MINUTES
The Planning and Zoning Commission met in a Regular Business Meeting on October 7, 1996, at
6:30 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North,
Wylie, Texas 75098. A quorum was present and a notice was posted in the time and manner required
by law.
COMMISSION MEMBERS PRESENT: Chairman Bart Peddicord,Rich Eckman,Cecilia Wood,
and Steve Ahrens.
ABSENT: John Crowe - excused, Stuart Allison- excused and Tim Owen- unexcused.
STAFF MEMBERS PRESENT: Director of Community Development-Mike Phillips,Planner -
Kelley Shaw and Secretary- Rebecca Rogers.
ACTION ITEMS
ITEM NO. 1: Consider approval of the Minutes from September 9, 1996 Regular Business
Meeting. A motion was made by Steve Ahrens, seconded by Rich Eckman to accept the minutes with
one correction as noted. Motion carried, all in favor(4).
ITEM NO. 2: Discuss and consider a recommendation to the City Council for approval of a
Preliminary Plat for the Novid Business Park Addition submitted by Novid Properties, Inc., located
north of the intersection of FM 1378 and FM 3412 (Brown Street) and being a part of a 14.497 acre
tract out of the Charles Atterbury Survey, Abstract No. 22. Chairman Peddicord asked for Staff
recommendation. Mike Phillips,Director of Community Development, stated that Staff recommends
approval of this preliminary plat. This is not an approval for construction, but will allow water and
sewer to be put in. The owner of the property is responsible for the cost of getting utilities to the site.
The current zoning on this property is "B-2", Business-2. Motion was made by Steve Ahrens to
make a recommendation to City Council for approval of a Preliminary Plat for the Novid Business
Park Addition submitted by Novid Properties,Inc., located north of the intersection of FM 1378 and
FM 3412(Brown Street)and being a part of a 14.497 acre tract out of the Charles Atterbury Survey,
Abstract No. 22., seconded by Cecilia Wood. Motion passed, all in favor(4).
PUBLIC HEARING
ITEM NO. 1: Hold a Public Hearing and Consider a recommendation to the City Council a request
from Farmers Electric Cooperative Inc. d/b/a FEC Electric for approval of a Specific Use Permit for
an electrical substation on property located on the east side of Kreymer Lane between Brown Street
and Stone Road, and further described as being 5.31 acres of a 22 acre tract land out of the Francisco
de la Pina Survey, Abstract 688. Chairman Peddicord asked for Staff comments. Kelley Shaw,

Planner, stated that FEC Electric had done studies and found this site to be the most economical and
have the least impact on the community. Only one notification was sent and has not been returned.
Chairman Peddicord opened the Public Hearing and Pete Montes of Farmers Electric Cooperative,
Greenville, Texas, spoke. Mr. Montes brought conceptual drawing to show what FEC expects the
substation to look lice. There is an existing TU transmission line and FEC will be tying into that and
existing power lines on Kreymer Lane. FEC selected this sight to minimize the visual impact on
Kreymer Lane and the surrounding area. Most of the trees shown on the concept plan are existing
and some additional landscaping will also be done. Questions were raised regarding expansion,
underground or overhead lines, and who this substation would service. Mr. Montes stated that
expansion of the substation is not planned in the foreseeable future (10-15 years), that FEC would
tie into the existing TU overhead transmission lines and would run their lines underground, and the
substation would be servicing existing customers in Wylie and surrounding areas. Weight and type
of equipment for the substation was discussed and the FEC substation would be setup like the TU
substation on Highway 78.
Richard Parker, 630 Ballard Avenue, Wylie, Texas, was present to speak against the SUP request.
Mr.Parker owns property to the south of EEC's and also leases the property that FEC is buying and
did not receive notification of this request,it was verified that he is within 200' (they share a common
fence). Mr.Parker is against the SUP and feels that there will be no benefit to the City of Wylie and
it will slow development of the adjacent property and would like it located in Dallas County.
Discussion ensued among Commission members. Kelly Shaw reiterated that this is a request for a
SUP only, not for construction and site plan review must come before the Commission before any
construction can start. Benefits of the substation to the City were discussed (ensuring an adequate
supply to current customers and currently using TU's substation on Hwy. 78). Kelley Shaw stated
that Staff recommends approval of this Specific Use Permit. Chairman Peddicord closed the Public
Hearing. Mr. Ahrens would like the 200'range of notification expanded and Mr. Shaw stated that
state law governed the maximum of 200' and public notices were required to be published for two
weeks in the local newspaper. Several members of the Commission voiced their screening concerns.
Mr. Phillips interjected that a SUP could have stipulations added to it, ie. screening requirement
added to it. Discussion followed. A motion was made by Rich Eckman, seconded by Steve Ahrens,
to recommend to City Council a request from Farmers Electric Cooperative, Inc. d/b/a FEC Electric
for approval of a Specific Use Permit for an electrical substation on property located on the east side
of Kreymer Lane between Brown Street and Stone Road, and further described as being 5.31 acres
of a 22 acre tract of land out of the Francisco de la Pina Survey, Abstract 688 with the stipulation
added that a permanent greenery screening of a minimum of 6 - 8 ft. be placed around the cyclone
fencing. Motion passed,3 in favor(Steve Ahrens,Rich Eckman, Bart Peddicord) - 1 against (Cecilia
Wood).
CITIZEN PARTICIPATION
Richard Parker, 630 Ballard Avenue, Wylie, Texas stated that the City should try to plan things that
benefits the citizens not the corporations.

Issue
Discuss and consider a recommendation to the City Council for approval of a Final Plat
(Approved for Construction) for the Novid Business Park Addition submitted by Novid
Properties, Inc., located north of the intersection of FM 1378 and FM 3412 (Brown Street)
and being a part of a 14.497 acre tract out of the Charles Atterbury Survey, Abstract No. 22.
Background
Mr. Bobby Abbott, representing Novid Properties, Inc., owns a 14.497 acre tract and is
platting 0.7576 acres as the Novid Business Park.
On October 7, 1996, the Planning and Zoning Commission recommended approval of the
Novid Business Park Preliminary Plat. The City Council approved the same Preliminary Plat
at their meeting on October 29, 1996. The Final Plat submitted for a recommendation by the
P&Z is the same configuration as the Preliminary Plat. If recommended for approval, the
developer will then be allowed to begin construction of the public facilities to be dedicated to
the City.

Legal Considerations
According to the City of Wylie's Subdivision Regulations, a Preliminary Plat must be
submitted and reviewed by Staff to ensure that sufficient information exists, and is then
recommended for approval by the Engineer. The Preliminary Plat and Plat Application is
then submitted at least 15 consecutive days before the meeting of the Planning & Zoning
Commission (P&Z) for its study and recommendation. The P&Z shall endeavor to act on the
Preliminary Plat within 30 days from the date the plat was filed with each body for their
approval. The Preliminary Plat shall then be submitted to the City Council for final action.
After approval of the Preliminary Plat by the City Council, the subdivider may then prepare
a Final Plat of all or a portion of the land included in the Preliminary Plat for submission to
and consideration by the Planning & Zoning Commission for final recommendations.
Upon final action by the P&Z on any Final Plat, the same shall be referred to the City Council
for Final Plat approval. Upon approval action of the City Council, the Mayor is authorized to
sign the signature block "Approved for Construction". At this time, the developer shall pay
his required Developmental Inspection Fees and begin construction of the public facilities to
be dedicated to the City. These construction areas include public streets, alleys, water lines,
sewer lines, storm drainage lines, channels and all associated construction to be dedicated
to the City. The City Council's vote that the Final Plat as presented is approved for
construction indicates that at that point in time, no known conditions exist which will require
changes from the approved Final Plat.
Inspections will be made throughout the construction of the infrastructure facilities which are
intended for dedication to the City. After completion of the "dedicated improvements", the
developer shall apply to the City Council for acceptance of the Final Plat, which includes
dedications and easements. City Staff shall indicate to the City Council that all public
improvements have been completed in accordance with the requirements of the City of
Wylie. Only then is the Mayor authorized to sign the signature block "Accepted". The Final
Plat shall then be filed with the appropriate County, and issuance of building permits may
begin. Building Permits may only be issued on a completed development or within a
completed, approved phase.
Staff Recommendations
This Plat has been reviewed by City Staff and Consulting Engineer, Greg MacLean and
meets all City of Wylie Subdivision Regulation requirements. Staff recommends approval for
construction for the Novid Business Park Final Plat.

The Final Plat shall generally conform to the Preliminary Plat, as approved by the City Council
and shall be drawn legibly to show all data on a scale not smaller than 1" = 100' with a graphic
scale provided. Six sets of direct prints and three Mylars of all originals, plus one on Mylar to be
17-1/2" x 23-3/4" shall be submitted. Plats prepared using AutoCad or other computer aided
design techniques shall also provide a copy of all drawings on diskette to the City.

Issue
Discuss and consider a recommendation to the City Council a request from Myran
Corporation for approval of a Preliminary Plat for the Newport Harbor Subdivision
submitted by Myran Corporation. This property is located north of the intersection
of FM 1378 and FM 3412 (Brown St.) and more specifically described as being
87.781 acres out of the J.C. McUlmurry Survey, Abstract No. 629.
Background
Owner/Developer Myran Corporation, of Dallas, is the owner of 87.781 acres and
is proposing a housing development consisting of 359 lots (total) to be constructed
on said property. Originally, this development's (Newport Harbor) Preliminary Plat
was approved on February 2, 1987 and consisted of three phases. However, only
the first phase was ever approved as a final plat and approved for construction.
This first phase consists of the lots presently located on Schooner Bay and Anchor
Road.
Myran Corp. is now proposing to finish out what would have been phases two and
three. This new proposal from Myran Corp. contains some changes in design from
the Preliminary Plat originally submitted and as such must be evaluated on its own
merits. Myran Corp. is proposing to again develop in phases with the first phase
consisting of approximately 80 lots.
The land use classification for this property is SF-3 single family residential and in
reviewing the Preliminary Plat's lot dimensions, the proposed lots meet SF-3
criteria.

Legal Considerations

Staff Recommendation
This Preliminary Plat has been reviewed by City Staff and the City's consulting
engineer. Staff has approved the Preliminary Plat as far as the overall concept.
However, there were some specific items on the plat that was submitted that
needed to be addressed. Staff has informed Carter Burgess (Engineers for Myran
Corp.), that in order for staff to recommend approval of the Preliminary Plat, a
revised Preliminary Plat needs to be submitted.
Carter Burgess has informed Staff that due to time constraints, they could not have
the revised Preliminary Plat ready by Friday, November 1, to go out in the packets
for the P&Z members. They do say that they can have the revised plats ready by
noon on Monday, November 4.
Staff feels that the changes that are needed do not affect the overall concept in a
major way. Therefore the Preliminary Plat that was originally submitted by Carter
Burgess is to be distributed in the Agenda Packet so that the P&Z members can
familiarize themselves with the overall scope of the development.
Upon receipt of the revised plat, Staff will then review the plat making sure the
requested changes were made. Staff will distribute the revised plat to the P&Z
members and will discuss the changes with the Commission members making sure
that they are aware of the amendments. If the revised plat does not have the
amendments requested by staff, staff will recommend to the P&Z denial of the Plat.
Staff recognizes the time restraints due to the upcoming Holidays and endeavors
to work with the applicants in order to pursue the realization of this development.
