04-28-1983 (Planning & Zoning) Minutes PLANNING & ZONING COMMISSION REGULAR MEETING APRIL 28, 1983 7:00 P.M. The Wylie Planning & Zoning Commission met in regualr session at 7:00 p.m. on April 28, 1983 in Council Chambers at City Hall . A quorum was present and notice of the meeting had been posted for the time and in the manner required by state law. Those in attendance were Chairman Joe Fulgham, John Seeley, Bryant Barry, Ab Harrison, Mike McAnally, Judy Brewster, Ken Mauk, City Manager Lee Vickers, City Secretary Sarah Connelly, Don Kreymer, Mayor Robert Squires, Randy Gaston, Melvin St. John, Sam Self, I .W. Santry. Chairman Fulgham called meeting to order. There were corrections to be made to previous minutes. March 24, 1983 minutes were amended as follows: Item #3- McAnally made motion seconded by Bryant Barry, all in favor. Also that future agenda items include "permanent" zoning for recently annexed Birmingham Trust Land, two-hundred-foot strip of land not to be included as a part of Glen Knoll Mobile Home Park, and any other land that might be in same catagory. Also that correct procedures be done to get this done correctly. Item #5- That City Administration pass rules of procedure on to City Council for approval . April 19, 1983 minutes amended as follows: Record to show that Bryant Barry was absent. Item #6- Vote to be corrected to five in favor, one against, Mike McAnally. John Seeley made motion to accept minutes as amended, Mike McAnally seconded, all in favor. Consider rezoning of Tracts #1 & 2, S. B. Shelby Survey, Abst. 820- Wylie Independent School District- Corner of Birmingham & Highway 78. Mr. Don Whitt requested that this property be rezoned from Public to R-Retail . These two tracts contain 2.5177 acres of land and developer plans to construct office buildings. Mike McAnally made motion to rezone tracts #1 &2, Abst. 820, S.B. Shelby Survey, which contains 2.5177 acres from public to R-Retail , this is also known as Birmingham & 78 (from Sonic to Birmingham) Ken Mauk seconded, Five in favor, two abstaining, Judy Brewster and Bryant Barry. Review Final Plat for Don Kreymer-on west side of South Second at Park Developer Don Kreymer requested that this item be removed from agenda at approximately 10:00 a.m. on April 28, 1983. CONSIDER APPROVAL OF HOME CONSTRUCTION IN WESTWIND MEADOWS II PRIOR TO COMPLETION OF STREETS AND ALLEYS. Melvin St. John and Sam Self would like to start construction before completion of streets and alleys. All utilities are in except storm sewers. Traffic during construction will be channeled down alleys. Developer is asking for construction apporval of approximately 8 to 10 houses. John Seeley asked what kind of hardship would be encountered if unapproved. St. John stated it would be about 6 to 8 weeks delay due to completion of streets. P & Z MINUTES 4-28-83 Pg. 2 Bryant Barry asked City Manager in view of facts since ordinances were worked out, what is his recommendation on this. City Manager stated ordinance calls for completion block by block and take out building permits without asking for a variance on ordinance, and Council could accept and approve a section of sub-division at a time. Mike McAnally stated he felt sub-division should be complete before building permits be issued. Streets need to set for 28 days before traffic is on them. Fire protection could be a problem if Planning and Zoning approve this request. St. John stated that no certificate of occupancy would be issued until completion. Bryant Barry was concerned about fire and also curing of concrete for 28 days. I .W. Santry stated higher strength cement would be up to standards and this could speed up construction. Ab Harrison made motion to statr construction prior to completion of streets and storm sewer on Lots 20,21, Blk. 3; Lot 29-30-31-27-28, Blk.1; Lot 10-11, Blk.8; Lot 4, Blk. 5. Judy Brewster seconded. Four in favor one against, Mike McAnally, one abstaining, Bryant Barry, who stated his reasons as (1) precedent set with Kinsington Manor which was done in Barry' s absence, (2) because we are not enforcing the ordinances. Barry would like to ask City Council to take into consideration when considering this ordinance, this particular ordinance, fire code problem and curing of concrete. Mayor addressed the Commission on range of responsibility of Board of Adjustment and Planning and Zoning. Mayor has retained service of J. T. Dunkin to answer these questions brought up by Planning & Zoning. Mr. Dunkin can meet with the boards on May 26, 1983. Mayor stressed to Planning & Zoning that City Council looks to their recommendations very seriously. Mike McAnally aware that these items were not on the agenda, asked Mr. St. John about strip of property that he was going to deed to City as a park. St. John stated he had deeded this strip to City, it is approximately 50 x 1300 feet, donated 20 feet alley between Valentine and Willow Way. McAnally also asked about 6-plex apartment building. Mr. St. John stated he had had problems with this unit, and hoped to have it completed soon. Ken Mauk made motion to adjourn, Bryant Barry seconded, all in favor. J Fulgham, Ch r an
