A quorum was present and a notice was posted in the time and manner required by law. Members Present: Staff Present: Steve Ahrens, Chairman Tobin E. Approval of September 7, 1999, Regular Business Meeting Minutes. • Corrections : Page 1,Citizen Participation,Catherine Butschek, add"Lot Size within Development" Page 3, Discussion, 4th item, add"provided by City not Developer" Motion: A motion was made by Cecilia Wood, Seconded by Sharon Dowdy to approve the Consent Agenda with noted corrections to the minutes. Minutes-Planning and Zoning Commission September 21, 1999,Regular Business Meeting Page 1 ACTION ITEMS 1.Recommendation to the City council regarding a preliminary plat for the Summit Private School Addition, Jonvitch,Inc.,for the property generally located at the southwest corner of Brown Street and Rustic Trail and being all of a 4.039 acre tract out of the Samuel B. Shelby Survey, Abstract No. 820, city of Wylie, Collin County, Texas. Tobin Maples Update: Preliminary Plat under consideration is for the Summit Private School Addition. The applicant is platting 4.039 acres of land in order to develop the property with a private school(day care facility). Currently the property is vacant and zoned for R(Retail)uses. Staff has reviewed the proposed plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City o Wylie except to the rear yard building line. Applicant is aware and the surveyor will correct. Staff is recommending approval. Discussion: — The City Fire Chief will determine if an alleyway is required. Screening will be required per City Ordinances. -- Residents behind this property will be access by Rustic Circle or Rustic Trail. — Brown is a proposed Four (4) Lane Undivided Thoroughfare. Right of Ways are existing. Motion: A motion was made by Sharon Dowdy, Seconded by Julie Schmader to recommend approval to the City Council. Motion Carried- all in favor (6-0). 2. Recommendation to the City Council regarding a final plat for the Provident Bank Addition, proposed by Provident Bank for the property generally located along the north side of SH 78 ad the railroad tracks between Birmingham Avenue and Jackson Street and being all of a .9863 acre tract out of the Samuel B. Shelby Survey, Abstract No. 820, City of Wylie, Collin county, Texas. Tobin Maples Update: The final plat under consideration is for the Provident Bank Addition. The applicant is platting .9863 acres in order to develop with business uses (new bank). Currently the property is vacant and zoned for I (Industrial) uses. Staff has reviewed the proposed plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie. Staff is recommending approval. Applicant: Bart Carroll — Provident Bank does not wish to acquire the Right of Way from the RR at this time. - The sewer lines run parallel with RR down Jackson Street. Motion: A motion was made by Julie Schmader, Seconded by Cecilia Wood to recommend approval to the City Council. Motion Carried- all in favor(6-0). STAFF REPORT APA Conference will be October 6th through October 9t. Council Actions: ZC 99-02 was approved Brookshires rezoning case was tabled and will return to P &Z It is requested by the Commission to move items that must be approved by State Law to the Consent Agenda. Steve Ahrens, Chairman Carrie Smith, Secretary Minutes-Planning and Zoning Commission September 21, 1999,Regular Business Meeting Page 3 • City of Wylie Action Item No. 1 Creekside Estates Preliminary Plat/Development Plan Planning and Zoning Commission Meeting: October 5, 1999 Owner/Applicant: Campbell/Wylie Partners Location: Generally located at the northeast corner of McCreary Road and McMillen Road Existing Zoning: A (Agricultural) with an approved Conceptual Plan for a PD (Planned Development) for Single Family, Multifamily, Business, and open space uses Summary: The preliminary plat/development plan under consideration is for Creekside Estates. The applicant is preliminary platting 296.441 acres in order to develop the property with a master planned single family residential community. Specifically, the applicant is proposing a master planned community encompassing single family and open space uses. The development plan aspect of this case is the final step associated with establishing the PD (Planned Development) zoning requested. In order to establish a PD (Planned Development), the developer must follow a two-step process which includes submitting for approval a Conceptual Plan and a Development Plan. The developer must first submit for approval a Conceptual Plan. The Conceptual Plan must show the applicant's intent for the use of the land within the proposed development in a graphic manner as required by Staff, and be supported by written documentation of proposals and standards for development. The Conceptual Plan must also show thoroughfares, preliminary lotting arrangements and other pertinent development data deemed necessary. Department of Planning, 09/30/99 Once Staff has determined that the applicant has provided sufficient information, a Public Hearing must be held at which the Conceptual Plan will be submitted to the Planning and Zoning Commission to consider recommending approval or denial of the Conceptual Plan to the City Council. Once the Planning and Zoning Commission has taken action, the City Council will call a Public Hearing at which the Conceptual Plan will be submitted for approval. The Second phase of establishing a PD District is submitting for approval a Development Plan. The Development Plan shall set forth the final plans for the PD District and shall conform to the data presented and approved on the Conceptual Plan. The Development Plan is a complete site inventory analysis of what is to be developed. The ordinance establishing the PD District will not be approved until a Development Plan has been approved. Issues: • Staff has reviewed the proposed preliminary plat/development plan for Creekside Estates and found it to be in compliance with the concept plan approved by the Commission and Council. This preliminary plat/development plan also complies with the Subdivision regulations and other pertinent ordinances of the City of Wylie except for street names, building line labels, and cul-de-sac labels. Specifically, the applicant needs to change the name of Kristen Drive , Kyle Court, and Kyle Drive as these street names already exist. Also, the applicant needs to incorporate radii labels for all cul-de-sac's and add a 20' side yard building line to Lot 11, Block O. • The City's traffic consultant (Stanton Foerster) has reviewed the proposed development plan and is recommending approval. Please note the applicant is aware that their participation in the signalization of the FM 544/McCreary Road and McMillen/McCreary road intersections will be required at the time final plats are submitted. • It should be noted that all issues associated with above ground storm water retention should be addressed at the time final plats are submitted for consideration and that it is the applicant's responsibility to provide detailed engineering studies verifying the integrity of the proposed system(The applicant has submitted a detailed Floodplain Hydrology& Hydraulics study). The City Engineer will be present to answer any questions the Commission may have regarding the applicant's preliminary drainage and retention plans. • The applicant is aware that a final plat must be approved prior to the issuance of any building permits. Financial Considerations: Application fee in the amount of$1,633.00 - Paid Department of Planning, 09/30/99 Staff Recommendation: Approval, subject to the following stipulations being verified at the time of final platting. 1. Final approval of all applicable engineering plans by the City's Consulting Engineer. 2. Street name, building line and cul-de-sac label revisions as previously detailed. The Departments of Public Works, fire, and Community Development concur with this recommendation.
