Staff Members Present: Commission Members Present: Claude Thompson, Planner Michael George Mike Phillip Carter Porter Consultants Present: Tony Snider Ray Stanland Gary Wiseman Commissioners Absent: Steve Ahrens William Chapman CALL TO ORDER Chairman George called the Special Work Session to order at 7:10 p.m., in the Council Work Session Room of the Municipal Complex. CITIZEN PARTICIPATION No one appeared to speak. WORK SESSION 1. Consider revisions to the nonresidential districts of the Comprehensive Zoning Ordinance with the consultant. Thompson distributed definitions and led a discussion of"spot zoning", noting that this has been an issue on two recent requests and will become increasing an issue as we transition from the old to the new requirements of the Zoning ordinance and revise the zoning map. He noted that zoning districts are required to encompass multiple parcels and allow multiple uses, and districts of small size which allow only limited uses has been termed spot zoning and ruled to be illegal by the courts. However, the major definition of spot zoning is neither size nor limited uses alone but is rather compatibility with surrounding uses. Rezoning a single lot differently than adjacent tracts is illegal spot if the uses are not compatible but is legal regardless of its size or allowed number of uses if the proposed use is compatible with that of adjacent parcels. P&Z Work Session May 29, 2001 Page 2 Stanland discussed a calendar of remaining review of the Zoning Ordinance. He distributed Articles 6 and 7 revised from earlier meetings, and new Articles 8 and 9 for initial review tonight and next week. Drafts of proposed revisions of the complete Ordinance will be distributed at the June 11 meeting (or, if available, the previous weekend for discussion on June 11), and members will be allowed two weeks to review the entire document. Thompson encouraged members to at least review topics in which they have a special interest or expertise, if they do not have time to review the complete document. We will attempt to have all reviews by staff and members compiled and incorporated into a new draft for distribution to the Council to distribute to P&Z and Council for a joint work session some time in mid July. The process of public review and hearing will then begin. While the text of the Ordinance is under review, potential revisions to the map will be proposed and reviewed. A methodology for transitioning from the old to new districts, requirements and map will be established. There is also likely to be some revision to the Comprehensive Plan. Standland led a discussion of Article 8, the sign Regulations. He noted that these proposed revisions are a closer revision of the existing requirements than are other parts of the revisions previously considered. Because of the special character of signs, this section contains its own somewhat special definitions and administrative processes. Discussion of the proposed revisions followed and the following recommendations were made by Commissioners. Garage signs should be limited to four (4) square feet, rather than eight (no. 8, page 4). Regulations for attached signs (Section 8.5, page 8+) should better accommodate multi-story structures, such as allowing the name of the building and/or primary tenant to be along the top of the secondary story and limit the number and size of individual tenants on the first floor street level. Neon should be permitted with controls similar to other signs. Monument signs should be favored and pole signs discouraged or limited. Back-lighted plastic signs should be prohibited. Ground signs should be allowed to four (4) feet height. Reader boards should be allowed only for institutional uses, and marquee signs allowed only within the downtown district. The existing regulations for "temporary real estate signs" should be kept and termed "subdivision marketing signs". Window signs should be limited, but the proposed 15% may be too restrictive rather than the existing 25% and some definition of these are measured should be included. Mobile signs should be allowed for more than nonprofit organizations, but still limited to by time. It should be clarified that flags and pennants does not prohibit all flags, and that floating devices/balloons does not limit all balloons. P&Z Work Session May 29, 2001 Page 3 2. Next meeting.
