BACKGROUND INFORMATION:
Mr. and Mrs. Griffis are requesting a variance to the minimum off-street parking
requirements of the Comprehensive Zoning Ordinance to allow the expansion of an
existing non-conforming use. The Zoning Ordinance requires that each single family
residence provide two covered and enclosed parking spaces - a two car garage. The
Griffis' have a one-car garage.
The house as it is has non-conforming status. However, they are wanting to
enclose the one-car garage thus provided no covered and enclosed parking spaces. This
is an expansion of a non-conforming use.
They have built a car-port and have stated that the former building official gave
them the indication that once they finished the carport, they would then be eligible to
apply for a building permit to enclose the garage. This is not correct under our current
zoning ordinance.
The Board has the ability to grant the variance although the request does not
demonstrate the following issues required by Zoning Ordinance and statute:
(1) that special conditions exist peculiar to the land, structure or building
(2) that literal interpretation of the ordinance deprives the applicant of rights
commonly enjoyed by other properties in the same district
(3) that the special conditions do not result for the actions of the applicant
(4) that granting the variance will not confer on the applicant any special
privilege that is denied to other structures in the same district
(5) that other non-conforming uses are not a grounds for approval of the
variance
(6) that financial hardship is not grounds for considering the variance

public hearing on Thursday, October 21 , 1993 at 6: 30 p.m. at the
Wylie Municipal Complex, located at 2000 Highway 78 North Wylie,
Texas, to consider approval of a request from Purvis and Lori
Griffis for a variance to the minimum parking requirements of the
Comprehensive Zoning Ordinance to increase an existing non
conforming use by allowing less than two covered and enclosed
parking spaces at 306 Stone Road, further described as Lot 8, Block
2 of Caldwell Estates.
As an interested property owner, you are encouraged to attend
this meeting or notify the Board of Adjustments of your feelings
