Ballard SUBMITTED BY: Mary Nichols, City Secretary REQUESTED BY: Tommy Reuthinger BACKGROUND INFORMATION: At your last meeting, the Board tabled action on this request until the applicant brings in additional information on her plans for the property. As you will recall, Ms. Reuthinger wants to subdivide a lot but cannot meet the minimum lot width of 60 feet on each lot. The zoning ordinance gives the Board of Adjustments the authority to grant variances to yard requirements "where there are unusual and practical difficulties or unnecessary hardships in the carrying out of these provisions due to an irregular shape of the lot, topographical or other conditions, provided such variance will not seriously affect any adjoining property or the general welfare." However, the ordinance also provides that: (1) the hardship circumstances must not result from the applicant's own actions (2) that neighboring non-conforming uses shall not be grounds for issuance of a variance (3) financial hardship may not be used as grounds for issuance of a variance (4) granting the variance must not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or buildings in the same district ATTACHMENTS: (1) Notes from Previous Meeting (2) Plat Showing Lot Location (3) Notices Returned From Property Owners Within 200 Feet ZONING 1:)OARD OF ADJUSTMENTS S July 12, 1993 2. BOA 93-2-Z Hold Public Hearing and Consider Approval of a Request from Tommy Reuthinger for a Variance to the Minimum Lot Width Requirements of the Comprehensive Zoning Ordinance to Allow Fewer than 60 Feet of Lot Frontage on a Lot to be Subdivided from 705 S. Ballard Ms. Reuthinger is proposing to replat a single lot into two smaller lots. The lot proposed for replatting originally contained one building that burned. Ms. Reuthinger wants to separate the lots and build one structure on each of the two lots. The existing lot at 705 S. Ballard is only 117 feet wide and the Comprehensive Zoning Ordinance requires that SF-3 lots be at least 60 feet in width. Ms. Reuthinger would be three feet short of subdividing two 60 foot wide lots. In your packet is a copy of Section 31 of Chapter 12 of the Comprehensive Zoning Ordinance which outlines the powers and duties of the Board. Like your first application, you may want to review this section to determine if there is grounds for granting a variance. The Board approved this request based on a Building Official error. This is an acceptable grounds for granting a variance under the zoning ordinance. The Hamms are also closing in their garage but this application does not result from a Building Official error. This house is a 'tornado" rebuild and the Hamms decided to enclose the garage upon making other structural repairs. While there appears to be no grounds in the Zoning Ordinance for approving such a variance, if the variance is denied, the Hamms will either have to tear out the construction being done, add on a two car garage, or go to the City Council and ask them to hold hearings to amend the Zoning Ordinance to change the requirement. If the variance is approved, there will be several more applications coming before the Board of Adjustments wanting variances to this requirement. We have received eight to ten phone call complaints/requests over the last two weeks. He is asking for a variance to allow him to obtain a building permit. If the Board of Adjustments approves the variance, Mr. Allison can obtain a single family building permit. If it is denied, he will be required to obtain additional property before platting or appeal to a court of record within ten days of the date of the Board's decision. My wife and I live on the corner of Keefer and Marble in a custom home we built in 1986. Our home is in the old part of town where new homes go up as the old ones go down. On the corner opposite our house is a lot to small to build on. Mr Alison wants the city to give permission for a house to be built on this lot. According to the current city ordinances the lot is to small to be built on. When we built our house we observed all the city codes and ordinances and we feel he should have to do the same. We do not feel that he is building this house for himself as he already has a nice home of his own. I do not believe that he would want this type of house next to his. This would either be a rent house or he would sell the lot to someone else and they would build a rent house. We feel that this type of house would hurt the value of our neighborhood. We also feel that this is a desperate move on Mr. Alison's part since he has been trying to sell the lot for several years now and no one will buy it, if the ordinances and codes are changed he will have a much better chance of selling it. The ordinances and codes were set by the planning and zoning colimittee for specific reasons, hopefully with the best interest of Wylie in mind, there should be no exceptions made. If you make this once exception where will you draw the line, how many more people will be lined up at your door for special privileges? Think about it, would you want this to happen next to your home? I doubt it. Also we did not even receive a notice of this meeting, we had to hear about it from a neighbor. I called the city and they said we should have gotten a notice, sounds as if someone is falling down on their job already. We trust that you will do what is best for our neighborhood, remember the next time it could involve your neighborhood and be next to your house, how would you feel then, take this into consideration as you make your decision, some of us will have to live with it for a lifetime.
