Approval of August 3, 1998, Regular Business Meeting Minutes. • Corrections Page 5 - last bullet item change "by Commission"to "from Commission". Page 7 - add Murphy to survey. Motion: A motion was made by Eric Hogue, Seconded by Mark Clark to approve the August 3, 1998, Regular Business Meeting Minutes with noted corrections. Motion Carried - all in favor ( 7 ). ACTION ITEMS 1. Recommendation to the City Council regarding a Final Plat for the Heatherwood Estates Addition, proposed by Charles and Tracy Lester, generally located at the northwest corner of Heatherwood Drive and Lanwood Drive, and being all a certain 7.345 acre tract out of the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas. Minutes-Planning and Zoning Commission August 17, 1998,Regular Business Meeting Page 1 • Tobin Maples Update: The final plat under consideration is for the Heatherwood Estates Addition. The applicant is platting approximately 7.3 acres to develop the property with 17 single family homes. The property is currently zoned SF-2 (Single Family Residential) and it is undeveloped. Staff has reviewed and it does conform with Subdivision Regulations and other pertinent ordinances of the City of Wylie, except for a few minor items: - Typical street paving section requested by Staff. - The applicant has shown all building lines for every lot. The only building lines required are front and exterior side yard (corner lots). Staff is recommending approval subject to the above corrections. • Discussion: The Ensearch Corporation easement on Lot 10 is going to have to be researched by Tobin Maples. This development will not be done in phases. Motion: A motion was made by Sharon Dowdy, Seconded by Mark Clark to recommend approval to the City Council with noted corrections. Motion Carried - all in favor (7). 2. Recommendation to the City Council regarding a Final Plat for the Highway 78 Business Park Addition, proposed by Jackson and Associates Land Surveyors, Inc. for Mortgage Recovery Fund-Land Fund Dallas, L.P., generally located at the southeast corner of SH 78 and Century Way, and being part of Lot 1, Block A Century Business Park, City of Wylie, Collin County, Texas. • Tobin Maples Update: The applicant is replatting approximately 12.3 acres into seven (7) lots in order to develop the property with I (Industrial) uses. Staff has reviewed and it does comply with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for original notarized signatures. The applicant is aware and will submit a revised plat prior to going to City Council. One other variance is Lot 4. The lot width is 170.96 feet and the minimum width allowed is 175 feet. The property to the south, Lot 1, did not want to be part of this plat. On Lot 3, 4, and 1, 2 common accent easements are being proposed but this is not a variance. The applicant has submitted a revision,being one common accent on Lots 2 and 3. Lot 1 and Lot 4 will eventually have there own driveways. This does meet minimum driveway separation of 200 feet. The elevation of the flood plain could be raised, but no engineering plans have been submitted to the Planning Department The City will maintain the drainage easement which will be an underground storm drain. There is not an alleyway. Don Jackson,2600 W. FM 544,noted Lot 4 is 170.96 + 15.57= 186.52 frontage and would not require a variance. Motion: A motion was made by Cecilia Wood, Seconded by Julie Schmader to recommend approval to the City Council with noted corrections and changes. Motion Carried - all in favor (7). 3. Recommendation to the City Council regarding a Final Plat for the Park Road Elementary School Addition, proposed by Glenn Engineering Corporation for Wylie Independent School District, generally located at the northeast corner of FM 1378 and McMillen Road and being all of a certain 10.799 acre tract and all of a certain .574 acre tract out of the Charles Atterbury Survey, Abstract No. 22, City of Wylie, Collin County, Texas. • Tobin Maples Update: Staff has reviewed the plat and found it to comply with the Subdivision Regulations and other pertinent ordinance of the City of Wylie except for the zoning district labels and proposed street names. The subject property and the property to the west and north need zoning district labels added. The applicant has proposed McClain Road as the new road on the east side of the property,but due to a conflict of interest we recommend the name is changed. These corrections and changes will be routed to City Council. Staff is recommending approval. • Discussion: McClain Road will eventually go to the north and tie in to 1378. The school is proposed to open for 1999 school year. There will only be one street in and out of the school in the beginning. The school will have two circular drives, one for student drop off and one for bus loading. Recommendation to the City Council regarding a Final Plat for Phase V of the Newport Harbor Addition, proposed by Carter & Burgess, Inc. for Centex Homes, generally located along the east side of FM 1378 just south of Anchor Drive and being all of a certain 26.753 acre tract out of the James McUlmurry Survey, Abstract No. 629, City of Wylie, Collin County, Texas. • Tobin Maples Update: The final plat under consideration is Phase V of the Newport Harbor Addition. The applicant is platting approximately 26.7 acres to develop the property with 110 single family lots. The property is currently zoned for SF-3 (Single Family Residential). The staff has reviewed and found it to comply with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for notarized signatures and block length. Specifically the original notarized signatures for Centex Homes, and Section 5.02 D (2) of the Subdivision Regulations states that the block length in residential areas shall not exceed 1,200 feet and the block length being prosed for Block 3 is 1,500 feet. This variance was approved in the preliminary plat and staff just wanted to call it out again here at the final plat. Staff is recommending approval. • Discussion: Galley Way is an extension of Schooner Bay. This is the last Phase that has been preliminary platted. The water is supplied by Wylie. Water pressure is being addressed by the City. The sewer is taken care of. An above storage tank will be located near Anchor Drive in the future. Motion: A motion was made by Sharon Dowdy, Seconded by Eric Hogue to recommend approval to City Council with noted changes and corrections. Motion Carried - all in favor (7). PUBLIC HEARINGS 1. ZC. This was a public hearing item on August 3, 1998 and was tabled to this meeting. The Staff did not receive the revisions prior to the packets going out to the Commission. Staff is recommending to table to the September 8, 1998 meeting. • Discussion: In favor of Pat Atkins, 2660 Beltline, Garland - We are requesting a straight SF-3 with the only variance being with increased house size to 1,600 square feet. Commission Questions Chairman Ahrens told Mr Atkins this plat would need to be reviewed by Staff prior to any decision. We will need to review this concept development. Citizen Participation Billie Jo Swaner, 210 Tanglewood Circle. Motion: A motion was made by Julie Schmader, Seconded by Cecilia Wood to table ZC. No. 98-07 to the September 8, 1998 P &Z Meeting along with the Developmental Plan. Motion Carried - all in favor(7). DISCUSSION 1. New Single Family Residential Development Standards. • Tobin Maples Update: The Residential Development Standards Survey is not complete, the City is waiting to hear from a few other cities. • James Brown with the Wylie Fire Department - Discussed problems with smaller lot sizes. If the side lot lines had been 15 feet larger between the houses that burned on Piccadilly Circle it could have prevented or could have been contained the second house fire. Problems with small front yards is heat damaging the trucks, to prevent damage they have to stop short of the fire or pull passed and then drag the hoses farther across yards. Cul-da-sacs cause a problem with parking. The worse kind of cul-da-sac is one with a long street and a cul-da-sac at the end. Rear Minutes-Planning and Zoning Commission August 17, 1998,Regular Business Meeting Page 5 yard setbacks are not a real issue, alleyways are not used by the large fire trucks. Some cities • require residential homes to have sprinkler systems and these are very effective. The fire department is going from a key rate to an ISO rate. This rate affects your home insurance. Mr. Brown will develop some reports to help the P & Z Commission review the current set backs. • Reminder letters regarding the August 31, 1998 workshop will be sent this week. • P &Z will be provided with a list of the Steering Committee. • Mark Clark announced his resignation, effective immediately. •ADJOURNMENT Motion: A motion was made by Eric Hogue, Seconded by Cecilia Wood to adjourn. Spencer Location: Generally located at the northeast corner of Brown Street and FM 1378 Existing Zoning: B-2 (Business) Requested Zoning: Temporary Specific Use Permit (SUP) for a driving range Summary: The applicant is requesting a temporary Specific Use Permit (SUP) on 9 acres in order to develop the property with a golf driving range. Currently the property is zoned B-2 (Business) and partially developed with business uses. The property to the north is zoned B-2 (Business) and developed with business uses. The property to the east is vacant and zoned for B-2 (Business) uses. The property to the south is vacant and zoned for A (Agricultural) uses. The property to the west is zoned A (Agricultural) and partially developed with single family homes and the city's new fire station. Public Comment Forms were mailed to eleven (11) property owners within 200 feet of this request. One (1) Public Comment Form in support of the request has been returned. Department of Planning, 09/16/98 98-11 Issues: • The Comprehensive Plan recommends retail, commercial, and business uses for the property. The proposed land use is consistent with the Comprehensive Plan. • In every zoning district, certain specific uses are allowed when granted in accordance with Section 23 of the Comprehensive Zoning Ordinance No. 85-23A. In this particular case, the applicant must obtain a Specific Use Permit (SUP) do to the fact that a golf driving range is defined as a commercial outdoor amusement (Section 33.22 of the Comprehensive Zoning Ordinance No 85-23A). • In an effort to open the golf driving range as soon as possible, the applicant is seeking a temporary specific use permit in accordance with Section 23.2 (7) of the Comprehensive Zoning Ordinance No 85-23A. Specifically, in some cases, a temporary specific use permit may be issued with the approval of the Planning and Zoning Commission and City Council for a period not to exceed eighteen(18) months. Should the Council approve the request for a temporary specific use permit (SUP), the applicant will be required to seek permanent zoning prior to the expiration of said temporary specific use permit. Also, the applicant is aware that approval of a temporary specific use permit does not establish permanent zoning and that it is his responsibility to request permit zoning within eighteen(18) months. Should permanent zoning not be established prior to the expiration of an approved temporary specific use permit (SUP), all activity associated with the golf driving range temporary use shall be discontinued upon said expiration. • The applicant is aware that a minimum of thirty(30) off-street parking spaces must be provided and that improvements associated with creating said parking must be approved by the Community Development Department. • Specific development standards associated with this request are as follows: 1. The applicant intends to screen the majority of the property with netting. Specifically, the attached site plans indicate 450 feet of fifty(50) foot high netting along Brown Street and approximately 700 feet of forty(40) foot high netting along FM 1378 and the northern property line. All netting will be located on private property, attached to wooden telephone poles, and setback twenty(20) feet from the property line. 2. In order to light the facility the applicant is proposing seven(7) forty-five (45) foot poles. Staff recommends that the applicant verify the illumination area and add a note to the site plan documenting said information. 3. The site plan indicates that a concession stand may be built on the southeast corner of the property. The applicant is aware that the property will have to be platted prior to issuance of permits for any new structural development. Department of Planning, 09/16/98 Financial Considerations: Not applicable Staff Recommendation: Approval, subject to the construction and approval of required off-street parking. The Departments of Public Works, Fire, and Community Development concur with this recommendation. Attn Pat Atkins Location: Generally located along the east side of McCreary Road just south of Southfork Mobile Home Park Existing Zoning: MF(Multifamily), R (Retail), and B-1 (Business) Requested Zoning: PD (Planned Development) for single family residential uses Summary: The applicant is requesting rezoning on 45.3768 acres in order to develop the property with a master planned single family residential community. The property to the north is zoned MH (Mobile Home) and developed with a mobile home park. The property to the south is vacant and zoned A (Agricultural). The property to the east is vacant and zoned PD (Planned Development) for single family residential uses. No Public Comment Forms have been returned. Department of Planning, 09/16/98 98-07 Issues: • The Comprehensive Plan recommends Single Family Residential uses for the property. The proposed zoning and land use are consistent with Comprehensive Plan and compatible with the surrounding residential to the north. • The applicant is filing this PD in order to ensure a quality development and request one (1) variance to the single family residential requirements. Specific reductions to the single family residential area regulations being requested are as follows: Proposed Required for SF-3 Side Yard 10 ft.between structures and 15 ft. Not less than 6 ft. on each side of for side yards adjacent to a side the lot and 20 ft. for side yards street. adjacent to a side street. • Section 5.01 C. (1) (b) of the Subdivision Regulations state that all subdivisions must have two means of access or approach. Where development phasing or constraints of the land prevent the provision of a second, separate means of access, the city may accept a median divided street or divided entry to satisfy this requirement. Riverway Lane was preliminary platted as the one point of divided approach for Phase II of Sage Creek (the 62 acre tract to the east). The applicant is proposing to utilize Riverway Lane as the one point of divided approach for both Phase II and Phase III. As a result and consistent with the City's traffic consultant (Transportation Strategies, Incorporated), staff recommends that no more than 20% of the lots (26) in this phase should be permitted prior to secondary access being provided. • Park Plans for the City recommend that an additional five (5) acres be dedicated and provided adjacent to a school site playground proposed as a joint use concept or neighborhood park. The Parks Board reviewed this proposal at their July 27, 1998, and voted unanimously to accepted payment in lieu of park land dedication. Per the Park Board recommendation, the applicant has removed the proposed park land dedication. • The applicant has proposed a minimum dwelling size of 1,600 sq. ft. The minimum dwelling size permitted within the SF-3 district is 1,100 sq. ft. • The applicant will be required to plat the property prior to the issuance of any building permits. Department of Planning, 09/16/98 Planning and Zoning Commission Update: At the August 3, 1998, Planning and Zoning Commission meeting, the Commission voted unanimously to table this case to August 17, 1998, as the applicant indicated that the conceptual plan would be revised to minimize the variance request for lot area. At the August 17, 1998, Planning and Zoning Commission meeting, the Commission voted unanimously to table this case to September 8, 1998, in order to give staff an opportunity to review the revised conceptual plan. Specifically, the revised conceptual plan had not been submitted for staff review and, therefore, was not included in the August 17, 1998, Planning and Zoning Commission packet. The Planning and Zoning Commission public hearing concerning this request was scheduled for the September 8, 1998, Commission meeting. However, due to unanticipated circumstances,the September 8, 1998, Commission meeting was canceled. As a result, this case had to be re-advertised for the September 21, 1998,Planning and Zoning Commission meeting. Staff Recommendation: Approval, subject to the following stipulation: 1. Attn Pat Atkins Location: Generally located along the east side of McCreary Road just south of Southfork Mobile Home Park Existing Zoning: MF(Multifamily), R (Retail), and B-1 (Business) Requested Zoning: PD (Planned Development) for single family residential uses Summary: The preliminary plat/development plan under consideration is Phase III of Sage Creek Estates. The applicant is preliminary platting 45.3768 acres in order to develop the property with a master planned single family residential community. The development plan aspect of this case is the final step associated with establishing the PD (Planned Development) zoning requested in ZC. No. 98- 07. In order to establish a PD (Planned Development), the developer must follow a two-step process which includes submitting for approval a Conceptual Plan and a Development Plan. The developer must first submit for approval a Conceptual Plan. The Conceptual Plan must show the applicant's intent for the use of the land within the proposed development in a graphic manner as required by Staff, and be supported by written documentation of proposals and standards for development. The Conceptual Plan must also show thoroughfares, preliminary lotting arrangements and other pertinent development data deemed necessary. Department of Planning, 09/16/98 Once Staff has determined that the applicant has provided sufficient information, a Public Hearing must be held at which the Conceptual Plan will be submitted to the Planning and Zoning Commission to consider recommending approval or denial of the Conceptual Plan to the City Council. Once the Planning and Zoning Commission has taken action, the City Council will call a Public Hearing at which the Conceptual Plan will be submitted for approval. The Second phase of establishing a PD District is submitting for approval a Development Plan. The Development Plan shall set forth the final plans for the PD District and shall conform to the data presented and approved on the Conceptual Plan. The Development Plan is a complete site inventory analysis of what is to be developed. The ordinance establishing the PD District will not be approved until a Development Plan has been approved. Issues: • The Comprehensive Plan recommends Single Family Residential uses for the property. The proposed zoning and land use are consistent with Comprehensive Plan and compatible with the surrounding residential to the north. • Staff has reviewed the proposed preliminary plat/development plan for Phase III of Lakeside Estates and found it to be in compliance with the concept plan proposed in ZC. No. 98-07. This preliminary plat/development plan also complies with the Subdivision regulations and other pertinent ordinances of the City of Wylie except for right-of-way dedication. Section 5.04 C. (1) of the Subdivision Regulations state that the property owner shall provide all right-of-way required for existing or future streets, including perimeter streets, as shown in the Thoroughfare Plan. The preliminary plat/development plan under consideration shows a permanent roadway easement along McCreary Road. Should the Commission recommend approval, said easement needs to be dedicated to the city as right-of way for McCreary Road as shown in the Thoroughfare Plan. • The applicant is filing this PD in order to ensure a quality development and request one (1) variance to the single family residential requirements. Specific reductions to the single family residential area regulations being requested are as follows: Proposed Required for SF-3 Side Yard 10 ft. between structures and 15 ft. Not less than 6 ft. on each side of for side yards adjacent to a side the lot and 20 ft. for side yards street. adjacent to a side street. • Section 5.01 C. (1) (b) of the Subdivision Regulations state that all subdivisions must have two means of access or approach. Where development phasing or constraints of the land prevent the provision of a second, separate means of access, the city may accept a median divided street or divided entry to satisfy this requirement. Riverway Lane was preliminary platted as the one point of divided approach for Phase II of Sage Creek (the 62 acre tract to the east). The applicant is proposing to utilize Riverway Lane as the one point of divided approach for both Phase II and Phase III. As a result and consistent with the City's traffic Department of Planning, 09/16/98 consultant (Transportation Strategies, Incorporated), staff recommends that no more than 20% of the lots (26) in this phase should be permitted prior to secondary access being provided. • Park Plans for the City recommend that an additional five (5) acres be dedicated and provided adjacent to a school site playground proposed as a joint use concept or neighborhood park. The Parks Board reviewed this proposal at their July 27, 1998, and voted unanimously to accepted payment in lieu of park land dedication. Per the Park Board recommendation, the applicant has removed the proposed park land dedication. • The applicant has proposed a minimum dwelling size of 1,600 sq. ft. The minimum dwelling size permitted within the SF-3 district is 1,100 sq. ft. • The applicant will be required to plat the property prior to the issuance of any building permits. Staff Recommendation: Approval, subject to the following stipulations: 1. The preliminary plat/development plan be corrected by dedicating the necessary right-of-way as detailed above. 2. The following notes being added to the preliminary plat/development plan: Note 1: A. Proposed screening wall shall be located on private property and maintained by the Homeowners Association. Note 2: A. Per Section 5.01 C. (1) (b) of Ordinance 93-33, Subdivision Regulations, secondary access shall be required for Development Plan of Sage Creek Phase III at the time one (1) of the following two (2) events occur: 1. The community park incorporates a cabana, swimming pool, and off-street parking to be utilized and maintained by the Home Owner's Association (HOA). The property is currently vacant, unplatted, and zoned PD (Planned Development) for single family uses. Issues: • Staff has reviewed the proposed final plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for off-site easements. Issues: • Staff has reviewed the proposed final plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for thoroughfare screening and block length. Specifically, Section 5.03 of the Subdivision Regulations states that where subdivisions are platted so that the rear yards of residential lots are adjacent to a dedicated roadway, the owner shall provide screening at his/her sole expense. The plat under consideration incorporates a ten foot (10') wall maintenance easement along the rear property line for Lots 1-10, Block J, and Lots 8 and 9, Block F. Staff recommends that the applicant extend said easement across the back of Lot 11, Block F, and clarify the type, size, location, and maintenance responsibility for all required screening. Said clarification should be provided by adding a note to the plat accordingly.
