Bradley, Secretary Don Hughes Terry Capehart, Planner Carter Porter Dale Jackson, Building Official Tony Snider Commission Members Absent: Jeff Adamcik Mike Phillips CALL TO ORDER Chairman George called the Regular Meeting to order at 7:10 p.m. PLEDGE AND INVOCATION Commissioner George offered the Invocation and Commissioner Porter led the Pledge of Allegiance. CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the July 16, 2002, Regular Meeting. Motion was made by Commissioner Chapman, seconded by Commissioner Porter, to approve the minutes as submitted. Motion passed 5 —O. P&Z Commission Meeting August 6, 2002 Page 2 of 3 WORK SESSION 1. Consider draft proposal of new sign regulations. Mr. Thompson stated that sign regulations have been a part of the Zoning Ordinance since the early 1980s. However, when the City Council approved the current Zoning Ordinance in January/February of 2002, the sign regulations were pulled out for additional discussion. The previous (1985) regulations are being enforced until revisions are adopted, and several concerns have arisen recently in sign permitting under this system. A public hearing has been scheduled for the August 20 Commission meeting, and the Council will consider adoption with a hearing on August 27. Building Official Dale Jackson has researched sign regulations of several municipalities, and drafted revised requirements, which will be adopted as a separate ordinance and be administered by the Building Official as are other building codes, rather than incorporated back into the Zoning Ordinance. Mr. Jackson presented a summation of the draft and guided a review of the specifics. He noted that the draft closely follows the format and content earlier proposed by the consultant and recommended by the Planning and Zoning Commission for approval. The draft included additional definitions, which help to better define and direct the regulations. Several types of signs, which had been omitted from the previous regulations, as well as several problems, which have been identified in administration of the regulations, have been addressed by the revision. The draft generally reflects the philosophy discussed by the Council in the earlier review. For example, developer's signs, promoting new subdivisions and often located within the public street rights-of-way, have been added. Signage attached to buildings has been somewhat reduced, and directed to those walls must viewed from the streets. A major concern of the Council with the earlier draft was the complete deletion of pole signs by the Commission from the earlier draft, and Council expressed a desire that new pole signs be allowed in some locations and that existing pole signs by protected. The previous regulations had also favored monument signs; a recent trend in retail signage, over pole signs and the current draft continues to tax or monument signs. The current draft presents a compromise, allowing pole signs only along the State Highway 78 commercial corridor and then only on large lots and when set back 50 feet from the roadway. Several Commissioners restated their desire that new pole signs not be allowed throughout the City, as such signs produce visual clutter and are not effective as they often block view of others. Commissioner Porter responded that if pole signs are to be allowed they should be allowed along all major highway corridors, or at least the more commercial portions of S.H. 78, F.M. 544 and even the expanding Park Boulevard. Commissioner Snider responded that the current definition as well as the previous regulations, limiting pole signs to a height of 20 feet and area of 100 square feet, does not eliminate the competitive clutter but rather results in squatty inefficient design, and recommended that pole signs should be allowed to mush greater heights and be much larger in area if allowed at all. No decision was reached. P&Z Commission Meeting August 6, 2002 Page 3 of 3 Mr. Jackson noted that off-premises signs are still prohibited. Every sign within the public right-of-way, such as subdivision/builder promotions, must be separately permitted and are allowed only between noon on Friday until 9PM on Sunday. City Code Enforcement staff working weekends will remove all violating signs. The omitted limits for gasoline pricing signs will be added to the text. Reference to a "Sign Board" is barrowed from another municipality, and will be revised to give appeal authority to the Board of Adjustment at the Commissioners recommendation. Mr. Jackson summarized the consensus of the work session as preferring three options; (1) No pole signs allowed, (2) Pole signs related to the Zoning District, but (3) Keep the current revisions as they are. Surveyor/Engineer: Dal-Tech Engineering, Inc. Location: Generally located east of Westgate Way and south of Fleming Drive between the Westgate Hollow Addition and Bachon Townhomes Addition Existing Zoning: Multifamily(MF)being developed to Townhouse (TH) standards Summary: The Preliminary Plat under consideration will create 130 single-family residential lots for attached housing and one additional platted lot for entry features to be maintained by the Homeowners Association. The subject property totals 16.842 acres in size. This tract of land has been zoned for Multi-family (MF) uses since 1985, but is being developed to Townhouse (TH) District standards with a minimum of 3,500 square feet for exterior lots with side yards and 3,000 square feet for interior lots without side yards. Attached single-family dwellings are permitted within the MF District. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the plat is filed. A plat is considered approved by the municipality unless it is disapproved within that time period". Preliminary Plat—The Village Issues: 1. The Plat provides for the last portion needed to complete the extension of Fleming Drive toward the west to Westgate Way. 2. Although this tract is being developed to Townhouse (TH) District standards the zoning is Multifamily (MF) and is therefore exempt from parkland dedication and/or fees. 3. The Preliminary Plat complies with all applicable technical requirements of the City of Wylie. Financial Considerations: Plat application fees—Paid Staff Recommendation: Approval. The Departments of Planning, Engineering, Development Services, Public Works and Fire concur with this recommendation. The applicant is requesting rezoning of the subject property to a Planned Development (PD) District in order to develop a subdivision of single-family residences. The property totals 34.306 acres in size. Properties abutting to the north and west are zoned Single-Family 10/19 (SF-10/19) District, and are developed as the Stoneridge Farms Addition with single-family residences on lots of one acre in size. The average house size in the Stoneridge Farms Addition is approximately 2350 square feet. Properties abutting to the south are within unincorporated Collin County but within the Wylie's Extraterritorial Jurisdiction, and are developed with single-family residences on lots of one acre in size. The average house size in this subdivision is approximately 1970 square feet. 02-06, Rolling Hill Estates PD The property to the east across F.M. 544 is zoned for the 475-acre Bozman Farms Planned Development District, allowing 1,350 single-family lots of an overall minimum average area of 7,630 square feet as well as multi-family residential and commercial uses. The Conditions of the Planned Development District generally tie the proposed development to the Single Family— 20 Residential District. All lots will be a minimum of 20,000 square feet, and the development will comply with requirements of the SF-20 District of the Zoning Ordinance with the following exceptions: Development Proposed Requirement Requirements of the Condition of the PD Zoning Ordinance Alleys None required Required Side Yard 10 feet on one lot only, 15 feet all others will be 15 feet Rear Yard 15 feet on two lots only, 30 feet all others will be 30 feet Dwelling Size 1,900 square feet 2,100 square feet Land Design 30 required, including 20 ft. 35 required by addition of Points buffer w/ 8 ft. trail, drinking some other feature fountain and decorative paving Public Comment Forms were mailed to eighteen (18) property owners within 200 feet of this request. Four Comment Forms had been returned at the time of posting, each opposing the request. Issues: 1. The Comprehensive Plan recommends Country Residential uses for the subject property. This classification requires lots of one acre or larger, with dwellings of 2,600 square feet or larger. The proposed development does not comply with these recommendations of the Comprehensive Plan. 2. Adjacent properties are developed in the Country Residential character, with lots of one acre or larger. 3. The Planned Development proposed to provide no public parkland, but will be linked by a pedestrian trail to the private and public open spaces of the Bozman Farms development across F.M. 544. 02-06, Rolling Hill Estates PD 4. The subject property is effectively land-locked, with no possibility of street connection with developed properties to the north, west or south. The relatively long and narrow configuration of the property makes the potential for development of one-acre lots difficult without undesirable over-length access street and dead-end utilities. 5. The proposal development generally complies with the basic and flexible point requirements of the SF-20 District, except for the proposed house size of 1,900 square feet 6. The major entry street of the proposed development aligns across F.M. 544 with the newly- platted entry to the first phase of the 475-acre Bozman Farms Planned Development District. This PD allows a potential 1,350 single-family lots ranging in size from 6,000 to 8,500 square feet and averaging 7, 630 square feet overall. Staff Recommendation: Denial. The proposal does not comply with the recommendations of the Comprehensive Plan and existing adjacent development. The Departments of Planning, Engineering, Development Services, Public Works and Fire concur with this recommendation. The rezoning as submitted under ZC 02-06, a Planned Development District tied to Single Family—20 Residential District, would place the developed lots far from the reach of prospective homebuyers attempting to build homes in a price range supported by the present properties developed adjacent to the subject property. In brief, both economic and engineering studies addressing the proposed 20,000 square foot minimum lot size have indicated that the price of a developed lot, which directly affects the price of the final constructed residence, would be exorbitant when compared to the current and forecast socio-economic conditions in the Wylie market. It is our intent to further study the available options with respect to the subject property and resubmit for rezoning at a later date. Sincerely, Realty D el a at - tr/If .... of- C. hillip g Managing Director r W I 4 City of Wylie Public Hearing Item No. 2 Proposed Revision of the Sign Regulations Planning and Zoning Commission Public Hearing: August 20, 2002 Applicant: City of Wylie Issue: Receive public comment and consider a recommendation to the City Council regarding adoption of certain proposed revisions to the Sign Regulations for the City of Wylie Background: The first comprehensive regulations to control private signs by the City of Wylie were adopted and incorporated into the Zoning Ordinance in 1981, and these have been revised several times since. At the last major revision to the Zoning Ordinance in January/February of 2002, the City Council removed the sign regulations for further discussion. The sign regulations from the 1985 Zoning Ordinance are currently in use. The attached draft revisions are a combination of research and opinion by staff and the consultant for the Zoning Ordinance. These Sign Regulations will continue to be a free-standing ordinance such as the Building Code, and will be administered by the Building Official. Public notification of these proposed revisions to the Sign Regulations has been made in the time and manner required by State law. Notice of the public hearing was published in The Wylie News. No public comments have been returned at the time of this posting. Financial and Other Considerations: NA Revision of the Sign Regulations Staff Recommendation: Hold a public hearing and recommend that the City Council adopt the revisions to the Sign Regulations as proposed.
