12-27-1984 (Planning & Zoning) Minutes 1 MINUTES PLANNING & ZONING COMMISSION CITY OF WYLIE, TEXAS THURSDAY, DECEMBER 27, 1984 The Planning & Zoning Commission for the city of Wylie , Texas met in regular session on Thursday , December 27 , 1984 in the council chambers at city hall . A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. The meeting was called to order at 7 :05 P .M. by Chairman, Randy Gaston. ''embers present were Bryant Barry , Harold Spence , Kent Crane , Ken Hauk and Nancy Conkle . Absent was Sarah Connelly . Present from the city staff were Gus Pappas , City 1.4anager , Roy Faires , C.E.U. and Barbara LeCocq , secretary . Also present were Barron Cook , Paul Phy , attorney for Mr . Cook , Roland Foerster , Jim McKnight , Danny Holley and Nr . Holley ' s engineer . ITEM NO. 1 - APPROVAL OF MINUTES - Chairman Gaston asked if there were any additions or corrections to the minutes . There being none , Harold Spence made a motion , seconded by Ken Mauk to approve the minutes as submitted . Notion carried 5-0 . ITEM NO. 2 - CONSIDER APPROVAL OF FINAL PLAT FOR MURRY- WILLIAMS SD IN STEEL INDUSTRIAL PARK - Gus Pappas reported that this plat conforms to the subdivision regulations and that the developer has agreed to participate in bringing Steel Road up to city standards . Staff recommended approval . Randy Gaston asked Kent Crane for a report from the Plat Review Committee . Mr . Crane reported that the plat review committee had reviewed this plat and found it to be in conformance and therefore recommends approval . With no further discussion , Chairman Gaston asked for a motion . Kent Crane made a motion , seconded by Harold Spence to recommend to the city council approval of the final plat for hurry-Williams subdivision in Steel Industrial Park. All in favor . 5-0 . ITEM NO. 3 - CONSIDER APPROVAL OF PRELIMINARY PLAT FOR REGENCY BUSINESS PARK IN STEEL INDUSTRIAL PARK - CM`i Pappas reported that this is an approximately 10 acre tract in Steel Industrial Park . He also called attention to the fact that Regency Drive had been platted to end with a temporary barrier at the end of the street . This street will , in the future , extend down through the entire subdivision . `he developer has agreed to participate in bringing Steel Road up to city standards . Mr . Pappas reported that the appropriate staff members had reviewed the plat and found it in conformance with city subdivision regulations and thus recommends approval . Chairman Gaston asked Kent Crane for a 2 report from the Plat Review Committee . Mr . Crane reported that the Plat Review Committee had reviewed the plat and recommends approval . With no further discussion , a motion was made by Kent Crane to recommend to the city council approval of the preliminary plat for Regency Business Park. Motion seconded by Harold Spence . Motion carried 6-0 . ITEM NO. 4 - CONSIDER APPROVAL OF PLAT FOR CANTERBURY HILL (ETJ APPROVAL) - Chairman Gaston recognized Mr . Barron Cook , developer , who requested that this item be discussed later in the meeting when his attorney would be present . The request was granted . ITEM NO. 5 - CONSIDER APPROVAL OF PRELIMINARY PLAT FOR WYLIE PLAZA - Gus Pappas showed on the map the location of this tract . He explained that it is actually two lots combined into one for platting purposes . Staff recommends approval . Kent Crane reported that the Mat review committee recommends approval . With no further discussion , Bryant Barry made a motion to recommend to the city council approval of the preliminary plat for Wylie Plaza . Motion seconded by Nancy Conkle. Motion carried 6-0. ITEM NO. 6 - CONSIDER APPROVAL OF REPLAT OF KINSINGTON MANOR Gus Pappas explained at the time of the original platting of Kinsington Manor , this piece was not included in the platting . In order for anything to be done with this piece of property it must be platted . It has been designated Lot 1 , Block I) of Kinsington Manor . It is 45 feet wide and 1057 ft . long . After a brief discussion concerning zoning on this property , a motion was made by Kent Crane to recommend to the city council approval of the replat of Kinsington Manor . Motion seconded by Bryant Barry . Motion carried 6-0. ITEM NO. 7 - CONSIDER APPROVAL OF FINAL PLAT FOR POINTE NORTH ADDITION - Gus Pappas reported that this plat had been reviewed by the appropriate staff members and is recommended for approval . he also stated that arrangements between the state and NIMWI) are being made for tie-ins and easements . Kent Crane reported that the Plat Review Committee recommends approval . lith no further discussion , a motion was made by Bryant Barry to recommend to the city council approval of the final plat for Pointe North Addition . Harold Spence seconded the motion . Motion carried 6-0 . ITEM NO. 8 - CONSIDER RESUBMITTAL OF ZONING PETITION FOR EAST RIDGE ADDITION - Gus Pappas stated that the original petition for zoning was approved by the P Z and subsequently denied by the city council and thus , the developer was resubmitting a request for zoning to be compatible with the desires of the city council . His request was for retail at the front of the tract , along Old State Hwy 78 , duplex behind that and SF-1 in the area most nearly touching Rush Creel: and Quail Hollow additions . 3 After brief discussion , a motion was made by Ken Mauk to recommend to the city council approval of the zoning petition for East Ridge Addition. Motion seconded by Bryant Barry . Motion carried 6-0 . ITEM NO. 4 - CONSIDER APPROVAL OF PLAT FOR CANTERBURY HILL (ETJ APPROVAL) - Gus Pappas reported that this subdivision is located on Beaver Creek Road and is in Wylie ' s ETJ . Approval of a subdivision is required, by the county from the city :in whose ETJ the subdivision is located or the city nearest to the subdivision . Br . Pappas reported that this plat does not conform to the city ' s subdivision regulations and for this reason was rejected by the staff reviewers and the Plat Review Committee . He also explained that the developer chose to come before the P Z and the city council to state his case . _Ir . Pappas also stated that Beaver Creek Road is on the city ' s thoroughfare plan and would thus be required to meet those specifications . Chairman Gaston asked rr . Barron Cook , the developers to state his case before the commission . Mr . Cook stated that this subdivision is actually an extension of his previous subdivision of Beaver Creek Estates and he felt would be consistent with that SD . Me is asking that he be allowed to waive the requirement for alleys since these are one acre lots and have no need for an alley . lie also is asking for a septic system for sewage . He feels that he should not be required to install a concrete street to meet thoroughfare standards since the road on both sides is of two-shot penetration asphalt . IIe reasons that it is financially prohibitive for him to develop these 14 lots if he is required to meet the concrete street requirement . r . Paul Phy , attorney for Cook , stated that in most cities , provision is made in the subdivision regulations for ranchettes and that standard subdivision regulations Co not apply . Mr . Cook and Mr . Phy contend that the fact of Beaver Creek Road becoming a thoroughfare is minimal and in the far future and this subdivision should not be required to comply . Mr . Pappas stated that an alternative to the septic tank system had been suggested to the developer which would include a sewer system for the homes in the area to be fed into a holding tank that would be pumped out by the city and dumped into the city ' s waste treatment plant . After lengthy discussion , the members of the commission , although sympathetic to the developer ' s problems , considered their only option was to uphold the subdivision regulations of the city . A motion was made by Bryant Barry to recommend to the city council rejection of the plat for Canterbury Hill Addition , with the recommendation that the council take into consideration ( 1 ) the proper handling; of a sewage collection tank in order to comply with the best interests of the city , ( 2) we would be open to consideration of a 22 4 ft . concrete street which would comply with construction standards . (3) that we recognize that the 6" water line is acceptable and that alleys are not a consideration in this development and that they ( the developers) have complied with the 65 ' right-of-way as requested ; and that ROW be granted to the city to provide ingress and egress for the sewage holding tank. :iotion seconded by Kent Crane . Motion carried 4-0-2 . Nancy Con .le and Randy Caston abstaining . ITEM NO. 9 - DISCUSSION OF MUDDY CREEK RESERVOIR - Gus Pappas made a presentation aprising the commission members of a problem that has come to the attention of the city concerning proposed mobile home parks . ir . Pappas explained that two developers have come to the city with proposed mobile home parks . One developer , Mr . Holigan , has a development near Muddy Creek and has petitioned the state for a private sewage treatment plant . After speaking with Kr . Pappas , he is willing to annex into the city , run water and sewer lines and be served by the city of Wylie . The other developer , Mr . Roberts , has a proposed development on our southeastern border . T. r . Pappas explained that our existing mobile home park ordinance is legally undefendable and asked for the commission to read the ordinance and make any suggestion for revision that would put the city in a better position for defense . Mr . Pappas explained that a city ' s strongest protection is zoning and that pert-taps we might want to make provision for mobile home parks by zoning . Annexing the parks also puts the city in a position for control . There being no further discussion , a motion was made by Bryant Barry and seconded by Kent Crane for adjournment . Notion carried .
