E. , Staff Engineer DATE: February 1 , 1989 RE: Wylie Shopping Village Preliminary and Final Plat Brookshire Grocery Company Site Plan The Planning and Zoning Commission reviewed the Preliminary and Final Plat for the Wylie Shopping Village subdivision on July 18, 1988 and recommended its approval to the City Council contingent upon the acquisition of a joint access easement by the owner, Wylie Shopping Village, Ltd. (Mr . Dwight Scott, President ) , from the Wylie Community Hospital . The negotiations with the Wylie Community Hospital have not resulted in the acquisition of the joint access easement required by the Planning and Zoning Commission as part of their recommendation to the City Council ; therefore, the owner and prospective buyers (Brookshire Grocery Company) would like to discuss the matter further. Inserted in your packet is a copy of a site plan for the proposed Brookshire Grocery Company facility which also shows the existing facilities at the Wylie Community Hospital . Please review this site plan inorder to prepare for the scheduled discussion. MEMORANDUM TO : Planning and Zoning Commission FROM : Ron Homeyer, P. E. , Staff Engineer DATE : February 1 , 1989 RE: Abandonment and Closure of the Second Street Railroad Grade Crossing of the AT&SF Railway The Atchison Topeka and Santa Fe Railway Company is currently in possession of a new Grade Crossing request from the City of Wylie for the proposed Sanden Boulevard project. They have completed all of their internal review processes of the proposed construction, but they are hesitant to add the additional liability associated with roadway grade crossings of their railway. One action by the City of Wylie which would encourage the release of the grade crossing agreement from the AT&SF Railway would be the closure of one of the existing unsignalized grade crossings in the central part of town. Therefore, I would like to recommend the consideration of the closure of the Second Street grade crossing because the preliminary design of State Highway 78' s widening proposes the closure of Second Street as part of the project. E. , Staff Engine r i�,i DATE: February 15, 1989 RE: Singletary-Beckham 104 acres Tract Request for Variances - Subdivision Regulations Mr . Nelson has requested specific variances from the City of Wylie Subdivision Regulations for the owners of the above referenced tract of land. My comments on the variances are as follows : Request No. it Culleoka Water Supply specifications will allow PVC potable water pipe classes other than the City of Wylie specified AWWA C-900 PVC water pipe. The use of the lower classes of potable water pipe would be unacceptable in the City of Wylie distribution system because of the additional maintenance costs which would be encountered. The use of 6 inch minimum pipe for the entire development will be acceptable provided they maintain a gridironed ( looped) system which has a maximum distance of 1000 feet between intersections (connections ) . Fire hydrant spacing using the City of Wylie criteria is appreciated, but I wish to reiterate the fact that all portions of each and every lot must fall within an 600 foot arc from the fire hydrant location. Request No. 2: The use of five inch (5" ) concrete pavement is not desirable, but may serve adequately under the rural conditions which will be expected under the one ( 1 ) acre and larger lot configuration. I wish to clarify and extend the specifications under this variance to include all of the existing City of Wylie specifications, including 3500 psi minimum 28-day compressive strength concrete, with the only variance being on the thickness of the pavement. The lime stabilized subgrade should also meet all of the requirements of the City of Wylie Subdivision Ordinance in all regards. I would also recommend that the roadway include a minimum dirt shoulder width of eight feet (8' ) with a cross-slope not to exceed 1/4 inch per foot in all instances . Request No. 31 Open ditches adjacent to the roadways for drainage is not overly objectionable in the rural conditions anticipated with this subdivision, but I would recommend that the maximum cross-slope of 4 to 1 provided in the City of Wylie Subdivision Regulations be applied to this development. The use of corrugated metal pipe for storm drainage culverts is not acceptable in my opinion for any street crossings and is recommended for all driveway crossings. Staff continues to recommend that the City of Wylie Extra- TerriLorial Jurisdiction not be relinquished for this tract of land . If variances from the City of Wylie Subdivision Regulations are allowed by the City of Wylie for this tract, then all future subdivisions within the ETJ will expect to receive the same variances ; therefore, I recommend that no variances be allowed. The normal procedure of submitting construction drawings along with the final plat for review should be enforced if variances from the Subdivision Regulations are allowed inorder to assure compliance with all of the specifications established. Also, the construction of the improvements must be completed prior to the final release of the final plat to the Commissioners Court for acceptance. PLANNING AND ZONING MEETING MINUTES JANUARY 16, 1989 The Planning and Zoning Commission met in regular session on Monday, January 16, 1989, in the Council Chambers of the Municipal Complex . A quorum was present and notice of the meeting had been posted in the time and manner required by law. Members present were Chairman Brian Chaney, Vice- Chairman Bart Feddicord , Cecelia Wood , Marty Stovall , Bob Skipwi ._h and Steve Wright. Staff members present were Code Enforcement Cf f i cer Roy Faires and Secretary Francis Varnell and 2ity Engineer Ron Homeyer . Ron Jeffries was absent. Brian Chaney called the meeting to order . APPROVAL OF MINUTES: Cecelia Wood corrected the Minutes of January 4, 1989 by stating that in the last paragraph of page 1 ) should read Mayor Tr i imt l e ' s in lieu of as written. Bart F edd i cord made a motion to accept the Minutes as corrected. Seconded by Cecelia Wood. The motion carried with all in favor. CONDUCT PUBLIC HEARING IN REGARDS TO THE REQUEST FOR MR. DOUG POOLE, OWNER OF POOLE FEED SUPPLY TO OBTAIN SPECIFIC USE PERMIT FOR FEED STORE WITH OUTSIDE SALES. Chairman Brian Chaney opened the Public Hearing. Roy Faires stated that the City Secretary advised that she had sent out letters and two were returned , both were in favor and both with no comments. So being that there were no other comments or opposition the Public Hearing was closed. Mr . Faires also pointed out that Mr. Doug Poole had also requested two Specific Use Permits. ( 1 )outside plant sales, retail only in a B-1 Zone, (2) outside sale of feed and seed items in conjunction with a feed and seed store in a B-1 Zor+e. He advised on how the Planning and Zoning Commission reeds to Carefully specify the Various items which will actually be appl is atl e to the application. The Planning and Zoning Comdr.ission+ discussed each item that Mr . Poole had listed for sale in the proposed areas and these are the final specified items, with limitations, to be sold in these said areas. In all areas the hay is to be the common rectangular baled hay In all areas the wood shavings are to be bagged In all areas the fertilizer is to be bagged In all areas the peat moss is to be bagged In all areas the firewood is to be stacked and or bundled The Planning and Zoning Commission divided Area 1 into Area I and Area la. Area 1 - everything in this area limited to three (C) ft. nigh , wood shavings, firewood, christmas trees and farm and home supplies with the stipulation of lawn and garden items as normally defined. DOUG POOLE, OWNER OF POOLE FEED SUPPLY TO OBTAIN SPECIFIC USE PERMIT FOR FEED STORE WITH OUTSIDE SALES. Bob Skipwith made the motion to recommend to the City Council a One Year Specific Use Permit for Mr. Doug Poole. Seconded by Bart Peddicord. The motion carried with all in favor. CONSIDER RECOMMENDATION TO THE CITY COUNCIL IN REGARDS TO THE REQUEST OF SINGLETARY AND BECKHAM TO RELINQUISH EXTRA TERRITORIAL JURISDICTION ON 104.67 ACRES LOCATED OUT OF THE SD TERRY SURVEY ABSTRACT 890 IN COLLIN COUNTY TEXAS (BRANCH PENINSULA) . Mr. Faires updated new board member Steve Wright that many years ago the City annexed many acres of government land in order to provide ETJ protection for the Branch Peninsula and for the area surrounding the lake. Mr. Faires said this particular request is for a large tract that falls within our ETJ in which we are by State Law authorized to apply our subdivision regulations and subdivision regulations only. He stated that for some reason Singletary and Beckham have decided to resubmit their request. Roy Faires also stated that in the meantime, he had spoke with the city 's attorney and his question tc him was if we were to relinquish this particular piece of property when we shouldn ' t , would we 5e liable i a law suite filed by a person that had beer offended by that action. The lawyers answer was undoubtedly so. The lawyer said the only way you can get out of this situation is by legislative action; which is to reduce the extent of the one mile ETJ, which would effect the whole city. Mr. Faires also read a memo from City Engineer Ron Homeyer stating that he recommend that the City of Wylie not relinquish it 's ETJ requirements on this tract of land at this time. Mr. Faires also stated that it is also his recommendation to not relinquish the ETJ either. Mr. Nelson stated that the reason they were back before the Planning and Zoning Commission with this request was that before the Commission had not had a chance to study County Ordinances. Mr . Nelson also said that they don 't believe in the near future that the City of Wylie will be able to bring utilities to this area. He also stated that if the City can ' t bring utilities to this area, that they could petition to come into the city limits and that there would be a statutory limit of when the City would have to get utilities to this area. Mr . Roy Faires then made the correction that if they petition for annexation, that the City is not required to provide them with services of any type, and that with voluntary annexation it is not req+aired. David McCaw, Attorney for Mr. Beckham and Mr. Singletary stated that Mr . Beckham bought the property, and after buying it, the City cf Wylie decided to annex certain other pieces of property. He said that Mr. Beckham did not request annexation , he never had and he probably will not ever request annexation. He said when Mr. Beckham bought the land they intended to develop the property under the laws that existed for the property at the time. He continued to say that Mr. Beckham was being adversely effected in an after the fact situation. Mr. Beckham questioned if the City ever intended to control the area so far from. downtown Wylie. Brian Chaney spoke up and stated that the Planning and Zoning Commission did want to control the Branch Peninsula for an orderly development. Mr . Beckham stated that the area is so remote, because of the size of the lake. He stated that the city 's requirements in a rural area would make it not affordable and would be hard to sell becaose of the cost of the required concrete streets and sewer lines. He asked that the Planning and Zoning Commission not to impose the city ordinances on something that is not going to be in the city. Roy Faires stated that sewer and services is not the question. There is not anything in the state law that says the city can apply it 's ETC , provided it provides you with services. It states anything within a mile of the city is within it 's jurisdotion , regardless of whether we ' ll ever be able to service it or not. The city can control subdivision regulations; that it is one ordinance that the State of Texas says the city can enforce and the City of Wylie has extended the ordinance in that direction. Cecelia Wood stated that the more stringent regulations shall apply for the benefit of the citizens and that the Planning and Zoning Commission does have the opportunity to ensure that the citizens are provided with proper streets, drainage and fire hydrants. Bob Skipwith stated that he couldn 't understand how the City could control a man 's land. Mr. Faires offered a couple of possibilities of drawing a one mile line around the Branch Peninsula and abandon the whole thing out there in the water. He stated that he would not recommend that they shorten the one mile ETJ , because the City needs the ETJ in other areas. He said the idea was, since they annexed the lake , was ( 1 ) to get the parks back to the people (2) to prevent some of the things that have been going on through the exercise of ETJ. Chairman Brian Chaney stated that the Legislature in Austin decided it was the right of the cities, cities the size of Wylie, to have the one mile ETJ ir order to protect orderly development of the cities. He stated the City of Wylie is not defying the subdivision of this property , and all the requirements are is that they meet the ordinances. He continued to say that development in this area, due to our annexations, will be orderly and to the standards of the City of Wylie and until those standards are made stronger or weaker they are to abide by them. Cecelia Wood also stated to Mr. Beckham that he did not come before the Planning and Zoning Commission requesting variances, but that he came before the Commission to relinquish the city 's ETJ powers, and that perhaps he may have made the wrong request . Bob Skipwith also stated that someone needs to address this issue, that he just could not see the City of Wylie ever annexing the whole lake. He said that he understands both sides. Marty Stovall also agreed with Mr. Skipwith. He believed that the Planning and Zoning Commission should relinquish it 's ETJ and not stifle Mr. Beckham. Roy Faires pointed out that the Planning and Zoning Commission cannot pick and choose, per the city 's attorney. Bart Peddicord made the motion to recommend to the City Council , that the Planning & Zoning Commission not relinquish the Extra Territorial Jurisdiction requested by Singletary and Beckham for 104. 67 acres. Seconded by Steve Wright. A vote was taken with four votes in favor and two against , there was a misgiving on the part of one member and a revote was taken by decision of the chairman. The motion passed with five in favor and one against. Mr. McCaw objected to the revote. CONSIDER RECOMMENDATION TO THE CITY COUNCIL IN REGARDS TO THE CITY COUNCIL IN REGARDS TO THE FINAL PLAT OF PHENNEL ADDITION LOCATED ON THE BRANCH PENINSULA. City Engineer Ron Homeyer recommended the approval of this plat but with stipulations. He stated the staff recommends that the subdivision be approved contingent upon the construction of the perimeter street in compliance with the City of Wylie subdivision regulations. Bob Skipwith made the motion to recommend to the City Council that this piece of land be subdivided under the City of Wylie Subdivision Ordinances. Seconded by Bart Peddicord. The motion carried with all in favor. DISCUSSION OF THOROUGHFARE PLAN AND COLLECTOR STREET PLAN. Roy Faires explained that this was the same Thoroughfare Plan brought to the Planning and Zoning Commission before, but with the elimination of the one way streets downtown. He explained that the only major variation between this document was the relocation of one connection point; which was to eliminate a major creek crossing and make a minor creek crossing , and the insertion of the collector streets. Roy stated that with the additions that have been added, it would be his recommendation to go with it. The board also discussed the possibility of making some streets dead ends. They also discussed railroad crossings and the one way streets and discussed the extension of Springcreek Parkway and Sanden Boulevard. They also discussed the widening of Akin Lane. Box 428 Wylie, Texas 75098 Dear Mr. Homeyer: Please reference a recent telephone conversation with Ms. Jan Wagner on December 21, 1988 concerning the Brookshire Grocery Company median opening. We have reviewed Brookshire's requests (see attached letter dated December 19, 1988) and have developed two possible alternatives. These two alternatives are attached and labeled Figure 1 and Figure 2 . Figure 1 A left turn lane has been shown for the Brookshire Grocery Company and the Wylie Community Hospital main entrance. Due to the proximity of the proposed Brookshire Grocery development to the Wylie Community Hospital and F.M. 544 , the above mentioned left turn storage lengths would be built with minimum storage lengths (see attached Figure 4-28) . As shown on Figure 1, only 125 feet of storage would be available for the left turn movement from S .H. 78 to F.M. 544 . A storage length of 240 feet would be available for the left turn movement from S.H. 78 to F.M. 544 . A safer design would result if the Hospital and Brookshire had a common access driveway, as shown in Figure 2 . The following would result: 1. Longer storage for the left turn movement from S.H. 78 to F.M. 544 2 . Fewer median openings with desired distances between openings 3 . Possible signalization if warranted by the traffic volumes 4 . Easier access to southbound S.H. 78 from the proposed Brookshire development 5. S.H. 78 would operate at a higher capacity 6. Fewer accidents would probably occur This District and the Federal Highway Administration (FHWA) prefers to have all left turn storage lengths be designed at desirable standards for high volume signalized intersections. Based upon projected traffic volumes, the desirable standard for the S.H. 78/F.M. 544 intersection would be 285 feet for a design speed of 45 mph (see attached worksheet) . Figure 1 reflects a minimum storage length and Figure 2 reflects a less than desirable storage length. Selection of either one of the above alternatives by the City of Wylie as well as the S.H. 78 project will require the approval of our Austin Office and the FHWA. We are anticipating a March 1989 submittal of the S .H. 78 project to our Austin Office and the FHWA. If the current design schematic needs to be revised, we feel these changes can be made before the March 1989 submittal. When this project is approved, we will Afford An Opportunity For A Public Hearing. The anticipated construction letting date is July 1992 .
