Resolution 2012-31 �� RESOLUTION NO. 2012-31(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, ADOPTING THE PREVAILING WAGE RATE OF PER DIEM WAGES FOR REGULAR, LEGAL HOLIDAY AND OVERTIME WORK FOR ALL CONTRACTS FOR PUBLIC WORKS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Wylie, Texas (the "City Council"), has investigated and determined that it would be advantageous and beneficial to the City of Wylie, Te:xas ("Citv") to adopt the prevailing wage rate of per diem wages for regular, legal holiday and ov��rtime work for all contracts for Public Works awarded by the City; and WHEREAS, in accordance with the provisions of §2258.022, Texas Government Code, the: City Council hereby adopts as the prevailing wage rate of per diem wages for regular, legal holiday and overtime work for all contracts for public works awarded by the City those wages shown as the mean in the National Compensation Survey — Wages compiled and published by the United States Department of Labor, Bureau of Labor Statistics, for the Dallas — Fort Worth, T?: CSA for the second month preceding the month in which any such contract for public work is ,�warded. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE "�'�` CI:TY OF WYLIE. SECTION 1: Findin s�Incorporated. The findings set forth above are incorporated into th� body of this Resolution as if fully set forth herein. SECTION 2: Adoption of the Prevailin� Wa�e Rate of Per Diem Wa�es. The City Council of the City of Wylie, Texas, hereby adopts the prevailing wage rate of per diem wages for regular, legal holiday and overtime work for all contracts for Public Works awarded by the City, in accordance with the provisions of§2258.022, of the Texas Government Code. SECTION 3: Savin�s/Repealin� Clause. All provisions of any resolution in conflict with this Resolution are hereby repealed; but such repeal shall not abate any pending matters of the repealed resolution. Any remaining portions of conflicting resolutions shall remain in full force an effect. SECTION 4: Severabilitv. Should any section, subsection, sentence, clause or phrase of this Resolution be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Resolution shall remain in full fe�rce and effect. Frisco hereby declares that it would have passed this Resolution, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more se;ctions, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. ��. SECTION 5: Effective Date. This Resolution shall take effect immediately upon its passage and adoption.
