The Chairman and Board request that all cell phones and pagers be turned off or set to vibrate. Carole Ehrlich,City Secretary Date Notice Removed 7 Parks and c 1 CIFY OF LI Meeting Minutes Monday,August 22,2011 —6:30 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road, Building 100 Wylie,Texas 75098 CALL TO ORDER Announcing the presence of a Quorum, Chairwoman Anne Hiney called the meeting to order at 6:34 p.m. Board Members present: Gary Robas, Matt Rose, Jim Ward and Cristine Price. Absent was Dan Chesnut. Staff members present: Robert Diaz, Board Liaison and Park Board Secretary, Nancy Williams. CITIZENS PARTICIPATION No citizens addressed the Board. WORK SESSION 1. Work session to gather Board and public input on the Wylie Neighborhood Parks Master Plan for Pheasant Creek Park and Forrest Ross property. (Presentation made by Chris Seely, Tim May, Joe Madrid and Mark Holiday of Teague, Nall and Perkins.) Board Discussion Tim May gave a PowerPoint presentation that was previously given to the City Council containing their concept plans for the two parks. He reminded the Board that no input has been given from the public, Board or Council and once this input has been given, the concept may change. After the presentation input from the public was requested. No citizens addressed the Board. Mr. May presented a concept for the Forest Ross property, "Park A", that incorporated three pieces of property (City-owned parkland, the Army Corps of Engineers and North Texas Municipal Water District properties) but noted that each one can stand alone. The thread pulling them together is the trails. Chair Hiney wanted to focus on the Forest Ross property owned by the City. Chair Hiney asked for suggestions from the Board. Member Robas liked the way they designed it. Member Price suggested multipurpose playing field into this area. Mr. May indicated he does have a basketball court in the NTMWD piece but said it could be incorporated in such a way as to keep the natural feel of the land. Member Ward didn't feel it necessary to add anything to the design of the parks since it was just a concept plan and there were no funds to build the parks. Member Rose felt the park should be left as more natural with trails for hiking biking since there are few parks that are left with just natural feel that would encourage outdoor activities for Scouts and other similar uses; he felt the more amenities added the fewer of those activities it will encourage. Liaison Diaz asked for input from the Board on the Council's request to make that area a gateway to the lake. Member Ward suggested just adding a trail head at the north end of the park with a crossing across Skyview and an entry into East Fork park. Chair Hiney indicated the signage at the south end as well as features in the park would help to define it. She asked staff if we could get ahead of the plan before the Park Street extension is built by requesting a four way stop or signal at Park and Forrest Ross. Liaison Diaz indicated that there have been talks with City Engineer, Chris Hoisted, and it has yet to be determined whether or not Forrest Ross is going to remain a thoroughfare or not; which will depend on what happens with the NTMWD's triangle piece. Member Ward suggested that if we were able to acquire the triangle piece the road could become parking with speed bumps with and entryway at the south end. Pheasant Creek, "Park B", discussions began with Member Ward asking Mr. May if it was feasible to put a crossing for the creek or if it was too cost-prohibitive. Mr. May said it was possible but it might be expensive due to the layout and depth of the creek. It would probably cost around $100,000 to cross at the narrowest section. It might become feasible if there were more recreational opportunities on the other side. August 22,2011 Parks and Recreation Board Meeting Minutes Page 2 of 3 Member Price expressed her concern over lack of off-street parking. Mr. May indicated that it would be possible to include a few spots near the existing lift station. Chair Hiney inquired how much more boardwalk with synthetic materials was than concrete. Mr. May indicated due to the terrain, it may be cheaper. Member Rose indicated he liked the way the four separate areas were designed to enjoy the boardwalks linking those areas together. Member Rose asked if the HOA piece in part of the property was conducive to basketball or other sport feature. Mr. May said there was some soil stabilization issues that prevented the HOA from doing anything; however, the City might be able to do it. BUSINESS ITEMS 2. Consider and act upon approving the Minutes from the July 25, 2011 meeting. Board Action Member Robas noted the header from the July 25, 2011 meeting was incorrect. Motion from Member Robas, seconded by member Rose to accept the minutes as amended. The motion passed 5-0 with Member Chesnut absent. 3. Consider and act upon approving the Vendor Application from the American Cancer Society Relay for Life as a fundraiser for cancer survivors. Board Action Item was pulled from the agenda, as it was cancelled. 4. Consider and act upon approving the Tree Preservation Ordinance for Tree City USA. Board Discussion Member Robas asked Shohn Rodgers, Parks Manager, regarding Section 78-255, 4th paragraph section D, to add a section that stated, "The Director should be notified if another (exempt) department is removing a tree." Chair Hiney asked if we would develop a standard form for those who want to plant a tree on any City property. Mr. Rodgers indicated he would look into that. She also asked how penalties would be determined if someone violates the ordinance. Mr. Rodgers said that would be up to the courts and police department. Member Robas suggested increasing the maximum fine should someone destroy an older tree that would cost thousands to replace. Member Price suggested they set a minimum fine and no maximum amount. Mr. Rodgers said he would consult with the attorney on that issue. Member Ward suggested a replacement mandate. Mr. Rodgers indicated the time line is to be finished by October so the program falls with our fiscal year. The mandate for celebration for Arbor Day doesn't need to be on specific day but he indicated November was a good time. Board Action A motion to table the item by Member Rose and seconded by Member Ward. The motion passed 5-0 with Member Chesnut absent. DISCUSSION ITEMS 5. Discuss Planet Kidz Youth Program. Board Discussion Liaison Diaz reviewed his meeting with WISD with the Board. The meeting was very encouraging and they could see the value in the program. It will be a school district decision. He said that he hoped we would get some feed back in time to come back to the Board at the September meeting and then on to Council in October. 6. Discuss large animal rules for parks. Board Discussion Liaison Diaz reviewed the concerns Police Chief Duscio had about the prospective ordinance. Member Ward suggested we ask the leagues to place a rule in their packet that the parents have to sign acknowledging if the bring an animal to the park the coach or referee has the authority to have it removed should it misbehave prior to spending money on signage and making a new ordinance. Lance Wallace, WBA President, addressed the board to say that there are people in the park that are not part of the ball games that it would be impossible to regulate. He also stated he would like it to say that you cannot have a dog or any animal on the playing surfaces/fields. August 22,2011 Parks and Recreation Board Meeting Minutes Page 3 of 3 Member Robas noted that the current ordinance prohibits animal owners to allow the pets to defecate without immediate removal. Member Rose suggested it read, "during organized play or events domestic animals are not allowed" or any way that gets the message across that it is only during events, as it's not a problem when the fields/concession stand aren't being used. Liaison Diaz suggested the ordinance specifically indicate when organized sporting events are occurring animals are not allowed in posted areas which include playground areas and the fencing or edge of any playing field...as designated by the Superintendent and have the signage reflect that. Member Ward suggested it would suffice to make the few changes in the ordinance as well as a notice to the leagues that verbiage should be included in their packets for parents and referees. Mr. Wallace suggested allowing them on the trails but prohibiting them from going near the playing fields, spectator areas and concession stand during games. Member Price said it should exclude service animals. Chair Hiney suggested that a sign on the entrance to the fenced fields saying "No animals allowed on the fields" and others on all playgrounds as well. Liaison Diaz indicated he would refine the verbiage and come back to the Board as well as going to the leagues when the ordinance is finalized. Liaison Diaz informed the Board that he received an official resignation from Brandi Lafleur and would get the reappointment scheduled on the next Council Meeting Agenda. All proceeds will go towards purchasing and shipping requested supplies to the troops in Afghanistan. Most of the supplies will be used for teaching literacy programs. Recommendation Motion to recommend to the City Council the Tree Preservation Ordinance for Tree City USA. Discussion At the last meeting of the Parks and Recreation Advisory Board, several questions were raised about the proposed Tree Care Ordinance submitted by the Parks and Recreation Department. These questions were passed along to the City Attorney, whose responses are listed below. 1. "How will the final amount of a penalty be decided? " Should a case involving a potential fine under this ordinance go to court, a judge would determine the final amount of a fine, up to $500.00. 2. "Could the maximum fine specified in the ordinance be left open-ended?" By statute, it cannot. $500.00 is the limit on fines assessed by a municipal ordinance. 3. "Would it be possible to insert language that ties the amount of any fines to the replacement cost of trees damaged or destroyed? " This would require very cumbersome legal wording, and would be likely to cause confusion. The value of any damaged or destroyed tree would have to be assessed by an outside expert, which would place a burden on the City. The attorney has added language reserving the City's right to file suit to recover damages if applicable. In addition, several typographical errors noted by the Board have been corrected, and minor changes have been made to the following sections: 78-255, 78-256, 78-257, and in the penalty provision section. These changes are noted on the attached copy of the proposed ordinance. WHEREAS, the City of Wylie, Texas ("City") is in the process of applying to the Arbor Day Foundation for"Tree City USA" status; and WHEREAS, the application for"Tree City USA" st atus requires the City to adopt certain regulations related to the care and preservation of trees and shrubs on property owned, controlled and/or maintained by the City; and WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that"Tree City USA Status" will benefit the citizens of Wylie by enhancing the public health, safety and beauty of the city and safeguard the protection of public trees, shrubs and plants; and WHEREAS, the City Council has investigated and determined that it is necessary and in the best interest of the City to adopt regulations related to the care and preservation of trees and shrubs on property owned, controlled and/or m aintained by the City so the City m ay achieve "Tree City USA" status and safeguard the protection of public trees, shrubs and plants. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Chapter 78 (Parks and Recreation) by adopting Article VIII (Planting, Maintaining Trees, Shrubs on Public Property) to Wylie's Code of Ordinances. Article VI(Planting, Maintaining Trees, Shrubs on Public Property)is hereby adopted and added to Chapter 78 (Parks and Recreation)to read as follows: "ARTICLE VIII. PLANTING, MAINTAINING TREES, SHRUBS ON PUBLIC PROPERTY Sec. 78-250. -Purpose The purpose of this ordinance is to provide the City with authority over the care of all trees, plants, and shrubs located within C ity owned, controlled and/or m aintained property, public rights-of-way, parks and other public places, which will aid in the establishm ent of a municipal landscape program and will enhance the public health, safety, and beauty of the city. Sec. 78-251. -Definitions The following words and phrases shall have the meanings ascribed unless the context clearly indicates otherwise: City means the City of Wylie, Texas. City Managed Property means public streets, alleys, rights -of way, parks, public places and other property owned, controlled and or maintained by the city. City Manager means the city manager of the City of Wylie, Texas or his or her designee. Parkway means the area lying between the street right-of-way line of any public street and/ or alley, and the curb line of the street an d/or alley; or if there is no curb line , the paved portion of the street and/or alley. Generally, the parkw ay area is the area betwee n the edge of the road/ curb and th e farthest edge of the sidewalk, so that the entire sidewalk is contained in the parkway area. Public Property means all streets, alleys, rights-of-way, parks, public places and other property owned, controlled and/or maintained by the City. Top or Topping means the non-standard practice of cu tting back of limbs to stubs larger than three (3)inches in diam eter within a tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Sec. 78-252. -Grant of Authority; coordination with public works department a. The Public Services Director and/or hi s designee, hereinafter referred to as "Director," shall have authority over all trees and woody plants growing in or upon all City owned, controlled or maintained property, rights-of way, city parks, and other public property in the City. b. All City departments will coordinate as necessary with the Director and will provide services as requir ed to assure com pliance with this ar tide as it r elates to str eets, alleys, rights-of-way, drainage, easem ents and other public properties not under the direct jurisdiction of the Director. Sec. 78-253. -Tree Advisory Board a. Board membership. The Tree Advis ory Board s hall consist of the m embers of the Parks and Recreation Advisory Board. b. Duties. The duties of the Tree Advisory Board shall include: i. To review the tr ee management plan, tr ee preservation and m itigation guidelines, and the tree care program as may be necessary; ii. To promote the protection of healthy trees and provide guidelines for the replacement and/or replanting of trees necessarily removed during construction, development, and redevelopment; iii. To uphold rules and regulations governing the protection and preservation of native or established trees within the City, which provide for purification of air and water, provide for shade, windbreaks and the cooling of air, provide for open space and m ore efficient drainage of land, thus red ucing the effects on soil erosion; iv. To study, investigate, counsel and de velop and/or update periodically a written plan for the care, preservati on, pruning, planting, replanting, rem oval or disposal of public trees and shrubs on City property; v. To review and recommend spe cific beautification projects and public awareness programs to the parks and recreation department, City Manager and/or City Council as may be appropriate; vi. Coordinating and promoting Arbor Day activities; vii. Submitting the annual application to renew Tree City USA designation; and viii. Other duties that may be assigned by the City Council. Sec. 78-254. —Annual Arbor Day a. It is established that each year, Arbor Day shall be held in the City of Wylie, Texas. b. The Director shall plan and execute such celebrations or cerem onies as he or she deems appropriate each year. Sec. 78-255. -Planting, Preserving, Maintaining, Removing, etc. on Public Property a. The Director shall have the authority to pl ant, preserve, spray, trim, cable or rem ove any tree, shrub or plant on any City-m anaged property, street, alley, public place or easement owned or controlled by the City. Th e Director is authorized to rem ove, or order removed and/or sprayed any tree, shrub or plant or any part thereof that is in an unsafe condition, is injurious to the comm on good or to sewer pipes, public utility lines, drainage facilities, pavements, improvements, or is infested and dangerous to other trees, shrubs or plant, that is located on City-owned or managed property. b. It is an offense for any person to plant or remove, or permit or cause to be planted or removed any tree, shrub or plant on or fr om, any public street, park or other City- managed property without the prior approva 1 of the Director. The parkway area not managed by the City is the responsib ility of the adjacent property owner, as described in Article 7 of the Zoning Ordinance No. 2001-48, as amended. c. No tree, shrub or other landscaping shall interfere with the free passage of vehicles on a public street or alley, or of pedestrians on the sidewalk or obscure the view of m otor vehicle operators of any traffi c control device or street sign, visibility triangle, or otherwise create a traf fic hazard and shall at all tim es comply with City ru les, regulations and ordinances. d. City departments and authorized contractors of the City constructing and/or repairing streets, alleys, or other City utilities or facilities sh all be exem pt from this chap ter upon City approval of constr uction plans and specifi cations identifying such construction, and notif ication of the Director, _ provided that Best Managem ent Practices as promulgated by the International Society of Arboriculture, as am ended, are utilized. Sec. 78-256. -Adjacent Landowner Responsibility a. The owner of land adjacent to any city stre et or highway may, when acting within the provisions of this ordinance, plant, rem ove, prune or spray trees in the parkway area. Permission of the Director shall only be required when the owner of the abutting property intends to deviate from the rules and regulations contained in this ordinance. b. No property owner shall be permitted to allow a tree, or other plant growing on his or her property or within the parkway to: a. obstruct or interfere with the view of drivers of vehicles; b. place pedestrians on the sidewalk at risk for serious injury; or c. create a traffic hazard. Property owners must maintain a clear space of seven (7)feet above the surface of a sidewalk and ten (10) feet above the curb line of an adjacent street. If an obstruction persists, the Director sh all notify the property owner, in writing, to prune or remove the tree, shrub or plant with in thirty (30) calendar days. If the owner fails to comply with the notice, the City may issue citations to the property owner for each day that the property owner continues to be in violation, and/or depending on the severity of the obstruction, the City m ay undertake the necessary work to remove the obstruction. c. Other than property ow ners described above, it shall be unlawful for any person to plant or set out any trees or woody plants, or cause or authorize any person to plant or set out any trees or woody plants in or on a ny city street or highway within the city without first obtaining a written permission from the Director. Sec. 78-257. -Breaking, Injuring, etc. Trees and Shrubs on Public Property a. Except to remove, prune, trim or maintain trees, shrubs or landscaping as required above or as authorized by the Director in writing, it shall be an offense for any person, firm or corporation to cut or break any branch of any tree or shrub or injure in any way the bark of any tree or shrub on any public street, park or other city-managed property. It shall be an offense for any pers on, firm or corporation to permit, suffer or allow any injurious substance such as gas, salt, oil or other harmful substance to come in contact with any tree, shrub or plant on any public street, pa rkway area, park or other city property. b. It shall be an offense for any person, firm or corporation to attach any cable, wire, rope, sign or any other object to any tree, shrub or plant on any public street, park or other city-managed property without the prior written consent from the director. c. It shall be unlawful for any person, firm , or City department to top any street tree, park tree, or other tree on public property. T rees severely damaged by storm s or other causes, where best pruning practices are impractical, m ay be exempted from this requirement at the determination of the Director. d. The City may issue citations to persons, firms or corporations in violation with this subsection in accordance with this ordinance." SECTION 3: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed, but such repe al shall not abate any pending prosecution for violation of the repealed ordinance, nor shal 1 the repeal prevent a prosecution from being commenced for any violation if oc curring prior to the repeal of the ordinance. Any remaining portions of said ordinance shall remain in full force and effect. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitu tional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall re main in full force and effect. W ylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irre spective of the fact that any one or m ore sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 5: Penalty Provision. Any person, fir m, corporation or entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding Five Hundred and 00/100 Dollars ($500.00). Each continuing day's violation under this Ordinance shall consti tute a separate offense. The penal provisions im posed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 6: Effective Date. Recommendation N/A Discussion Douglas Properties Inc., working with Tipton Engineering, is requesting input from Parks and Recreation Board on a proposed development on the east side of Wylie near the intersection of East Brown Street and W. A. Allen Blvd. The proposed development is called, Kreymer Estates and will consist of 36.475 acres with 100 lots. Per Section 78-76, (a), (1) and (2) of the Code of Ordinances, the proposed parkland does not meet requirements because a portion of it is located in the 100 year floodplain and its overall topography is not usable for organized activities If the Board decided to accept funds in lieu of land, it would be based on 100 lots divided by 36.475 acres = 2.74 lots per acre. Parkland fees for developments with 2.74 lots per acre are assessed at $3,000 per lot. The maximum parkland dedication would be 100 lots x $3,000 = $300,000. After meeting with the developer, staff recommended that the developer return with a combination of land dedication and improvements for Park Board review. This plan is attached to the agenda report and will be presented to the Board by Richard Hovas, Tipton Engineering, and Jim and J.R. Douglas, Douglas Properties Inc. In addition to the plan, the applicable Code sections are also attached for Board review. (a) Any land dedicated to the city under this article must be suitable for park and recreation uses. The following characteristics of a proposed area are generally unsuitable: (1) Any area primarily located in the 100-year floodplain. (2) Any areas of unusual topography or slope which renders same unusable for organized recreational activities. Such characteristics of a park land dedication area may be grounds for refusal of any preliminary plat. The city parks and recreation board shall consider the usability of any proposed dedications of land in the 100-year floodplain or in any easement on a case-by-case basis. The board's recommendation to accept or deny the proposed dedication shall be forwarded to the city council with supporting justification explaining the recommendation. (b) Land that is deemed to be unsuitable by the city parks and recreation board as listed in subsection (a) of this section may be accepted by the city council, provided that suitable land in the proper amount is dedicated which is contiguous with the unsuitable land. (c) Drainage areas may be accepted as part of a park if the channel is constructed in accordance with city engineering standards, and if no significant area of the park is cut off from access by such channel. (d) Each park must have ready access to a public street. (e) Unless provided otherwise in this section, an action by the city shall be by the city council, after consideration of the recommendations of the planning and zoning commission and the parks and recreation board and its recommendation to the city council. Staff waited to bring this item to the Board and Council for review until the Wylie Recreation Center was completed and there was a place available to accommodate the program. th Planet Kidz is a program for children in 3-8 grades held on Friday or Saturday nights during the school year. The program is held in area school gyms, YMCA’s, and municipal recreation centers throughout Texas. The program is from 7pm-11pm and features live dj, sports, dancing, tournaments, contests, celebrity apprearances, crafts, educational demonstrations, prizes and giveaways. The admission is $10 per child plus the cost of concessions. From the $10, the recreation center (City) would receive $2 per child. Potential attendance could be 4-500 children per event. The events are held weekly during the school year. This program achieves two important goals: a program specifically aimed at youth in grades 3-8 and a steady revenue stream for the recreation center. The challenge to getting this program started at the recreation center is accommodating its hour of operations. The recreation center currently is opened until 10pm on Friday’s and 8pm on Saturday’s. Set up for the program at the recreation center would need to start by 6pm on either Friday or Saturday. Therefore hours of operation would need to change to accommodate this program. Staff recommends closing early on Saturdays because of the potential increase in rental revenue on those days when Planet Kidz is not operating (summer months). Staff is in need of direction from the Board on the viability of this type of program, which day to have the program on, and what adjustment in the hours of operation to the recreation center to accommodate the program. Staff will then have a work session with Council to review the program and provide the Board’s input. Staff met with WISD staff on August 18, 2011 to review the Planet Kidz program. Staff met with Ian Halperin- Communications Director, Don Poole-Maintenance Director, and Marcia Coker-Communications Assistant. Staff reviewed all the history of program startup, information about the vendor, and possible scenarios on how to bring the program to Wylie. Some possible scenarios discussed were for the WISD to contract directly with vendor or have the City contract with the vendor and WISD separately. WISD officials will discuss all the scenarios and get back with the City. After receiving some direction from WISD staff will update the Board on the progress.
