Absent were Jim Ward, Cristine Price and Brandi Lafleur. Staff members present: Robert Diaz, Board Liaison and Park Board Secretary, Nancy Williams. Also in attendance were City Council Members Bennie Jones and Diane Culver. CITIZENS PARTICIPATION No citizens addressed the Board. BUSINESS ITEMS 1. Members Price, Ward and Lafleur being absent. DISCUSSION ITEMS 3. Discuss Planet Kidz Youth Program. Board Discussion Superintendent Diaz related to the Board City Council's direction given to staff after the last work session. First to see if staff could make contact with WISD to see if there was potential to do a joint program. Superintendent Diaz said due to the summer break he has been unable to make contact but that he will continue to be proactive. Chair Hiney informed Mr. Diaz that Marcia Coker had been out of town but was now back. Chair Hiney said she would like to invite the WISD (Superintendent, Athletic Director/ Communications Specialist)for a work session with Parks and Recreation Board. The second concern was cutting Recreation Center hours on Saturdays. Should we implement the program as proposed, the Recreation Center would be closing two hours earlier on Saturdays. A Council Member suggested we shift those hours to Saturday and/or adjusting Sunday hours. Chair Hiney asked what the additional cost would be to add those hours elsewhere. Mr. Diaz stated there would be no additional cost. During the Planet Kidz program Chair Hiney asked how many staff would be required. Superintendent Diaz said only one or two staff members would remain but they would be covered by the contract at no cost to the City. June 27,2011 Parks and Recreation Board Meeting Minutes Page 2 of 3 He suggested adding either one hour earlier each day or two hours earlier on Saturday. Instead of opening at 8 am, change it to 6 am on Saturday. Chair Hiney indicated her preference to keep them on Saturday to not effect staffs time off on Sunday. Member Robas asked how many patrons used the facility on Saturdays after 6 pm. Averaging the numbers from the statistics that have been collected, it is approximately 56 people between 6:30 and 7:30 pm. Chair Hiney felt with enough notice to the patrons it was an acceptable amount considering the program would allow us to provide activities to hundreds of an underserved demographic and people would be understanding. Mr. Diaz stated there were quite a few questions about the program from Council and that he felt it would be beneficial to have a joint work session with Council to answer any further questions the Council might have for them. Member Robas asked about attendance on Fridays. Mr. Diaz noted that the statistics are considerably higher than Saturdays; approximately three times the amount of patrons on average. Member Rose asked if the hours would be adjusted back to the original times during the summer when the program is not running. Superintendent Diaz indicated from a staff perspective it would be most beneficial to keep the hours the same all year round, allowing for more rental opportunities in the summer. Summing up, Superintendent Diaz remarked he would continue to seek contact with WISD and look at the hours of Recreation Center usage Saturday mornings. Those present were all in favor of opening the Recreation Center two hours earlier on Saturdays to accommodate Planet Kidz Youth Program. 4. Discuss the City's application for certification as a Tree City USA. (Presentation made by Shohn Rodgers, City of Wylie Parks Manager.) Board Discussion Superintendent Diaz introduced Parks Manager Shohn Rodgers. Mr. Rodgers passed out a sample ordinance and proclamation for Tree City USA, a budget worksheet and summary of the program. The first requirement is to have a budget equal to $2 per capita. He explained that anything you do involving trees applies to this program. To be recertified our budget must reflect a $2 per capita budget annually. Once certified it is easier to keep track especially once new Work Order system is in place next fiscal year. It will keep track of labor, purchases, etc. Mr. Rodgers informed the Board how helpful Member Ward was in helping with this application process since he had done this for Sachse. The second requirement is to have a board. The Parks and Recreation Board will be charged with carrying out the functions of the official tree board. The third requirement is to have a tree ordinance. He proposed adopting the sample tree ordinance be adopted by the Board as part of the Parks Ordinances. The last requirement is to have an Arbor Day Proclamation in place. There is no requirement for a specific day,just that we have one annually. Once all of this is in place, everything is sent to the State Forestry Coordinator who forwards it on to the Arbor Day Foundation which makes the final determination. The coordinator has seen all of our documentation and doesn't see a problem. The ordinance is currently under review by the City Attorney and once complete will be brought back for recommendation for passage by the City Council. Chair Hiney asked the benefits of being a Tree City. Mr. Rodgers said the benefits are that you have signage at all the entrances into the City indicating that Wylie is a "Tree City USA"which tells everyone that Wylie is a community that cares about trees and the environment and the ecology of where we live. It is a great public relations tool which encourages residents to plant trees of their own beautifying the city. Member Robas asked if there was a tree planting minimum. Mr. Rodgers said there was not. Once all trees are planted we can continue including all maintenance, programs, education, etc. count toward the program. This program only applies to publicly owned land, not private. Mr. Diaz told the Board that he is anticipating that Mr. Rodgers become a Certified Arborist for the City at some point in the future. He felt that if we pursue the Tree City route that that would be necessary; it could possibly be one of the supervisors if not Mr. Rodgers. June 27,2011 Parks and Recreation Board Meeting Minutes Page 3 of 3 Prior to the close of the meeting, Member Chesnut wanted to personally commend Mr. Diaz, Mr. Sferra and Ms. Powlen for the great job they did with their presentations at the June 28th Council meeting. Recommendation Motion to recommend to the City Council the Tree Preservation Ordinance for Tree City USA. Discussion Current Status : Staff has completed review of the ordinance with the City Attorney. Shohn Rodgers, Parks Manager will review the completed ordinance with the Board and answer any questions. Previous Information regarding the History: The Tree City USA program is administered by the Arbor Day Foundation, and recognizes cities across the nation who has demonstrated a commitment to preserving, caring for, and celebrating frees. Some of the benefits of becoming a Tree City USA are: encouraging better care of community forestry, increasing public awareness of the social, economical, and environmental benefits of urban forestry practices, contributing to community pride, and telling visitors, through signage, that this is a community that cares about its environment. There are four standards which a community must meet to be certified for this program, and yearly re-certification is required. The four standards are: 1) a free board or department which is responsible for the care and maintenance of public trees, 2) a free care ordinance, 3) a community forestry program with an annual budget of at least$2 per capita, 4) an Arbor Day observance and proclamation. The Parks Division has worked with the Texas State Urban Forestry Coordinator to refine our application materials and make sure we will meet the standards. Staff is currently working with the City Attorney on wording for a draft tree care ordinance, but it has been reviewed by the State Forestry Coordinator, and has been deemed sufficient to meet the standards. It also serves to establish the Parks and Recreation Board as the official Tree Board for the City, and provides for an annual Arbor Day observance. Staff will review the process for applying for the Tree City Status and answer any questions the Board may have on this process. Staff will bring the draft tree ordinance and proclamation for a recommendation by the Board for the August meeting. Approved By Initial Date Department Director RD 8/19/11 Page 1 of 1 ORDINANCE NO. 2010-XX AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ADOPTING ARTICLE VIII (PLANTING, MAINTAINING TREES, SHRUBS ON PUBLIC PROPERTY) OF CHAPTER 78 (PARKS AND RECREATION) OF THE CITY OF WYLIE CODE OF ORDINANCES; TO PROVIDE FOR THE CARE OF PUBLIC TREES AND SHRUBS WITHIN THE CITY OF WYLIE; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City of Wylie, Texas ("City") is in the process of applying to the Arbor Day Foundation for"Tree City USA" status; and WHEREAS, the application for "Tree City USA" status requires the City to adopt certain regulations related to the care and preservation of trees and shrubs on property owned, controlled and/or maintained by the City; and WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that "Tree City Status" status will benefit the citizens of Wylie by ; and WHEREAS, the City Council has investigated and determined that it is necessary and in the best interest of the City to adopt regulations related to the care and preservation of trees and shrubs on property owned, controlled and/or maintained by the City so the City may achieve "Tree City USA" status. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Chapter 78 (Parks and Recreation) by adopting Article VIII (Planting, Maintaining Trees, Shrubs on Public Property) to Wylie's Code of Ordinances. Article VI (Planting, Maintaining Trees, Shrubs on Public Property) is hereby adopted and added to Chapter 78 (Parks and Recreation) to read as follows: "ARTICLE VIII. PLANTING, MAINTAINING TREES, SHRUBS ON PUBLIC PROPERTY Sec. 78-250. -Purpose The purpose of this ordinance is to provide the City with authority over the care of all trees, plants, and shrubs located within City owned, controlled and/or maintained property, public rights-of-way, parks and other public places, which will aid in the establishment of a municipal landscape program and will enhance the public health, safety, and beauty of the city. Sec. 78-251. -Definitions The following words and phrases shall have the meanings ascribed unless the context clearly indicates otherwise: City means the City of Wylie, Texas. City Managed Property means public streets, alleys, rights-of way, parks, public places and other property owned, controlled and or maintained by the city. City Manager means the city manager of the City of Wylie, Texas or his or her designee. Parkway means the area lying between the street right-of-way line of any public street and/ or alley, and the curb line of the street and/or alley; or if there is no curb line, the paved portion of the street and/or alley. Generally, the parkway area is the area between the edge of the road/ curb and the farthest edge of the sidewalk, so that the entire sidewalk is contained in the parkway area. Public Property means all streets, alleys, rights-of-way, parks, public places and other property owned, controlled and/or maintained by the City. Top or Topping means the non-standard practice of cutting back of limbs to stubs larger than three (3) inches in diameter within a tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Sec. 78-252. -Grant of Authority; coordination with public works department a. The Public Services Director and/or his designee, hereinafter referred to as "Director," shall have authority over all trees and woody plants growing in or upon all City owned, controlled or maintained property, rights-of way, city parks, and other public property in the City. b. All City departments will coordinate as necessary with the Director and will provide services as required to assure compliance with this article as it relates to streets, alleys, rights-of-way, drainage, easements and other public properties not under the direct jurisdiction of the Director. Sec. 78-253. -Tree Advisory Board a. Board membership. The Tree Advisory Board shall consist of the members of the Parks and Recreation Advisory Board. b. Duties. The duties of the Tree Advisory Board shall include: i. To review the tree management plan, tree preservation and mitigation guidelines, and the tree care program as may be necessary; ii. To promote the protection of healthy trees and provide guidelines for the replacement and/or replanting of trees necessarily removed during construction, development, and redevelopment; iii. To uphold rules and regulations governing the protection and preservation of native or established trees within the City, which provide for purification of air and water, provide for shade, windbreaks and the cooling of air, provide for open space and more efficient drainage of land, thus reducing the effects on soil erosion; iv. To study, investigate, counsel and develop and/or update periodically a written plan for the care, preservation, pruning, planting, replanting, removal or disposal of public trees and shrubs on City property; v. To review and recommend specific beautification projects and public awareness programs to the parks and recreation department, City Manager and/or City Council as may be appropriate; vi. Coordinating and promoting Arbor Day activities; vii. Submitting the annual application to renew Tree City USA designation; and viii. Other duties that may be assigned by the City Council. Sec. 78-254. —Annual Arbor Day a. It is established that each year, Arbor Day shall be held in the City of Wylie, Texas. b. The Director shall plan and execute such celebrations or ceremonies as he or she deems appropriate each year. Sec. 78-255. -Planting, Preserving, Maintaining, Removing, etc. on Public Property a. The Director shall have the authority to plant, preserve, spray, trim, cable or remove any tree, shrub or plant on any City-managed property, street, alley, public place or easement owned or controlled by the City. The Director is authorized to remove, or order removed and/or sprayed any tree, shrub or plant or any part thereof that is in an unsafe condition, is injurious to the common good or to sewer pipes, public utility lines, drainage facilities, pavements, improvements, or is infested and dangerous to other trees, shrubs or plant. b. It is an offense for any person to plant or remove, or permit or cause to be planted or removed any tree, shrub or plant on or from, any public street, park or other City- managed property without the prior approval of the Director. The parkway area not managed by the City is the responsibility of the adjacent property owner, as described in Article 7 of the Zoning Ordinance No. 2001-48, as amended. c. No tree, shrub or other landscaping shall interfere with the free passage of vehicles on a public street or alley, or of pedestrians on the sidewalk or obscure the view of motor vehicle operators of any traffic control device or street sign, visibility triangle, or otherwise create a traffic hazard and shall at all times comply with City rules, regulations and ordinances. d. City departments and authorized contractors of the City constructing and/or repairing streets, alleys, or other City utilities or facilities shall be exempt from this chapter upon City approval of construction plans and specifications identifying such construction, provided that Best Management Practices as promulgated by the International Society of Arboriculture, as amended, are utilized. Sec. 78-256. -Adjacent Landowner Responsibility a. The owner of land adjacent to any city street or highway may, when acting within the provisions of this ordinance, plant, remove, prune or spray trees in the parkway area. Permission of the Director shall only be required when the owner of the abutting property intends to deviate from the rules and regulations contained in this ordinance. b. No property owner shall be permitted to allow a tree, or other plant growing on his or her property or within the parkway to obstruct or interfere with the view of drivers of vehicles or pedestrians on the sidewalk to create a traffic hazard. Property owners must maintain a clear space of seven (7) feet above the surface of a sidewalk and ten (10) feet above the curb line of an adjacent street. c. If an obstruction persists, the Director shall notify the property owner, in writing, to prune or remove the tree, shrub or plant within thirty (30) calendar days. If the owner fails to comply with the notice, the City may assess undertake the necessary work and charge the cost for such work to the property owner. Fees will be based on the current hourly wages of city maintenance workers. d. Other than property owners described above, it shall be unlawful for any person to plant or set out any trees or woody plants, or cause or authorize any person to plant or set out any trees or woody plants in or on any city street or highway within the city without first obtaining a written permission from the Director. Sec. 78-257. -Breaking, Injuring, etc. Trees and Shrubs on Public Property a. Except to remove, prune, trim or maintain trees, shrubs or landscaping as required above or as authorized by the irector in writing, it shall be an offense for any person, firm or corporation to cut or break any branch of any tree or shrub or injure in any way the bark of any tree or shrub on any public street, park or other city-managed property. It shall be an offense for any person, firm or corporation to permit, suffer or allow any injurious substance such as gas, salt, oil or other harmful substance to come in contact with any tree, shrub or plant on any public street, parkway area, park or other city property. b. It shall be an offense for any person, firm or corporation to attach any cable, wire, rope, sign or any other object to any tree, shrub or plant on any public street, park or other city-managed property without the prior written consent from the director. c. It shall be unlawful for any person, firm, or City department to top any street tree, park tree, or other tree on public property. Trees severely damaged by storms or other causes, where best pruning practices are impractical, may be exempted from this requirement at the determination of the Director. SECTION 3: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed, but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinance shall remain in full force and effect. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 5: Penalty Provision. Any person, firm, corporation or entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding Five Hundred and 00/100 Dollars ($500.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 6: Effective Date. This Ordinance shall become effective immediately upon its passage and publication as required by law. PASSED AND APPROVED on the day of , 2011. Recommendation N/A Discussion Current Status: Staff met with WISD staff on August 18, 2011 to review the Planet Kidz program. Staff met with Ian Halperin- Communications Director, Don Poole-Maintenance Director, and Marcia Coker-Communications Assistant. Staff reviewed all the history of program startup, information about the vendor, and possible scenarios on how to bring the program to Wylie. Some possible scenarios discussed were for the WISD to contract directly with vendor or have the City contract with the vendor and WISD separately. WISD officials will discuss all the scenarios and get back with the City. After receiving some direction from WISD staff will update the Board on the progress. Previous Information regarding Planet Kidz program: Staff has been discussing the Planet Kidz youth program with the owner, Dale Oakes,for approximately three years. Staff waited to bring this item to the Board and Council for review until the Wylie Recreation Center was completed and there was a place available to accommodate the program. Planet Kidz is a program for children in 3-8th grades held on Friday or Saturday nights during the school year. The program is held in area school gyms, YMCA's, and municipal recreation centers throughout Texas. The program is from 7pm-11pm and features live dj, sports, dancing, tournaments, contests, celebrity apprearances, crafts, educational demonstrations,prizes and giveaways. The admission is $10 per child plus the cost of concessions. From the $10, the recreation center (City) would receive $2 per child. Potential attendance could be 4-500 children per event. The events are held weekly during the school year. This program achieves two important goals: a program specifically aimed at youth in grades 3-8 and a steady revenue stream for the recreation center. The challenge to getting this program started at the recreation center is accommodating its hour of operations. The recreation center currently is opened until 10pm on Friday's and 8pm on Saturday's. Set up for the program at the recreation center would need to start by 6pm on either Friday or Saturday. Therefore hours of operation would need to change to accommodate this program. Staff recommends closing early on Saturdays because of the potential increase in rental revenue on those days when Planet Kidz is not operating (summer months). Page 1 of 2 Page 2 of 2 Staff is in need of direction from the Board on the viability of this type of program, which day to have the program on, and what adjustment in the hours of operation to the recreation center to accommodate the program. Staff will then have a work session with Council to review the program and provide the Board's input. Recommendation N/A Discussion Current Status: Staff has discussed the ordinance option below with Wylie Police Chief John Duscio to get his opinion: "Designated areas where domestic animals are not allowed include inside playground areas and within xx feet of the fencing, border, edge, or striping of any designated playing field, surface, court, backstop, dugout, or any other area identified by the posting of signage authorized by the Superintendent." Chief Duscio had the following concerns: Enforcement of a distance could be problematic and if implemented do not designate distance just place conspicuous signage in areas that would need to be enforced. Chief Duscio also commented that a broad stroke of law changes might not be needed for such isolated incidents and the leagues could enforce their own rules. Staff would like input from the Board on what direction would need to be taken regarding this ordinance. Previous Information regarding rules for large animals in parks: Staff discussed with the Board at the March 28, 2011, meeting the idea of restrictions on dogs in athletic field areas. Representatives from Wylie Youth Soccer Association, Wylie Baseball Association and Wylie Football League commented to the Board that they have some concerns about the safety of the spectators watching their respective sports due to park patrons having dogs near the playing areas. Staff notified the Board at the meeting that it could do some research on policies or ordinances from surrounding cities and bring it back to the Board in April for their review. Nancy Williams, Parks Administrative Assistant, researched the following cities: Plano,Allen, McKinney, Rowlett, Garland, Sachse, and Plano Sports Authority. Attached are the results she received from the cities and Plano Sports Authority. The City of Rowlett and City of Garland are the only two cities that address dogs and athletic fields. The other cities and Plano Sports Authority only address dogs be on a leash and that dog waste is picked up and disposed of. Current Wylie Prohibited acts regarding dogs: Secs. 78-110.Prohibited acts. It shall be unlawful for any person to commit any one or more of the following acts in a park unless authorized by city staff in writing: (1) To hitch,fasten, lead, drive or let loose, any animal, reptile or fowl of any kind,provided that this shall not Page 1 of 2 Page 2 of 2 apply to domestic animals as defined by the Animal Control Code when led by a static cord or chain not more than ten (10)feet long or a retractable cord not more than fifteen (15)feet long except in designated areas.
