed use is compatible with its surroundings. The subject tract was identified within the Birmingham Farms Phase 13 Planned Development District (PD 2002-39) for day care uses by right without the requirement for an SUP. However, that PD provided no further development or design regulations for the day care use. The subject Site Plan, therefore, reflects a combination of dimensional requirements and character of the residentially-based PD with the nonresidential regulations of the Zoning Ordinance. A Final Plat creating the single lot is also on the current agenda for consideration. Site Plan — Bear Foot Lodge School Section 8.1.D of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning and Zoning Commission for any development within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, accommodation of sensitive environmental issues, safe and efficient vehicular and pedestrian circulation, and provision of supporting utilities and other services, and site plans shall contain sufficient information related to existing site considerations as well as the proposed site design and development characteristics. Site plans shall serve as part of the zoning for the property, and changes in site plans shall constitute a change in the zoning. No development shall occur or building permit approved for the property, which does not conform to the approved site plan. Issues: 1. The proposed Site Plan for the Bear Foot Lodge School complies with the Nonresidential Design Standards of Section 4.4 of the Zoning Ordinance, except for exterior wall building materials. 2. The applicant desires a log cabin image, used on other day care facilities, and proposes to use on the front and west facades wood planks, fashioned in the appearance of log rounds, finished on-site with a stain/preservative, with caulked seams (See elevation and photographs of a similar facility is under construction on Sachse Road at Miles Road in Sachse). The Zoning Ordinance requires that all nonresidential buildings be constructed of 100 percent masonry, and masonry is defined as brick, stone, cast stone, decorative concrete or stucco. The specific Development Conditions of the PD governing the subject tract requires that exterior walls for residential dwellings shall be 100 percent masonry (brick, stone, stucco, or Hardi-Plank) with a minimum exterior finish of 75 percent brick or stone. However, Section 3.4.F.I.a of the Zoning Ordinance provides that the Planning and Zoning Commission may grant exceptions to the masonry requirement for "new subdivisions which use an architectural style other than masonry and which provide similar or better long-term durability and maintenance quality as masonry". This provision is currently included only for residential development and is not provided within the nonresidential section, and the residential provision clearly states that "wood materials shall not be used". In January, the Commission approved an exception to the masonry requirement, allowing walls to 100% fiber cement siding for the 130 duplex Birmingham Farms Phase 2A Addition. Staff recommended against a request to use a similar 2" by 12" natural wood planking as facade material for a commercial use within the downtown area. Such a waiver could be granted as a condition of a Special Use Permit or as a condition of Site Plan review. The applicant has provided no documentation that the requested substitute provides similar or better long-term durability and maintenance quality as masonry construction. Site Plan — Bear Foot Lodge School 3. A tabulation of compliance with the requirements of the Zoning Ordinance is included on the Site Plan. The Plan provides for the additional Residential Adjacency Setback as required in Section 7.1 for nonresidential uses which abut residences. Common access is provided with the adjacent retail as required by Section 4.4.D.3, and parking is placed to the side and rear rather than in front of the building as desired in Section 4.4.D.1. Building illustrates that articulation features and at least two complimentary primary materials are used on the façade (Section 4.4.F.1.), and a pitched roof with dormers are used(section 4.4.F.2.). Staff Recommendation: Denial. While the concept of the log lodge is both acceptable and desirable as a unique design theme and the proposal complies with all other regulations of the Zoning Ordinance, the applicant has not yet documented that the wood siding to be used is as durable as masonry. All other aspects of the proposal are acceptable to staff The Departments of Planning, Engineering, Development Services, Public Works and Fire concur with this recommendation. This lot was identified within the Birmingham Farms Phase 13 Planned Development (PD 2002-39) for daycare uses by right without the requirement for an SUP. The PD also provided that the Development Plan serves as an approved Preliminary Plat. This Final Plat accommodates only the single lot for the Day Care and none of the remaining residential portions of the PD. A Site Plan for this project is also on the current agenda for consideration. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Final Plat — Bear Foot Lodge Addition Issues: 1. Staff has reviewed the proposed Final Plat for the Bear Foot Lodge Addition and found it to substantially conform to the approved Development Plan and complies with the Subdivision Regulations and all other pertinent code requirements of the State and City of Wylie. 2. The Plat provides an additional 70 feet of right-of-way for the future expansion of Park Boulevard, which is the primary point of access. Access easements are also provided from the adjoining commercial property to the west. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit. Staff Recommendation: Approval.
