Motion was made by Commissioner Chapman, seconded by Commissioner Hughes, to approve the minutes as submitted. Motion passed 5 —0. P&Z Commission Meeting September 17, 2002 Page 2 of 6 ACTION AGENDA 1. Consider and act upon approval of a Site Plan for Verizon Wireless telecommunications tower, being all of a certain 0.057 acre (2,500 square feet) tract of land, located at 218 Regency Drive, being part of Lot 4 of Block D of the Regency Business Park Addition, and being situated in the William M. Sachse Survey, Abstract No. 835, City of Wylie, Collin County, Texas. Thompson stated that the Site Plan is for a telecommunications facility, which includes a 150-foot high monopole tower, an equipment building of 160 square feet and related outdoor equipment. The facility is to be located on a 0.057 acre (2,500 square feet) leased tract to the rear of an existing lot. The property has been platted since 1987 as Lot 4 of Block D of the Regency Business Park Addition. The tract was rezoned from Industrial(I)to Business Center(BC) District in February with the adoption of the new city wide Zoning Ordinance and Map. The Zoning Ordinance encourages co-location of such towers, and requires that they be located at least 5,000 feet from other towers. The applicant has investigated alternate sites and in a letter submitted to staff explained that existing towers were either too low to allow for the maximum coverage or there was inadequate spacing for antennas. Motion was made by Commissioner Porter, seconded by Commissioner Phillips, to approve the Site Plan as submitted. Motion passed 5 —O. 2. Consider and act upon approval of a Site Plan for Wylie Family Dentistry office, being all of a certain 0.255 acre (11,125 square feet) tract of land, located at 304 South Ballard Avenue, being all of Lots 5, 6 and 7 and part of Lot 4 of Block 3 of the Railroad Addition, and being situated in the S.B. Shelby Survey, Abstract No. 820, City of Wylie, Collin County, Texas. Thompson stated that the building will be approximately 2,206 square feet in size and serve as a professional dentistry office. The property was rezoned from Single-Family 8.5 Residential to Corridor Commercial (CC) District in July of 2002, and the Site Plan accompanying the rezoning indicated parking to the rear of the lot. In August, the City Council abandoned the alley abutting the rear of the subject property to the west, in order to accommodate rear access and parking. A replat to create the subject lot is also on the current agenda for the Commission's consideration. Dr. Keith Teague, 405 Birmingham, Wylie, Texas, applicant for the property, stated that currently the intention for the employee parking is at the front of the building and the alley will not be used. There will be a three-foot hedge along the west side of the property abutting Calloway Street as required by the Commission as a stipulation of the rezoning. Dr. Teague stated that there are no plans at this time for Lot 2 of the property. P&Z Commission Meeting September 17, 2002 Page 3 of 6 Commissioners questioned the location of a dumpster. Dr. Teague responded that no dumpster is required because little trash is generated. Thompson stated that dumpsters are not required, only controlled when desired. Commissioners questioned the location of the access drive on Lot 2 rather then sharing at the property line. Thompson stated that the drive was located to avoid having to relocate the drive inlet, and serves adequately as cross access as shown. Motion was made by Commissioner Porter, seconded by Commissioner Adamcik, to approve the Site Plan as submitted. Motion passed 5 —O. 3. Consider a recommendation to the City Council regarding a Replat for Lots 1R and 2R of Block 34 of the Railroad Addition, being a replat of Lots 1, 2, 3, 4, 5, 6 and 7 of Block 34 of the Railroad Addition, and being situated in the S.B. Shelby Survey, Abstract No. 820, City of Wylie, Collin County, Texas. Thompson stated that this Replat will combine seven previously platted lots into two lots. The new Lot 1R is intended to accommodate the dentistry office, the Site Plan for which was previously considered on the current agenda. There are no plans for use of the remaining Lot 2R. Motion was made by Commissioner Porter, seconded by Commissioner Phillips, to recommend approval to the City Council. Motion passed 5 —O. 4. Consider a recommendation to the City Council regarding a Preliminary Plat for the Stiles Crossing Addition, being all of a certain 34.0839 acre tract of land, generally located west of North Ballard Avenue (F.M. 2514) and north of Brown Street (F.M. 4312), as described in a deed to Peerless Manufacturing Company as recorded in Volume 744, Page 515 of the Deed Records of Collin County, Texas, and being situated in the S.B. Shelby Survey, Abstract No. 820, City of Wylie, Collin County, Texas. Thompson stated that the Preliminary Plat will create 100 single-family residential lots and right-of-way for the extension of Ann Drive. The subject property totals 34.01 acres in size. Lot sizes are 8,500 square feet minimum, and the subdivision will comply with all of the current regulations of the Zoning Ordinance. The property is traversed by several major water and gas transmission corridors, and the development anticipates using these corridors as a greenbelt pedestrian trail system. The current Thoroughfare Standards require that streets be 31 feet of pavement within 55 feet of right-of-way and alleys provide 20 feet of right-of-way and 12 feet of pavement. On September 10, 2002, the City Council approved a waiver of rights-of-way widths for the subject property, allowing the proposed streets with 31 feet of pavement within 50 feet of right-of-way and alleys will provide 12 feet of pavement within 15 feet of right- of-way, in order to tie this addition to surrounding existing conditions. P&Z Commission Meeting September 17, 2002 Page 4 of 6 Commissioners questioned the position of Lots 4 and 5 of Block C. Allen Bussell, 1621 Amanda Court, Ponder, Texas, engineer represented as the applicant, stated that no lots will be facing Ann Drive. There will be uniform screening on the lots abutting Ann Drive. Motion was made by Commissioner Phillips, seconded by Commissioner Adamcik, to recommend approval to the City Council on September 24, 2002. Motion passed 5 —O. PUBLIC HEARING 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Single-Family Residential (SF-8.5/17) to Planned Development (PD) for Single-Family Residential, generally located east of Ballard Avenue and east of the existing Southplace Estates Phase IV Addition, being a portion of a 48.516 acre tract, as described in County Clerk's File No. 95-0018290 of the Deed Records of Collin County, Texas, and being all of a certain 12.754 acre tract of land situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas. (Zoning Case 2002-08) This case was tabled at the September 3, 2002 Commission meeting. Thompson reviewed the history of the subject property and reviewed the PD Conditions and stated that the applicant is requesting rezoning of the subject 12.754 acres to PD District in order to continue development of the Southplace Estates single-family residential neighborhood in a manner comparable to the existing development but complying with as much of the current code regulations as feasible. Commissioner George questioned the purpose of the PD. Robert Betancur, Zena Land Development, P. O. Box 92864, Southlake, Texas, represented as the applicant, stated that a PD was needed due to the changes in the Zoning Ordinance for the new architectural requirements and required lot size. Marc Junger, Choice Homes, 5630 Highway 78, Sachse, Texas, represented as the home builder for the subject property, stated that there is a significant difference in the existing subdivisions that follow the old Zoning Ordinance and the new architectural requirements and the point system for the new Zoning Ordinance. The PD attempts to provide a compromise between these two requirements to accomplish as attractive continuation and transition. The Commissioners discussed in detail the PD Conditions revised since the discussion of the September 3 meeting. The lot setbacks for the side yards in the PD state 7 feet for interior side yard and 15 feet for street side yard. After discussion, the applicant agreed to change the street side yards to 25 feet, which is the same as the existing subdivision and requirement. Betancur stated that there are eight houses, which will be less than P&Z Commission Meeting September 17, 2002 Page 5 of 6 1,700 square feet due to the lot restriction. The plan repetition of the PD was revised to 4 houses on the same side and 2 houses opposite side of the street as required by the Zoning Ordinance. Masonry requirement was changed to 100% on front side excluding dormers for both one and two story residences. Commissioner George opened the continuation of public hearing from the September 3 meeting. No one appeared to speak. Commissioner George closed the Public Hearing. Motion was made by Commissioner Porter, seconded by Commissioner Phillips, to recommend approval for the PD with the following revisions: street side yards to 25 feet; plan repetition 4 houses on the same side and 2 houses opposite side; masonry 100% on front side; and 18% of the residences may be less than 1,700 square feet but none less than 1,500 square feet. Motion passed 3 — 2, with Commissioner Adamcik and Commissioner Snider voting against. 2. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Single-Family Residential (SF-8.5/17) and Neighborhood Services (NS) to Planned Development (PD) for Single-Family Residential, generally located east of Ballard Avenue and south of the existing Southplace Estates Phase I Addition, being a portion of a 48.516 acre tract, as described in County Clerk's File No. 95-0018290 of the Deed Records of Collin County, Texas, and being all of a certain 10.129 acre tract of land situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas. (Zoning Case 2002-09) This case was tabled at the September 3,2002 Commission meeting. Thompson stated that the rezoning of the 10.129 to Planned Development (PD) District is in order to serve as the new entry and expand the Southplace Estates single-family residential neighborhood in a manner comparable to existing development. The same developer and builder as the previous agenda item are proposing the subject development. The PD Conditions are basically the same as the previous agenda item, therefore, the same compromises and additional compromises were discussed. Robert Betancur, Zena Land Development, P. O. Box 92864, Southlake, Texas, represented as the applicant, stated that there is one lot that will be 8,453 square feet, but all others will exceed the 8,500 square feet required by the Zoning Ordinance. Commissioners questioned the masonry requirements, pointing out that some of the houses will back onto Ballard Avenue and these should appear to be total masonry. Marc Junger, Choice Homes, 5630 Highway 78, Sachse, Texas, represented as the homebuilder, stated that the houses visible from Ballard will be 100 percent masonry. P&Z Commission Meeting September 17, 2002 Page 6 of 6 The Planned Development Conditions were discussed and revisions were made on the following items: the minimum lot size is 8,453; the street side, front and rear setback will be 25 feet; plan repetition will skip 4 houses the same and 2 houses skipped on the opposite side; and 82% of the residences may be less than 1,700 square feet but none shall be less than 1,500 square feet. Commissioner George opened the continuation of public hearing from the September 3 meeting. No one appeared to speak. Commissioner George closed the Public Hearing. City of Wylie Action Item No. 1 Final Plat Wylie High School Addition Planning and Zoning Commission Meeting: October 1, 2002 Owner: Wylie Independent School District/City of Wylie Surveyor/Engineer: RLK Engineering Location: Generally located south of F.M. 544 and east of Country Club Road Existing Zoning: Agricultural (A) Summary: The Final Plat for the Wylie High School Addition will create two lots, Lot 1 being a 78-acre tract of land, which is the location of the existing high school and the proposed new stadium that was previously unplatted and Lot 2, which is the 80-acre site of Founders Park. When the Wylie Independent School District decided to purchase this land for the new high school the City took advantage of the opportunity to acquire a large tract for an athletic complex and purchased their half of the property using special 4b funding. The School District and City plan on co- developing this site to accommodate parking for both school events as well as park activities through a joint use resolution passed by the City Council, thus it was deemed appropriate to bring these two tracts together on one plat. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". Final Plat—Wylie High School Addition Issues: 1. The Final Plat substantially conforms to the Subdivision Regulations and all other pertinent code requirements of the City of Wylie.
