construction of a 6-foot masonry fence. Mr. King proposes to construct an office building,
warehouse and equipment storage yard at 1323 and 1327 Century Way and further described
as Lots 5 & 6, Block C in the Century Business Park Addition.

Minutes of the Zoning Board of Adjustments
The Zoning Board of Adjustments met in a Regular Business Meeting on September 8, 1997 at 7:30 p.m. in
the Council Chambers of the Wylie Municipal Complex,located at 2000 Highway 78 North,Wylie,Texas
75098. A quorum was present and a notice was posted in the time and manner required by law.
COMIVIISSION MEMBERS PRESENT: Chairman Gerald Clark,Emily Hartwig,Marilyn Herrera,
-Mar-le-Clark and Greg Alford,plus alternates Denise Mays and Jeff McCoy.

ELECTION OF OFFICERS
Emily Hartwig nominated Gerald Clark for Chairman, seconded by Ken Ryburn. Motion carried,all in favor
(4).
Emily Hartwig nominated Marilyn Herrera for Vice- Chairman, seconded by Greg Alford. Motion carried, all
in favor(4).
ACTION ITEMS
ITEM NO. 1: Consider approval of the Minutes of the March 10, 1997 Regular Business Meeting. A motion
was made by Greg Alford, seconded by Marilyn Herrera to accept the minutes as presented. Motion carried,
all in favor(5).
ITEM NO.2: Consider an appeal from Metroplex Multifoods,Inc.from the City of Wylie Zoning Ordinance
which requires that an application or request for a variance will hot be heard or granted to any parcel of
property or portion of said property until a Concept Plan,detailed Site Plan, Preliminary Plat, or Final Plat has
been finally acted upon by both the Planning and Zoning Commission and the City Council. Mike Phillips,
Building Official,stated that the Zoning Ordinance requires the applicant to have exhausted all other avenues
available to detailed Site Plan review,Concept Plan,Preliminary Plat,etc.before a variance may be requested.
Metroplex Multifoods has requested this variance prior to approval of a site plan, concept plan, etc.however,
those items will still be required prior to a building permit being issued. No site plan has been submitted for
review or approval. Kenneth Durrett,Metroplex Multifoods,Inc, 101 E. Cherokee St., Jacksonville,TX 76766
was present to speak for the variance. Mr. Durrett stated that thelwere applying for a variance before the
property was purchased because if they couldn't get the sign variances requested,this property would not be
of interest to them(visibility on FM 544 and SH 78 is very important). Mr. Durrett stated that if the variances
are not approved they can not build at this site and could not say if they would build at another location in
Wylie or another city entirely.
A motion was made by Greg Alford, seconded by Ken Rybum, to consider an appeal from Metroplex
Multifoods,Inc.from the City of Wylie's Zoning Ordinance which requires that an application or request for
a variance will not be heard or granted to any parcel of property or portion of said property imtil a Concept
Plan, detailed Site Plan, Preliminary Plat, or Final Plat has been finally acted upon by both the Planning and

Zoning Commission and the City Council. 3 in favor(Greg Alford, Ken Ryburn, Gerald Clark), 2 opposed
(Marilyn Herrera, Emily Hartwig). Motion denied due to lack of majority vote(Chairman Clark quoted the
75%vote,requirement.) No need for Public Hearing to be held.
PUBLIC HEARING(not held)
ITEM NO. 1:Hold a Public Hearing to consider an appeal from Metroplex Multifoods,Inc.for a variance
from the City of Wylie Zoning Ordinance"Sign Regulations"which requires a 20-foot maximum height for a
general business pole sign.
ITEM NO.2:Hold a Public Hearing to consider an appeal from Metroplex Multifoods,Inc.for a variance
from the City of Wylie Zoning Ordinance"Sign Regulations"which require a maximum allowed area of 60
square feet for a general business pole sign.

Variance Request for Alternate Screening Between Zoning Districts
November 10, 1997
Issue
Consider an appeal from Robert M. King for a variance in regards to the decision of the
Building Official denying a request to delete the requirement for a 6-foot masonry
screening wall between zoning districts for property located at 1323 and 1327 Century
Way and further described as :
Lots 5 & 6, Block C in the Century Business Park Addition
Background
Robert M. King is seeking permission to construct an office, warehouse and a construction
yard at 1323 and 1327 Century Way. The initial review of the project revealed the
necessity for a screening wall on the eastern property line to separate the property from
an adjoining residential district as required in the Zoning Ordinance of the City of Wylie.
Sec.20.3 (b) Side Yards: . . .When the industrial district is
adjacent to any residential district, a minimum side yard of
twenty feet(20') shall be observed and a six feet (6') masonry
or wood wall shall be constructed adjacent to the industrial
district's property line.
The proponent wishes to construct, in lieu of the masonry or wood wall, a six feet (6') chain
link fence with Red Tip Photenias planted 3' apart on his side of the fence to augment the
existing mature tree line. Screening walls of chain link fencing and live plants or of live
plants are allowed by the Zoning Ordinance to screen other situations caused by
development or uses, such as with outside storage. Separation from residential zoned
districts is required from all commercial zoned districts, "R", "B-1", "B-2", and "I".
The Board of Adjustments may authorize on appeal, a variance from the terms of the
Zoning Ordinance that will not be contrary to the public interest, where, owing to special
circumstances, a literal enforcement of the provisions of this ordinance would result in
unnecessary hardship. The spirit of the Ordinance must be upheld and substantial justice
done. In order for a variance to be granted, the proponent must be able to demonstrate:
(1) That the literal interpretation of the provisions of the Zoning Ordinance would deprive
the applicant of rights commonly enjoyed by other properties in the same district; (2) That
the special conditions and circumstances do not result from the actions of the applicant;
(3)That granting the variance does not confer on the applicant any special privilege that
is denied by this ordinance to other lands, structures, or buildings in the same district; (4)
No non-conforming use of lands, structures, or buildings in the same district and no
permitted use of lands, structures, or buildings in other districts shall be considered
grounds for the issuance of a variance.
Staff Recommendation
Should this variance be granted, staff recommends that the variance be granted on the
condition that if any of the large mature trees which form this barrier should die, the owner
of this property would be required to replace them or the property owner would be required
to construct the required 6' masonry or wood wall required by the Zoning Ordinance.
