02-06-1986 (Planning & Zoning) Minutes - � MINUTES PLANNING & ZONING COMMISSION THURSDAY, FEBRUARY 6, 1986 The Planning and Zoning Commission for the City of Wylie, Texas met in regular session on February 6, 1986 in the Wylie Community Center. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were: Chairman Kent Crane, Don Montgomery, Ben Scholz , Joe Strigle, and Ken Mauk . Representing the staff was Gus Pappas; City Manager , Roy Faires; Code Enforcement Officer , Susan Marquardt; Secretary, and Amanda Maples; Secretary. Those absent were Vice- Chairman Brian Chaney, and Bill Chapman. The meeting was called to order at 7: 00P. M. by Chairman Kent Crane. � APPROV - Chairman Kent Crane asked for any additions or corrections from the minutes. Ken Mauk made motion to accept the minutes as submitted. Joe Strigle second the motion. Motion carried 5-0. - City Manager Gus Pappas stated that this was not a sub-division but this plat reflects the road dedication that the developer of the Southfork Mobile Home Park is . making to the City of Wylie. The road is actually an extension of McCreary Road. The Staff has reviewed this plat and recommends approval . Chairman Crane asked if they were going to be annexed into the City of Wylie. City Manager Gus Pappas replied that they will be appling for annexation. After some discussion Joe Strigle made motion to accept the preliminary plat for the road dedication as submitted. Ken Mauk second the motion. Motion carried 5-0. ~ 3 - This- property is described as 320. 907 acres out of the Francisco de la Pina Survey, Abstract 688 and is located on E. SH 78. This property surrounds the site for the proposed Municipal Complex and is owned by Texana Ltd. , the donors of � the City Hall property. Chairman Kent Crane opened the Public Hearing. There being no questions or opposition the public hearing was closed and brought before the board for discussion. Don Montgomery made the motion to accept the annexation as proposed. Joe Strigle second the motion. Motion carried 5-0. _ ~ INq__q!A ANNEXATION OF ..!:Ig-.ACRES - This property is described as 148. 5696 acres out of the Francisco de la Pina Survey, Abstract 688 and is located on E. SH 78 east of and adjacent to Wylie Ranch East Addition. Chairman Kent Crane opened the public hearing. There being no questions or opposition the public hearing was closed and brought before the board for discussion. Motion was made by Ben Scholz to accept the annexation as proposed. Don Montgomery second the motion. Motion carried 5-0. ITEM NO. PUBLIC HEARING ON ANNEXATION- OF A HARVARD..._TRACT - This property is described as 7. 228 acres out of the Duke Strickland Survey, Abstract 841 and is located adjacent to the Harvard tract. It was, at one time, a part of the tract now refered to as the Harvard tract. The owner has now petitioned for annexation. Chairman Kent Crane opened the Public Hearing. Jim McKnight showed a drawing to the board. There being no other public discussion or opposition on this item, Chairman Crane closed the public - hearing and brought it before the board for discussion. After little discussion, Ben Scholz made the motion to accept the annexation as proposed. Don Montgomery second the motion. Motion carried 5-0. HEARING ON ANNEXATION OF PACHSE_ - This property lies in two counties. Tracts 1 ,2,& 3 lie in Collin County and Tr. 6 in Dallas County and is located at the ''Y" intersection of S. Ballard St. and Old Sachse Road. The property owner was asked to annex voluntarily, but did not respond affirmatively, therefore, the staff determined that it was in the best interests of the City to exercise forced annexation in this instance in order to provide contiguity to other property owners who have petitioned for annexation. This property is currently owned by Fred Brunner. Chairman Kent Crane opened the public hearing , no one wished to speak so the public hearing was closed and brought back to the board for discussion. Chairman Crane was disturbed by the forced annexation , he felt it was not necessary. City Manager Gus Pappas said that this property owner was almost ready to sign for the annexation and that he was not hostile. In fact , he was exploring the possibilities of developing this tract and how it should be zoned. Chairman Crane was concerned because he felt if this man was so close to signing, then why should we ~ force it . He felt we should wait and let him make the decision. Ken Mauk made a motion to accept the annexation. Joe Strigle second the motion. Motion carried 4-1 - ITEM NO.7 - PUBLIC INSOUN ANNEXATION OF 135 ACRES ON PLEASANT VALLEY - This property is described as 21 acres, 1 acre and 113. 89 acres out of the Guadalupe de los Santos Survey. Twenty-two (22) acres are located in Collin County and the Abstract No. is 1100. The 113. 89 acres are located in Dallas County in Abstract 1384. The owner , Roddy Groves, indicated his desire to be in the City of Wylie some time ago and recently signed the necessary petition for annexation. This property is directly adjacent to the property described in Item No. 6. Chaiman Crane opened the Public hearing. There being no questions or opposition, the public hearing was closed and brought before the board for discussion. Ben Scholz made the motion to accept the annexation as proposed. I TEM NO. 8 - PUBLIC HEARING ON ANNEXATION OF 31 ACRES ON PLEASANT VALLEY ROAD -- This property is described as 15 - acres ""` of the ""a"~^~p~ ~e ^~~ ~~`^~~ Survey,` --- - -n County Abstract No. 1100 and Dallas County Abstract No. 1384 and 16 acres out of Wm. Sutton Survey, Abstract 1275. It is located on Pleasant Valley Road and is adjacent to the Roddy Groves property. The owner , Larry Morgan , petitioned for annexation to the City of Wylie. Chairman Crane opened the Public Hearing. There being no questions or opposition , the public hearing was closed and brought before the board for discussion. Don Montgomery made the motion to accept the annexation as proposed. Ken Mauk second the motion. Motion carried 5-0. ITEM NO. _9 - PUBLIC HEARING ON ANNEXATION OF 84 ACRES NEXT TO GROVES__PROPERTY - This property is described as 84. 98 acres out of the Guadalupe de los Santos Survey, Dallas County Abstract 1384. This property is adjacent to the Groves property. Chairman Crane opened the public hearing. There being no questions or opposition, the public hearing was closed and brought before the board for discussion. Ken Mauk made motion to accept the annexation as proposed. ITEM i-NO._10 - PUBLIC HEARING ON ZONING F.0RL_I -ACRNE_�N BH_78 - _ This property is described as 1 . 04 acres out of the Francisco de la Pina Survey, Abstract 688 and is commonly known as Discount Bait House. It is adjacent to "Steaks 0ver Tex as^' . The petitioner is requesting B2 zoning. City � Manager Gus Pappas feels that since there is no pressing need for B2 zoning , B1 zoning should be granted. B1 goes with the zoning of the surrounding properties. Chairman Crane opened the public hearing. There being on questions or opposition , the public hearing was closed and brought before the board for discussion. Joe Strigle made the motion to accept B1 zoning for this tract of land. HEARING ON ZONING FOR 4 ACRES ON SH78. - This property is described as 4 acres out of the Francisco de la Pina Survey, Abstract 688 and is located on the southeast corner of Eubanks Lane and SH 78. The petitioner is requesting retail zoning. This is compatable with the proj6cted land use in the area and is located on what will be a major intersection. The staff recommends approval of B1 zoning. Chairman Crane opened the public hearing. There being on questions or opposition , the public hearing was � closed and brought before the board for discussion. HEARINGITEM NO. 12 - PUBLIC ���_AK�R�� ADJACENT��£�� � TO HARVARD TRACT - This property is described as 23. 218 acres out of the R. D. Newman Survey, Abstract 660, the H. J. Hardin Survey, Abstract 438 and the I . Clifton Survey, Abstract 193 and is located adjacent to the Harvard tract and the Dingban Wang tract. The petitioner is asking for agricultural zoning which is compatable with the existing use. While the staff feels that sometime in the future, this property will be more valuable for another use, we have no objection to granting this zoning. Chairman Crane opened the public hearing. There being no questions or opposition, the public hearing was closed and brought before the board for discussion. Ben Scholz made a motion to accept the zoning as requested. Don Montgomery second the motion. Motion carried 5-0. ITEM NO. 13 - PUBLIC HEARING ON ZONING OF 51 ACRES ON HOOPER . ROAD - This property is described as 51 . 531 acres out of the Wm. Sachse Survey, Abstract 835 and is located on Hooper Road directly adjacent to Regency Business Park. The ~_ petitioner is asking for agricultural zoning, which is compatable with exiting use. Motion carried 4-1 � ITEM NO. 14 - PUBLIC HEARING ON ZONING FOR 450 ACRES ON SH78 - This property is what is known to us as the Louis Reese property and is located along S. SH 78. It includes the 295 acres known to us as the George Lewis property. The petitioner is asking for multiple zonings which include B2, B1v MF, SF3, and SF2. Chairman Crane opened the public hearing. A representative of Louis Reece Co. , Mr. Tony Blancard , made a presentation to the board, including a drawing of the proposed zoning and the park that they are going to dedicate to the City of Wylie. This park will include a 16 acre lake, the park itself will be about 130 acres and will be surrounded by SF2 and SF3 zoning. This tract of land has a great deal of flood plain on it and will require a large amount of dirt work to make the land useable for subdivisions. This piece of property will include about 8.8% Multi-family, 13% B1 and B2 zoning, and about 16% Residential with a small border of Commercial property. Motion carried 5-0. ITEM NO._15_- PUBLIC ZONING OF 7 ACRES ON_FM544 -- This property is described as 7. 599 acres out of the M. Sparks Survey, Abstract 849. It is located on W. FM 544 at the Wylie/Murphy city limits sign. The petitioner is asking for B2 zoning. Chairman Crane opened the public hearing. Mr. Jerry Bond was present as a representative of W. R. Rose Co. , and offered to answer any questions pertaining to this item. There being no questions or opposition , the public hearing was closed and brought before the board for discussion.
