I apologize for the delay in getting this to you, but I do hope that you have the time to review these items prior to our meeting. I also realize that this is an exceptionally long agenda. It was my charge when hired to complete review and decisions of applications in a more timely manner. The State law is specific in the time allowed for a public decision, and we have often exceeded that time allowance. I do not perceive future agendas being nearly so extensive. I do believe that we can complete adequate review of this agenda in a reasonable time. Note that the items require differing levels of review. The rezoning cases and plats will go on to the City Council for public hearing review and approval. The site plans receive no further review. However, both plats and site plans have already been thoroughly reviewed for technical compliance by staff and consultants. City of Wylie Public Hearing Item No. 00-07 Rezoning Planning and Zoning Commission Public Hearing: November 7, 2000 Owner/Applicant: Barry Patrick Location: Generally located along the west side of Sanden Boulevard and south of F.M. 544 Existing Zoning: A (Agriculture) District Requested Zoning: PD (Planned Development) District for Industrial Uses Sum ma ry: The applicant is requesting rezoning of a 5 acre tract in order to develop a portion of the property for light industrial uses. Specifically, the applicant proposes to construct a single story building of 12,000 square feet to house the operation of his precision sheet metal fabrication business. The applicant earlier submitted a request to rezone the property to straight Industrial District. However, that request has been converted to Planned Development District in order to restrict the potential for incompatible uses and conditions which were considered unacceptable by both the applicant and staff The properties to the immediate north, west and south are vacant and zoned for A (Agriculture) uses. The property to the east is zoned and developed for I (Industrial) uses. Public Comment Forms were mailed to seven (7) property owners within 200 feet of this request. No Public Comment Forms have been returned. 00-07 Issues: 1. The Comprehensive Plan recommends Business Center land use for the area. The Business Center category is intended to accommodate professional office and clean manufacturing and assembly light industrial uses. The proposed development plan and conditions are consistent with this recommendation of the Plan, and the conditions of the Planned Development District restrict the potential for incompatible development. 2. The applicant intends to develop approximately one (1) acre of the total 5-acre tract, as reflected on the Detailed Site Plan. The remainder of the property is largely occupied by floodplain of Muddy Creek and is not developable. The applicant purchased the 5 acres to satisfy the City requirement that Planned Development Districts be at least 5 acres in size. The adjustment to the floodplain proposed by this development complies with the approved floodplain requirements of the Federal Emergency Management Agency. 3. Additional right-of-way for the widening of Sanden Boulevard is to be dedicated by the earlier owner (Birmingham Land Trust), and the subject property will ultimately front on the improved Sanden. Until construction of the future roadway is completed, an access easement connects the subject property to Sanden. 4. The applicant is aware that a Final Plat for the property must be approved prior to obtaining a permit to begin construction. The Detailed Site Plan will serve as a Preliminary Plat. Financial Considerations: Rezoning application fee -Paid Staff Recommendation: Approval. The zoning and use are compatible with the Comprehensive Plan and surrounding development. The Departments of Development Services, Public Works, and Fire concur with this recommendation. Attachments: Location Map Area Zoning Map Property Owner Notification Map Detailed Site Plan Planned Development Conditions • City of Wylie Public Hearing Item No. 2 00-10 Rezoning Planning and Zoning Commission Public Hearing: November 7, 2000 Owner/Applicant: Campbell/Wylie partners Location: Generally located along the south side of Parker Road, between McCreary Road and Country Club Road (F.M. 1378) Existing Zoning: A (Agriculture) District Requested Zoning: PD (Planned Development) District for single-Family Residential Uses Summary: The applicant is requesting rezoning of a 45.192-acre tract to a Planned Development District in order to develop a master planned residential community. Specifically, the proposal is to create a total of 64 single-family residential lots, 32 of which will be a minimum of 10,000 square feet and 32 of which will be a minimum of 12,000 square feet. The concept also provides for a 17.0-acre public park and additional right-of-way for the expansion of Parker Road (F.M.2514). The properties to the west, north and east of the tract are sparsely developed in low-density large- tract single-family residences. The property to the south is undeveloped. The lands to the west and south are within the City of Parker and lands to the north across Parker Road are within the City of Lucas Public Comment Forms were mailed to nine (9) property owners within 200 feet of this request. No Public Comment Forms have been returned. oo-io Issues: 1. The Comprehensive Plan recommends low-density Country Residential development for this property. Country Residential is defined as allowing single-family detached houses on one- acre lots, served by streets with no curb and gutter or sidewalks to maintain the rural character. Smaller lots are permitted if gross densities do not exceed 0.75 dwelling units per acre. The proposed concept plan reflects a gross density of 1.4 dwelling units per acre, and is, therefore, not fully consistent with the recommendation of the Future Land Use Plan. 2. However, the tract is situated between the drainage systems of Muddy Creek and Turner Branch, and this isolated location buffers it from neighboring lower-density rural developments. The proposed density and development standards are consistent with the Suburban Residential recommendations of the Comprehensive Plan. 3. This proposal was filed prior to the adoption of the new residential districts and development conditions of the Zoning Ordinance and may legally comply with the requirements in place at that time. The following is a comparison of the Design Standards of the proposed Planned Development District with those of the previous and current Zoning Ordinance. The proposal envisions construction of relief channel to improve the flow of Muddy Creek and allow removal of the floodplain from parts of three residential lots. This adjustment complies with the approved floodplain requirements of the federal Emergency management Agency. 5. The applicant will extend the central north/south roadway through the proposed development south through the City of Parker(including the bridging of Turner Branch) in order to connect with Francesca Drive within the previously approved Creekside Estates development. This extension will serve as a second point of access/egress to the proposed development as well as improved regional emergency circulation. 6. In addition to the dedication of 17 acres for public park land, the applicant will provide off street parking for park access, as well as a lighted hike and bike trail with benches. 7. This proposal provides for the dedication of right-of-way for the widening of Parker Road (F.M. 2514). A 50 feet wide easement for access is also provided for future access to developable property within the City of Parker. 8. A Homeowners Association will maintain all common screening and landscape areas. 9. The applicant is aware that the property must be platted prior to beginning construction. Financial Considerations: Rezoning application fee - Paid Staff Recommendation: Approval. The proposal Concept Plan and Design Standards, controlled by the Planned Development District, are appropriate to achieve the overall intent of the Comprehensive Plan and newly-adopted residential standards of the Zoning Ordinance. This plat will create 231 single-family residential lots, certain common areas to be maintained by the Homeowners Association, as well as provide a public park and additional rights-of-way for the widening of McCreary and McMillen Roads. The plat contains a total 84.378 acres. The Preliminary Plat was approved by City Council in October of 1999. The property is currently vacant, unplatted, and zoned for PD (Planned Development) for single- family residential uses with specific development conditions. Issues: 1. Staff has reviewed the proposed plat for the Creekside Estates, Phase I Addition and found it to conform with the approved Preliminary Plat and to be in technical compliance with all applicable State subdivision regulations. The plat also complies with all Subdivision Regulations and other pertinent development ordinances of the City of Wylie. Final Plat—Creekside Estates, Phase I 2. The plat dedicates 46 feet of right-of-way for widening of McCreary Road. Right-of-way is also dedicated for widening of McMillen Road which cannot be acquired from the Mobile Home Park on the south side of McMillen, including 60 feet at its intersection with McCreary in order to allow for immediate construction of a turning lane and 55 feet to accommodate the new Lewis Drive intersection and common area to screen the rear of adjoining residential lots. Additional right-of-way for McMillen will dedicated by future plats. Financial Considerations: Plat application fees -Paid The applicant is aware that impact fees must be paid before the plat can be filed with Collin County. The applicant is creating a new lot from the combination of three separate lots. The subject Site plan envisions development of 2.449 acres of the total 4.333 acre property. Utility and drainage easements divide between the developing section and that portion to remain initially undeveloped. 3. The property to the east of the tract is developed for office and light industrial uses. Other properties to the east of the tract are currently developing for industrial uses. 4. The proposal includes an apartment within the office for 24-hour accommodations of custodial/management personnel. 5. The initial phase will include 9,000 square feet, including 1,120 square feet of office space and 7,800 square feet of warehouse. The property is platted as Lot 5, Block A of the Creek Bend Industrial Park. It is currently vacant and zoned for 1(Industrial) uses. Section 29A.2 of the Comprehensive Zoning Ordinance, Number 85-23A, states that site plan review and approval by the Planning and Zoning Commission shall be required for any development located within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, safe and efficient vehicular and pedestrian circulation, and provision of utilities and other services. Site plans shall contain sufficient information relative to site design considerations and shall conform to data presented within the building permit application. Site Plat—Greenway Construction Company Issues: 1. Staff has reviewed the proposed site plan and found it to be in compliance with the Zoning Regulations and other pertinent ordinances of the City of Wylie. 2. Properties to the west of the tract fronting Kristen Lane is developed for office and light industrial uses. The property to the south is occupied by the City of Wylie waste water treatment plant. The property to the north is undeveloped. 3. Kristen Lane is a private street, platted as an access and utility easement. It is maintained by the private Creek Bend Industrial Association. 4. Much of the +/- 4-acre property is occupied by the 100-year floodplain and is not developable. The subject Site Plan envisions that the floodplain will not be encroached upon. 5. Due to existing development, a common access cul-de-sac could not be provided at the termination of Kristen. The design envisioned on the Site Plan allows sufficient turning movements for fire trucks and other over-sized vehicles. This common access will be kept open and unobstructed.
