Planning & Zoning Commission #1 Action Item Re: Approval of Minutes from the August 21, 1995 Meeting August 28, 1995 Consider approval of the Minutes of the August 21, 1995 Regular Business Meeting. MINUTES The Planning and Zoning Commission met in a Regular Business Meeting on August 21, 1995, at 6:30 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North, Wylie,Texas 75098. A quorum was present and a notice was posted in the time and manner required by law. COMMISSION MEMBERS PRESENT: Chairman Bart Peddicord, Vice-Chairman Rich Eckman, John Crowe, Tim Owen, Cecilia Wood, and Stuart Allison. ABSENT: Steve Ahrens - unexcused. STAFF MEMBERS PRESENT: Director of Community Development, Mike Phillips; Technical Coordinator, Lisa Price and Secretary, Rebecca Rogers. ACTION ITEMS ITEM NO. 1: Consider approval of the Minutes from August 7, 1995 Regular Business Meeting. A motion was made by Rich Eckman and seconded by Stuart Allison to approve the Minutes as submitted. Motion carried, all in favor (6 votes). PUBLIC HEARING ITEMS ITEM NO. 1: Hold a Public Hearing and consider approval of a request from Tomi K. Silsbee for a zone change from Agriculture to Industrial on a 2.387 acre tract of land located east of Hooper Road and south of Hooper Business Park, and further described as Abstract No. 703, Tract 2 of the L.K. Pegues Survey. One person from the public was present, James Mitchell of 3104 Peppertree, Plano, Texas; son of Tomi K. Silsbee. Mr. Mitchell stated that he oWns a heating and air conditioning company and would like to have the zoning changed so that he may move his business from Plano to Wylie. No one else present to speak for or against this proposal. Chairman Peddicord asked Mike Phillips, Director of Community Development, if he had any comments. Mr. Phillips stated that initially Ms. Silsbee had originally come to him requesting a zoning change to B-2 instead of Industrial. Mr. Phillips suggested that they request a change to Industrial zoning to avoid spot zoning because the surrounding area is zoned Industrial. This would also give Mr. Mitchell some additional options for the future. Stuart Allison questioned whether this was the lot with the abandoned house on it and Mr. Mitchell stated that it was the lot next to it (next to cotton field and TU Electric power poles). Tim Owen asked if Mr. Mitchell was planning on building a new structure on this lot, Mr. Mitchell responded that he would be building a conventional 1,500 sq. II. shop. John Crowe asked if Mr. Mitchell's building would be required to meet the masonry requirements as set forth by the City of Wylie and if Mr. Mitchell was aware of that. He stated that he was not. Mr. Phillips explained the ordinance that requires 75% masonry on the exterior covering. Plans for building had not yet been discussed or reviewed by Mike Phillips as of yet. John Crowe also asked what city services are currently provided in Page 2 this area. Lisa Price, Technical Coordinator, responded that services are within 500 ft. of the property and that water and sewer services are available to the north of Hooper Park and services available from Regency Park. Mr. Phillips stated that he recommends that the zoning be changed to Industrial. Rich Eckman made a motion to recommend to City Council that Tomi K. Silsbee's lot be rezoned from Agriculture to Industrial, seconded by Stuart Allison. Motion carried, all in favor (6 votes). Respectfully submitted, Bart Peddicord, Chairman .Rebecca Rogers, Secretary Planning & Zoning Commission #1 Public Hearing Item Re: Consider a recommendation to the City Council to review and consider amending a Specific Use Permit August 28, 1995 Hold a Public Hearing and consider a recommendation to the City Council to review and consider amending a specific use permit for Phoenix Galleries, an auction house operated by Doyle Spurgin, located at 130 N. Ballard. This Specific Use Permit was originally granted with the specification that is was to be reviewed in 18 months. Council member Reta Allen requested that this SUP follow closely with the SUP that was recently granted to Earl Wilson for his auction house. Mr. Spurgin would like to amend Item #8 in Section 2 of Ordinance 93-57 to read: Auctions are limited to two nights per week between the hours of 6:00 p.m. and 10:30 p.m. and unlimited Sundays between the hours of 1:00 p.m. and 6:00 p.m. This would change only the Sunday schedule. In the original ordinance he was allowed to operate for no more than 5 Sundays per year. The auction house is now contained only on Lot 18, Block 18 whereas on the original SUP is was housed on Lots 17 and 18. He currently has 50 required parking spaces. His parking was recalculated at the same rate (1:3 occ.) as the other SUP. This SUP is to be limited to a period of 15 months from the date of approval which would allow both of Wylie's auction houses to be reviewed concurrently. Twenty Public Hearing Notifications were sent out and two were returned, both in favor of the request. ORDINANCE NO.93-57 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE AS HERETOFORE AMENDED SO AS TO GRANT A SPECIFIC USE PERMIT • FOR AN AUCTION HOUSE AS HEREIN DEFINED ON A TRACT OF LAND DESCRIBED AS LOTS 17 AND 18, BLOCK 18, RAILROAD ADDITION; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A REPEALER CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, A Specific Use Permit for an Auction House has been requested by Doyle Spurgin for the property described as Lots 17 and 18, Block 18, Railroad Addition; and WHEREAS, the Planning and Zoning Commission of the City of Wylie and the governing body of the City of Wylie, in compliance with the laws of the State of Texas and the ordinances of the City of Wylie, have given the requisite notices by publication and otherwise, and have held public hearings and afforded a full and fair hearing to all property owners generally, and to all persons interested in and situated in the affected area and in the vicinity thereof, the governing body in the exercise of its legislative discretion has concluded that the Comprehensive Zoning Ordinance of the City of Wylie should be amended as follows: NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Wylie, Texas: Section 1. That the Comprehensive Zoning Ordinance of the City of Wylie, as heretofore amended, be and the same is hereby amended so as to grant a Specific Use Permit for an Auction House as provided herein on the following described property: Lots 17 and 18, Block 18, Railroad Addition and further described on the approved site plan attached hereto as Exhibit "A". Section 2. That the Specific Use Permit shall be subject to the following special conditions: 1. The approved uses shall be limited to retail uses including the sale and/or auction of antiques and collectibles and the sale of estates 2. A parking agreement with the First Baptist Church providing the deficient number of minimum parking spaces required shall be ' q3 -�� 2 executed to the satisfaction of the City of Wylie prior to issuance of a Certificate of Occupancy 3. The occupancy load of the building shall be limited to 100 persons 4. That a scaled site plan shall be submitted to and approved by the Building Official prior to issuance of a Certificate of Occupancy and attached hereto as Exhibit "A" and made a part of this ordinance. 5. That a minimum of 50 parking spaces shall be provided either on-site or by way of official agreement with the First Baptist Church 6. No industrial products or equipment are authorized for sale or auction under the terms of this SUP 7. That all non-residential auctions shall not take place in or on the property described herein but must take place off-site 8. That auctions are limited to two(2) nights per week between the hours of 6:00 p.m. and 10:30 p.m. as proposed by the applicant no more than (5) Sundays per year between the hours of 1:00 p.m. and 6:00 p.m. 9. That this Specific Use Permit is limited to a period of eighteen (18) months from the date of approval Section 3. That the above described tract of land shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City of Wylie as heretofore amended, as amended herein by granting of this Specific Use Permit and as may be amended in the future. Section 4. That all ordinances of the City of Wylie in conflict with the provisions of this ordinance be, and the same are hereby repealed to the extent of that conflict. Section 5. Any person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a penalty of fine not to exceed the sum of TWO THOUSAND DOLLARS ($2,000.00) for each offence and each and every day such offense shall continue shall be deemed to constitute a separate offense. Section 6. If any section paragraph, or provision of this ordinance or the application of that section, paragraph, or provision to any person, firm, corporation or situation is for any reason judged invalid, the adjudication shall not affect any other section, paragraph, or provision of this ordinance or the application of any other section, paragraph or provision to any other person, firm, corporation or situation, nor shall adjudication affect any other section, paragraph, or provision of the Comprehensive Zoning Ordinance No. 85-23A of the City of Wylie, Texas, and the City Council declares that it would have adopted the valid portions and applications of the ordinance without the invalid parts and to this end the provisions for this ordinance are declared to be severable. Section 7. That this ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance as the law in such cases provides. The tenant and owner have stated that the maximum occupancy load will be 80 people. Therefore, the Building Inspection Department has based the following on that number: Minimum Plumbing Facilities Toilets - One (1) Male Three (3) Female Urinals One (1) Male Lavatories - One (1) male One (1) Female Drinking Fountain - One (1) Since there are no specific parking requirements for an Auction House, we must use Similar Use Classifications: Restaurants - One parking space per three people • Auditoriums - One parking space per three people The required parking spaces for an Auction House with 80 people would therefore be 27 parking spaces. q5 - 10 N. 2 6. That all non-residential auctions shall not take place in or on the property described herein but must take place off-site 7. That auctions are limited to one Sunday per month as requested by the applicant between the hours of 1:00 p.m. and 9:30 p.m. Additional days per month shall not be granted without City Council approval and an amendment to this ordinance. 8. That this Specific Use Permit is limited to a period of twenty (20) months from the date of approval by the City Council. SECTION 3. That the above described tract of land shall be used.only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City of Wylie as heretofore amended, as amended herein by granting of this Specific Use Permit and as may be amended in the future. This Planned Development Community includes, but is not limited to uses for residential and non- residential with the exception of minimum lot sizes of 5,000 square feet, multi-family, commercial and retail uses. This property is located east of F.M. 1378 and north of F.M. 3412 (West Brown Street). After a review of Wylie Bilco's proposed concept plan for Birmingham Park by City Staff members and our consulting Engineer, Greg MacLean, a letter was sent on July 27, 1995 by Mike Phillips, Director of Community Development, to Karen Porter, Planner with Carter•Burgess. This letter informed her that the information provided to the City was insufficient to perform a thorough review and requested specific items to be further addressed. These specific items in no way represented a comprehensive list - that was the developer's responsibility to provide all information as identified in the Zoning Ordinance. On Monday, August 7, 1995, Carter•Burgess held an informal presentation to the Planning and Zoning Commission which introduced the proposed planned development for Birmingham Park. This was the same concept plan which City Staff had previously reviewed and rejected as having insufficient information. On Tuesday, August 22, 1995, Carter•Burgess held an informal presentation for the City Council with the same concept plan. Dozens of interested and concerned citizens attended this meeting to gain some information and dispel some of the rumors which have been spreading throughout the city. The Community Development Department sent out 67 notification letters to residents within 200 feet of the proposed development. Three of those letters have been returned, all opposing the zone change. However, notification letters with the concept plan copied on the reversed side have been circulated by unknown persons, and we have received 19 of these, all opposed to the zone change. To date, Carter•Burgess has not addressed any of the issues as requested by Mike Phillips and has submitted no new information to allow Staff to perform a thorough review of their Concept Plan for Birmingham Park. BIRMINGHAM PARK - PROPOSED PLANNED DEVELOPMENT August 28, 1995 - Public Hearing • Guidelines A strong and vocal interest has been expressed by the citizens of Wylie regarding the zone change proposed for the Birmingham Farms tract of land. Anticipating a large number to attend the Public Hearing tonight, it is necessary that we create a very structured process for the meeting. This will allow fairness and will give all an opportunity to speak. A very important reminder of the purpose of tonight's meeting needs to be given. The proposal for the zoning change to "Planned Development" (PD) should be considered primarily as a land use issue. In other words, is the zoning an appropriate use of the land? For example, are allowable uses in a B-2 zoning category appropriate when located next to a residential area? While issues such as amenities and landscaping, etc. are important, those are development related issues that would best be dealt with after a discussion of land use takes place. After review by several members of the City staff, the consensus of opinion is that the proposal is indeed preliminary and that insufficient information is included to perform a thorough review. This proposal provides very little more detail than your initial proposal and many issues should be addressed before further consideration is given. The Zoning Ordinance of the City of Wylie contains the following definition: "The planned development district:is intended to provide for combining and mixing of uses allowed in various districts with appropriate regulations, and to permit growth flexibility in the use and design of land and buildings in situations where modification of specific provisions of this ordinance is not contrary to its intent and purpose or significantly inconsistent with the planning on which it is based and will not be harmful to the neighborhood." Keeping the above purpose of the planned development in mind, districts should be modified within the scope of the zoning ordinance instead of creating new and original classifications. Typically one or more of the requirements for a specific district would be modified. However, in the case of this PD, every requirement except height of building and maximum lot coverage, has been modified. The proposed changes, in most cases, significantly lessen the quality standards established in the zoning ordinance. The only exception to this would be the duplication of the MF and the B-2 requirements. In reference to the B-2 use, a more appropriate use would be retail (R) which is more in harmony with and more beneficial to the residential uses. The R zoning Would also be consistent with the Comprehensive Plan of the City of Wylie. / Page 2 The following list represents issues for which complete and detailed information needs to be provided. This is not a comprehensive list, as it is the responsibility of the developer to provide all information as identified in the Zoning Ordinance. Among these issues are: • Thoroughfare Plan, traffic impact figures, perimeter street requirements, and street construction requirements. • Drainage study and plans, water and sewer utility issues, and flood plain considerations. • • Acquisition of appropriate permits from state and federal agencies. • The guidelines in the Comprehensive Plan which call for low density housing being a priority for the development of the City of.Wylie. Wanting to be an effective partner with you, an expedited schedule has been established for this project during the month of August. Dear Ms. Price, We are very much opposed to the change in zoning requested by Wylie Bilco, Inc. for the following reasons: 1) We purchased our home in good faith that the current zoning requirements would be upheld and that our future neighbors would have lot sizes at least as large as our own. 2) We moved from Garland to get away from the kind of neighborhood that Wylie Bilco, Inc. is proposing. Our experience is that apartments and smaller lot sizes mean lower mean incomes and lower mean incomes mean increased crime rates. This may sound harsh, but this can be statistically proven all over the metroplex. 3) If accepted, this zoning change will drive down the value of the surrounding property, including ours. Again, this can be statistically proven. Just check a realtor's MLS listings before and after similar zoning changes in other areas. 4) The current roads, schools and city services are not adequate to carry the increased burden of this many additional families in such a small area. Furthermore, we are opposed to FM 3412 becoming a major highway for carrying this traffic. 5) The increase in the number of students would decrease the quality of education presently available at Birmingham Elementary. This was a major selling point when we purchased our home. We would be happy to have Wylie Bilco, Inc. develop the property within current zoning requirements. We feel that 10,000 square feet should remain the absolute minimum lot size allowed. We would not be opposed to a small amount of commercial and retail rezoning as required to support the needs of the expanding community, as long as the residential zoning requirements are not changed.
