Motion was made by Commissioner Phillips, and seconded by Commissioner Porter, to approve the minutes as submitted. Motion passed 6—0. Consider and act upon approval of a Site Plan for Anderson's Little Half Acre, being all of a certain 0.48 acre (20,910 square feet) tract of land, located at 2811 F.M.544, as recorded in a deed to Keith Anderson in Volume 4562, Page 972 of the Deed Records of Collin County, Texas and being situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Thompson stated that the tract is 0.48 acre, and the Site Plan under consideration is for a retail center with two proposed suites which totals 20,908 square feet. Thompson reviewed the history of zoning for the property having been changed from Business—2 to its current Corridor Commercial. The property is part of the McCord's Little Six Addition, which was never properly recorded and each lot is required to be platted as development plans are proposed. No one was present to represent the request. Commissioners discussed the ADA regulations and the need for a sidewalk to safely access the handicap parking, and the location of the fire hydrant within the dedicated fire lane. There was also discussion of landscaping for the front and sides, and the location of proposed signs. The applicant was not present to answer questions. A motion was made by Commissioner Porter, and seconded by Commissioner Chapman, to table action on the Site Plan until January 21, 2003, so that technical questions can be reviewed with the applicant. Motion passed 4—2, Commissioner Snider and Commissioner Phillips opposed. 2. Consider a recommendation to the City Council regarding a Final Plat for Lot 1, Block A of Anderson's Little Half Acre Addition (formally known as Lot 5 of McCord's Little Six Subdivision, an Addition not filed for record), being all of a certain 0.48 acre tract of land, located at 2811 F.M. 544, as recorded in a deed to Keith Anderson in Volume 4562, Page 972 of the Deed Records of Collin County, Texas and being situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Thompson stated that the previously reviewed and tabled Site Plan might dictate changes of the subject Plat. In response to the Commissioner's concern, he reviewed the legal formality of tabling a Plat versus denying due to technical questions and stated that the issues raised on the Site Plan provide sufficient technical concern to either delay action or deny the Plat without endangering automatic approval within the 30-day review allowed by law. P & Z Commission Meeting January 7, 2003 Page 3 of 5 A motion was made by Commissioner Phillips, and seconded by Commissioner Adamcik, to table consideration of the Final Plat until January 21, 2003, in order to allow the applicant time to address the technical questions raised in review of the Site Plan. Motion passed 6—0. 3. Consider a recommendation to the City Council regarding a Final Plat for the Avalon Addition Phase 1, being a certain 42.372 acre tract of land generally located south of Brown Street and west of Kreymer Road (C.R. 432), being part of a called 77.14 tract described in a deed to Neva Lou Kreymer and Robert Kreymer as recorded in Volume 2787, Page 255 of the Deed Records of Collin County, Texas, and being situated in the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Thompson stated that the subject Plat creates 109 single-family residential lots, 4.803 acres of public parkland and additional right-of-way for the future widening of Kreymer Road (C.R. 432). The property totals 42.372 acres in size, and is Phase One of the subdivision. Phase Two is also on the current agenda for consideration. The land is zoned for a Planned Development District, and the Plat conforms to the approved development plan of the PD. No one was present to represent the request, and there was no discussion by the Commission. A motion was made by Commissioner Snider, and seconded by Commissioner Chapman to recommend approval to the City Council. The motion passed 6-0. 4. Consider a recommendation to the City Council regarding a Final Plat for the Avalon Addition Phase 2, being a certain 28.2213 acre tract of land generally located south of Brown Street and west of Kreymer Road (C.R. 432), being part of a called 77.14 tract described in a deed to Neva Lou Kreymer and Robert Kreymer as recorded in Volume 2787, Page 255 of the Deed Records of Collin County, Texas, and being situated in the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Thompson stated that the subject property is Phase Two of the subdivision for which Phase One was previously approved on the current agenda, and creates 86 single-family residential lots, and 2.00 acres of public parkland on 28.2213 acres. A motion was made by Commissioner Snider, and seconded by Commissioner Porter, to recommend approval to City Council. Motion passed 6—0. P & Z Commission Meeting January 7, 2003 Page 4 of 5 5. Consider and act upon approval of a request by Pulte Homes for a waiver of the requirements for masonry exterior façade materials, Section 3.4.F.1.a(3) of the Zoning Ordinance, to allow a fiver cement siding to create a theme of traditional neighborhood design within the Birmingham Farms Phase 2B Addition. Thompson reviewed the history of the subject property and stated that the property totals 23 acres and includes 130 duplex residential lots. The property was platted as duplexes in June 2001, but was rezoned to Single-Family 8.5 (SF 8.5/17) Residential in February of 2002. The development must comply with the architectural regulations of the current Zoning Ordinance, which requires the exterior walls of all residential dwellings to have 100 percent brick or stone laid masonry units or masonry stucco. The Ordinance allows the Planning Commission to approve variance to this masonry requirement when such is compatible to surrounding development. The owner/applicant desires to develop a community of duplex dwellings, with a similar "Traditional Neighborhood Design"theme architectural design, which is growing in popularity throughout the nation. A variance from the 100% masonry requirement is being requested in order to allow exterior walls to be 100% fiber cement siding rather than masonry. The requested variance is within the spirit of the Zoning Ordinance which both encourages Neotraditional design and nonmasonry materials within thematic subdivisions. Thompson noted that when the property was platted the Ordinance allowed single-car garages for duplexes, although two-car garages are required by the current Ordinance. Gary Gardner, Pulte Homes of Texas, 1234 Lakeshore Drive, Coppell, Texas, represented as the applicant, stated that the property owner will choose either a one or two car garage, and all garages will be accessible from the alley. Commissioners discussed the issue involving numerous drivers in one household and the lack of parking spaces provided for a duplex. Gardner stated that all three-bedroom duplexes will have a 2-car garage. The applicant agreed to require 2-car garages in all three-bedroom dwellings. A motion was made by Commissioner Chapman, and seconded by Commissioner Phillips,to approve the variance of exterior masonry, with stipulation that all three- bedroom dwellings include 2-car garages and the two-bedroom duplexes may have either a 1 or 2-car garage. Motion passed 6—0. Commissioner George adjourned for a break at 8:07 p.m. and reconvened for a work session at approximately 8:30 p.m. P & Z Commission Meeting January 7, 2003 Page 5 of 5 WORK SESSION 1. Review draft proposal of new Subdivision Regulations. Thompson reviewed differences between the current Regulations and the proposed. He stated that a separate Concept Plan or Land Study must now be approved prior to a Preliminary Plat, which previously served as the land study/concept. The Preliminary Plat now will more closely resemble the filable Final Plat. Development requirements and details of other codes have been referenced but not repeated, to eliminate need to revise all codes when any one is revised. A motion was made by Commissioner Snider, and seconded by Commissioner Porter, to recommend approval to City Council the Subdivision Regulations with no changes. Motion passed 6—0. Bradley, Secretary tflipf city of Wylie Action Item No. 1 Site Plan Anderson's Little Half Acre Planning and Zoning Commission Meeting: January 21, 2003 (Tabled from January 7, 2003) Owner: Keith Anderson Designer: Gerald Monk Consulting Engineer Location: 2811 F.M. 544 Existing Zoning: Corridor Commercial(CC) District Summary: This item was tabled from the January 7, 2003 Planning and Zoning Commission meeting due to the absence of the applicant and his representatives. The Site Plan under consideration is for a retail center with two proposed suites. The first suite is approximately 2,940 square feet and the second suite is approximately 2,050 square feet for a total building size of approximately 4,990 square feet. The lot totals 0.48 acre(20,908.8 sq. ft.). The property was zoned Business District (B-2) in 1989 and was part of the unrecorded McCord's Little Six Addition. This property was rezoned to Corridor Commercial (CC) District in February,2002 with the adoption of the new citywide Zoning Ordinance and Map. A proposed plat creating Lot 1, Block A of Anderson's Little Half Acre Addition, which creates the lot of record for the facility, is on the current agenda for consideration. Section 8.1.D of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning and Zoning Commission for any development within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, accommodation of sensitive environmental issues, safe and efficient vehicular and pedestrian circulation, and provision of supporting utilities and other services, and site plans shall contain sufficient information related to existing site considerations as well as the proposed site design and development characteristics. Site plans shall serve as part of the zoning for the property, and changes in site plans shall constitute a change in the zoning. No development shall occur or building permit be approved for the property which does not conform to the approved site plan. Site Plan—Anderson's Little Half Acre Issues: 1. Since the McCord's Little Six Addition was never properly recorded, the owners of each of these lots are being required to plat the property as development plans are proposed on each. Additionally, owners have no vested rights in previous zoning and all of the development requirements of the new Zoning Ordinance apply to these projects. 2. The Commission addressed a number of concerns during the Public Hearing of this Site Plan at the January 7, 2003 meeting, including ADA requirements, sidewalks, and landscaping in the front yard. The Site Plan has since been revised and the applicant has resolved these issues and complies with all applicable technical requirements of the City of Wylie, including the regulations of the newly revised Zoning Ordinance. The Site Plan includes a tabulation of how the development points will be achieved. 3. The code encourages joint/common access/egress drives in commercial developments, and the Site Plan indicates such access has been provided to the adjoining property to the east. This joint access is created by an access easement on the plat, which is also on the current agenda for consideration. Location: 2811 F.M. 544 Existing Zoning: Corridor Commercial (CC) Summary: This item was tabled from the January 7, 2003 Planning and Zoning Commission Meeting due to the absence of the applicant and his representatives. The Final Plat for Lot 1, Block A of Anderson's Little Half Acre Addition includes 0.48 acre and will create a single lot for Retail/Office uses. This property is located within the McCord's Little Six Addition, a subdivision that was never filed for record and therefore never legally platted. The property was zoned Business District (B-2) in 1989 and was rezoned to Corridor Commercial (CC) with the adoption of the new citywide Zoning Ordinance and Map in February 2002. A Site Plan for the subject property is also on the current agenda for consideration. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Final Plat—Anderson's Little Half Acre Addition Issues: 1. The Final Plat substantially conforms to the Site Plan and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. No additional Right of Way will be required to be dedicated for F.M. 544 with this plat. 3. A joint access easement has been provided on this plat to provide cross access to the adjoining tract to the east for future development in order to reduce the number of curb cuts needed. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit on each lot. Staff Recommendation: Approval The Departments of Planning, Engineering, Development Services, Public Works and Fire concur with this recommendation. Location: Generally located east of F.M. 544 and south of Stone Road Existing Zoning: Planned Development(PD 2002-21) (Formerly PD 2001-51) Summary: The Final Plat under consideration is for the Bozman Farm Estates, Phase 1. The property includes 94.525 acres and will create 278 single-family residential lots and 22 common areas/open spaces to be owned and maintained by the Homeowners Association. The subject property is part of the larger Bozman Farms Planned Development (PD 2002-21), which consists of a mixed use development of Single Family Residential of varying densities, a Village Center community as defined by the Comprehensive Plan with Multifamily Residential and neighborhood retail, a school site, and common open spaces. The Concept Plan approved by the City Council as part of the original Planned Development (PD 2001-51) on December 11, 2001 serves as an approved Preliminary Plat. An amendment to Planned Development PD 2001-51 was approved by the City Council on December 10, 2002 thus changing the ordinance number to PD 2002-21. The subject development will comply with all of the applicable requirements set forth in the conditions of the PD 2002-21. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Final Plat—Bozman Farm Estates,Phase 1 Issues: 1. The Final Plat substantially conforms to the approved Concept Plan of the Planned Development PD 2002-21 and complies with the Subdivision Regulations and all other pertinent code requirements of the City of Wylie. 2. Collins Boulevard will be constructed to provide primary access to the subject property. A portion of Collins is located outside of the subject Plat and is part of the Lake Trails of Bozman Farms Addition, which received Final Plat approval by the Council in July 2002 and is also a part of PD 2002-21. 3. A second point of access will be Chestnut Hill Drive, which connects with F.M. 544 just north of the Collins Boulevard intersection. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid prior to issuance of a building permit on each lot.
