The agenda and background are enclosed. We received no comments related to the proposed revisions to the nonresidential districts of the Zoning Ordinance, so bring your opinions and changes with you to the meeting. I realize that we have required a number of special meetings recently, and some of extended length. However, I do not expect Tuesday's meeting to take too long. I appreciate your continued involvement in these important community tasks. Remember the special training session at 6:00 p.m. on Monday, November 20 with the City Council, Planning and Zoning Commission, Board of Adjustment and City development staff. This session will review the basic philosophies and laws concerning development planning, in order to get everyone "on the same page" philosophically as private development increases in Wylie. Hold a Public Hearing and consider a recommendation to the City Council regarding a Replat for the Stone Grove, Phase I Addition, proposed by Jackson and Associates Land Surveyors, Inc., for the property located at 503 and 505 Stonehedge Drive, and being all of Lots 1 and 2 of Block B of the Stone Grove, Phase I Addition, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Claude Thompson, Planner stated that this Replat is to consolidate two lots into a single lot of approximately 21,500 square feet to accommodate one single-family dwelling of approximately 4,600 square feet. The Replat has been reviewed by staff and is in technical compliance with all City and State codes. Representative, Don Jackson, 2600 W FM 544, Wylie, Texas 75098 testified that the owner wants to build a house at this location, but due to the size of house needs the larger lot size provided by this Replat. Sidewalks will be put down to meet the sidewalk at Stonehedge. A motion to approve was made by Tony Snider and seconded by Carter Porter. A vote was taken and passed 5-0. 2. Hold a Public Hearing and consider a recommendation to the City Council regarding the vacation of alleys, proposed by Jackson and Associates Land Surveyors, Inc., and being all of a north and south 20' alley and part of a west and east 20' alley in block 28 of Railroad Addition, an addition to the City of Wylie, Collin County, Texas, according to the plat thereof recorded in Volume 77, Page 494, Map Records, Collin County, Texas. Claude Thompson, Planner reported that this item has been withdrawn and the proposed action incorporated into the related Replat, Public Hearing Item No. 3, on tonight's agenda. 3. Hold a Public Hearing and consider a recommendation to the City Council regarding a Replat for the Railroad Addition, 1st Revision, proposed by Jackson and Associates Land Surveyors, Inc., for the property generally located at the southwest corner of Masters Avenue and Fifth Street, and being all of a certain 1.496 acre tract consisting of Lots 1-6, Lots 7A-9B, Lot 16, Lot 17 of Block 28, and part of a 20' alley abandoned in Block 28 in the Railroad Addition, and part of a formerly abandoned portion of Fifth Street, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Claude Thompson, Planner stated that this Replat is to combine several lots and abandoned alleys into a single lot for the expansion of Allen Funeral Home. A Public Hearing is required by State law because the property has been zoned for residential uses within the last five years. It is zoned Planned Development for single family residential use. That Funeral Home is an appropriate use and does meet development requirements of zoning. Portions of Fifth Street were abandoned in 1931. Staff has determined that the alleys which are being vacated by this plat as well as incorporated into the new lot are no longer required for utilities or vehicular access. Representative, Don Jackson, 2600 W FM 544, Wylie, Texas 75098, reported that the Replat is required to incorporate together the owner's various lots and abandoned alleys and Fifth Street for the expansion of Allen Funeral Home. This property will be screened from the surrounding residential property. A motion to approve was made by Steve Ahrens and was seconded by Gary Wiseman. A vote was taken and passed 5-0. ACTION ITEMS 1. Consider and act upon approval of a Site Plan for the First Baptist Church, generally located at the southwest corner of Marble Street and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920, City of Wylie, Collin County, Texas. Claude Thompson, Planner, states that Site Plan review is required because the zoning for this area is B-1 or nonresidential. Portions of Fifth Street were abandoned in 1997 and portions of the Railroad have been abandoned and these have been conveyed to the church. Staff has reviewed the proposed Site Plan and finds it in compliance with City and State technical code requirements. Staff recommends approval. Representative, Jim Riley, 4144 North Central Expressway #1100, Dallas, TX 75204, answered Commissioners' questions about paving, parking, and the new Oak Street alignment. Building plans for the new addition have not yet been submitted for review, but will meet the building code requirements as to structure and parking spaces needed. A motion to approve was made by Carter Porter and seconded by Gary Wiseman. A vote was taken and approved 5-0. 2. Discuss and consider a recommendation to the City Council regarding a Final Plat for the First Baptist Church, generally located at the southwest corner of Marble Street and Second Street, and being all of a certain 5.0 acre tract situated in the James Truett Survey, Abstract No. 920, City of Wylie, Collin County, Texas. Claude Thompson, Planner, states that this Final Plat is to combine properties owned by the church, including abandoned railroad and Second Street rights-of-way. Staff has reviewed the Final Plat and finds it in compliance with applicable codes and recommends approval. Representative, Jim Riley, 4144 North Central Expressway #1100, Dallas, TX 75204, was present for questions but Commissioners reported that all questions were answered during the review of the Site Plan. A motion to approve was made by Steve Ahrens and seconded by Gary Wiseman. A vote was taken and passed 5-0. 3. Consider and act upon approval of a Site Plan for the Albertsons Center, generally located at the southeast corner of FM 544 and Westgate Way, and being all of a certain 27.49 acre tract situated in the Duke Strickland Survey, Abstract No. 841 and the E.C. Davidson Survey, Abstract No. 267, City of Wylie, Collin County, Texas. Claude Thompson, Planner, states that staff has reviewed the Site Plan and found that it meets all applicable City and State requirements, and recommends approval. Representative, Rodney Hitt, 17770 Preston Road, Dallas, TX 75252, states that this development will be constructed in two phases, with Albertson's and the Fuel Center being the first phase. The remainder of the retail space will be constructed as leases are obtained. Plans have been submitted for landscape buffer (screening), parking lot lighting, concrete paving and irrigation, about which Commissioners had quuestions. Commissioner Michael George and Tony Snider were concerned about access to and from FM 544. The plans do meet Texas Department of Transportation requirements. Commissioners expressed concern about how off-site drainage was to be handled. The applicant's representative reported that some storm water will be retained on the property within the parking areas and that the amount and route of water leaving the property has been approved by the City's engineers. A motion to approve was made by Carter Porter and seconded by Steve Ahrens. A vote was taken and passed 3 for and 2 against, with Michael George and Tony Snider opposed. 4. Discuss and consider a recommendation to the City Council regarding a Preliminary Plat for the Greenway Addition, generally located at the southeast corner of FM 544 and Westgate Way, and being all of a certain 27.49 acre tract situated in the Duke Strickland Survey, Abstract No. 841 and the E.C. Davidson Survey, Abstract No. 267, City of Wylie, Collin County, Texas. Claude Thompson reports that this Plat is to allow construction of the Albertsons retail center. Commissioners had no additional concerns other than those earlier expressed during review of the Site Plan. A motion to approve was made by Steve Ahrens and seconded by Carter Porter. A vote was taken and passed 4-1, with Tony Snider voting no. 5. Discuss and consider a recommendation to the City Council regarding a Final Plat for Sage Creek, Phase Ill, generally located east of McCreary Road, south of McMillen Road and to the east of Sage Creek Phases I and II, and being all of a certain 24.476 acre tract situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas. Claude Thompson states that the Final Plat conforms to the Preliminary Plat which was approved by the Council in September of 1998. Staff has reviewed the Plat and found that it complies with all City and State subdivision requirements. Representative Richard Hovas, 6330 Belt Line Road, Garland, Texas states that this Plat will create 94 lots which are a minimum of 7,200 square feet in size. The amenity center, part of an earlier plat, is nearing completion. A motion to approve was made by Gary Wiseman and seconded by Steve Ahrens. A vote was taken and passed 5-0. Commission Members Present: Staff Members Present: Michael George, Chairman Claude Thompson, Planner Carter Porter, Vice-Chairman Fern Casteel, Secretary Gary Wiseman William Chapman Tony Snider Steve Ahrens Phillip Tramell WORK SESSION A Special Work Session began at 5:30pm in the City Manager's Conference Room, adjacent to the Council Chambers at the Municipal Complex. Revisions to the nonresidential districts of the Zoning Ordinance were discussed with the consultants. Janet Thorp distributed proposed Use Regulations which defines development requirements for both residential (earlier adopted by the Council but for which some modification is recommended) and nonresidential uses. The nonresidential uses were discussed to some extent. Ray Stanland distributed proposed Nonresidential District Regulations. These recommend development requirements and design standards for the several nonresidential districts. These were discussed, and Commissioners asked what they would like to have included as Base Standards and optional Desirable Attributes. Commissioners expressed desire to require masonry wall for screening, encourage tree preservation and larger trees for landscaping, and increase the use of masonry materials on exterior building walls. Claude Thompson encouraged Commissioners to write concerns and mark desired revisions and additions on their copies and return them to him by November 15, so that modifications can be compiled for the next work session on November 21. CALL TO ORDER Chairman Michael George called the Regular Meeting to order at 7:00 p.m. in the City Council Chambers CITIZEN PARTICIPATION Al Duncan, 7250 E. Parker Rd, Wylie, TX 75098, addressed the proposed residential development south of Parker Road (Public Hearing Item No. 2 on the current agenda). He was concerned that the trees there would be cut down, opening view of the new homes. Mr. Gary Defrain, representative for that proposal, stated he would be leaving the trees along the fence line. CONSENT AGENDA ITEMS 1. Consider and act upon approval of the Minutes from the October 17, 2000 meeting. The action was tabled until the next meeting, when the minutes will be made available. PUBLIC HEARING ITEMS 1. Hold a Public Hearing and consider a recommendation to the City Council regarding the change in zoning from A (Agriculture) District to PD (Planned Development) District for Industrial Uses, proposed by Barry Patrick, for a 5.0 acre tract located west of Sanden Boulevard and south of F. M. 544, situated in the Duke Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas. (Zoning Case No. 00-07) Claude Thompson, Planner reported that the development was to occupy only one acre of the 5-acre site, and the remainder of the acreage was undevelopable floodplain. The applicant had earlier submitted a request for rezoning to a straight Industrial district, but that would allow uses and development standards which may not be acceptable either to the City or the applicant. The proposed development conditions of the current Planned Development District restrict uses and construction which are potentially incompatible to this planned Business Park area. Land to accommodate the widening of Sanden Road will be dedicated by the previous owner, Birmingham Trust. Applicant, Barry Patrick, 5705 Murphy Road, Sachse, Texas 75048 explained that he has purchased the property in order to relocate his business to Wylie from garland. They fabricate precision metal cabinets for the telecommunications industry. Commissioners questioned whether there was to be any outside storage of materials, and the applicant answered that there would be no outside storage as stated in the proposed Development Conditions. Commissioners expressed the desire that the outside air handling equipment be screened and that the trash dumpsters be screened by masonry walls, and Mr. Thompson stated that the code requires that dumpsters be screened. The applicant agreed to screen the HVAC equipment with shrubs. A motion to approve with appropriate screening of Air Conditioning Units and brick masonry screening of the Trash Dumpsters was made by Carter Porter. William Chapman seconded the motion. A vote was taken and passed 7-0 2. Hold a Public Hearing and consider a recommendation to the City Council regarding the change in zoning from A (Agriculture) District to PD (Planned Development) District for Residential Uses, proposed by Campbell/Wylie Partners, for a 41.870 acre tract located east of F. M. 1378 and south of Parker Road, situated in the Lewis M. Marshall Survey, Abstract No. 594, City of Wylie, Collin County, Texas, (Zoning Case No. 00-9. Mistakenly noted on agenda as 00-10). Claude Thompson, Planner stated that the proposal to develop 10,000 square feet lots was contrary to the recommendations of the Comprehensive Plan that the area become a large-lot rural subdivision with no curbed streets. However, staff supports the current proposal because of its location between two creeks which will buffer it from neighboring properties. The central roadway to be constructed with this project, south through the City of Parker and including a bridge over Turner Branch, will provide a needed collector thoroughfare to relieve traffic pressures on McCreary Road and F.M. 1378. Applicant, Gary Defrain, 8235 Douglas, Dallas, Texas explained that the proposed plan under consideration incorporated several changes from earlier versions reviewed by staff and Commissioners. He testified that the developer is going to construct a parking lot and lighted trail within the 17-acrea public park. He noted that a landscaped screen wall will screen this subdivision from the neighboring properties, in response to concern raised earlier by Mr. Duncan. Commissioners expressed concern that the secondary access/egress would be later and requested that the road to the south be connected as soon as possible. Commissioners also requested that no railroad ties be used for retaining walls. Mr. Hundly, who lives next to the property said that he believed that the proposal does not fit the rural character of the area and wants City to require larger lots, which is why most of the existing residents built there. He mentioned that this area was annexed into the City of Wylie against the wishes of most area property owners. He did not want to look into the back yards of the new smaller houses. A motion to approve was made by Tony Snider and seconded by Phillip Tramell. A vote was taken and passed 6-1, Steve Ahrens was opposed. ACTION ITEMS 1. Discuss and consider a recommendation to the City Council regarding a Final Plat for the Creekside Estates, Phase 1 Addition, proposed by Bury & Partners-DFW, Inc., and being all of a certain 84.378 acre tract generally located east of McCreary Road and North of McMillen Road, situated in the John H. Mitchell Survey, Abstract No. 589, City of Wylie, Collin County, Texas. Claude Thompson, Planner stated that the Final Plat conformed to the Preliminary Plat approved in October of 1999, and complies to all technical requirements of City and State subdivision codes. Staff recommends approval. Applicant, Gary Defrain, 8235 Douglas, Dallas, Texas stated that the area noted on the Plat to be dedicated as City Park was to be private and maintained by the Homeowners Association. The City Park portion of the development is across the creek to the north. The HOA will also maintain the detention basins. These errors will be corrected before the Plat is considered by the City Council. Commissioners questioned whether the HOA or the City was most capable of maintaining the drainage functions. Steve Ahrens made a motion to approve, recommending that City Council decide who will maintain the Retention Pond. William Chapman seconded the motion. A vote was taken and passed 7-0. 2. Discuss and consider a recommendation to the City Council regarding a Final Plat for the Riverchase Phase Two Addition, proposed by Kurtz- Bedford Associates, Inc., and being all of a certain 37.756 acre tract generally located west of F. M. 1378 and south of Parker Road, situated in the William Patterson Survey, Abstract No. 716, City of Wylie, Collin County, Texas. Claude Thompson stated that this subdivision was earlier proposed to be partly gated with private streets and partly ungated with public streets, but that this plat now reflects the decision that the entire subdivision be gated and have private streets maintained by the Homeowners Association. Staff had reviewed the Plat and found that it conforms to the Preliminary Plat approved in December of 1999, and complies to all technical requirements of City and State subdivision codes. Staff recommends approval. Applicant, Tony Kruska, Rosehill Road, Garland, Texas testified that the City has approved the location and type of gates to be installed, and the streets and detention basins will be constructed to City standards but will be maintained by the HOA. A motion to approve was made by Gary Wiseman and seconded by Tony Snider. A vote was taken and passed 7-0. 3. Discuss and consider a recommendation to the City Council regarding a Final Plat for the Riverchase Phase Three Addition, proposed by Kurtz- Bedford Associates, Inc., and being all of a certain 42.894 acre tract generally located west of F. M. 1378 and south of Parker Road, situated in the William Patterson Survey, Abstract No. 716, City of Wylie, Collin County, Texas. Claude Thompson reported that the public park was to be part of a longer open space and trail system which connects several subdivisions. Staff had reviewed the Plat and found that it conforms to the Preliminary Plat approved in December of 1999, and complies to all technical requirements of City and State subdivision codes. Staff recommends approval. Applicant, Tony Kruska, Rosehill Road, Garland, Texas stated that all streets would be private but open at all times for public service and emergency access. The park on the western edge will be public but the detention basin will be maintained by the Homeowners Association. Commissioners expressed concern about how the public park land will be accessible. Discussion suggested that bridging of the creek in order to obtain access was not the best solution. Commissioners also requested that fences backing on the park be iron to enhance the views rather than wood. (The Horton representative said that they would consider plaacing that restriction in the HOA covenants. A motion was made by Steve Ahrens and seconded by Carter Porter to approve the Plat with a stipulation that fences along the park be iron rather than wood. A vote was taken and passed 7-0. 4. Discuss and consider a recommendation to the City Council regarding a Preliminary Plat for the Shiloh Baptist Church Addition, proposed by Jackson & Associates Land Surveyors, and being all of a certain 2.001 acre tract located at 840 East Brown Street, situated in the Francisco de Ia Pina Survey, Abstract No. 668, City of Wylie, Collin County, Texas. Claude Thompson reported that the church has moved two frame buildings on to the property believing it to be in the unincorporated County. However the property is within the Wylie City Limits, and the buildings and several other existing site features do not comply with current City codes. The property requires platting in order to create an official lot so that appropriate permits for renovation can be issued. Staff recommends approval. Applicant, Don Jackson, 2600 West FM 544, Wylie, Texas, representing the church was present to answer questions of the Commissioners. A motion to approve was made by Tony Snider and seconded by Phillip Tramell. A vote was taken and passed 6-1, Steve Ahrens voting no. 5. Consider and act upon a Site Plan for the Rowan Addition, proposed by Glenn Associates, and being all of a certain 1.0 acre tract generally located north of S. H. 78 and west of Eubanks Lane, situated in the Francisco de Ia Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Claude Thompson stated that staff had reviewed the proposed Site Plan found that it complies with all applicable codes, and recommends approval. Applicant, Jerry D. Glenn, 2240 E. Lucas Road, Wylie, Texas was present to address concerns of the Commission. Commissioners requested that the east side of the building, which is be a front entry and could be visible from S.H. 78, be masonry. The applicant responded that some brick could be added, but that it had not been anticipated that the building be masonry except for the street front as the code requires. Phillip Tramell made a motion to approve with the consideration that the east-facing corners be wrapped back 10 feet with the same material and the front of the building, which is 100% masonry. William Chapman seconded the motion. A vote was taken and passed 4-3, Carter Porter, Steve Ahrens and Gary Wiseman voting no. 6. Discuss and consider a recommendation to the City Council regarding a Final Plat for the Rowan Addition, proposed Rockwall Surveying, Inc., and being all of a certain 1.0 acre tract generally located north of S. H. 78 and west of Eubanks Lane, situated in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Claude Thompson stated that staff had reviewed the proposed Site Plan found that it complies with all applicable codes, and recommends approval. Applicant, Todd Misak, 2031 N. First Street, Jacksonville, AR 72076. Agent, Walter Nelson, 1002 W. Wall Street, Grapevine, Texas, 76051 were present to address questions of the Commissioners. The development is to be a self-storage facility with leasing spaces, and will contain an apartment for management and security personnel. Location: 901 Hensley Lane at Sanden Boulevard Existing Zoning: I(Industrial) Summary: The Site Plan under consideration is for the Lonestar Circuits manufacturing facility. The current proposal is to develop a 101, 908 square feet building for manufacturing/warehouse uses and a 40,800 square feet two-story office building, totaling 142,708 square feet. The property is 13,523 acres in size. The Site Plan envisions a future building for office/manufacturing functions to the west of the proposed development. The property is currently vacant, zoned for I (Industrial) uses, and platted as Lot 3A, Block A of the Premier Business Park, Section 29A.2 of the Comprehensive Zoning Ordinance, Number 85-23A, states that site plan review and approval by the Planning and Zoning Commission shall be required for any development located within a nonresidential zoning district, The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, safe an.d efficient vehicular and pedestrian circulation, and provision of utilities and other services. Site plans shall contain sufficient information relative to site design considerations and shall conform to data presented within the building permit application. Site Plat— Lonestar Circuits Issues: 1. Staff has reviewed the proposed site plan for the Lonestar Circuits facility and found it to be in compliance with the Zoning Regulations and other pertinent ordinances of the City of Wylie. 2. The property to the west of the tract is developed for office and light industrial uses. The properties to the west, east and south of the tract are zoned and developed for industrial uses. The property to the north is zoned A (Agriculture), undeveloped and owned by the Wylie Independent School District. 3. Additional right-of-way is provided for the future widening of Sanden Boulevard. Financial Considerations: Site Plan application fees -Paid Staff Recommendation: Approval The Departments of Development Services, Public Works and Fire concur with this recommendation.
