2. Hold a public hearing to consider and act upon a request by Keith Spurgin for a
Variance to Section 5.5.A of the Zoning Ordinance requiring that all temporary uses
operate 90 days or less within a one-year time frame, property located at 1100 West
Brown Street (ZBA 2010-06).

CALL TO ORDER
Announce the presence of a Quorum.
Vice-Chair Marilyn Herrera called the meeting to order at 7:10 p.m. and stated
that a quorum was present. Board Members present were; Board Member Bill
Baumbach, Board Member Darnell Harris, Board Member Karyn McGinnis, and
Board Member Bryan Rogers. Chair Linda Jourdan was absent.
Staff members present were: Planning Director, Renae 011ie, Assistant Planner
Jasen Haskins, and Administrative Assistant Mary Bradley.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the March 22,
2010 Meeting.
A motion was made by Board Member Rogers, and seconded by Board Member
McGinnis, to approve the Minutes from the March 22, 2010 Meeting as
submitted. Motion carried 4 — 0, with Board Member Harris arriving after the
vote.
PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Mayra
R. Walters for a Variance to Sections 2.5.C.2.c (2), (4), & (6) of the
Zoning Ordinance requiring that no accessory building be located
within an easement, that they be located with a side yard setback of
a minimum of 5' from the property line, and a minimum set back of
5' from any other structure, property located at 1207 Scottsdale

2010-04).
Mr. Haskins stated that the property is located at 1207 Scottsdale, and the
applicant is Ms. Mayra Walters. The applicant is requesting three variances in
order to place a 112 square foot accessory building on the side of their property.
The variances consist of requesting a four foot side yard setback, a three foot
building setback, and to place the structure within a drainage easement. The
Board Members can choose to approve the request as submitted or choose to
approve two of the variances, with the stipulation that the setbacks be five feet
from either the side yard or the building setback. The City Engineer has provided
a statement stating that the accessory building may be placed within the
easement with the following requirements; the building must be portable, and no
permanent foundation because the drainage easement is for an underground
eighteen inch Reinforced Concrete Pipe (RCP).
The applicant has stated that the hardship exists due to existing trees in the back
yard, the amount of property located within an easement, and an existing pool.
Public comment forms were mailed to 29 property owners within 200 feet. Staff
commented that the applicant is obviously a good neighbor, as we received nine
comment forms and all were in favor of the variance.
Chair Herrera opened the public hearing.
Ms. Mayra Walters, the applicant, stated that she was willing to place the
accessory building within five feet from either her main structure or from the side
yard. The plat layout proposed the accessory building in the middle, just for easy
access around the structure.
Board Member Baumbach expressed concerns for fire access. Mr. Haskins
stated that in previous approved requests, the Fire Marshal had no concern for
the accessory buildings being located within two to three feet of the main
structure.
Chair Herrera closed the public hearing.
With no further questions, a motion was made by Board Member Rogers, and
seconded by Board Member Harris, to Grant the variance to Sections 2.5.C.2.c
(2), (4), and (6) of the Zoning Ordinance with these conditions; that the accessory
building be portable, not be on a permanent foundation because of drainage
easement, that the side yard setback be four feet instead of a minimum of five
feet from the property line, and that the setback from any other structure be
three feet instead of five feet. The property is generally located at 1207
Scottsdale, being Lot 10, Block H of the Quail Meadow Addition. Motion carried
4 — 1, with Board Member Baumbach voting in opposition.

Discussion
The applicant was requesting a variance to required parking due to the parking for his development potentially
being located within a utility easement. However, staff research has revealed that required parking is allowed
within all easements except in at-grade drainage easements. As the Ordinance does allow for parking only on
improved surfaces it is still required that the applicant obtain written approval from the owner of the easement
to allow the improvements. This issue will be addressed when the Site Plan is submitted to the Planning and
Zoning Commission for consideration, so staff respectfully withdraws this item from the Board.
Public comment forms were mailed to ten (10) property owners within 200 feet of this request, as required by
State Law. One (1) comment in favor and two (2) comments in opposition of the request were received at the
time of this posting.

ScoBilt Contractors owns two pieces of property across the street from 2415 Exchange..
See the attached tax statements.The City Ordnances requires parking for ScoBilt's
building and the other buildings throughout this area.The City needs to adhere to its rules
and require the subject property to also meet parking requirements.If there are no
parking spaces at 2415 Exchange will the parking for 2415 Exchange be on the street.We
already have to put up with 18 wheelers currently park on Regency at Exchange and
sometimes they are parked three abreast at the end of Regency.With more parking on the
street instead of on their property it makes it unsafe for my employees to get to our office.
One of my employees already had an auto accident on Regency because someone parking
on the street made a U-turn in front of him.So voiding a City Ordnance parking
requirement for the subject property will only add to more parked vehicles on Regency
and Exchange.

Discussion
The subject property is located at 1100 West Brown Street. The property is owned and occupied by New Hope Christian
Church and zoned as SF 10/24.
The applicant recently attended a Development Issues Review Team (DIRT) meeting in which they proposed a site plan
and elevations for a new and separate addition to the New Hope Christian Church. However, the church is considering
placing a temporary building on site until the construction of a permanent structure is financially possible. The Zoning
Ordinance allows for a temporary structure to be placed on site for up to 90 days during a given 12 month period. The
applicant foresees a longer than 90 day time period being needed for the temporary building. Therefore the applicant is
requesting a variance to that Section of the Ordinance 5.5.A. The requested variance is to last for one year or until the
completion and occupancy of a new building.
The Board can approve the Variance as requested or for any time period it sees fit. The Board has approved similar

response was received at the time of this posting, in favor of the Variance request.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.

In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions,the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance, if granted will not change the character of the zoning district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the development code; and
(8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.

We are currently in the beginning stages of designing a new building on our property. However,due to
overcrowding in our facility,especially in our Children's Ministry area we are in need of additional
classroom space as soon as possible.
We are asking for approval to locate 1 or 2 temporary buildings on our property behind our existing
building(see site plan)to alleviate congestion and more effectively relate to and educate our children.
The specifics for the buildings are attached but in summary they are:
- 23'6"x 64'0"each
- 4 classrooms each
- Hvac is built-in to each building
