CALL TO ORDER
Chair Linda Jourdan called the meeting to order at 7:00 p.m. and stated that a
quorum was present. Board Members present were; Board Member Bill
Baumbach, Board Member Kelly Price, and Board Member Bryan Rogers. Board
Members Karyn McGinnis, and Darnell Harris were absent.
Staff members present were: Renae' 011ie, Planning Director, Charles Lee,
Senior Planner, Jasen Haskins, Assistant Planner, and Mary Bradley,
Administrative Assistant.
ELECTION OF CHAIR AND VICE CHAIR
A motion was made by Board Member Rogers, and seconded by Board Member
Price to nominate Board Member Baumbach as Chairman. Motion carried 4 — 0.

1. Hold a public hearing to consider and act upon a request by Carlos
Torres for a Variance to Section 3.1 A (3) Development Standards
of the Zoning Ordinance for A/30 zoned properties requiring a
minimum 200 feet width and 20 feet side yard setbacks, property
located at 950 Hensley Lane, being Lot 1, Block A of the Torres
Addition. (ZBA 2011-04).
Mr. Lee stated that the property is located at 950 Hensley Lane, and the
applicant is Carlos Torres. The applicant is requesting a variance from
requirements in the Development Standards from a 200 foot minimum lot width to
a 100 foot lot width and from a 20 foot side yard to 10 foot.
The applicant desires to construct a Single Family Residential House. The
existing residential structure was demolished in March. The applicant made the
effort to purchase adjacent property in order to meet the Development Standards
Requirements and was unable to obtain the property.
The property was annexed into the city in the 1990's. A single family residential
dwelling is an allowed use, but the subject lot does not comply with minimum
yard requirements. A Final Plat was approved by Planning and Zoning on August
2, 2011 and will be considered by City Council on August 23, 2011 subject to
approval of the variance requests.
Public Comment Forms were mailed to nine property owners within 200 feet of
the property, and no comment forms were returned either in favor or opposition
of the request.
Chair Jourdan opened the Public Hearing.
Mr. Carlos Torres, 950 Hensley Lane, applicant, stated that there are no other
structures on the property, and he desires to construct a Single Family
Residential Home.
Mr. Baumbach expressed concern of request for two variances on the same lot,
and when the tract of land was annexed into the city a hardship was created on
the lot width and setbacks.
Chair Jourdan closed the Public Hearing.
A motion was made by Board Member Baumbach, and Board Member Price, to
Grant a variance to Section 3.1 A (3) Development Standards of the Zoning
Ordinance for A/30 requiring a minimum 200 feet width and 20 feet side yard
setbacks, property located at 950 Hensley Lane, being Lot 1, Block A of the
Torres Addition. ZBA 2011-04. Motion carried 4 — 0.

Discussion
The applicant requests a variance to Section 4.3.F.1.a(1) of the Zoning Ordinance requiring the base materials for non-
residential buildings be constructed of a masonry product with at least 20% stone on the front facade. The request is to
allow for the metal building to continue its non-conforming status. The applicant is also challenging staff's determination
of non-conforming status.
Staff determined that the building is of non-conforming status.Non-conforming means that the building does not meet the
standards of the current Zoning Ordinance. Currently the building is legally non-conforming and is allowed to continue
operation and occupancy. Legally non-conforming status is usually a result of the Ordinance being changed after the
building was occupied (grandfathering) or the building changing ownership with the same or similar use continued
(continuing use).
The applicant believes his business is a Contractor's Maintenance yard use and staff agrees. However, the applicant
believes that the current use, an iron fence manufacturer, is the same use and the legal non-conforming status should
continue. A Certificate of Occupancy (CO) was issued for the current use as Light Assembly and Fabrication in 2007.
Staff asserts that these two uses are fundamentally different and the building should become non-conforming. This CO
has been included in the packet for reference. If the Board agrees with the applicant then the legally non-conforming
status would continue and the building would not need to be improved to current Zoning Ordinance standards.
However, in accordance with Article 8, Section 8.4 the Board may reverse or affirm wholly or partly or may modify the
order, requirements, decisions or determination, and may impose reasonable conditions in its order to be complied with by
the appellant in order to further the purpose and intent of this chapter.
If the Board agrees with staff's interpretation then the applicant is seeking a variance to the building materials requirement
of the Ordinance. The Comprehensive Zoning Ordinance requires all commercial buildings to be constructed of a masonry
product with stone accents. The existing building has a metal exterior finish. The applicant is proposing to improve the
building by applying a masonry product of brick, stone, faux stone or stucco on the front facade, and masonry wainscot 3'
- 4' high on the sides and rear of the building. He also plans to upgrade the landscaping in the front of the building.

However the applicant's proposal does not meet the requirements of the Zoning Ordinance. Therefore a variance through
Board approval is required.
Public comment forms were mailed to 12 property owners within 200 feet of this request, as required by State
Law. No responses favoring the request were received, while one written response opposing the request was
received at the time of this posting.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.
In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions,the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance, if granted will not change the character of the zoning district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the development code; and
(8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
The appellant shall act on an approved variance or interpretation within 90 days from the date of the favorable
action of the Board or an extended period specifically granted by the Board at the time of the hearing. If the
appellant fails to act within the time period, the action of the Board is void and the appellant shall begin the
appeal process or variance process anew.
