MINUTES The Planning and Zoning Commission met in a Regular Business Meeting on May 19, 1997, at 6:30 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North, Wylie,Texas 75098. A quorum was present and a notice was posted in the time and manner required by law. COMMISSION MEMBERS PRESENT: Chairman-Bart Peddicord, Cecilia Wood, James Smith, Rich Eckman, Steve Ahrens, Stuart Allison and Tim Owen. ABSENT: None STAFF MEMBERS PRESENT: Building Official-Mike Phillips and Secretary- Rebecca Rogers. ACTION ITEMS ITEM NO. 1: Consider approval of the Minutes from the April 7, 1997 Regular Business Meeting. A motion was made by Steve Ahrens, seconded by Cecilia Wood, to accept the minutes as presented. Motion carried, all in favor (7). ITEM NO. 2: Discuss and Consider approval of a Land Study submitted by Goff Homes for a 71.814 acre residential development designated as Cottonwood Farms located on Whitley Road, north of the intersection of Elm Grove Road and Whitley Road in the City of Wylie's Extra Territorial Jurisdiction. Mike Phillips, Building Official, stated that since this property is within the City of • Wylie's ETJ it is subject to the City's Subdivision Regulations. Several variances are being requested along with the Land Study: 1) individual septic systems in lieu of hooking up to sanitary sewer as required by the Subdivision Regulations;2) due to the estate style of the lots, a request has been to made to not build sidewalks on both sides of the street; 3) the Paving Standards require that all type G residential streets have curbs and gutters and a request is being made to not build any curbs and gutters and have open barrel ditch drainage on both sides of the street. Any variances that the Commission grants will actually be performed at the Preliminary Plat phase. The proponent is requesting these variances at this stage of development so that they proceed with the development of the Preliminary Plat. There is no sanitary sewer in this area at this time (nearest sewer is 1 3/4 miles away). It is conceivable that due to the proximity of the wastewater treatment plant that an oversize line would be put in for future development. There are no plans for that sewer line at this time (estimate online in maybe in 5 years). There is water to the site and gas lines across the street. History of problems experienced with the older type (leach field, not OSSF) of septic systems, don't need the same problems occurring here. Staff recommends denial of the variances and approval of the Land Study. Neal Heckel, Goff Homes, 2653 Tarna, Dallas, Texas, was present to speak on the behalf of the request. Closest sewer is approximately 9,000 feet at the crow flies, no perq test is needed because the newer septic system is a self-contained tank and the water is treated in a two tank system. Philip Robbins, Robbins Engineering, Garland, Texas was present to explain the new septic system. Mr. Robbins, explained that the newer septic systems treats wastewater like a treatment plant and the result is a 95%pure water that is sprinkled onto the lawn. This system is more efficient and quicker 1 (no refuse or sludge to have pumped out). The water is dispersed in spray irrigation in which 1/3 of the moisture evaporates before it hits the ground. The system is easily changed out for sanitary sewer, already has clean out. TNRCC regulates this system and the installer is required to provide two years of maintenance (maintenance to be performed every 4 months) at no charge and requires the installer to be certified to install and maintain the system(Operator, Level C). The cost of the system is slightly higher(not even 10%) and has come down a lot in price in the last few years. The life of the system is indefinite with maintenance, the life of the old system was 10-20 years. The tank is constructed of fiberglass or concrete. Mr. Harold Chenault was present to speak on behalf of the variance request. Feels that property would be valueless if variances are denied. This property is closer to Rowlett and Sachse, but unfortunately is not in their ETJ. Other properties in the area are on septic systems under county requirements. These new systems have been proved in Heath and Forney. Neal Heckel brought up that construction would be done in two phases. Perhaps Phase I could be allowed to have the new septic system and that could be evaluated before it would be approved for Phase II. Mindy Manson, Asst. to the City Manager, stated that perhaps the septic system could be allowed at this point and require the subdivision to tie in to the sanitary sewer when it became available in that area (as required by City ordinance). Discussion among board members followed. A motion was made by Steve Ahrens, seconded by Cecilia Wood, to table the variance requests until further information could be obtained. Motion denied, none in favor. Request not tabled. More discussion followed. TNRCC has very strict guidelines governing this type of system. Mr. Phillips stated that there are provisions in the utility ordinance that allow the City to request the property owner to tie into the sanitary sewer once it is within 500 feet of that property(once it is annexed). A motion was made by Steve Ahrens, seconded by Rich Eckman to approve the variance allowing on site waste water treatment systems. Motion carried, 6 in favor, 1 opposed (Stuart Allison). Variance granted. A motion was made by Steve Ahrens, seconded by Cecilia Wood, to deny the variance request to not build any sidewalks. Motion carried, all in favor. Variance denied. A motion was made by Rich Eckman, seconded by Stuart Allison, to deny the variance request to have open barrow ditch drainage and not build curbs and gutters down all sides of the streets. Mt carried, all in favor. Variance denied. Staff recommends approval of the Final Plat for Stoneridge Farms. A motion was made by James Smith, seconded by Rich Eckman, to recommend approval to City Council of the Final Plat for Stoneridge 2 Farms. Motion carried, all in favor (7). Respectfully submitted, 0 Bart Peddicord, Chairman Rebecca Rogers, Secr 3 ,ice` Planning & Zoning Commission #2 Action Item Re: Consider Zoning Classification June 16, 1997 11 Issue Consider Zoning Classification for "Bed and Breakfast Inn" Background A request has been received for the conversion of an existing single family dwelling into a Bed and Breakfast establishment. The category for "Bed and Breakfast Inn" is not listed as a permitted use in the Zoning Ordinance of the City of Wylie. The Building Official is seeking an interpretation from the Planning and Zoning Commission to refer to the City Council on the most appropriate classification in which to place "Bed and Breakfast Inn". Per Section 29 of the Zoning Ordinance, the Building Official shall refer the question concerning any new or unlisted use to the Planning and Zoning Commission along with an accompanying statement of facts listing the nature of the use and whether it involves dwelling activity, sales, processing, type of product, storage and amount, and nature thereof, enclosed or open storage, anticipated employment, transportation requirements, the amount of noise, odor, fumes, dust, toxic material and vibration likely to be generated and general requirements for public utilities such as water and sanitary sewer. The Planning and Zoning Commission shall consider the nature and described performance of the proposed use and determine the zoning district or districts within which such use should be permitted. The Planning and Zoning Commission shall relate its findings and recommendations to the City Council as to the new or unlisted use. The City Council shall, by resolution, approve the recommendation of the Planning and Zoning Commission or make such determination concerning the classification of such use as is determined appropriate based on the findings. In researching the issue, staff contacted the cities of Plano and Mc Kinney. Excerpts from their respective zoning ordinances are attached. The definitions are very similar. However, the two cities have different approaches regarding locational standards. The City of McKinney requires a Specific use permit for any Bed and Breakfast facility. The SUP may be granted in Agricultural and a variety of Residential and Commercial Districts. The City of Plano allows this type of use by right in Business Government District. This District allows for retail, office, governmental, cultural, and entertainment uses in the development, redevelopment, and renovation in, specifically, the original downtown area of Plano. Financial Considerations "Bed and Breakfast Inns" would be classified Under the Hotel/Motel Tax Ordinance and subject to the Hotel/Motel Tax of four per cent (4%). Legal Considerations Article 9, Section 2 (B2) of the Wylie Home Rule Charter, states that the Planning and Zoning Commission will recommend to Council proposed ordinances and amendments regarding planning and zoning changes. Staff Recommendations The City of Wylie Zoning Ordinance permits "Hotel or Motel" by right in the "R", Retail District. Because of the similarity in use , Staff recommends that "Bed and Breakfast Inn" be allowed by right in the"R", Retail District and by Specific Use Permit in "MF", Multi-family District. The use is recommended to be defined as: "an owner/operator occupied residence with up to five (5) bedrooms available for overnight paying guests. The maximum length of stay is fourteen (14) consecutive days in any one calender month. Meals may or may not be provided, however, no facilities for cooking will be permitted in any of the bedrooms. Minimum off-street parking will be required at a rate of one (1) space per each bedroom." Planning & Zoning Commission #1 Public Hearing Item Re: Recommendation for Approval of a Zone Change June 16, 1997 Issue Hold a Public Hearing and consider a recommendation to the City Council for a request from Goran Juric for approval of a zone change from "MF" Multi-Family to "SF-3" Single Family District for the property located at 105 South Third Street, and further described as Lot 13 and the south 17' of Lot 14, Block 22 of the Railroad Addition. Background Goran Juric has requested a zone change for the property he intends to buy at 105 South Third Street. Mr. Juric plans to replat the lots into a single lot through the Minor Plat process, on which a single family dwelling would be constructed. The newly formed lot would meet all minimum requirements for SF-3 development, including lot width, length and area. The remainder of Lot 14 would also meet these requirements after the Minor Replat. The property Mr. Juric intends to buy had recently become vacant when a single family home was demolished and removed. Research on this property indicated that because a zone change to "ME" Multi-Family District had been approved prior to 1987, the original house was considered a non-conforming use. The existing Multi-Family zoning does not allow new single family development. The area that was rezoned "MF" includes neighborhoods with older, wood framed, single family dwellings and a recently completed masonry duplex located at the north end of the block. Some dwellings have undergone refurbishment, while others are in their near original condition. While the issue being formally for zone change effects an individual property, perhaps the discussion could be broaden in the future to evaluate the continued viability of Multi-Family zoning for the area defined in the attached map. The Comprehensive Plan adopted by the City of Wylie recommends that low density residential development be the predominant land use. Consistent with the Land Use Plan, the area that contains Mr. Juric's property is identified for low density residential use. Even though a large portion of the area has been zoned "MF", the predominant use is still single family residential. The type of single family redevelopment proposed by Mr. Juric is ideal for the neighborhood and if approved, could continue a positive development trend. The City Council approved a revised Multi-Family Development Standards on April 8, 1997. These standards require a minimum of one (1) acre on which to build multi-family units. Applying this standard to the general area being considered for the zone change, virtually the entire block in the neighborhood would be required to be developed as multi-family in order to comply with the minimum lot size. As a practical matter, the existing single family structures would have to be eliminated. These standards applied to this area discourage single family ownership, redevelopment of existing single family structures and is inconsistent with the recommended Land Use Plan. Financial Considerations N/A Legal Considerations Under Article 9, Section 2 (B2) of the Wylie Home Rule Charter, it states that the Planning and Zoning Commission will recommend to Council proposed ordinances and amendments regarding planning and zoning changes. Staff Recommendations Staff recommends approval of the Zone Change Request. This request conforms to all regulations and requirements of all City ordinances.
