08-15-2011 (Zoning Board of Adjustment) Minutes Wylie Zoning Board of Adjustment CITY OF WYLIE Minutes Zoning Board of Adjustment Monday, August 15, 2011 — 7:00 pm Wylie Municipal Complex — Council Chambers 300 Country Club Road CALL TO ORDER Chair Linda Jourdan called the meeting to order at 7:00 p.m. and stated that a quorum was present. Board Members present were; Board Member Bill Baumbach, Board Member Kelly Price, and Board Member Bryan Rogers. Board Members Karyn McGinnis, and Darnell Harris were absent. Staff members present were: Renae' 011ie, Planning Director, Charles Lee, Senior Planner, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant. ELECTION OF CHAIR AND VICE CHAIR A motion was made by Board Member Rogers, and seconded by Board Member Price to nominate Board Member Baumbach as Chairman. Motion carried 4 — 0. A motion was made by Board Member Rogers, and seconded by Board Member Jourdan to nominate Board Member Price as Vice-Chairman. Motion carried 4 — 0. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the April 18, 2011 Meeting. A motion was made by Board Member Baumbach, and seconded by Board Member Rogers, to approve the Minutes from the April 18, 2011 Meeting as submitted. Motion carried 4 — 0. PUBLIC HEARINGS Minutes August 15, 2011 Wylie Zoning Board of Adjustment Page 1 of 3 1. Hold a public hearing to consider and act upon a request by Carlos Torres for a Variance to Section 3.1 A (3) Development Standards of the Zoning Ordinance for A/30 zoned properties requiring a minimum 200 feet width and 20 feet side yard setbacks, property located at 950 Hensley Lane, being Lot 1, Block A of the Torres Addition. (ZBA 2011-04). Mr. Lee stated that the property is located at 950 Hensley Lane, and the applicant is Carlos Torres. The applicant is requesting a variance from requirements in the Development Standards from a 200 foot minimum lot width to a 100 foot lot width and from a 20 foot side yard to 10 foot. The applicant desires to construct a Single Family Residential House. The existing residential structure was demolished in March. The applicant made the effort to purchase adjacent property in order to meet the Development Standards Requirements and was unable to obtain the property. The property was annexed into the city in the 1990's. A single family residential dwelling is an allowed use, but the subject lot does not comply with minimum yard requirements. A Final Plat was approved by Planning and Zoning on August 2, 2011 and will be considered by City Council on August 23, 2011 subject to approval of the variance requests. Public Comment Forms were mailed to nine property owners within 200 feet of the property, and no comment forms were returned either in favor or opposition of the request. 11 Chair Jourdan opened the Public Hearing. Mr. Carlos Torres, 950 Hensley Lane, applicant, stated that there are no other structures on the property, and he desires to construct a Single Family Residential Home. Mr. Baumbach expressed concern of request for two variances on the same lot, and when the tract of land was annexed into the city a hardship was created on the lot width and setbacks. Chair Jourdan closed the Public Hearing. A motion was made by Board Member Baumbach, and Board Member Price, to Grant a variance to Section 3.1 A (3) Development Standards of the Zoning Ordinance for A130 requiring a minimum 200 feet width and 20 feet side yard setbacks, property located at 950 Hensley Lane, being Lot 1, Block A of the Torres Addition.
