Reopen and Hold Public Hearing to consider a recommendation to the City Council a request from Wylie Bilco, Inc. for a zone change from a multi-zoned tract of land consisting of "SF-1", "SF-2", "SF-3", "SF-A", "2-F", "MF", "B-1", "B-2", "P", and "R" to "PD" (Planned Development, including but not limited to uses similar to those found in the City of Wylie's Comprehensive Zoning Ordinance for residential and non-residential use with the exception of minimum lot sizes of 5,000 square feet, multi-family, commercial and retail uses) for a 630 acre tract of land to be platted as Birmingham Park, generally located east of FM 1378 and north of FM 3412 (West Brown Street). Planning & Zoning Commission #1 Action Item Re: Approval of Minutes from the September 18, 1995 Meeting October 16, 1995 Consider approval of the Minutes of the September 18, 1995 Regular Business Meeting. Note any changes or additions which need to be made. • • MINUTES The Planning and Zoning Commission met in a regular Business Meeting on September 18, 1995, at 6:30 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North, Wylie, Texas 75098. A quorum was present and a notice was posted in the time and manner required by law. COMMISSION MEMBERS PRESENT: Chairman Bart Peddicord, Vice-Chairman Rich Eckman, Steve Ahrens, Cecilia Wood, Tim Owen, Stuart Allison and John Crowe. ABSENT: All present. STAFF MEMBERS PRESENT: Director of Community Development, Mike Phillips; Technical Coordinator, Lisa Price and Secretary, Rebecca Rogers. ACTION ITEMS ITEM NO. 1: Consider approval of the Minutes from August 28, 1995 Called Business Meeting. A motion was made by Steve Ahrens and seconded by Rich Eckman to approve the Minutes as submitted. Motion carried, all in favor (7 votes). ITEM NO. 2: Consider a request for a variance from Melissa Abbott from the City of Wylie's Subdivision Regulations eliminating a sidewalk required to be constructed on Industrial Court adjacent to the new Cornerstone Private School which is located at 120 N. Birmingham Street and further described as Lot 1 of the Cornerstone Private School Addition. No citizen participation. Chairman Peddicord asked why Ms. Abbott was requesting this variance. Mike Phillips, Director of Community Development replied that he and Greg MacLean, Engineer, felt it would be detrimental to place a sidewalk on the Industrial Court side because there are no other sidewalks going down Industrial Court. They don't want to encourage people to walk down the sidewalk that does not lead to any other sidewalks. Greg and he were going to waive the requirement for the sidewalk, but the Subdivision Regulations required that this request go before the Board of Appeals. Mr. Phillips had some concerns regarding the rear parking but there are two auxiliary entrances in the rear that are open during hours of operation of the day care. The rear parking lot is for employees only. Chairman Peddicord asked why this request initially went before the Zoning Board of Adjustments. Mr. Phillips replied that he initially thought that it was a Zoning requirement, not a Subdivision requirement. The Code of Ordinances refers to the Zoning Board of Adjustments for the Board of Appeals and that is what confused the issue. Mr. Phillips checked with as many staff members as possible and it was determined that this request should go before the Zoning Board of Adjustments. Unfortunately, Mr. Phillips was out of town last week and during that time it was discovered that this request should have been heard by the Planning and Zoning Commission. Cecilia Wood was concerned that if they granted this variance that everyone else would want the same variance. Mr. Phillips replied that the requirements for sidewalks, not in residential developments, are ambiguous in the Code of Ordinances 1 and Subdivision Regulations. The older provisions (that are not covered by the Subdivision Regulations) state that in that in Industrial Districts, sidewalks are almost optional. Ms. Wood stated that this in not an Industrial District. Recently, a Retail business went in on a corner lot and was required to have sidewalks on both sides (Regal Quick Lube & Oil). Mr. Phillips replied that the unique feature in Ms. Abbott's case, is that you turn the corner on Industrial Court and hit all the industrial businesses almost immediately. The other property (Regal Quick Lube) is in more of a residential area. Ms. Wood questioned what happens if that is not an Industrial District forever, then there is no sidewalk. There is a lot across the street on Industrial Court that Mr. Phillips believes is zoned Industrial also and doesn't see that this would be a problem. Rich Eckman asked if Ms. Abbott planned on putting a fence along the Industrial Court side and Mr. Phillips replied that there would be a wrought iron fence there that comes to the property line, not the curb/street. Steve Ahrens asked if that would be all greenbelt and Mr. Phillips replied that it would be sodded and landscaped. There are three houses adjacent to this property, one has a poorly maintained sidewalk and the other two houses have no sidewalk. Mr. Phillips stated that across the street from Cornerstone on Birmingham, there is a brand new four foot wide sidewalk that runs the length of Birmingham Street . Chairman Peddicord stated that there is very little traffic on Birmingham Street, maybe four children that cross Hwy. 78 to go to Hartman Elementary and maybe three-four that go to the high school or middle school. Steve Ahrens questioned the penalty factor of the Planning and Zoning Commission trying to overturn the Zoning Board of Adjustments decision. Mr. Phillips replied that because it went before the wrong board to begin with, the Zoning Board of Adjustments' decision was null and void. Also, there was some confusion about the legality of an existing member voting who had not been sworn in. John Crowe asked if Ms. Abbott was asking only for the variance on Industrial Court, not on Birmingham, and Chairman Peddicord answered in the affirmative. Cecilia Wood stated that she felt that the kids might still be going down Industrial Court and was concerned about that. She questioned the driveway on Industrial and the fencing. Mr. Phillips stated that the driveway would not be fenced in, but the exposed yard area would be fenced in and reiterated that the rear drive is for employees only. Chairman Peddicord requested the staffs recommendation. Mr. Phillips stated that the staff feels that the sidewalk on Industrial Court is unnecessary. Motion was made to recommend to Council, Chairman Peddicord questioned if this had to go through City Council. Mr. Phillips stated that Subdivision Regulations stated that the need for a sidewalk on the side of a corner lot can be waived by the Board of Appeals after judicial review. Rich Eckman asked if this was a variance on the Final Plat and Mike answered that is had no bearing on the Final Plat. The Planning& Zoning Commission can waive that specific requirement for the sidewalk required on the side of a corner lot. Mr. Phillips stated that the P &Z Commission was the governing body, no recommendation to City Council needed. Motion was made by Stuart Allison approve a request for a variance from Melissa Abbott to eliminate a sidewalk required to be constructed on Industrial Court adjacent to the new Cornerstone Private School , seconded by Steve Ahrens. 6 in favor, 1 against (Cecilia Wood), motion carried. 2 ADJOURN: A motion was made by Steve Ahrens and seconded by Rich Eckman to adjourn. 'i# Respectfully submitted, '1 Bart Peddicord, Chairman Rebecca Rogers, Secretaryir ; 1 3 1 Planning & Zoning Commission #1 Public Hearing: Reopen and hold a Public Hearing to consider a recommendation to the City Council for a request for a zone change to "PD" for a Planned Development Community; October 16, 1 995; On August 28, 1995 the Planning and Zoning Commission held a Public Hearing to consider a request from Wylie Bilco, Inc. for a zone change from a multi-zoned 630 acre tract of land to "PD" Planned Development. After hearing a presentation from Carter • Burgess, Engineers/Planners for Wylie Bilco, the citizens were allowed to address the Commission with their objections and concerns. Opposition from each person was voiced for concerns ranging from objecting to a multi-family zoned area placed next to Birmingham Elementary, to the small lot sizes proposed by the developers. The citizens expressly asked for larger lots, preferably 1 acre in size, to keep the country-like atmosphere that most people moved to Wylie for in the first place. The Public Hearing was held over until October 16th to allow Wylie Bilco to make some adjustments on their proposal and resubmit their Concept Plan. On September 25, 1995, Skip Hynek and John Wells of Wylie Bilco, and Brad Meyer! and Karen Porter of Carter • Burgess met with staff members. At that time staff was informed that no changes were to be made to the original concept plan, and Wylie Bilco was going to proceed with what was already submitted to the City. Their proposal stands as-is. The Community Development Department sent out 67 notification letters to residents within 200 feet of the proposed development. 16 were returned with all 16 opposed to the zoning request. We have also received 67 notification letters that were not sent by the City, with 66 opposing the zone change and 1 in favor. At the August 28th Public Hearing we received a petition from the homeowners at Newport Harbor with 38 signatures opposing this development. This totals 120 against, 1 in favor. After review by several members of the City staff, the consensus of opinion is that the proposal is indeed preliminary and that insufficient information is included to perform a thorough review. This proposal provides very little more detail than your initial proposal and many issues should be addressed before further consideration is given. The Zoning Ordinance of the City of Wylie contains the following definition: "The planned development district:is intended to provide for combining and mixing of uses allowed in various districts with appropriate regulations, and to permit growth flexibility in the use and design of land and buildings in situations where modification of specific provisions of this ordinance is not contrary to its intent and purpose or significantly inconsistent with the planning on which it is based and will not be harmful to the neighborhood." Keeping the above purpose of the planned development in mind, districts should be modified within the scope of the zoning ordinance instead of creating new and original classifications. Typically one or more of the requirements for a specific district would be modified. However, in the case of this PD, every requirement except height of building and maximum lot coverage, has been modified. The proposed changes, in most cases, significantly lessen the quality standards established in the zoning ordinance. The only exception to this would be the duplication of the MF and the B-2 requirements. In reference to the B-2 use, a more appropriate use would be retail (R) which is more in harmony with and more beneficial to the residential uses. The R zoning Would also be consistent with the Comprehensive Plan of the City of Wylie. Page 2 The following list represents issues for which complete and detailed information needs to be provided. This is not a comprehensive list, as it is the responsibility of the developer to provide all information as identified in the Zoning Ordinance. Among these issues are: • Thoroughfare Plan, traffic impact figures, perimeter street requirements, and street construction requirements. • Drainage study and plans, water and sewer utility issues, and flood plain considerations. • Acquisition of appropriate permits from state and federal agencies. • The guidelines in the Comprehensive Plan which call for low density housing being a priority for the development of the City of.Wylie. Wanting to be an effective partner with you, an expedited schedule has been established for this project during the month of August. The quality standards that had always been communicated for this development have not yet appeared in this plan. believe that you still share the common desire to produce.a development that will establish the standards for future development in this community. We as the residents of Newport Harbor in Wylie, Texas submit the signed petition requesting that you decline or at least delay the development of Birmingham Park based on the following beliefs: I. The Wylie city economy is stable but the infrastructure is not ready to accommodate the rapid growth of the Birmingham Park planned community. 2. The residents of Newport Harbor appreciate the country-type setting of the City of Wylie and was the reason most of the residents moved to this area. 3. The residents do not want the city to pay for 50% of the street improvements of Park Boulevard which will run through Birmingham Park. Typically the street improvements are at the expense of the developer. WE DO NOT WANT TO PAY MORE TAXES FOR THIS IMPROVEMENT. 4. The residents are concerned about the traffic and safety issues of the traffic on Brown Street and FM 1378. Not to mention the very limited access of thoroughfares leading to Plano, Garland and the surrounding Dallas Metroplex. 5. The residents are concerned about the limited use of current traffic control devices the in area of the proposed Birmingham Park area. 6. The residents feel strongly that the minimum dwelling sizes for the R5 homes (1100 square feet) do not meet the minimum dwelling sizes of surrounding neighborhoods. Newport Harbor has a minimum dwelling size of 1300 square feet. 7. The residents are concerned that the smaller dwelling size of the R5 home will adversely effect property values in surrounding neighborhoods. While the residents of Newport Harbor do believe that growth to any city is beneficial for the residents of the community we do not believe that such a rapid growth planned community is the answer. Growth is both necessary and beneficial to any city or organization. We would only be opposed to such growth if there was a lack of planning or waste of money and resources to our community. We consider one of Wylie's major resources to be its small town, less hurrried lifestyle. While this can not remain this way for ever it does give us the opportunity to learn from our neighoboring citites some of their success and some of their failures. We all know that Plano and Allen have both had tremendous growth spurts. But along with these have come tremenduous problems such as severe overcrowding of schools lack of water and utilities, and sever crowding of facilities. While Wylie is still along way from this kind of growth it is only a matter of time before other developers, builders, and future homeowners discover what a wonderful community we have. This is, after all why most of us moved to this city. What we would like to see as the city develops is a truley planned city with enough interstructure to support large development projects. We do not want to hinder the growth of the city or to prevent anyone the right to develop their property. But, we do seek the cooperation from this Planning and Zonning Commission in the developing the future "City of Wylie" into a community where not only new commers will want to live but, where those of us living here today would still like to raise our families. We would welcome a beautiful park in this area but not a the taxpayers expense. The entire development would center around this lake area so the cost of this should fall to the developer not the city. The only access for the general public would be through the front parking lot area and we have to supply the parking lot. We respect the right of the developer to keep his project from becomming a major thourofare. And the general public should not use these streets as main routes to excess Hwy 1378. If new roads are to be built then the city should use this opportunity to work with the developer to add roads to help with the over crowding of Brown St. and by opening up a new access to Hwy 1378 for the people living in the Rustic Oaks addition. Lets also work with developer to help eliviate the flooding around Birmingham School and Rustic Oaks. We do feel that the density of housing in this development would cause major overcrowding in our schools and on our only two excessable roads, Hwy 1378 and Brown St. 2,000 to 6,000 new people moving into this small area would be more than we could possibly absorb with out major Road Imporvements, Major Utility Improvements and more personnel for our Police and Fire dept. We would like to strongly ask the Planning and Zoning Commission to not allow any apartment complexes or business to be built near Birmingham Elementary. We would not be opposed to a nice apartment complex or Businesses placed on 1378 near some of the new proposed roads. But access to these would be almost impossible from Brown street and would only make an already overcrowded situation almost impossible. As a homeowner I chose Wylie for its accessability to the larger cities surronding it but also because it was small and spacious. We can still grow and offer this same aminity to a new commer to our community if the Citizens, Developers, Planning ans Zonning Commission and City Council all work together. Questions to Developers: A. What part of these properties does Wylie Bilco own? How much do they have options on? 1. Do you own the property next to Birmingham school? 2. What is this property presently zoned? B. If the City does not take the option to use the land offered as a park what does the developer plan to do with this porperty? 1. How will they solve the flooding problem? C. Wylie has a country atmosphere would the developer be willing to change his concept to make his development more of a country type atmosphere. (Many developers in Plano and surronding areas are spending alot of money and time to develop their communities in just such a way.) D. Dear Ms. Price, We are very much opposed to the change in zoning requested by Wylie Bilco, Inc. for the following reasons: 1) We purchased our home in good faith that the current zoning requirements would be upheld and that our future neighbors would have lot sizes at least as large as our own. 2) We moved from Garland to get away from the kind of neighborhood that Wylie Bilco, Inc. is proposing. Our experience is that apartments and smaller lot sizes mean lower mean incomes and lower mean incomes mean increased crime rates. This may sound harsh, but this can be statistically proven all over the metroplex. 3) If accepted, this zoning change will drive down the value of the surrounding property, including ours. Again, this can be statistically proven. Just check a realtor's MLS listings before and after similar zoning changes in other areas. 4) The current roads, schools and city services are not adequate to carry the increased burden of this many additional families in such a small area. Furthermore, we are opposed to FM 3412 becoming a major highway for carrying this traffic. 5) The increase in the number of students would decrease the quality of education presently available at Birmingham Elementary. This was a major selling point when we purchased our home. We would be happy to have Wylie Bilco, Inc. develop the property within current zoning requirements. We feel that 10,000 square feet should remain the absolute minimum lot size allowed. We would not be opposed to a small amount of commercial and retail rezoning as required to support the needs of the expanding community, as long as the residential zoning requirements are not changed.
