No. 99-07: Public Hearing and recommendation to the City Council regarding a request from Brookshires Grocery Co.,for approval of a zone change from R(Retail)to B-1 (Business) for the property generally located along the east side of SH 78 in front of the Brookshire Grocery Store and being a .9028 acre (39,325 square feet) strip of land situated in the E.C. Davidson Survey, Abstract no. 267, City of Wylie, Collin County, Texas. Tobin Maples Update: The applicant wishes to develop the front portion of the property with a gas station. The property to the north is vacant and zone for I(Industrial) uses. The properties to the northeast are zoned B-2 (Business) and developed accordingly with business uses (Exxon gas station and Eckerd drug Store). The property to the south is zoned R (Retail) and developed with professional office and hospital uses. No Public Comment Forms have been returned. One letter of opposition was received from Kwik Chek. Public Hearing... No Comments Discussion among the Commission: Concerns due to the number of entrances existing from Kirby to the Hospital. The}� elQpmen ----�- - --- _-- __ applicant is requesting rezoning and preliminary platting on 136 339 acres in order to develop the i‘jR property with a master planned single family residential community. The properties to the north and south are vacant and zoned for A (Agricultural) uses. The property to the west is vacant and zoned A (Agricultural) with an approved PD (Planned Development) conceptual plan for single fanuTy residential uses. The property to the east (Newport Harbor) is zoned SF-3 (Single Family Residential) and developed accordingly with single family homes. The property to the northeast is vacant and zoned for MF (Multi-Family) and B-1 (Business) uses. Public Comment Forms were mailed to twenty-six (26) property owners within 200 feet of this request. Two (2) Public Comment Forms in support of the request have been returned. Department of Planning, 09/02/99 99-02 Issues: • The Comprehensive Plan recommends Single Family Residential(Country Residential) uses 'for the property. The proposed zoning and land use are consistent with the Comprehensive Plan and compatible with the surrounding residential to the east. Specifically, the applicant is dedicating approximately 23.514 acres of open space_which establishes an average density of 2.13 dw egg mots per acre. Staff is of the opinion that the proposal complies with the overallintent offhe Comprehensive • Staff has reviewed thezeliminary plat element of this case and found it to be in compliance with the proposed zonin (development plan), This preliminary plat also complies with the Subdivision regulations and other pertinent ordinances of the City of Wylie. Said private streets will be built according to City specifications and comply with all applicable access codes recommended by the public safety departments (emergency access easement). • The applicant is aware that a final plat must be approved prior to the issuance of building permits. • Staff will provide a Parks Board update at the meeting.
