09-26-1985 (Planning & Zoning) Minutes PLANNING AND ZONING COMMISSION REGULAR MEETING - MINUTES SEPTEMBER 26, 19S5 The Planning and Zoning Commission for the City of Wylie met in regular session on Thursday, September 26, 1985 at /: 00 P. M. in the Wylie Community Center. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those present were Chairman Kent Crane, Brian Chaney, Don Montgomery, Ben Scholz , Ken Mauk, and Bill Chapman, City Manager Gus Pappas, City Secretary Carolyn Jones, Code Enforcement Officer Roy Faires, Sue Marquardt, Ken Swayze, Barron Cook, Mike Cummings, John Seeley, Kent Flynn, Billy Thompson, and Bill Baker. Mr. Joe Strigle was absent . Chairman Kent Crane called the meeting to order. There being no corrections or addition to the minutes, a motion was made by Ken Mauk to approve as submitted. Seconded by Brian Chaney. This motion carried - with all in favor. pUBLIC HEAR��G ON ZONING_OF 4. 6 _ACRES AND 1 . 97 ACRES OUT OF L. K. PEGUES SURVEY, AB S OUT OF I . CRIQ lv! SAC�SE--SU{�/EY� ABSTRACT 835: This property is owned by Texas Power & Light Company and is not simply an easement. Industrial zoning is being requested for 18. 009 acre tract in William Sachse Survey and agricultural zoning for the remaining tracts. Chairman Kent Crane opened the public hearing, there being no questions or opposition, the public hearing was closed and this item returned to the commission. There being no questions of the commission, a motion was made by Bill Chapman to recommend approval to the City Council . Seconded by Ben Scholz . This motion carried with all in favor. FRANCISCO DE LA PINA SURVEY ABSTRACT 688: This property is commonly known as Wyndham Estates and the request for re- zoning is from Industrial to Multi -family and Single Family -3. City staff has no objections to changing the zoning from Industrial to Multi-family and Single Family 3. Chairman Kent Crane opened the public hearing, there being no questions or opposition, the public hearing was closed and this item returned to the commission. Chairman Kent Crane said he was on the board when this came in and this was one of the first industrial tracts annexed. Don Montgomery wanted to know if staff felt this was more compatible than industrial zoning. City Manager Gus Pappas ' said that staff felt this was compatible. Motion was made by Brian Chaney to recommend to Council approval of this zoning change. Seconded by Bill Chapman . This motion carried with all in favor. PUBLIC HEARING FOR ZONING ON 30 ACRES OUT OF THE G. W. ABSTRACT 351 : This property is borders on the east by o� FM 1378 and on the north and west by Lake Ranch r Estates. The request for zoning is for Single Family 1 and 3 and Duplex (2F) and Business 1 . City Manager Gus Pappas said the original request for zoning was for duplex (2F) , but the developer has come back to staff and requested Single Family 1 , 2, and 3 and Business 1 . Chairman Kent Crane opened the public hearing, there being no questions or opposition, the public hearing was closed and this item returned to the commission. Ben Scholz wanted to know why the SF 2 was abutting the larger tracts with out being zoned SF-1 . City Manager Gus Pappas said that these property owners had been given a chance to annex into the City. Mr . Drain and other property owners did not want to annex or have the protection of the zoning nor did they want to take advantage of the water line being put in. City Manager Gus Pappas said that it was the City' s responsibility to protect the citizens of our City. Motion was made by Ken Mauk to - recommend to the Council to zone this property Single Family 1 , Single Family 2, Single Family 3, and Business 1 . Seconded by Don Montgomery. This motion carried with all in favor. PUBLIC HEARING ON THE ZONING OF 1 /. 1478 ACRES OUT OF THE WILLIAM SACHSE SURVEY, ABSTRACT 835: This property is located on FM 544 and is adjacent to Steel Industrial Park. This area being zoned will be phases 2 & 3 of Regency Business Park. The request for zoning is for Industrial . Chairman Kent Crane opened the public hearing, there being no questions, the public hearing was closed and this item returned to the commission. Motion was made by Brian Chaney to recommend to Council the approval of Industrial zoning for this 17. 1478 acres. Seconded by Bill Chapman. This motion carried with all in favor. APPROVAL OF PRELIMINARY PL GENCY BUSINESS PARK: City Manager Gus Pappas said the only request from staff is to have the developer go ahead and extend Capital St. west and Regency Dr. South. If these streets are extended now, then there will be no problem as the tracts west and south of this property begin to develope. Mr . Ken Swayze said he would leave the easement for Capital and Regency to be extended but had rather not have the expense of putting in these streets at this time. Chairman Kent Crane said making _- Capital and Regency through streets will be expensive, but this is a part of the commissions planning duties. Ben Scholz said the only way this is going to get paved is by the developer doing the street now. Don Montgomery wanted - to know why these streets could not be done at the time the other tracts begin development. City Manager Gus Pappas said because there would be no one to pay for the paving of these sections. After the developer has sold the lots then the City would have to assess the properties in order to pave the streets. Motion was made by Bill Chapman to recommend to Council approval of the preliminary plat for Regency Business Park with the stipulation that the developer go ahead and extend Capital and Regency Streets at the time of developing this property. Seconded by Bryan Chaney. This motion carried with six (6) in favor and Don Montgomery voting against the plat. City Manager Sus Pappas said that the streets, Winding Oaks and Rustic Trail , coming from Rustic Oaks I and II will continue through Rustic Oaks IV. Fleming Street will be a collector street which will require 60' right-of-way but will only require 37` of pavement. This plat has met all requirements for drainage and staff recommends approval . Motion was made by Brian Chaney to recommend approval to Council of the final plat for Rustic Oaks IV. Seconded by Bill Chapman. This motion carried with all in favor. — Thiproperty is located on FM 1378. This plat has met all. requirements and staff recommends approval . Motion was made by Brian Chaney to recommend approval to Council of the preliminary plat for Crescent Cove South. Seconded by Don Montgomery. This motion carried with all in favor. APPROVAL OF PRELIM This property is located between FM 3412 and FM 544 (Kirby St. ) . City Manager Gus Pappas said this property has the option of going under the old zoning ordinance or going under the new zoning ordinance. This plat has a connecting street from FM 3412 to FM 544 of 60' right-of way and the ordinance requires a 65' right of-way. The staff recommends this plat with the stipulation that this 60' right of-way be changed to a 65' right-of way. Mr. Kent Flynn, Mr. Billy Thompson, and Mr. Bill Baker were present to represent the development of Westgate. Mr . Flynn gave the presentation which included pictures of the types of 2F homes and single family homes that would be built. This development is proposing 370 units in multi Family and this is considerably less than the density in the zoning ordinance. Chairman Kent Crane said the problem he had with this plat was the curve in the connecting street and having parked cars on it. With this curve in the street, you would need the extra five (5) feet of right-of way. If two cars on _ parked on this road, one on each side of road, it would only leave TO feet on the curve for traffic . Mr . Baker said the reason for a 36' instead of 37' street and 60' instead of 65' right-of-way was to discourage thru traffic . Kent Crane said it would be good if you could discourage traffic but the truth is it will collect a lot of thru traffic. City Manager Gus Pappas said we had lost track of what we are dealing with. First, Planning and Zoning put the road in the middle of this plat and not city staff . Staff has asked for 65' right-of-way and have not asked for this to be paved. The City has only asked for the developer to pave a 37` street. Motion was made by Bill Chapman to recommend approval to Council of the preliminary plat for Westgate Addition with a 65` right-of way and with 37` paved street. Seconded by Don Montgomery This motion carried with all in favor . Chairman Kent Crane called for a motion to adjourn since - there were no other questions or items of business.
