None • Discussion... - The difference between I (Industrial) and B-2 (Business). - Concerns about chemical use, traffic, and location to High School. - Richard Parker decided to withdraw his zone change request for I (Industrial) tonight and resubmit another zone change request for B-2 (Business). - Tobin Maples told Richard Parker if he withdraws his case the Staff would not require another application fee, but it will have to be readvertised. It will delay his public hearing date and he will have to return to the Planning and Zoning Commission. It will take approximately thirty(30) days. Minutes-Planning and Zoning Commission June 15, 1998,Regular Business Meeting Page 3 • Discussion: * Times for sign placement: put out Friday, 12:00 Noon to 9:00 PM and pickup Sunday by 9:00 PM. * Enforcement - left to police department. * On vacant lots only. * A$25.00 fine for any sign not picked up by 9:00 PM on Sunday evening. * Letter will be sent to all companies that put signs in our community and will be put into effect in January 1999. Signs will be renewed January 1, of each year. * No sticker will be put on each sign. * Use City of Mansfields violations and verbiage. • Public Hearing No one attended • Recommend changes by the Commission: • Signs to be picked up by 9:00 pm on Sunday. • Signs to be placed out by no later than 9:00 pm on Friday. • Use the violation verbage from Mansfield. • $25.00 fine for each sign left up passed deadline. Motion: A motion was made by Steve Ahrens, Seconded by Eric Hogue, to recommend approval with noted changes to the City Council. Motion Carried- all in favor (7). DISCUSSION 1. Planning and Zoning Commission Rules of Procedure. • Tobin Maples Update: We took the Commission's comments from the June 1, 1998 meeting and incorporated the changes into a new Rules of Procedure. 8.1 - Corrected to read: Director of Planning or designee for each meeting Commission directed Tobin Maples to forward these Rules and Procedures to City Council for adoption. They will bring in additional property. Richard Eckman announced his resignation. He would not be seeking re-application. Sam Satterwhite with Economic Development Department asked about the final vote on the Dollar General at the June 1 meeting. The final vote was approved 4 to 2. Richard Parker Surveyor/Engineer: Jackson& Associates Land Surveyors Location: Generally located at the southeast corner of SH 78 and Marble Street Existing Zoning: R(Retail) Summary: The final plat under consideration is for the Dollar General Addition. The applicant is replatting eight (8) lots into two (2) in order to develop the eastern portion of the property with a dollar general retail store. The property is currently vacant, zoned R (Retail), and platted as Lots 1 through 8, Block 15, of the Railroad Addition(1.628 acres). Issues: • At the June 1, 1998, Planning and Zoning Commission meeting, the Commission voted by 4-2 to favorably recommend this case. However, prior to this case being heard by the City Council, the applicant indicated that it was their intent to construct an access driveway facility to SH 78. At that point, staff informed the applicant that the regulations governing the driveway separation distance between adjacent intersections (4th and 3rd Streets) prohibited this property from having access to SH 78. As a result, the applicant withdrew the original case so that they could reexamine the development and determine the most desirable method of providing access. Department of Planning, 07/01/98 • The new plat under consideration is a direct result of the applicant's reexamination. Staff has reviewed the new proposal for the Dollar General Addition and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for the proposed SH 78 ingress/egress approach. Specifically, the plat under consideration incorporates a request for a variance to Section 2.4 (Driveway Access Location) of the Paving Standards (see attached letter from the property owner). Stated more simply, there is a minimum distance upstream and downstream from adjacent intersections within which driveways should not be located. This separation distance varies with the classification of street and is shown in figure 2.3 (see attachment). The minimum driveway separation dimensions applicable to this property have been marked for your convenience. • In order for this property to be in compliance and have access to SH 78, all points of approach would need to be at least 150' to the east of the northwest corner of Lot 2, and at least 200' to the west of the northeast corner of Lot 1. Due to the fact that this property only has a total of 297.85' of frontage between 3rd and 4th streets, it is not possible for this development to be in compliance and have access to SH 78. In an effort to eliminate the need for a driveway and variance request on each lot being platted, the applicant is requesting a variance for one (1) common driveway to be shared between the Dollar General development on Lot 1 and any future development which may occur on Lot 2 (see attached site plat). Staff does support this variance request and recommends that it be approved. • The applicant is aware that a fire hydrant will have to be installed per the fire departments request prior to the issuance of a C.O. (Certificate of Occupancy). Financial Considerations: The applicant is aware that the impact fees for Lot 2, Block A, must be paid prior to the issuance of building permits for future development. The impact fees for Lot 2, Block A, amount to $1,921.09. All applicable impact fees for Lot 1, Block A, have been paid ($2483.89). Richard Parker Location: Generally located across the street from the high school along the north side of FM 544 between FM 1378 and Sanden Blvd. Existing Zoning: A (Agricultural) Requested Zoning: B-2 (Business) Summary: The applicant is requesting rezoning on 6.134 acres in order to develop the property with business uses. Specifically, the applicant has stated that he intends to sell or lease the property to a small electronics firm in the future. The properties to the north, northwest and northeast are vacant and zoned A (Agricultural). The property to the east is zoned B-2 (Business) and developed with a legal non-conforming use (storage for landscape contractor with minor accessory office use). The property to the south is'zoned A (Agricultural) and developed with a high school and related accessory uses. Public Comment Forms were mailed to nine (9) property owners within 200 feet of this request. No Public Comment Forms have been returned. Department of Planning, 07/01/98 98-06 Issues: • This case was originally heard at the June 15, 1998, Planning and Zoning Commission meeting as a request to rezone from A(Agricultural)to I (Industrial). Per the applicant's request, the Commission voted unanimously to withdraw the case as the applicant indicated that he would like to request B-2 (Business) instead of I (Industrial) (see attached letter). • The Comprehensive Plan recommends industrial uses for the property. The proposed zoning and land use are compatible with Comprehensive Plan as uses permitted within the B-2 (Business) zoning district are less intensive than those permitted within the I (Industrial) district. • This property was annexed by the City in 1995. As a result, the existing metal building on the property became a lawful non-conforming structure. The applicant is aware that the structure and property will have to be brought up to code prior to the issuance of any building permits for future development or a change in use which would require a C.O. (Certificate of Occupancy)from the City. • The building improvement survey provided by the applicant does not include setback dimensions for the existing improvements(metal building) on the property. Department of Planning, 07/02/98 98-08 Issues: • The Comprehensive Plan recommends Single Family Residential, Multifamily, Retail, and Park/Open Space uses for the property. Staff is of the opinion that the Concept Plan under consideration does not meet the intent of the Comprehensive Plan as the minimum single family residential lot size permitted by zoning is 7,200 square feet. Also, the majority of the open space being proposed is located within the 100 year flood plain. According to Article IV (Parkland Dedication), Section 78-111 of the Code of Ordinances, areas primarily located within the 100 floodplain are considered unsuitable for dedication. As a result, the proposal under consideration may not comply with the City's parkland dedication requirements. • The applicant is filing this PD (Planned Development) in order to request several variances to the zoning ordinance. Specifically,the applicant is proposing a master planned community incorporating variances to both the single family and multifamily residential development standards as well as an amendment to the Master Thoroughfare Plan. • Specific variances' to the single family residential development standards are as follows: 1. The applicant is proposing a master planned community encompassing approximately 2,370 residential units. The minimum lot size being proposed on 786 of the lots (33%) is 6,000 square feet. "MF"—MULTI-FAMILY RESIDENTIAL DISTRICT REGULATIONS General Purpose and Description — The "MF," multiple family dwelling district is a residential attached district intended to provide for the highest residential density not to exceed fifteen (15) units per acre on a single story or twenty (20) units per acre for multiple story configuration. If the multi-story density of twenty (20) units per acre is selected by the builder/developer he or she shall be required to conform to the additional fire protection requirements specified in #14.7. The principal use of land in this district is for multiple-family dwellings, garden apartment and boarding or rooming houses. The district is usually located adjacent to a major street and serves as a buffer or transition between retail/commercial development or heavy automobile traffic and medium or low density residential development. 14.1 Use Regulations: A building or premise in the "MF" district shall be used only-for the following purposes: (1) Multi-family dwelling (apartment building). (2) Nursing and convalescent homes. (3) Boarding or rooming houses. (4) Garden apartments. (5) Accessory buildings and uses, customarily incident to the above uses and located on the same lot therewith, not involving the conduct of a retail business. (6) Batch plant, temporary during construction when permitted by code enforcement and limited to the subdivision for which they are permitted. The following specific uses when granted in accordance with Section 23: (1) Cemetery or mausoleum. (2) Charitable organization (3) University, college or parochial school and related facilities (public or private). (4) Country club or golf course and related uses such as driving range but not including similar forms of commercial amusement such as miniature golf (5) Day nursery, day camp or child care center. (6) Electric substation. (7) Museum, library or art gallery. (8) Post office. (9) Radio, television or microwave tower. (10) Golf course, public. (11) Private club. 14.2 Height Regulations: No building shall exceed thirty-five (35'). When buildings exceed one (1) story in height, an automatic sprinkler system shall be installed in accordance with existing fire codes and each unit shall have two points of entry or exit each providing separate access to a place of safety during an emergency or fire. 14.3 Area Regulations: (1) Size of Yards: (a) Front Yard: Twenty-five (25') minimum as measured from the front property line. Sixty feet (60') for accessory buildings. (b) Side Yard: There shall be a side yard on each side of the lot having a width of not less than eight feet (8'). There shall be ten feet (10') separation between buildings without openings (windows) and fifteen feet (15'). No side yard for allowable non-residential uses shall be less than fifteen (15'). If a side yard is adjacent to a single family zoning district then paragraph (d) shall apply. (c) Rear Yard: Twenty feet (20') minimum. (d) There shall be a total of sixty feet (60') setback from the adjacent property line for buildings in excess of one (1) story in height when an "MF" district is next to a single family zoning district or single family use. (2) Size of Lot: (a) Lot Area: Three thousand (3,000) square feet per dwelling unit, or portion thereof located on the first floor, with a maximum density not to exceed fifteen (15) units per acre for single story construction. When the option of maximum density at twenty (20) dwelling units per gross acre is selected compliance with increased fire protection (see#14.7) is mandatory. (b) Lot Width: Eighty feet (80') minimum as measured along the front building line. (c) Lot Depth: The average depth of the lot shall be not less than one hundred twenty feet (120'). (3) Minimum Dwelling Size: The minimum living area for multi-family dwelling units, "MF" shall be seven hundred fifty (750) square feet. (4) Lot Coverage: In no case shall more than forty-five percent (45%) of the total lot area be covered by the combined area of the main building and accessory buildings. (5) Minimum Building Site: . In no case shall any multi-family construction, regardless 'of size or configuration, be allowed on any property that is less than twenty-five thousand (25,000) square feet in area. 14.4 Parking Regulations: Two and one-half (2-1/2) spaces for each dwelling unit. Required parking may not occur within the front yard. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set forth in Section 24. 14.5 Refuse Facilities: Every dwelling unit shall be located within two hundred fifty feet (250') of a refuse facility, measured along the designed pedestrian and vehicular travel way. There shall be available at all times at least six cubic yards of refuse container per thirty (30) multi-family dwelling units. For complexes with less than thirty (30) units, no less than four (4) cubic yards shall be provided. Each refuse facility shall be screened from view on three (3) sides from persons standing at ground level on the site or immediately adjoining property, by an opaque fence or wall of wood or masonry not less than six (6'), no more than eight fee (8') in height or by an enclosure within a building. Refuse containers shall be provided and maintained in a manner to satisfy local public health and sanitary regulations. Each refuse facility shall be located so as to provide safe and convenient pickup by refuse collection agencies. 14.6 Border Fencing: Perimeter fencing of wood or masonry construction, not less than six feet (6') high, shall be installed, along the property line on any perimeter not abutting a public street or right-of-way at the time of construction by the builder and maintained throughout the existence of the multi-family unit by the owner/operator of the multi-family unit. 14.7 Fire Protection Requirements for 20 UPA Density: When the builder / developer selects the option for higher density, each building constructed to these standards shall include an automatic sprinkler system to be installed at the time of construction in accordance with currently adopted fire safety codes. In addition, each unit shall be provided with two (2) points of entry and exit with each providing separate access to places of safety in the event of emergency or fire. These provisions are automatic upon the selection of any multistory design regardless of density. "R"—RETAIL DISTRICT REGULATIONS General Purpose and Description: The "R" retail district is intended for neighborhood shopping facilities which provide limited business service and office facilities predominantly for the convenience of residents of the community. 17.1 Use Regulations: A building or premise shall be used only for the following purposes: (1) Any use permitted in"0" office district. (2) Banks or savings and loans w/wo drive thru. (3) Clinic, medical or dental. (4) Laboratory, medical or dental (5) Office, general. (6) Optical shop. (7) Studio, art, music, drama, speech. (8) Letter and mimeograph shop. (9) Garden shop and plant sales, inside. (10) Veterinarian office, no hospital. (11) Florist shop. (12) Mcitoue shop, enclosed. (13) Bakery or confection shop, retail (14) Barber or beauty shop. (15) Book, camera or card shop. (16) Clothing and apparel store. (17) Cleaning and laundry pick-up station. (18) Discount, variety or department store. (19) Drug store. (20) Drapery, needlework or weaving shop. (21) Supermarket. (22) Furniture and appliance. (23) Handicraft or hobby shop. (24) Key shop. • (25) Laundry or dry cleaning, self service. (26) Health studio. (27) Paint, wallpaper and hardware. (28) Personal service shop (29) Photography studio. (c) That all merchandise be sold at retail on the premises. (d) That such use not be objectionable because of odor, excessive light, smoke, dust, noise, vibration or similar nuisance. (8) Commercial amusements, indoor or outdoor. 17.2 Height Regulations: No building shall exceed one hundred feet (100'), except cooling towers, roof gables, chimneys, vent stacks or mechanical equipment rooms may project, not 5o exceed twelve (12') beyond maximum building height. 17.3 Area Regulations; (1) Size of Yards: (a) Front Yard: Minimum required setback, twenty-five (25') measured from front property line. Accessory buildings shall have a sixty foot (60') front yard. (b) Side Yard: (Adjacent to a street or different use property line); minimum required, ten feet (10'). (c) Rear Yard: A dedicated alley or private drive shall be required behind each lot or tract and the minimum rear yard setback shall be twenty feet (20') for any building or structure. When an alley is not required, a masonry or wood wall of a minimum height if six feet (6') shall be constructed adjacent to the rear property line to provide a barrier between the adjoining use. (d) Special Side or Real Yard Requirement: When a non- residential zoned lot or tract abuts upon a zoning district boundary line dividing the lot or tract from a residentially zoned lot or tract, a minimum side yard of ten feet (10') shall be provided on the non-residential property. A masonry or wood wall having a minimum height of six feet (6') above the average grade of the residential property shall be constructed on the non-residential property adjacent to the common side (or rear) property line.
