Commission Members Present: Staff Member Present: Steve Ahrens Mindy Manson William Chapman Michael George Mike Phillips Carter Porter Tony Snider Gary Wiseman PREMEETING The premeeting was convened at 6:30 p.m. Manson addressed questions from the Commissioners. CALL TO ORDER Chairman George called the Regular Meeting to order at 7:05 p.m. PLEDGE AND INVOCATION Commissioner Snider offered the Invocation and Commissioner Wiseman led the Pledge of Allegiance. CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the April 30, 2001 Special Work Session and the May 1, 2001 Regular Meeting. A motion was made by Commissioner Ahrens and seconded by Commissioner Porter to approve the minutes from the April 30 and May 1 meetings. The motion passed, 7 — 0. ACTION AGENDA 1. Consider and act upon approval of a Site Plan for a 1.351 acre retail center in the northwest corner of F.M. 544 and Springwell Parkway, being Lot 2, Block A of the FM 544/Springwell Addition, situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Commissioner Phillips excused himself from deliberation of this request, due to a possible conflict of interest. Staff reported that the proposed site plan was for property located at the northwest corner of F.M. 544 and Springwell Parkway. The proposed uses include a convenience store with pump islands and future retail. A minor plat will be processed for this lot and the lot to the west, which also establishes the shared access easement and driveway on F.M. 544. Jim Dewey of JDJR Engineers and Consultants, 2505 Texas Drive, Suite 109, Irving, Texas was present, representing the owners. Commissioners questioned the location and nature of the landscaping. Mr. Dewey responded that the landscaping will include trees and shrubbery and is located in the front and east side of the property. In addition there is a grassy area on the north side of the property that will be landscaped, but is not included in the totals reflected in the site plan. Commissioner Ahrens questioned the location of the 4 parallel parking spaces on the southeast corner of the property, and expressed concern that they would present maneuvering problems for the gas pumps. Mr. Dewey indicated that those spaces could be accommodated on the north side of the site. Commissioner George addressed the elevation of the building, with questions regarding the brick. He asked if they would consider raised columns in the front and side, along with some type of articulation in the front of each retail space, such as awnings or covered entrance. The applicant indicated that he did not believe that would be a problem. Discussion followed regarding the pole sign and the possibility of providing a monument sign, as is being discussed with proposed code amendments. The applicant stated that they would be willing to look at monument signs, if there are defined requirements, and if there is assurance that other businesses would be held to the same standard. Commissioner Snider made a motion to approve the Site Plan with the following conditions: 1. That articulation, including the raised brick columns and some type of awning be provided on the front and side of the project; and 2. The parallel parking at the southeast corner of the site be relocated to the back of the property; and 3. A masonry, double columned sign be provided. Commissioner Ahrens seconded the motion. The vote was 6—0 for approval. At this point, Commissioner Phillips rejoined the meeting. 2. Consider a recommendation to the City Council regarding a Final Plat for the Shiloh Baptist Church Addition, located at 840 East Brown Street, east of State Highway 78, being all of a certain 2.001 acre tract situated in the Francisco de la Pina Survey, Abstract No. 668, City of Wylie, Collin County, Texas. Staff reported that this is the final plat for the Church, and is in compliance with the Preliminary Plat and the Subdivision Regulations. This will establish a lot of record and enable the church to begin work on improvements to the property, including bringing two moved in buildings up to code. Todd Nivens, Senior Pastor for Shiloh Baptist Church was present. Commissioners asked about the electric line that was present on the property. Mr. Nivens responded that they have spoken with TxU and that the 3-phase line is no longer in use and will be removed, negating any need for an easement. A motion was made by Commissioner Ahrens to recommend to the City Council the approval of the plat. Commissioner Chapman seconded the motion. The vote was 7 — 0 for approval. 3. Consider a recommendation to the City Council regarding a Final Plat for the Twin Lakes Phase IV Addition, including a partial waiver of alleys, generally located south and north of Alanis Drive and east of South Ballard Avenue (F.M. 2524), to the east of Twin Lakes Phase I, being all of a certain 32.782 acre tract situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas. Staff reported that a partial alley waiver for the Final Plat of Twin Lakes Phase IV was recommended for approval by the Planning Commission during their May 1, 2001 meeting. This waiver affects Lots 16—30, Block L, and Lots 78 — 97, Block E. An alley waiver is not necessary for Lots 1 — 21, Block N because of the adjacent drainage easement, which was also reflected in the Preliminary Plat. A motion was made by Commissioner Snider to recommend to the City Council the approval of the plat. Commissioner Ahrens seconded the motion. The vote was 7 — 0 for approval. PUBLIC HEARING AGENDA 1. Hold a public hearing and consider a recommendation to the City Council regarding a change in zoning from Retail (R) District to Business-2 (B-2) District, for a 4.703 acre tract generally located south of State Highway 78 and south of West Kirby Street(F.M. 544), situated in the E.C. Davidson Survey, Abstract No. 267 and being Lot 1, Block 1 of the Wylie Shopping Village No. 1 Addition, City of Wylie, Collin County, Texas. (Zoning Case No. 01-06) Staff reported that the proposed zone change request was to accommodate a proposed gasoline service station. Discussion followed regarding a previous request for B-2 zoning in the same location. At that time, there were concerns regarding access and parking. Staff indicated that it has been determined on preliminary review of a site plan, that adequate parking will remain for the grocery store after the proposed gas station is built. However, specific issues such as provision of parking and access will be addressed at the time of site plan review. Discussion turned to the proposed B-2 zoning district. Commissioner Ahrens expressed concerns that the B-2 district permits a wide variety of uses which would not be desirable on an entryway. Commissioner Phillips agreed, stating that the B-2 district is a very heavy commercial district and allows uses such as car repair. Commissioners questioned why the B-1 district was not proposed. Staff explained that the existing zoning pattern in the area consisted of B-2 zoning directly adjacent to this property and retail zoning on the subject property. Introducing yet another commercial zoning district could be construed as spot zoning. Jim Reilly of Brockett Davis was present representing Brookshires Grocery. He stated that the intended use was for a gasoline station and that they were willing to go with the B-1 zoning, with the assurance that the proposed use was allowed in that district. Commissioners questioned Mr. Reilly about the driveway access to the property. Mr. Reilly stated that TxDOT was closing the north driveway access off of S.H. 78 as a part of the widening project. Chairman George opened the public hearing. No one was present to speak. A motion was made by Commissioner Porter to recommend approval of the B-1 zoning district to Council. Commissioner Phillips seconded the motion. The vote was 7 — 0 for approval of the B-1 district. 2. Hold a public hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (A) District to Planned Development (PD) District for Church Related Activities, for a 15.00 acre tract generally located at the northwest corner of Country Club Road (F.M. 1378) and McMillen Road (C.R. 298), situated in the William Patterson Survey, Abstract No. 716, City of Wylie, Collin County, Texas. (Zoning Case No. 01-07) Staff reported that the proposed PD is for the purpose of building a church. Although the current zoning permits churches by right, there are limitations which prompted the applicant to seek the PD. Specifically, the current zoning options require height limitations of 36' and no more than one main building may be built on a single lot of record. The Special Conditions of the PD establish the underlying zoning of SF-10 with the additional height limitation of 60', special reference to the exterior finish, and establishing accessory church functions as land use limitations. Autrey Perkins of HH Architects was present, representing the applicant. Commissioner Ahrens asked about the proposed drainage of the property. Mr. Perkins stated that the civil engineering was just being completed. Staff stated that the detailed engineering, including drainage would be reviewed through the platting process, which will also come before the Commission. Commissioners questioned the phasing of the project. Mr. Perkins stated that the Multi- Purpose building would be built first, followed by the Sanctuary. The phasing of the additional buildings has not yet been determined. Considerable discussion followed regarding the proposed exterior finish. Commissioners discussed the merits of stucco versus eface. The exterior of the building is proposed as a combination of a stucco-type finish and masonry. Chairman George opened the public hearing. Mr. Tom Langston of 1355 Country Club Road spoke in opposition to the request. He stated that a letter had been sent via certified mail with the signatures of five property owners in the affected area in opposition, in addition, individual letters had been mailed. Mr. Langston indicated that they were not against the proposed church, but were very concerned about the need for PD zoning and opening up the area to possible future rezonings with commercial uses. Mr. Langston stated that he did not see the need to change from the existing Agricultural zoning. Mr. Matthew Butschek of 1755 Country Club Road also spoke in opposition to the request. He stated that he was also concerned about establishing a PD zoning and wanted to see the area developed as is set out in the Comprehensive Plan. At that time Chairman George read into the record the names of the individuals who had signed the certified letter, a copy of which was provided by Mr. Langston: Tom Langston, 1355 Country Club Road; Mario Aguilar, 1720 McMillen Road; Pat and Debra Jojoka, 1730 McMillen Road; Gary and Barbara Weberg, 1740 McMillen Road; and Robert and Joann Washburn, 1710 McMillen Road. A motion was made by Commissioner Ahrens to recommend approval of the Planned Development District to the City Council. Commissioner Chapman seconded the motion. The motion was approved by a vote of 7 — 0. WORK SESSION 1. Consider revisions to the Comprehensive Zoning Ordinance. No workshop was held. ADJOURNMENT A motion was made to adjourn by Commissioner Ahrens and seconded by Commissioner Chapman. The motion was approved 7—0.
