01-16-2007 (Planning & Zoning) Minutes Wylie Planning and Zoning Board CITY OF WYLIE Minutes Wylie Planning & Zoning Board Tuesday, January 16, 2007 —7:00 pm Wylie Municipal Complex—Staff Conference Room 2000 Highway 78 North CALL TO ORDER Chairman Larson called the meeting to order at 7:00PM and stated that a quorum was present. In attendance were: Chairman Larson, Commissioner Goss, Commissioner Ames, Commissioner Finnell and Commissioner Gregg. Commissioner Onufreiczuk, and Commissioner Bennett were absent. Staff members present were Renae 011ie, Charles Lee, Jasen Haskins, and Mary Bradley. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Larson gave the invocation and Commissioner Goss led the pledge of allegiance. CITIZENS COMMENTS No one approached the Commissioners. Minutes January 16, 2007 Wylie Planning and Zoning Board Page 1 of 4 CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the January 2, 2007 Regular Meeting. A motion was made by Commissioner Gregg, and seconded by Commissioner Ames, to approve the minutes from January 2, 2007, regular meeting as submitted with no changes or corrections noted. Motion carried 5 - 0. ACTION AGENDA ITEMS PUBLIC HEARING 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a request for a Special Use Permit (SUP) for a Telecommunications Tower to be located generally at the northeast corner of Stone Road and Akin Lane. ZC 2006-19. Mr. Lee stated that the applicant is proposing to construct an 80-foot tall church tower and incorporate telecommunication antennas and equipment within a 900 square foot lease space located southeast of the existing church building. The subject property the First Christian Church of Wylie, and is surrounded by Single Family Residential uses and is zoned Single Family 10/24. The proposed tower is consistent and similar in appearance and character with accessory structure/towers normally associated with church campuses. In the Zoning Ordinance, Article 5, Section G. 14, in regulating telecommunication towers, sixteen provisions shall be met prior to consideration of the City Council. At the time of posting, the applicant complied with fifteen of the provisions, including maximum height, setback from residential districts, construction type and visual impacts. Prior to the meeting the applicant submitted certification letter that the antenna is available for use by other wireless telecommunications provider, which is one of the provisions. Thereby, the applicant complies with all sixteen provisions. A notification was mailed to the property owner only, due to the legal description the 200 feet notification area is for lease space only of the subject property. The proposed tower is approximately 270 feet from residential dwellings from the north, and approximately from the east is 229 feet and approximately 250 feet from the dwelling units to the west. The proposed tower measures 80 feet, which is approximately six stories with a single story being measured as 14 feet. Minutes January 16, 2007 Wylie Planning and Zoning Board Page 2 of 4 Commissioner Ames expressed concern of the number of providers allowed within the tower. Mr. Dave Kirk, T-Mobile Representative, 7668 Warren Parkway, Frisco, Texas, stated that the height of the tower will allow up to three additional providers. The tower will be screened by an eight-foot fence. The tower will be a three-sided structure with a cross on top. Chairman Larson opened the Public Hearing. Mr. Harold Hardee, Pastor of First Christian Church, 701 E Stone, spoke in favor of the zoning request, and will be a landmark and a good addition to the community. Ms. Alicia White, 814 Forest Edge Lane, spoke in opposition of the request, due to the height, which to her calculations was ten feet per story putting the tower to be eight stories tall, and no other structure is that tall within the area of the proposed property. Chairman Larson closed the Public Hearing. Commissioners Goss and Gregg expressed concern of the height. Ms. 011ie distributed comments from Commissioner Onufreiczuk, who was unable to attend the meeting, but submitted a written concern of the height. Mr. Kirk stated that the 80 foot request is the lowest height, in order to obtain coverage for the area. A motion was made by Commissioner Ames, and seconded by Commissioner Finnell, to recommend approval of Zoning Case 2006-19, regarding a request for a Special Use Permit (SUP) for a Telecommunications Tower to be located generally at the northeast corner of Stone Road and Akin Lane. Motion carried 3 -2, with Commissioner Gregg and Commissioner Goss voting in opposition. WORK SESSION 1. Discuss change of zoning for 10.005 acres located south of Brown Street and west of Country Place Lane and 10.005 acres located on the southwest corner of Brown Street and Country Place Lane. Mr. Lee stated that at the last meeting on January 2, 2007, the Commissioners and applicant agreed to hold a special work session to discuss uses for Neighborhood Services request. Mr. Lee stated that he spoke with Mr. Kreymer, one of the applicants, and he opted not to attend the meeting due to the applicant on adjoining property was not attending. Mr. Kreymer stated that the two properties were married together and with his property being in the middle of the block, he did not see the viability of his property being able to stand alone in the zoning request. Comments were received and distributed to the Commissioners from surrounding property owners that expressed desire to have on record their concerns for the Minutes January 16, 2007 Wylie Planning and Zoning Board Page 3 of 4 subject property. The Commissioners expressed their frustration of having to call for a special called work session for these properties, and no developer or applicants attending the meeting. A motion was made by Commissioner Gregg, and seconded by Commissioner Goss, to close the work session. Motion carried 5 — 0. ADJOURNMENT A motion was made by Commissioner Gregg and seconded by Commissioner Ames to adjourn the meeting at 7:38PM.
